OLD BUSINESS
A. Charmel Check
Everything checked out fine. Demlis Stroilc slated he has analog service and he sees a big
difference in picture and audio quality between his reception at home and the reception here.
Kathi explained that with the analog service, networks conhol the signal levels.
B. Correspondence Log and Follow Up on Complaints
Ms. Mary Persing of 2201 40`x' Avenue complained about a Comcast Representative who
requested her social security number or driver's license number in order to have Universal Service
installed. She declined to give it and questioned why this is needed. Kathi Dormelly-Cohen
replied that the last four digits are needed to ensure customer security. Kathi was not sure if she
went tlnough with the connection or not once she was given the explanation.
C. Responses to Questions Raised at Apri121, 2005 Commission Meeting
Kathi stated that there is no problem comrecting Universal Service to a new TV as Dan Swee had
indicated at Che last meeting. There was a discussion regarding the need to re-program the TV Co
pick up charmels, 23, 29, or 41. Kathi will ask Scott Melter to set up a test to see if this is correct.
The Emergency Alert appears on all chamrels, both analog and digital.
Kathi answered a question regarding Comcast Digital Voice and how it will operate. The RSU has
a battery backup, so an alarm will not be triggered when there is a power outage or maintenance of
the system.

D. Miscellaneous hiformational Items
Comcast and Time Warner have joined forces to acquire the assets of barilaupt Adelphia cable
systems. As part of the agreement, Comcast will be taking over the Minnesota systems previously
run by Time Wainer.

NEW BUSINESS
A. Franchise Fee for 1st and 2id Quarter 2005
We received the ls` and 2"~ Quarter franchise fee payments and copies were enclosed in the
agenda packets.
B. Changes to Channel Line Up
Some changes were made to the Chamrel Liue Up to standardize it with other systems and to
allow for exciting future products and services. The changes are to begin around August 26"'
and there is no price adjustment associated with these.
C. Cable Attorney Rate Adjustment
Notice was received that effective in August 2005, Bradley &Guzzetta LLC are increasing
their rates. The rates have not been adjusted in over four years. We currently are paying
between $145-$160/lu- and it will be increasing to $175/lu•. Linda reported she had checked
with other cities/conunissions and other firms are charging as much as $280/lu•. She explained
this increase in fees will amend the contract we have with them now. The Commissioners felt
it is important to keep continuity during the renewal of our franchise.
Motion by Henke, seconded by Swee to cwatinare witJa Bradley &Guzzetta LLC for• our legal
counsel for Telecommunication matters. All ayes. MOTION PASSED.
D. Other New Business
Linda asked if anyone was interested in attending the MALTA Fall Conference at the Mermaid
Conference Center in Mounds View on October 27-28, 2005. There is a discount for early
registration. However, no one was interested in attending this event.

B. ReporC of Comcast-
The reports for April-July 2005 were reviewed. Copies of the monthly newsleCters were
also enclosed in the packets for review. Kathi Donnelly Cohen told Cormnission members
about an alert that has been sent out by the League of MN Cities regarding the Ensign-
McCainbill that has been introduced that would basically take away all regulations and
allow phone companies to enter the cable industry also. Tt was her opinion that cities and
cable companies, would both be hurt by this proposed bill. Among the changes that would
occur as a result of this bill are:
It would do away with all franchises
Regulation would be done by the State or Federal govermnent-cities would not oversee the
service at all
Systems would be limited to 4 access chumels
Cities could not charge for Right of Way permits
Franchise fees would be limited to a certain amount and would only he allowed on certain
items.
Kathi went on to report that subscribers with digital boxes will have a new program guide
available to them that will be faster and more user friendly. Some additional prograrnrning
is being added to the I-IDTV service. And the speed of the Internet service is being
increased again.

Here we go again!! What is going on?? I am being billed for $80.36 Upon Receipt!!!
As per your letter to me of December Ts and our recent phone conversation, I am euclosing
my check in the amount of $25.12 -which brings my account to a "0" Balance -PAID IN RILL.
Obviously the bill is not correct. I do not want to go through any more inconvenience,
hassle, confifsion, wasting your time and mhte, to clear this np like I had to do with ComCas['s previous
errors.
Therefore, please armuge to have my Cable TV Service discontinued for tlfe thne being -
ALL EXCEPT THE COMPLIMENTARY CONIMUNITY/LOCAL CFIANNELS ... such as
City, Library, School District, etc. And have someone notify me about any monthly expense
for tlfat service, if any.
Thank you for arranging the credits. You have certaindy tried your Vest with a frustrating
situation and annoyed customer. This may assist your customer service/staff training - in
whichever couutry(city tlfey happen to be located. It is surprising how many people and in
haw many places I ]fad to contact in my efforts to straighten out ComCast's problems. You
seem to mrderstand that I have been more than patient with the waiting, referrals, agreeing to
be contacted by "someone" who never did call me back as promised (you were very reliable), etc.
If I do agree to re-subscribe to ComCast's Cable TV service hf tlfe future, I certainly hope
drat I will not be charged your "re-connection fees". Awaiting your reply. Thank You for

On September 29, 2005, Comcast will add a number of channels for the benefit of our
customers. The addition of these chancels will also necessitate a change in channel
locations as well as one channel deleted. Due to certain contractual obligations, it is
necessary that we make these changes by September 30.
Just in time for the hockey season, we recently entered in to a contract with the National
Hockey League to carry NHL games on OLN (Outdoor Life Network).
PBS-Sprout will be added on Digital Classic (D1) on channel 128. LOGO will be
added on Digital Plus (D2) on channel 163. MoviePlex will be added on all digital
converters on channel 149. TPT Minnesota (a new channel that replaced the announced
TPT Weather) will be added on channe1243 to Basic 1 service. KMWB HD will be
available to Basic 1 service. CBS Evening News is now available on Video on Demand
(VOD) for 24 hours after its initial carriage. College Sports TV, channel 274, will now
be shown in both the Digital Sports Tier and Digital Extra.
Lifetime Movie Network on channel 119 moves from Digital Extra (D3) to Digital Plus
(D2). GSN moves from channel 128 to channel 179 and remains on Digital Classic (D1).
Oxygen moves from channel 179 to channel 185 and remains on Digital Plus (D2). VHl
Sorel moves from Digital Plus (D2) to Digital Classic (D1). VHl Country will no longer
be available.
Our goal is to continue to add new and exciting options for our customers. More high
definition offerings and digital channels as they become available. To inform our
customers of these changes we are adding a bill message to all cycles, adding a message
on The Weather Channel crawl, providing a message alert on the digital converters and
including a message on the telephone IVR to inform customers as they call in to our
customer service center. While a new and updated channel line up card was mailed to
customers reflecting the additions and changes that occurred in August, customers can
print out channel locations from our web site, Channel Guide magazine or via the hlternet
at TV Guide.com or Zap2it.com

KSTP-HD is here!!!
We have reached an agreement with Hubbard Broadcasting for the launch of
KSTP-HD on Comcast channel 231. KSTP is the local ABC affiliate and carries
a number of popular programs in HD including Lost and Monday Night
Football. Comcast HD customers can view the new channel effective
immediately.

I am writing to give you a preview of an enhancement that will make the Comcast customer
experience even better. In September, Comcast migrated its billing functions to a new
platform. The ultimate benefit is to allow our customers to get one bill for all services. At
present, current Comcast Digital Phone customers will continue to see two bills -one for
video and Internet and one for phone. As we launch our new Comcast Digital Voice (CDV)
service in the beginning early 2006, CDV customers will receive the new format with their
January billing statements.
There are additional benefits to the new billing system, as well.
• Customers will receive more information about the services they currently subscriber
to including a summary of savings they receive as part of a package.
• The system is able to double check the representative's work and reduce the
possibility of incorrect billing.
• The new system will also designate the amount of time necessary to complete the
work required for an install or upgrade based upon what the customer is ordering.
• It will also route the job to the appropriate technician who is trained to perform that
particular work.
These last two functions are particularly exciting given the promise they hold to improve the
work order accuracy.

As you know, Comcast is committed to offering the best value in home entertainment in a
competitive marketplace, providing a wide variety of programming and an array of
packages to accommodate customers' preferences. We recognize that our customers
have other entertainment alternatives and we are working hard to offer the best choice in
the industry at a fair price.
Comeast's upgraded broadband network means better quality and reliability for all
customers, regardless of the services they choose to receive. Our Digital Cable
customers are enjoying more programming choices than ever before, as well as
unprecedented selections and control with ON DEMAND, which gives customers access
to up to 2,000 programs -two-thirds of which are available at no additional charge.
Comcast's HDTV customers continue to receive a combination ofhigh-definition
programming from local stations and cable networks that satellite cannot match.
In 2005, Comcast made the following enhancements available to its customers:
• All Digital Line-up
• Additional HD channels -TPT-HD, KSTP-HD, KMWB-HD and TNT-HD for a
total of 15 HDTV channels
• New channels added -PBS KIDS-SPROUT, TPT-You, TPT Minnesota,
Hallmark, Movieplex, Logo and KARE WeatherPlus.
• Expanded library of free movies ON DEMAND
• Improved On-Screen Program Guide
• Dual channel DVR equipment that allows you to watch a recorded program while
recording two other channels
• Speed increases on Comcast High-Speed Internet to 6 MB and a security solution
from McAfee at no additional cost
We have also worked hard to ensure that we provide the best possible customer service.
We made investments in new equipment to better serve the customer in addition to a new
billing platform so Comcast Digital Voice/video/Internet customers could be served with
one bill; increased training and coaching and implementation of the Think Customer First
principles. Comcast was recently recognized by the Customer Respect Group, an
international research and consulting firm, fot• the great strides we've made to improve
our responsiveness to our online customers, as well as our efforts to improve their online
experience.
As we continue to evaluate the value of our cable services, investments in system
enhancements, and competitive market place, we will be adjusting our prices accordingly.
In Columbia Heights, Comcast will adjust the following prices beginning in January.
Our Basic 1 service price will be lowered from $10.36 to $9.10. Basic 2 will increase
from $33.63 to $37.89. Standard Cable will increase from $43.99 to $46.99. The PEG
Fee will increase from $2.00 to $3.03 to reflect the actual cost recovery for access
operation, equipment, and staff. Within the next few days we will be forwarding
information on the pass-through calculations on non-subscriber revenue.
Attached please find a copy of the notice sent to customers as well as a new price list and
channel line up card which reflects changes that have occurred since last January as well
as any changes in equipment and service rates stemming from recent agreements. As
Comcast strives to bring our customers more convenience, choice and control at a fair
price, we have not raised our rates for Comcast High-Speed Internet or Comcast Digital
Phone Service.

On or about March 1, 2005, Comcast filed with the City Federal CommunYcations Commission (FCC)
Form 1240, "Updating Maximum Permitted Rates for Regulated Cable Services", purporting to set
forth and justify the maximum rate it could charge to subscribers in the City for basic
programming service, and FCC Form 1205, " Determining Regulated Equipment and Installation
Costs, Equipment Form", purporting to set forth and justify the rates it could charge to
subscribers in the City for equipment and installation. The relevant rate period covered is
June 1, 2005 to May 31, 2006. It should be noted that Comcast adjusted its rates effective
January 1, 2006.
Basic programming consists of over-the-air broadcast stations, public, educational, and
government access channels, and any other programming Comcast chooses to add to its basic tier
of service. The City does not regulate the rates for any programming not carried on the basic
service tier, including (but not limited to) programming offered on a pay-per-channel or pay-
per-program basis. Under federal law, the rates for all programming not included in the basic
service tiers are unregulated.
The chart below reflects Comcaet's maximum permitted rates as of June'1, 2005, and prior to
June 1, 2005, as well as the current rates.

As part of its ongoing rate proceeding, the City must hold a public hearing. The purpose of
the public hearing is to provide interested persons with an opportunity to express their views
on the basic service programming and equipment rates and installation charges Comcast
calculated in its March 2005 rate filing.
In accordance with federal law, it is the City's responsibility, as a certified rate
regulation authority, to determine whether the basic service programming and equipment rates
and installation fees comply with the Federal Communication Commissions rate regulation
rules, orders, and decisions.
RECOMMENDED MOTION: Move to establish a public hearing date of Monday, February 13, 2006, at
7:00 p.m. or as soon thereafter as possible, to permit interested persons an opportunity to
express their views on the basic services programming and equipment rates and installation
charges Comcast calculated in its March, 2005, rate filing.

SERVICE RATE SET FORTH 1N THE FEDERAL COMMUNICATIONS
COMMISSION FORM 1240 FILED BY COMCAST ON OR ABOUT MARCH 1, 2005
WHEREAS, under Section 623 of the Cable Communications Policy Act of 1984, 47
U.S.C. § 543, as amended, the City of Columbia Heights, Minnesota (hereinafter the "City") is
permitted to regulate rates for basic cable service; and
WHEREAS, the City is certified as a rate regulation authority pursuant to Hiles of the
Federal Communications Conunissiou (hereinafter "FCC"); and
WHEREAS, Comcast of Minnesota, hre. (hereinafter "Comcast"), the local franchise
holder, filed with the City an FCC Form 1240 "Updating Maxinmm Permitted Rates for
Regulated Cable Services", on or about March 1, 2005, purporting to set forth and justify the
maximum rate it could charge to subscribers in the City for basic cable service (hereinafter the
"2005 FCC Form 1240"); and
WIIEREAS, the City held a public hearing to solicit the views of interested persons
concerning the 2005 FCC Form 1240; and
WHEREAS, the rate set forth herein will govern Comcast's basic service rate until
Comcast lawfully implements a further rate change pursuant to applicable FCC regulations.
NOW, THEREFORE, the following is resolved:
1. Comcast's maximum permitted rate for basic cable service, as calculated in the
2005 FCC Form 1240, is neither approved nor denied, but may: (i) function as a basic service
rate ceiling during the relevant rate period; and (ii) be utilized in future basic service rate filings,
to the extent permitted by and consistent with FCC rules and decisions.
2. Comcast shall not charge any rate higher than the maximum permitted rate set
forth in the 2005 FCC Form 1240, nor increase that rate, unless such rate is first filed with and
approved by the City, in accordance with applicable law and regulations, including but not
limited to the notice requirements imposed by 47 C.F.R. § 76.1603, or as otherwise expressly
permitted under applicable law and regulations.
3. Comcast may charge rates less than the lawful maximum permitted rate for basic
service, as long as such rates are applied in a uniform and nondiscriminatory way, pursuant to
applicable federal, state and local laws and regulations. The City, however, shall not be deemed
to have approved such rates.
4. This Order is based on the representations made by Comcast iu its 2005 FCC
Form 1240. Should information come to the City's attention that these representations were
hraccurate in any material way, the City reserves the right to take appropriate action. This Order
is not to be construed as a finding that the City has accepted as correct any specific entry,
explanation, calculation or rate in the 2005 FCC Form 1240.
5. The City reserves all of its rights with respect to rate regulation, including (but not
limited to): (i) the right to request and review data, and documents concerning the 2005 FCC
Form 1240 in order to determine the impact, if any, such data and documents have on rates
proposed in future basic service rate filings; (ii) the right to address issues raised in the 2005
FCC Form 1240 that are relevant to any City review of subsequeut basic service rate filings; and
(iii) the right to request additional information concerning the 2005 FCC Form 1240 that is
relevant to any City review of subsequent basic service rate filings.
This Order constitutes a written decision for purposes of 47 C.F.R. § 76.936(a).
This Order shall be effective immediately upon its approval by the City.
8. This Order shall be released to the public and to Comcast, and a public notice
shall be published stating that this Order bas been issued and is available for review, pursuant to
47 C.F.R. § 76.936(b).

Guide Is Here! - As part of our ongoing commitment to provide enhanced features and services to our customers,
Comcast has launched a new On-Screen Programming Guide that offers improved performance. The new guide has a
high-resolution design, and is about 50% faster than the previous versions of the guide. It also offers some terrific new
features, such as the ability to search far programs by category, channel or title. The new guide was downloaded
automatically to all digital converters so there is no need for customers to do anything to receive it. If customers have
already set Favorites or Parental Locks, those features should transfer over to the new I Guide. Learning the features
and functions is easy too! Customers can go to the On Demand area and click on the Help and Services icon to view a
tutorial on how to select favorites, set the parental controls, and other features. Or if they prefer, they can go to
www.comcast.com and view an interactive tutorial.
More HDTV Channels - As quickly as contracts are negotiated, Comcast is excited to bring new programming to its
customers. KMWB - 23 has launched in high definition. Comcast continues to add more channels in HD as contracts
are finalized. KARE-PLUS WEATHER was launched on August 1 and is available to Digital customers. Later this month,
TPT-Minnesota will launch. TPT's Minnesota Production division has produced more than 200 programs with more than
90 Minnesota partners, ranging from large organizations, like the University and the Saint Paul Chamber Orchestra, to
smaller groups. The channel will also carry programming that was created by sister stations - QTV -Austin, PBSEight -
Duluth, Pioneer Public TV -Appleton, as well as stations in Fargo and Bemidji. The programs take many forms: town
meetings, lectures, documentaries, and concerts. An additional 130 hours of new programming far the channel will be
done in FY06. Be sure to tune in as The Outdoor Life Network (OLN) recently secured the rights to carry the NHL
games this year. More new channels will be added at the end of September including Logo, PBS-Sprout and
MoviePlex. New on VOD is the CBS Evening News. It will be available for 24 hours from when it was originally
broadcast to keep you informed on world news no matter what your schedule may be.
Comcast Delivers New Ultra-Fast Speed Tiers -Comcast High Speed Internet/Video customers will see an
enhancement in speed from 5 MB to 6 MB/384 kbps September 1. This marks the third time that Comcast has increased
its broadband speed; an increase of more than 400% in less than two years. Our network has been built with a virtually
unlimited capacity to deliver even higher speeds. For customers who pay $10 more 8 MB/768 kbps speed is also
available. Because of the new ultra-fast connection speeds, Comcast customers will more easily be able to share photo
slideshows with music via Comcast PhotoShow Deluxe; send video greetings with Comcast video mail (up to 3 minutes!);
stream online music or download songs from the Comcast.net Music Channel and download online games plus
experience better game play with Comcast Games on Demand. Remember to reboot your modem to realize the new
speed!
Comcast.net and McAfee -Comcast and McAfee have partnered to provide McAfee antivirus, firewall and parental
controls security products to Comcast High-Speed Internet customers. This is a quick and easy way to download online
security features, including firewall, spyware protection, pop-up blocking, and parental controls. The parental control
features allow Web content filtering, time limits, monitoring and supervision capabilities and prevention of users from
bypassing controls. Found on Comcast's Security Channel on The Fan, this suite of Internet security products is offered
as an option and at no additional charge. Comcast.net customers can quickly and easily download these three programs:
McAfee Virus Scan; McAfee Personal Firewall Plus and McAfee Privacy Service. While these McAfee security products
normally retail for over $100 -Comcast is offering all three completely free for all Comcast.net customers. Comcast and
McAfee support more Windows operating systems (MAC version currently not available).

COMMENTS
• The arrival and installation of a fow•th studio camera has made a big difference
in our productions. We have been able to shoot more complicated prodnctim~s
without bringing in a crew.
• Due to the storm and loss of power in the building we had to cancel production
of a shoot detailing the Park View construction project. The shoot is
rescheduled for early October.
• Staff will also cover the ribbon cutting ceremony for the Grand Central Lofts
development. That program will air in October.
• Next month staff will also begin production of a series of programs looking at the
city's Value First campaign. The first program will feature a discussion of
school bus safety with the police chiefs of Heights and Fridley.

Family Tler Coming Soonl -Comcast has announced that a new family-friend) y tier of service will be available to customers
early 2006. The 16 channels that will be included in this tier will be the most popular family-friendly programming: Disney
Channel, Toon Disney, PBS KIDS Sprout, Discovery IGds, Science Channel, Nickelodeon, National Geographic, etc.
Customers must subscrlbe to Basic 1 service in order to add the Family Tier and will require the use of a Digital converter. The
digital converter has easy-to-u se parental control features and an on-screen interactive program guide.
Movies, Movies and More Movies.. Comcast is now delivenn g 250 addition al movies every month to our ON DEMAND service
at no extra charge. Video On Demand is availabl a to custome rs who have digital service. Customers now have access to more
than 800 movies per month -the most extensive video-on -demand lineup available anywhere today. Customers are viewing
VOD movies in record numbers - in the first 15 day s of October, customers had watched 6.5 million free movies.
Prime Time Shows on VODI If you don't have a DVR, digital subscrlbe rs can still watch CS I and Law and Order shortly after
airing for a minimal fee. ABC, CBS, and NBC have agreed to place current shows on VOD. Watch for more information in early
2006.
Piano Lessons on Dema nd7 Yes, another of the interesting programs availabl a On Demand is now piano lessons. Customer
can team to play the guitar or sin g alon g with Karo ake as well. Take a few moments to visit the ON DEMAND site to see all the
feature s available includin g an extensive "How To" instmction al section featurlng such services as DV Rs. You never know what
you will find! The program ming changes every 30 - 90 days so something new is always available.
Billing System Enhancements- Customers will benefit from recent enha ncemenls made in the billing system. Once Comcast
Digital Voice (CDV) is launched early in 2006, customers who subscrlber to CDV and other products will be able to have all
charges on ju stone bill. The new bill explain s charges and services in much greater detail. The enhancements also help catch
possibl a hum an error in coding charge s and assists in props dy schedulin g time for service and installatio n appoi nlments base d
on the products orde red. The system routes to the properly trained technician for the job as well.
SprlnUNextel Joint wKh Comcast -Soon you will be able to have your cell phone service from Comcast along with your video,
intemet and phone service. There will be new features as well such as allowing you to program your DVR from your cell phone
and pick up your a-mails from your cell phon e. This service is expected to roll out in mid-20 06.
National Franchising - Be alert to adicles and information from the National League of Cities regarding legislation bei rig
considered to allow telep hone companies to obtain state fran chises ratherthan the traditional city award process. The future of
franchising as we know it could change in the very near future. Comcast has enjoyed a good working relationship with our local
franchising authorities. While we have no issue with competition, Comcast and other operators have invested billions to build
out and upgrade our cable systems making our services availa ble to the entire footprint of our communities. We would only ask
that any competitor be required to serve the same areas and the same obligations as the tune nt franchises. The bills being
proposed would take power away from the cities and could affect the future of public access prog ramming in your community.
Hurricane Relief -The damaging storms of Katrina and Wilma in the soul hem part of the United States hit Comcast employees
and customers in Mississippi, Alabama and Flod da very hard. Com casters from across the country donated gift cards for
Target, Home Dept and Lowe's to help fellow employees get back on their feet. In some systems, employees delivered hot
meals, water, generators and even pay checks to those who were less fortunate. When Call Centers sustained damage,
contract call centers across the count ry were in place to assist our customers when they needed us most Comcast has
donated 25 million in mone y and in-kind donatio ns to help these communitie s rebuild.

taping various recreation/sports programs and interviewing employees.

mid-January.
