All ayes. Motion by Peltier, seconded byRuen, to approve the minutes of April 19, 2007 as presented. All ayes. OLD BUSINESS A. Charmel Check Dennis noted the following variations from his home cormection as well as City Hall's. Channel 16 is loud, Channel 3 is very loud, and Channel 15 is quiet. IIe noted that Channel 19 (Library Access) looks and sounds much better. B. Correspondence Log and Follow Up on Complaints Staff had not received any new complaints. C. Status of franchise Renewal Magee reported that we continue to operate under the old franchise agreement on a month-to-month basis until a new franchise agreement can be finalized. Nawrocki questioned whether it is legal to do so, and Guzzetta stated that it is. Magee went on to explain that the City is having an equipment and technology needs assessment done prior to meeting with Comcast. It was also noted that Comcast had signed another lease with Mr. Herringer for the use of the local cable studio till next Jmre. D. Other Old Business No other old business. Motion by Buboltz, seconded by Henke, to accept the Annual Report as presented. All ayes. B, Receipt of 1st and 2nd Quarter Franchise Fees A copy of the franchise fees received from ls~ Quarter and 2"d Quarter were included in the agenda packets. C. Corrected Notice to Customers Regarding MLB Extra Innings Service After the notice was sent in March regarding the MLB Extra Innings package, an agreement was reached between our vendor and Major Baseball League allowing Comcast customers to order the MLB Extra Imungs, out of market, package of games. Customers were alerted through messages on their cable box and/or designated message channel. They could either purchase the service if they had digital service, or Comcast honored the previous coupon offer to purchase the 2007 regular season, out of market game, on the computer. D. Notice Regarding the Gospel Music Chamlel replacing the Black Family Channel on Charme1293 Notice was received in May that The Gospel Music channel would be replacing the Black Family channel carried on Channe1293 as part of the Digital Classic Tier. Peltier reported that he noticed this is not on Channe1293 as the notice indicated. He said it is not listed on the guide either. He will call it in and report this, at Kathi's request. E. Notice of Increased Upload Speed Comcast has added PowerBoost technology to increase the upload speed for intemet services. P. Relocation of Payment Center The Payment Center zeloeated fiom Roseville to Little Canada in July 2007. Katlu will bring a list of all the payment centers to the next meeting. G. Notice of A & E and National Geographic being added to HD line up Effective June 18, 2007, A & E HD and National Geographic HD were added on channels 199 and 200. A subscription to Digital Classic is required to receive these channels. Kathi stated that there will be a big increase in the number of HD channels by the 2"d quarter of 2008. Notice of NFL Network behrg added to the Sports Entertaimnent Package NFL Network will be added to the Sports Entertainment Pack on Channe1275. It will no longer be offered on other levels of service, including Digital Preferred. This will not affect the full schedule of games that are carried on CBS, FOX, NBC, and ESPN. I. Notice of HGTV being added to HD Line Up. HGTV HD was added as part of the High Definition line up on cham~el 198 starting in July. MALTA Connections Newsletter Copies of the newsletter were sent to members. K. Emergency Alert System Test Dan Swee had sent azi e-mail regarding the EAS test in June. He noticed audio levels were distorted and that the message was missing from the public access chamiels. Kathi forwarded this on to Scott Melter at Comcast. They asked Dan for further information on specific dates or tunes, but he has not responded to their request. She stated that since the system is tested several times weeldy it would be difficult to track what happened without more information. L. Notice of 24/7 Outage Reporting System A copy of a notice was enclosed in the packet explaining the network surveillance center that is in operation around the clock to detect outages azid problems for video, information and voice services. M. Notice of Big Ten Football Schedule and Update on Big Ten Coverage A notice was received regarding the schedule for Big Ten College Football genes. More than 150 college games and the best Big Ten match ups will be telecast without the additional cost of the Big Ten Network. Comcast would like to carry BTN as part of the Sports Entertainment Package, however azi agreement to do so cannot be reached. Comcast does not believe it should be a btn~den to all customers at the additional fee of $13 as FOX and the Big Ten Network would like to see by adding it to the digital basic package. Tf an agreement is reached the city will be notified. ICathi stated that begirrning in 2008 the satellite service companies will be able to provide this service as an "exha fee" service so she doesn't understazid why they won't allow the same thing for cable service providers. N. Addition of NHL Network to Sport Entertaimnent Package The NHL Network will be added to the SporC Entertainment Package as of October 1, 2007. A subscription to the Sport Entertaizunent Package and a digital converter box or cable card will be required to receive this programring. O. Notice that Music Choice will be removed from the City Digital Converter According to the agreement with Music Choice, the service is not allowed in conunercial establishments such as public areas or for integration into audio-visual or other programming produced by local access studios. Other New Business Dennis asked what the new deadline is for everything going to digital service. Ruen stated that he had heard that analog service is being extended another two years. Dennis then questioned whether there will be any analog service provided after that date. Kathi stated that Comcast will be required to provide service for a transitional period of time and that equipment may be needed to do so. Demiis asked if all inputs coming into Comcast are digital now and Kathi responded that yes, they are. This means if a subscriber has a digital converter box, they are receiving a digital signal, but if the cable is hooked directly to the television, they may only be getting analog service depending on the TV being used. REPORTS A. Report of Conunissioners Education- Broadcast of the School Board Meetings has poor audio quality. Demos said Comcast did what they canto improve things on their end and that the Dish•ict IT person is now trying to correct the problem on their end to hnprove the quality. Library- Nothing to report Public-Nothing to report Government-Nothing to reporC B. Report of Comcast- The reports were included in the agenda packets for the commissioners to review. Dennis asked for clarification of stats on the April report. Ruen asked a question regarding notices he receives to upgrade his phone service. IIe was told that he has to do this very soon as the type of service he has will be terminated. Kathi explained he would receive a credit to offset the additional fee charged for a period of time. C. Report of Cable Attorney Guzzetta said nothing is happening presently at the legislative level. But he expects bills will be presented at the next session, such as the Broadband Bill and House #2351. FTe recently met with Sheldon Johnson and they expect that some type of statewide fianchising bill will be introduced. They discussed the Illinois Model Bi11 and thought it was tine best one passed thus far, as far as protecting city's rights are concerned. Guzzetta stated that the FCC was to address how the Order and Ruling would affect incmnbent companies at its meeting scheduled for September 11, 2007. However, this item was pulled from the agenda at the last minute. Guzzetta said he will be watching the outcome of this closely. He also reported on a recent ruling by a Comiecticut Court. AT & T had pushed for legislation that would exempt them from needing a franchise to provide service. The court ruled that they do indeed need a franchise as they are providing IP service. Guzzetta expects tlnis ruling to be appealed, but felt it was an important step for levelhig the playing field. Guzzetta said that Jolm Stanek fiom Qwest stated that Qwest will be submitting franchise applications to vanious cities in the metro area. NAGE Y: NO: DATE: January 7, 2 DATE: On or about March 1, 2007, Comcast filed with the City Federal Communications Commission (FCC) Form 1240, "Updating Maximum Permitted Rates for Regulated Cable Services", purporting to set forth and justify the maximum rate it could charge to subscribers in the City for basic programming service, and FCC Form 1205, "Determining Regulated Equipment and Installation Costs, Equipment Form", purporting to set forth and justify the rates it could charge to subscribers in the City for equipment and installation. The relevant rate period covered is Juno 1, 2007 to May 31, 2008. Basic programming consists of over-the-air broadcast stations, public, educational, and government access channels, and any other programming Comcast chooses to add to its basic tier of service. The City does not regulate the rates for any programming not carried on the basic service tier, including (but not limited to) programming offered on apay-per-channel or pay- per-program basis. Under federal law, the rates for all programming not included in the basic service tiers are unregulated. The purpose of the public hearing is to provide interested persons with an opportunity to express their views on the basic service programming and equipment rates and installation charges Comcast calculated in its March 2007 rate filing. In accordance with federal law, it is the City's responsibility, as a certified rate regulation authority, to determine whether the basic service programming and equipment rates and installation fees comply with the Federal Communication Commissions rate regulation rules, orders, and decisions. Due to our continuing investments in technology, programming and improved customer care, we are adjusting the prices on some of our video products, effective with customers' January, 2008 statements. Customer Notification -Enclosed you will find letters that will be received by our customers. In addition to a general notice letter that will be received by most customers, we have developed specific letters to address changes for those customers who subscribe to service packages that are no longer available. These include customers who subscribe to our Take 2 and Take 3 discount packages, and customers of the old Gold, Silver and Bronze packages. Each customer will receive a new channel line-up card and a card which lists all prices and charges. Channel changes effective January 10, 2008: Comcast will add Fox Business Channel to our Digital Classic lineup. Also, Encore Love, Encore Action, Encore Western, Encore Drama and Encore Mystery will move to Digital Classic, and Outdoor Channel will move from Digital Preferred to the Sports Entertainment Package. In addition, we will be adding FSN-HD and TBS HD. Franchise Fee Calculation - As you know, Comcast pays the cities 5% of Gross Revenues. Due to regulatory obligations, we also pay you 5% on that 5%. In addition, Comcast pays your franchising authority 5% of advertising sales and home shopping revenue. This new calculation recovers from customers the fees on advertising sales and home shopping revenue paid to your cities in 2007. The calculation in 2007 was 6.00% and will be adjusted to 6.23% in 2008. Late Fee Change -Effective January 1, 2008, the late fee will increase from $5 to $7, reflecting our costs. Timing of when a late fee is assessed will move from 32 days to 38 days. As a reminder, Comcast offers customers a number of convenient payment options including automatic credit card payments and auto-withdrawal from checking or savings. Payments may also be made at a payment center, by mail, drop boxes, online and by phone. This is the first increase in our late payment fee in over twelve years. PEG Fee Reconciliation - We have attached a reconciliation of what we have collected from customers to recover the Operating and Capital costs to provide public, educational and government access programming. Comcast has invested nearly a half billion dollars in the Twin Cities community since we began the franchise renewals in 1999. This on-going commitment has resulted in the widest available selection of high-definition TV programming, interactive digital cable services, industry-leading video-on-demand, digital video recorder (DVR) service, the fastest available high-speed Internet service, and now digital voice home phone service. 2008 promises additional programming and speed enhancements! Comcast is a proud contributor to the communities we serve through non-profit contributions, volunteerism, and participation on local boards. SP1 RESOLUTION N0.2008-O1 ORDER REGARDING THE MAXIMUM PERMITTED BASIC PROGRAMMING SERVICE RATE SET FORTH IN THE FEDERAL COMMUNICATIONS COMMISSION FORM 1240 FILEll BY COMCAST ON OR ABOUT MARCH 1 2007 WHEREAS, under Section 623 of the Cable Communications Policy Act of 1984, 47 U.S.C. § 543, as amended, the City of Columbia Heights, Minnesota (hereinafter the "City") is permitted to regulate rates for basic cable service; and WHEREAS, the City is certif ed as a rate regulation authority pursuant to rules of the Federal Communications Commission (hereinafter "FCC"); and WHEREAS, Comcast of Minnesota, Ina (hereinafter "Comcast"), the local franchise holder, filed with the City an FCC Form 1240 "Updating Maximum Permitted Rates for Regulated Cable Services", on or about March 1, 2007, purporting to set forth and justify the maximum rate it could charge to subscribers in the City for basic cable service (hereinafter the "2007 FCC Fotm 1240"); and WHEREAS, the City held a public hearing to solicit the views of interested persons concerning the 2007 FCC Form 1240; and WHEREAS, the rate set forth herein will govern Comcast's basic service rate until Comcast lawfully implements a further rate change pursuant to applicable FCC regulations. NOW, THEREFORE, the following is resolved: 1. Comcast's maximum permitted rate for basic cable service, as calculated in the 2007 FCC Form 1240, is neither approved nor denied, but may: (i) function as a basic service rate ceiling during the relevant rate period; and (ii) be utilized in future basic service rate filings, to the extent permitted by and consistent with FCC rules and decisions. 2. Comcast shall not charge any rate higher than the maximum permitted rate set forth in the 2007 FCC Form 1240, nor increase that rate, unless such rate is first filed with and approved by the City, in accordance with applicable law and regulations, including but not limited to the notice requirements imposed by 47 C.F.R. § 76.1603, or as otherwise expressly permitted under applicable law and regulations. 3. Cotncast may charge rates less than the lawful maximutn permitted rate for basic service, as long as such rates are applied in a uniform and nondiscriminatory way, pursuant to applicable federal, state and local laws and regulations. The City, however, shall not be deemed to have approved such rates. 4. This Order is based on the representations made by Comcast in its 2007 FCC Form 1240. Should information come to the City's attention that these representations were inaccurate in any material way, the City reserves the right to take appropriate action. These additions will allow us to expand our playback capabilities and cut back on staff time spent dubbing down programs for airing on the channel. December also saw the addition of some new programs. We are now airing a locally produced Finnish Vaziety and Talk Show as well as Vic Tedesco's Big Band Show. Both of these programs offer music, dancing and lots of local color. Next month will bring a new "Community Development Update" as well as a new "We Remember" starring Louie Egey, a resident who celebrated his 100"' birthday in December. Convergence of technologies was the show's theme, and CES concluded that it couldn't tell the story of convergence without hearing from the cable leader. Roberts described how innovations launched in 2008 will put Comcast at the center of home entertainment and the PC. This breakthrough, which we are calling "Comcast 3.0", will be made possible through continued investment in our advanced networks, dedication to superior HDTV at home and on-the-go, taking customer service to new levels, and providing new products that are converged, plug-and-play, user-friendly and open to third-party innovation. "Tru2way" technology will be available for devices that consumers can own and plug into their cable system for full two-way interactivity like the Panasonic portable DVR, and TiVo set-top. Tru2way's open cable platform encourages new products from current manufacturers, start-ups, and entrepreneurs. Cable is working with Microsoft and others in the PC industry to enable Tru2way on future Windows Media Center PCs. In 2008, we will provide more VOD than anyone, with 10,000 On Demand choices each month, continuously refreshed, and 90% available at no additional charge. By the end of the year, Comcast will offer 1,000 HD choices! Roberts announced "Project Infinity", our vision for VOD, where eventually Comcast will provide customers with hundreds of thousands of choices On Demand. With Comcast 3.0, the consumer is king. Thanks to our state-of-the-art IP Comcast Digital Voice network, we will stay several steps ahead of traditional telephone with services like Caller ID on the TV. "SmartZone" already allows you to check home voicemail and email from the PC anywhere. And now SmartZone will let you to set up a DVR recording from the PC -another great example of convergence. Roberts also announced a new service from Comcast called "Fancast", a launching pad for convergence between the PC and TV. Fancast.com is the one Web site that links you quickly and easily to the world's greatest content wherever it is, on TV, On Demand, on DVDs, in theatres, or elsewhere on the Internet. Finally, thanks to "wideband" capability made possible by the new DOCSIS 3.0 cable modem protocol, Comcast High-Speed Internet will introduce service with download speeds of 100 Mbps and more. Imagine downloading a 2- hourand 20-minute HD movie in less than 4 minutes -the same download would be 6 hours with DSL. While this speed greatly exceeds the needs of the average customer, Comcast is committed to bringing our communities the most advanced and innovative services available. Standard speeds will continue their steady increase in 2008. Watch for further announcements in 2008 as Comcast 3.0 comes to the Twin Cities Region. Our Time to Vote - On Dec. 13, Comcast announced the launch of this non-partisan voter education and registration campaign designed to increase voting in diverse communities served by the cable industry. Comcast recognizes that broader participation in the democratic process is important to our nation. The $5 million campaign features four multi-cultural PSAs and national voter registration resources: ourtimetovote.com and 1-866-544-VOTE. Grants were presented to NAACP National Voter Fund, the Hispanic Federation, and others for voter outreach.
