Motio~a by Reuben, second by Dave, to approve the minutes from tlae meeting of January 20, 2005. All ayes. OLD BUSINESS A. Channel Check Everything checked out fine. Dennis reported that occasionally he is getting some horizontal lines moving through his TV screens at home. He is going to check it out further and call Kathi if he needs to schedule a service call. B. Correspondence Log and Follow Up on Complaints Mr. Modzin and Ms. Angela Klesk of 1316 43`~ Ave submitted a complaint regarding overcharges to their account when they made some service changes. The account was credited and the problem was resolved. A resident from 325 Summit St called to report an aerial cable drop that came loose and was laying on the ground. The cable was removed. Mr. Richard Lipa of 1220 Lincoln Terrace called to complain that HBO, Showtime, and other Pay per View channels are only offered on digital service, and that he had poor reception on Channels 4 & 5. His reception problems were cleared up when a bad sputter was replaced. Ms. Tammi Ericson Diehm of 5125 St. Moritz Dr called to complain about her inability to have Universal Service hooked up in her new home in a timely manner. She felt that the service techs sent out to do the connection were not very knowledgeable, and after several visits were still unable to provide the service as promoted by Comcast and the City. Bob Buboltz, attending Charter Commission meeting Ken Henke and Brad Peterson Bruce Nawrocki Jean Kuehn Kathi Donnelly-Cohen Kathi explained that the contracted service tech was not familiar with Universal Service and how to hook it up. She said Tammi's antenna that ran through the attic also needed to be hooked up so she could get local channels. The training issue is being addressed by Comcast. Universal Service The discussion continued regarding the Universal Service Issue that was brought about by Ms. Ericson-Diehm's complaint. Jean Kuehn showed Kathi the insert that is being included in the utility bills regarding Universal Service. Kathi Donnelley-Cohen explained that Universal Service can be provided to one TV at no charge if it is a standard installation within 250 feet. If it is a custom installation that requires wires to be run through walls, etc., then there is an installation charge. She also stated there is a $5.00 fee for a converter box per month, if it is needed. She reminded the members that subscribers to this service do not generate any franchise fees for the city. She also said that Comcast is not sure how many actual Universal Subscribers there really are since many times people disconnect the service or move, and since no fee is charged, they have no way of tracking how many really use it. Bruce Nawrocki stated the intent was to provide a service to people whereby they could be informed on decisions made by local governing bodies, not to collect revenue. He questioned whether the service is any different than when Meredith had the system. She stated it was the same and that only those systems that used to have Meredith have this service as it was a negotiated item of that contract. He further stated the larger concern is employees or contracted employees who aren't trained and are unable to provide the service as promised. Kathi Donnelley-Cohen informed the members that a new position has been added to Comcast's staff to address issues such as this. The Area Director of Fulfilhnent will ensure all employees and contracted employees are trained and that this situation has already been forwarded to her. Bruce then questioned Kathi on whether background checks are done on their employees and the contracted employees. He was questioning the allegation of a contracted employee who possibly assaulted a customer. Kathi responded that while this is still under investigation, the employee is on leave. Background checks are done prior to hiring an individual, as well as sporadic checks while employed, and nothing was found on this individual. She also said the companies they contract with also follow these stringent rules. ID badges are a requirement for all individuals and contracted companies are fined heavily if these procedures are not followed. The commission members suggested putting a notice on the statements or to insert a bill staffer that tells subscribers that all workers should have ID and if it is not visible, ask for one in all instances. Reuben told Kathi that about a month ago, he was contacted by a Comcast employee on his apartment security phone about 7 pm, and was told that he would be doing some work in the building and checking out some of the wiring. After questioning the employee, Reuben found that it was only a pretense to get in and sell cable service. Dennis has reported this to Kathi in the past also. She stated that each time this is reported it is traced back to the same sub-contracting company. She will check out Reuben's complaint. TELECOMMiJNICATION COMMISSION MINUTES APRIL 21, 2005 PAGE 3 D. Other Old Business No other old business. NEW BUSINESS A. Franchise Fee for 4th Quarter 2004 We received the 4th Quarter franchise fee payment and a copy was enclosed in the agenda packets. B. 2004 Annual report A copy of the 2004 Annual Report was enclosed in the agenda packets. The Commissioners discussed a few items in the report. Our current franchise expires November 9, 2006. Motion by Dan Swee, seconded by Dennis Stroik, to accept the 2004 Annual Report. All Ayes. MOTION PASSED. C. Other New Business *Dan Swee raised another problem with Universal Service hookup. That being, even if a subscriber to Universal Service uses an AB switch there will still be problems getting the UHF channels such as 23, 29, and 45. On a cable ready TV, depending on whether it is set up to run programming through an antenna or through cable, the local stations of 2, 4, 5, 9, and 11 may work. And switching the AB switch would allow the public access channels to be viewed. However the UHF channels would only work if the set up through the TV's menu is changed each time to pick up the UHF frequency. This will cause confusion for many subscribers and will probably generate complaints. Kathi said this service was set up 10 years ago and technology and TV's have changed a lot since then. She will bring this up to her technical staff to see how this should be addressed with the consumer. *Dan asked whether Outdoor Life was being taken out of the Analog line-up. He said he read it in the paper recently that it was, but Kathi was unaware of it. *Dan stated that he thought the commission and the technical knowledge the members possess were under-utilized. He felt several issues should have been brought before the body for input, such as the Police Communications System, the pros and cons of a Wireless Broadband System similar to Chaska's, and some of the equipment used to broadcast programming on the Public Access Channels. Jean Kuehn said she would pass that statement along to the City Manager, but explained our IS staff is very knowledgeable and therefore, his expertise is relied on by management and staff. *Bruce Nawrocki invited the other members to attend the Southern Anoka County Consortium meeting on May 4 where the person from Chaska who was instrumental in setting up their Wireless Broadband System will be the guest speaker. I got an answer from Scott Melter and I want to toss the a-mail before I lose it. Here are the questions and answers: Dan Swee brought up that the Universal service cannot be connected to new TV's due to the input channels -has to be either antenna or another source but not both. So connecting an a/b switch is not an option. Scott disagrees. Says we have no problem with this. Emergency Alert -does the alert appear on all channels including digital. Scott says YES. If you are watching a digital channel it cuts out in a weather emergency and turns to the Weather Channel but an alert appears on the top of the screen so the customer would know that it did not just change because something is wrong with cable or TV. On analog channels, they get the crawl and it directs them to turn to channel 6 and the national weather service information is there in text. Comcast Digital Voice -this is not the service we offer now but will offer early in 2006. It's the IP based phone but does not use the public Internet. Its our private network. Question came up - if we are doing maintenance in the maintenance window like 2 in the morning, and the phone is tied to the security system, will a false alarm ring causing the customer to incur false alarm charges from the city? Scott says NO. The RSU on the house has a battery back up. Even power outages that disrupt the cable will not trigger an alarm due to the battery back up in the RSU on the house. Now I am going to clean off my desk and toss the a-mail. Store this in a safe file until we meet again. This is a positive step for viewers who would otherwise be uninformed, unless they were tuned to local network channels. Also, Comcast has converted all the Access channels to digital. The picture is noticeably crisper BUT since we broadcast in analog, it is causing a 3 second delay in what we put out and what goes out on the channel if a digital converter box is in place. Misc info--If two tv's were side by side and one was cable ready with no box and the other has a digital box--the programming would be 3 seconds behind on the tv with the converter box. Strange. Under the agreement, several Time Warner cable systems, including those serving Minnesota, will become a part of Comcast at the end of the transactions. These transactions, which we anticipate closing within the first quarter of 2006, will allow Comcast to fillly divest its interests in Time Warner. Comcast joined the Twin Cities community in late 2002 as a result of a transaction with AT&T Broadband. These changes are being made to standardize our channel line-up and to allow for exciting future products and services. C-Span and C-Span 2 will be moving from Basic 2 to Basic 1. BRAVO and TBS will move from Basic 1 to Basic 2. Hallmai9c will change channel locations but will remain on Basic 2. EWTN will become fulltime and Inspiration will no longer be available. In the Twin Cities area, our firm continues to represent the City of Minneapolis and nearly all of the franchise areas in the Comcast territory. Unlike most other firms, we split fees between our local franchising authority clients whenever possible, which frequently allows the City to save a significant amount of money acrd to receive a significant amount of services at a reduced cost. Often times this translates to your City paying 1/6 or less of our discounted hourly municipal rates. If Comcast successfully acquires the Minneapolis-area Tone Warner Cable systems, the .City will likely receive even greater savings from this billing arrangement. As you may be aware, our• rates have not been adjusted in over four years. Of course the cost of living and doing business has not remained static during this time. We have informally polled some non-Bradley &Guzzetta clients and have found that other firms are charging between $185 to $250 per hour for similar services. Effective with your next billing cycle, our municipal discounted rata for partners will be $175 per hour, which is still below the market rate for attorneys with our experience in our• area of practice. All other rates will remain unchanged. We will also continue to split our fees, which effectively reduces our• partner rate to $30 per hour or less in many instances. COMCAST ANNOUNCES NEW PROGRAMMING FOR KIDS - In cooperation with PBS, Comcast recently launched PBS KIDS SPROUT as part of our On Demand offerings. In addition, a 24 x 7 digital cable channel will launch this fall, making PBS KIDS SPROUT the perfect place for parents and their little ones to enjoy the wonders of early childhood. The new channel will provide preschool age children and their families with safe, educational and entertaining programming that encourages and enhances learning and development. Just click ON DEMAND, and under the "Kids and Teens" category, you will find PBS KIDS! Enjoy Barney & Friends, Sesame Street, the Berenstain Bears, Teletubbies and more. 25% of the PBS SPROUTS programming will be updated bi-weekly so families will always have fresh viewing choices to enjoy together. OPEN HOUSE ASUCCESS - On March 3 and 4, Comcast hosted an Open House for local officials in our administrative offices at 10 River Park Plaza in St. Paul. Visitors were able to view and get hands-on experience with HDTV, ON DEMAND, digital video recorders (DVR), Comcast High Speed Internet and Comcast Digital Phone products. Comcasters showed interested visitors how to send video e-mails, record a full season's worth of a favorite program, and select programming ON DEMAND. It was an excellent opportunity to ask questions about the new technologies and products Comcast has to offer. UPCOMING CHANGES -Comcast is busy behind the scenes making technical changes that will expand and improve our services for customers. We are currently completing the processes necessary to simulcast the local broadcast channels and PEG access channels in digital. With the exception of TPT, the channel locations will not change. We are also preparing to add additional HDTV channels. To do this, we must manage our bandwidth by moving some channels now on analog basic to a digital tier and in some cases, discontinuing certain channels. The moving of an analog channel allows us the capacity to add two HDTV channels. And to make it easier for customers and customer service employees, Comcast will continue to realign channels and packages to make service offerings even more consistent across the Twin Cities market. Customers will receive advance notice of any changes that affect their service. This brief version of Comcast activity will be provided monthly. Chamber of Commerce Award -The St. Paul Area Chamber of Commerce Charitable Foundation board has announced its Herbie Award winners for 2005. This award, named after the late Herb Brooks, is given to an individual and company that are: Humanitarian, Enterprising, Resilient, Bold, Inspirational and Ethical. This year's recipients are Dick Hanson, 3M (retired) and Comcast. We are excited and proud to receive this award. The official recognition will be during the Chamber Annual Foundation Luncheon on June 16. TNT, KTCA in HDTV -Late in April, Comcast launched the HDTV version of TNT just in time for the exciting action of the NBA Play-Offs. On June 1, we will launch KTCA in HDTV and adding TPT-YOU, and TPT-KID on our digital tier. Now Comcast offers 13 channels in HDTV -KTCA, KARE, WCCO, KMSP, ESPN, TNT, Discovery, HBO, Cinemax, Showtime, Startz!, and IN DEMAND (2 channels). Watch for both TPT-Weather and KARE-Weather to launch in the coming months. HDTV service is an option available to Comcast customers who have HDTV compatible TV sets. Update on Analog to Digital Simulcast -Last month we shared with you our plans to take local broadcast channels and the local public access channels which are now analog and simulcast them in digital. This means that any customer who has a digital converter box will actually be seeing the Standard Cable services in digital format. Customers who do not have a digital converter or go cable-ready will continue to receive the analog services. We will have this available by the end of June in all our metro service areas. Parental Control -Comcast is committed to making sure our customers can control what they and their family members are watching. We combine the greatest level of programming options with technology that allows all of our customers to control the programming in their home. Last year we launched a campaign to help alert parents about the parental control features available to them. That campaign included TV spots, bill messages, a special 1-800 number to call for ideas and assistance. Beginning June 2005, even more tools will be available to parents such as the size of the ratings icons will be more prominent and the cable networks will begin inserting the icons after each commercial break to remind viewers throughout the program of the rating. We are developing partnerships with Best Buy and Circuit City to explore ways to provide information about parent controls through in-store displays. Comcast digital cable customers have the ability to block content, including specific channels, ratings, program titles, and ON DEMAND content anytime they want from the convenience of their own homes. The digital receiver allows customers to highlight and choose channels or R-rated, programming to be blocked. The Parental Control feature allows customers to choose a 4-digit PIN that blocks designated content from being viewed. Our Interactive Program Guide gives customers the control to determine which programming is appropriate for viewing in their home. Comcast's Parental Controls are easy to use. There is also a Parental Controls link in the "Find It Fast" section of Comcast.com, our consumer website. This link permits our customers to obtain, in just two mouse clicks; the specific parental control options for our system. Parental Controls are just another way we offer value and convenience with our digital cable product. For those who are analog only customers, there still are many options. The Leaders and Achievers Scholarship Program, funded through The Comcast Foundation, acknowledges high school seniors for exemplary community service, leadership skills, positive attitude and academic excellence. The students are nominated by their high school principal. A recognition ceremony is being planned for a future date. Comcast and its employees are very involved in community -volunteering thousands of hours each year. This scholarship recognizes the importance of learning community involvement early. Bike and Kids -Through our Reading Program at Roosevelt Elementary, we discovered that many students were in need of bicycles. The Technical Department at the Roseville Headend asked fellow employees to donate bicycles that their own kids have outgrown. On Saturday, June 4, the technical group spent the day repairing and sprucing up the gently used donated bikes. Comcast bought helmets to go along with the bikes. On Thursday, June 9, Comcast employees joined students and parents in a picnic at Roosevelt and the 52 donated bikes were presented to K-3 students who have had perfect attendance at school. The students were overjoyed! That same week, Prosperity Heights 4th, 5th, and 6~h grade students were the focus of a short film on the school's biking program, funded in part by a grant from Nickelodeon. The spot, featuring the students biking around Lake Phalen, will air Oct. 1 on Nickelodeon. Prosperity was one of 81 schools and organizations across the country tc receive the grant money, intended to support active and healthy lifestyles for kids. The $2,500 grant plus a matching grant from the school district allowed the school to purchase 32 12-speed mountain bikes and helmets. The bikes will be used in gym classes during the school year, in summer school and with after school programs next fall. You've Got (MORE) Video Maill -When Comcast introduced the Video Mail option on our high-speed Internet service, the length of each recorded message was 45 seconds. That has been increased to 3 minutes! By using a web cam, customers can record a message that the a-mail recipient can view, as long as Windows Media Player is on the user's computer (Windows Media Player is a free download). Video Mail is available at no additional charge to Comcast High- speed Internet customers, and also includes greeting card and photo-sharing options. And best of all, Video Mail messages are sent as links to the recipient, so there are no large files to fill up recipients' e-mailboxes. Learn more at Comcast.net. Channel Changes -Comcast continues to add new services and package tier options that are more consistent across the Twin Cities Market. By late September, all areas will have basic cable options that include Basic 1 and Basic 2. Those areas that have Basic 3 service will see that tier go away as most of those channels merged into the Basic 2 tier. Hallmark will now be offered in all of our communities. Watch for Starz-Encore Video-On-Demand by year's end. To enhance the service to Starz and Encore subscribers, more than 1,500 movies per year will be added to VOD. All Digital) -Soon all Comcast subscribers who have a digital converter will enjoy digital quality sound and picture on Basic 1 and Basic 2 (Standard) channels. She was then told that they could not install Universal Service unless she provided this information. This address is a single family home that she has lived in for the many years.
