Kathi Domlelley-Cohen will have a service tech check this out as it may be a problem with the digital receiver. Swee asked whether anyone else who had analog service and not using a box was hauirrg fuzzy audio on Chamie145. StroIlc said he would check it out on his set at home and get back to Swee. Kathi told Swee to have whoever was having the problem set up a service call. B. Correspondence Log and Follow Up on Complaints Staff had not received any new complaints. $. Status of Franciuse Renewal Staff and Legal Counsel met with Kathi Domlelley-Cohen from Comcast at the end of January. The City's proposal was to renew the fiaucly e `as is' for a term of five (5) years. Guzzetta explained that because of the regulatory uncertainty for both sides, afive-year renewal is reasonable and accepfable to both parties. This would put us on the same schedule to renew the fraxrchise as other cities being served by Comcast. I3e stated that Comcast is workhig on a counter proposal that would have some changes to the PEG fees and possible changes in regards to the Public Access Studio. Nawroclci questioned what types of changes were being proposed? Kathi Donnelley-Cohen stated that the lease is up at the Public Access Studio and they are considerhlg other options as part of the negotiation process. Columbia Heights is the only city with a separate studio and it has become very costly to produce the few programs that are actually done there. It is hoped that other arrangements can be made for our Public Access taping and programming needs. TELECOMMUNICATIONS COMMISSION MINUTES FEBRUARY 15, 2007 PAGE2 Members asked what would happen to the equipment used for distribution that is now located in the studio. Kat(ri explained that they would still need a small space to hold the equipment and that distr7butiou would still occur tluough that equipment, They just don't need to lease the entire facility as they have been doing. The employees would roost likely he kept on and work out of a different location. There was a discussion again about broadcasting NASA. Kathi explained that Comcast does have the technical ability to put NASA on au access channel, which has previously been offered. However, they will not put it on an empty charmel. Empty channels are reserved for programtning that is being added to all systems. C. Report of IS Dept. re: Streaming Video Reuben stated that he was surprised at how costly it is to stream video on the Internet, especially the storage fees of the video files. Members discussed the idea of having our own server, storing ow• own files, and having the staff to do this. They thought it would be interesting to know the cost involved in hosting your own. Hanson reminded members that this needs to be re-visited at a later time once decisions are made on what type of services we want to provide, so that the right equipment can be purchased as we upgrade the system, and to ensure the equipment is compatible to provide those services, It may tape the expertise of a consultant to make srue the entire system is moving in the right direction. This will be brought back to the commission when that process begins. ~ - D. Other Old Bushiess No other old business. NEW BUSINESS -ter Franchise Fees The fiaucluse fees for 4°i Quarter of 2006 were received and a copy was enclosed in the agenda packets. B. Notice that SOAPNet is Being Added to Line Up A copy of the notification that SOAPNet was being added to the channel lineup on channel 120, effective March 1, 2007 was enclosed in the packet. That letter also notified the city that the FCC fee was benig increased fi~om $.06 to $.07 effective March I, 2007. C. Update of WUCW Negotiations Kathi said this has still not been resolved, and is being negotiated at the corporate level. Comcast will not pay au exorbitant increase to carry this programming. She had heard that Media Com had reached an agreement with Shzclair and that their fees rose chastically. TELECOMMUNiCA'FIONS COMMISSION MINUTES MEETING OF FEBRUARY 15, 2007 PAGE3 D. City Wide Wireless Network h>formation as Presented by Unplugged Cities This was included hr the packets for informational purposes only. Unplugged Cities made a shorC presentation at a recent Division Head Meeting. It was pointed out that the higher the density of housing, the more affordable the service would be. Reuben stated he thought Convnission members should be px~serrt to hear these types of sales pitches. He said this comparry did work for St. Louis Park and, in lris opinion, made poor recormnendations on their equipment purchases. IIe felt that staff acrd the City Council need the expertise of the conunission members' technical lcuowledge before malchrg any decisions. E. Articles ou Wheless Service Two articles were also enclosed in the packets regaxduxg this issue for the corrurrissiorrers to review. Swee said cities should be careful about providing wi-fi service and going alto competition with others that provide the carne service. IIe tlurrlcs it would be financially and teclnically diffrcult for cities to compete in this area. IIe reconmiends a "wait and see" approach on this issue, F. Other New Business Dennis wanted to make others aware of arr article he was e-mailed that was a false sent from Customer Central, aslung for inforwation supposedly for the Cable Company. Kathi stated she is aware of these false e-mails and warned the others not to even open them, as it is a way for the sender to obtain hrforrnation from your computer. Demos also stated he had received the subscriber survey in the mail this week and that it is due back by February 20~'. He thought that was a very short time frame to get many responses. There was a short discussion regardurg some items listed on the survey. REPORTS A. IIe informed the members that MACTA and the League of MN Cities recently had a semurar. At this thee, a lobbyist told hhn drat Qwest will t1y and get a statewide frauclusirrg bill sponsored this year. IIe told members to stay apprised of this and to ta11c to legislators to voice their opposition to such a bill being passed. He staCed Qwest's hill is opposed to any Tdnd of build-out requiremeuis, and if passed, would allow them to pick and choose where they provide service. They want to target the more affluent areas. Status of Franchise Renewal Guzzetta reported that the City is still waiting for a response regarduig how Comcast proposes to meet the City's PEG access needs and hnterests. Comcast had indicated that Chamlel 6 may be interested ui moving from their Miimeapolis location to the Columbia Heights Studio, and would allow the public to continue using the facility. But after checking uito that option, it was discovered that they have a lease miti12010 at their present location, so that option will not work The Blaine Studio is the closest studio site, and that doesn't meet the city's needs. Guzzetta stated fllat Comcast has until Monday, April 23ra to provide a detailed proposal of how they intend to meet the City's PEG access needs and interests. The conunissioners felt stxoiigly about the need.for studio space and equipment to use for public access programming. TELECOMMUNICATIONS COMMISSION M1N[ITES APRIL 19, 2007 PAGE 2 D. Other Old Business No other old business. NEW BUSINESS A. Receipt of Annual Report The Annual Report was enclosednr the packets. Kathi Donnelly-Cohen wasn't present to answer quesfions. Since there wasn't a quorum, tlxe report couldn't be accepted at this meeting. The commissioners present conunented on a few items ui the report they found interesting. B. Notice that Bloomberg Television is moving to Digital Classic Bloomberg Television moved from the Sports Entertainment Package to the Digital Classic level of service effective March 27, 2007. More subscribers will receive this programming due to this change. C. Notice to Customers Regarding MLB Extra Imxings Service Due to a recent decision by Major League Baseball, Comcast can no longer offer MLB Exh~a Innings beginning with the 2007 baseball season. Army subscriber who previously had this service was offered cone-time $50 credit toward MLB.TV, a web site where they can subscribe to watch any 2007 regular season, out of market game, ou the computer. This credit would help offset the cost of this MLB.TV ixrternet service. D. Other New Business No other new business. REPORTS A. Report of Cable Attorney Guzzetta reviewed the FCC's Order and Rules regarduig competitive entrance into the cable market and what possible affects it could have to the City and its fiauchise. The Rules become effective 30 days after publication, which means that some of them will be effective Apri120, 2007. He noted the deadline for filing cormnents is Apri120, 2007. He reported that comments have been filed on behalf of many of lxis clients. Guzzetta explained that the new Order is supposed to apply to new entrants into the market azxd that it was lobbied for by companies who claim that cities are slowing the process down, and therefore, prohiUiting competition. Companies that already have use of the right of ways can suUmit au application to provide cable services and tlxe city will have 90 days to approve the application. If they don't already have use of the right of ways then the city would have 180 days to process the application. Dm•iug this review tune, the couipa~xies would have hxterim rights to set their equipment in the right of ways. Allowing placement of the equipment in the right of ways prior to approving a franchise creates potential legal problems and restricts the city's authority. Companies now offeziug service could operate under the same rules as the new eutz•ants when then Piauchises are renewed. The order also says that Uuild-out requu~ements constitutes a barrier that is detarnvned to be too costly and mueasonaUle, so new companies will be allowed to select the areas they choose to offer service to. However, in Mimiesota we have regulations that ensure an "equal playing f eld", so tlxis may not be allowed because the Order cannot pre-empt State law. Guzzetta also reviewed the changes to how PEG fees and Franchise Fees are calculated and how Colmnbia Heights could be affected. This Order axed Ruling is not a good thing for cities as it takes away their rights. Lawsuits have been filed in various Appellant Courts with hopes to stay the Rules as ordered until the case is heard based on the complaint that they have overstepped their authority. We anticipate the opening of this facility on July 9, 2007. This new location is extremely convenient and easy to find. There will be much more visibility in this strip mail location and more parking spaces. We are confident that the new facility will provide a service enhancement for customers in the north metro area. Comcast will provide customer information about the relocation in several ways. A newspaper notice will occur in the next week in the St. Paul Pioneer Press. Flyers will be placed on the counter in the current Roseville location with maps fo the new site for customers who frequent this facility. Signage will be placed on the glass door panel as a notice and the sign will remain once the site is vacated. TI~e website and ib'R information v~~tl6-be updated with hours and location information. An HD receiver and HD TV are required to view HD programming. A subscription to Digital Classic is required to receive A&E HD and National Geographic HD. At the same time, NFL Network will remain in the Sports Entertaimnent Package on channel 275, but will no longer be available on other levels of service including Digital Preferred. Customers will be notified by advertisements in the Pioneer Press uid Star Tribune. Bill messages will be sent to each customer prior to the change. This change will not affect the full schedule of NFL games carried on CBS, FOX, NBC and ESPN. This decision does mean that our customers who are NFL fans will be able to watch the NFL Network on our Sports Entertainment Pack, while customers who do not wish to watch these NFL games will not incur additional costs. We believe that this is the best and fairest solution for all our customers. Effective June 18, 2007 the NFL Network will remain on channel 275 of the Sports Entertainment Package and will no longer be available on other levels of service, including Digital Preferred, channel 180. In order to receive the NFL Network, customers will need to subscribe to the Sports Entertainment Pack. The Sports Entertainment Package also includes Fox College Sports Atlantic, Fox College Sports Central, Fox College Sports Pacific, Fox Soccer Channel, Speed Channel, College Sports TV, The Tennis Channel and more. In addition to updates on the latest legislative and regulatory activity, the Community Networks and Programming tracks will again be chock full of "news you can use." One of the treats will bre an al)-day workshr~o, put together by the Multimedia and ProgrammingCommittee, entitled "Storytelling is a Team Sport" and featuring our own Boyd Ruppert and Jonathan Malat from IW2E11 here in the Tv~in Cities. Members of the MMP Committee also prepared three articles for the fall NATOA Jourrnsl ,and they are working to compile a listing of free and lowcost programming that can be used on PEG channels. Of course, the Policy Committee remains active in following federal and state legislative actvity, the FCC and the cerent progress of the court challenge to the FCC's video imnchising order. Members of that committee are wodcing on a survey that can be used to gather information about what's happening in those states that moved frenchising authority to the stale level. We need hard data about whether competition is developing inthose states and, if so, whether it is having arty effect on pricing. Even as the Communications Committee is putting the fall issue of the Joumal to bed, we have begun planning the winter edition. The committee works hard to bring you infonnalive and thoughtful articles about communications developments and issues. The Cily of VNlminglon, North Carolina is no exception. Like many municipalities and special districts they have discovered they must run an increasingly cost-effective and efficient operation in order to meet performance demands. Tackling this challenge head-on, Wilmington deployed Granicus throughout their city in order toe~gage and educate iheir community through mission-cdtical video content such as Public Service Announcements and Hurricane Preparedness videos. Wnal's unique about their Granicus deployment is that they didn't stop there. Granicus is being used fo improve intemal effciency through textbook applications like HR benefits meetings, but ono intemal application in particular has proved to be a huge success. The Cityof Wlmirgton is now transmitting ondemand tmining content to the entire staff of their Fire Department. The Fire Depadment and city staff both agree that Gmrecus has measurably enhanced their ability to meet expanding tmining certiflcafion requirements. In2o06, the wlmingfon Fire Depadment, aforce 200 strong and spread across eleven fre stations, was faced with the challenge of efficiently facilitating 50 hours of mandatory tmining to their entire staff, including an upgrade of all flrsl responders totally-qualified Emergency Medical T~hnicians (EMT). Inthis age of fenodsm threats and homeland security preparedness mounting on top of the vast traditional emergency response requirements, it was fundamentally mission-critical that Wilmington meet this challenge. EMT is a cdtical certification granting firefig}6ers the skill fo administer emergency medical services to the critically ill arid injured. Before Granicus, the only way to train the full fim staff was to bring entire unitsof fire engines out of seNice, and then convene in a central location. This forced atough decision: temporarily allow weaknesses in fire and life safety coverage fo that district during thetmining time, or bring inadditional staff al ovedime rates to fill in the gaps. Neither alternative was good for tax- payers, or cost-effectivefor the fre department. Incollaboralion with local Emergency Medical Services, the Cityof Wilmirtglon Fire Department and Cape Fear Community College engine companies can now complete their training using Granicus. No longer do firefighters have to complete iroining certifcation requirements on a set time schedule or at a fixed location that Is inflexible or compromising of their principal obligation: public safety response. If called to an emergency, firefighters can watch the archived versions of the training videos at a later time oftheir choosing. The efficient combination of Granicus' Outcast Encoder and short broadcast latencies allow frofighters at remote stations to call in questions, as needed. With the success of the EMT program, the Wtlmirgton Fire Depadment is eager toexpand their use of Granicus beyond trainirg purposes. They hope toevenlually use streaming video as a way locommunicate vrith staff live and through arohives. The Wilmington Fire Department started with only one encoder, nowthey have added iwo more, for"added flexibility."Pccording fo Bergmen, the VNlmington Fire Department "likes havinga robust, full service set-up." Comcast, tFe Illinois Court ofPppeals mled on May 17, 2007, that Comcast must pay imnchise fees on cable modem services to the Cily of Chicago, dating back to 2002. This decision will have asignificant fnancial impact for the Cily of Chicago and it also severely limits tF~ persuasive authority of seveml unpublished district court decisions mling against municipalities on the issue, inctudirg one in Minnesota. In the Chicago franchise in question, Comcast agreed to pay "a franchise feo of five pemenl (5%) of the annual gross revenues received by the [franchisee]...:' Gross revenue was defined in the franchise as"all revenue derived directly or indirectly from the operation or use of all or pad of a cable television system...." The Illinois Court of Appeals concluded 'that the Agreements are valid contracts under state law and that the Agreements are not preempted by federal law." The Court also rejected Comcast's argument that requiring the payment of franchise fees on cable modem service violates the Internet Tax Freedom Act. Comcast was ordered to pay franchise fees on cable modem services going all the way back to 21702. Inso ruling, the Illinois Court of Appeals rejected as unpersuasive seveml lower court decisions addressing the payment offranchise fees on cable modem services, including Cily of Minneapolis vs. Time Warner Cable, where the U.S. District Court mled against the City of Minneapolis in its declaratory judgment action against Time Warner Cable on the franchise fee on cable modem services issue. The Cily of Minneapolis appealed that ruling to the Eghth Circuit Court of Appeals, where ttte matter was beefed and argued, but the parties reached a settlement before the Eighth Circuit issued an opiniar. used on the City of Chicago decision, Minnesota cities should not hesitate to challenge the negative and, as the Illinois Court of Appeals found, unpersuasive Minnesota U.S. District Coud decision. The most current initiative 6y Programs Manager Chris Vogl and the Orono Schools has been a monthly program, "Orono Schools Update." This program started with information on the Orono School's referendum and is continuing with pedptent information about student programs and other related subjects. Another new monthly government access program initiated by the Minnetrista Police Reserve is the "MinneMsta PD's Roll Call." This program covers safely issues and many other areas of service that public safety departments provide out communities. Eventually this will eMend into all high school activities, extracurricular and academic. We are includirg upload and editing fools and broadcast quality playback. Wewill populate the section through anelwork of student, coach, and parent contributors. These contrbulors are most likely involved with video production, video broadcast classes, orwith the athletic teams. Wewould look for game highlights, the winning shot/play/goal, an amazing play, a feature on a team or a player, or a gootl interview. The contributors would upload their video onto the site. In return for being a contributor, they would have an opportunity for their video work fo be seen by a wider audience. When the video is newswodhy, the sports department may use if and credit the contributor and tyre school. Comcast wants to make the BTN available to fans of Big Ten sports, but Fox's BTN has demanded that Comcast and every other cable and satellite company rreke it part of their "expanded basic" service in every home in all Big Ten states, and they want our customers to pay them more than $13 every year for the programming. In addition, the Big Ten is demanding that we carry this new network as part of our digital basic package nationally. We'd like you to know that we want to carry the BTN and are working to reach an agreement with them that would let us add the network to our Sports and Entertainment Package. Customers may add this service to tiers as low as Digital Starter which is $1.99 a month. Notice is being sent to customers in the next few days. As we were working on this, I questioned how this would affect the access studios and their use of the service for background on your channels. Unfortunately I was advised that Music Choice is not authorized to be used as background music on these channels. According to Music Choice, our agreement with them does not cover the copyright permission for any use other than use in residential locations. Music Choice is not allowed in commercial establishments such as public areas nor for integration into audio-visual or other programming produced by local access studios. A separate agreement must be obtained directly from ASCAP or BMI by each facility. We have supported set-top boxes, televisions and other devices that use the CableCARD for several years and will continue to do so. Comcast and other cable companies had sought a waiver allowing for the continued deployment of low-cost set-top boxes with integrated security for which there is no retail market. The consumer electronics market makes some high-end, expensive set-tops available. Complying with the FCC order, effective July 1, our new boxes come with security on apre-inserted CableCARD. Set-top boxes installed in the customer home prior to July 1 can still be used and do noY need to be replaced. Because boxes with CableCARDs are more expensive for us to purchase (and provide no additional benefits to the customers using them), the Separable Security mandate amounts to an "FCC tax' on millions of consumers with no additional benefits. We are evaluating how we can manage that cost impact for our customers. Highlights included coverage of the City's Safety Camp, National Night Out and a cooking show hosted by an aspiring young chef who made lasagna. September will bring more community related programming including a discussion of the school district's Family Center and its various activities and another Community Development Update. Looking forward a bit, staff is in pre-production for the star•C of a series featuring the Sister City's organization. The month of August began like no other. Minnesotans responded bravely and without hesitation. Like so many, we offered to do anything to help. One of our employees pulled survivors from the water.Our August news follows. Comcasta F Irst on theScene - Rid< Kraft, CommTech 3 from our Southwest Tech Ops Center, had just exited 35W at University Ave when the bridge collapsed. He dialed 911 and headed to the river, making his way between train cars on the north side and down the steep riverbank. He wasconfronted by a chaotic, unreal scene. Some of the bridge still stood; cars were scattered about on the fallen deck. Being an excellent swimmer, he headedto the water. After guiding several dazed survivors at waler'sedge to higher ground, he heard calls for hdp from a red Ford Focuslhat was nearly submerged. The injured driver could not get out of his sealbelt. Rid<waded out and was joined by other volunteers. Calling upon his First Aid training, Rid< helped keep the driver ce nsdous by asking him questions. He learned hewas helping Garrettfrom New Ulm. Rid<stayed with Garrettand kept his head above wateruntil paramedics arrived. He went onto rescue three others. As emergency workerslookover, Rid< returned to his truck and continued his trip home. His last ad was to call the New Ulm Police that evening to let them know, should anyone worrier, that Garretthad been rescued. BringingCommu nicatims to the River- Our Construction, Engineering, Finance and Fulf Ilment teams worked tirelessly on Augusl7 to provide Comcast High-Speed Intemet and video services to the Henneph County Sheriffs Command Center, the FBI, and U.S. Navy. In addtion, both services have been made available to the Minneapolis Police Mobile Command Unit. In less than a day, Comcasl employees and contrail construction crews desgned and extended ou' plant from the upper bluffs to the river. These services will provide local, state and federal authorities with lods to help carry out the long investigation and recovery.
