Motion: Move to Adopt Resolution 2007-05, a Resolution confirming approval of the 2008 Public Housing Agency certifications of compliance with the PHA plans and related regulations. 10. Resolution 2007-06, 2008 Budget for Parkview Villa North Motion: Move to Adopt Resolution 2007-06, being a Resolution of the Housing and Redevelopment Authority in and for the City of Columbia Heights, adopting the 2008 Parkview Villa North Budget of $845,387 and recommending this to the City Council for approval. 11. Resolution 2007-07, 2008 Budget for Parkview Villa South Motion: Move to Adopt Resolution 2007-07, a Resolution of the Housing and Redevelopment Authority in and for the City of Columbia Heights adopting the 2008 Parkview Villa South Budget of $271 ,517 and recommending this subject to the City Council for approval. 12. Resolution 2007-08, Parkview Villa North Notice to Vacate Policy Motion: Move to Adopt Resolution 2007-08, a Resolution Approving Parkview Villa North Notice to Vacate Policy and to authorize Management to make the necessary changes to the lease agreement. 13. Resolution 2007-09, Parkview Villa South Notice to Vacate Policy Motion: Move to Adopt Resolution 2007-09, a Resolution Approving Parkview Villa South Notice to Vacate Policy and authorize staff to make the necessary changes to the lease agreement. 14. Resolution 2007-10, Parkview Villa North Violence Against Women Act Motion: Move to Adopt Resolution 2007-10, a Resolution Approving Parkview Villa North Lease Incorporation of the Violence Against Women Act and to authorize management to make the necessary changes to lease 15. Parkview Villa South Siding Panels Replacement Motion: Move to Approve the bid from M.J. Construction for the replacement of Parkview Villa South siding panels in an amount not to exceed $25,700; and furthermore, to authorize the Chair and Executive Director to enter into an agreement for the same. 16. HOUSING & REDEVELOPMENT AUTHORITY REGULAR MEETING MINUTES OF APRIL 24, 2007 Call to Order - The Regular Meeting of the Columbia Heights Housing & Redevelopment Authority (HRA) was called to order by Chair, Tammera Diehm at 7:02 p.m., Tuesday, April 24, 2007, in the Parkview Villa Community Room B, 965 40th Avenue NE, Columbia Heights, Minnesota. Roll Call- Tammera Diehm, Bruce Nawrocki, Bobby Williams, Dennis Ecklund Jr., Patricia Jindra, and Bruce Kelzenberg Pledge of Allegiance CONSENT AGENDA Approve the Minutes of January 23, 2007 Financial Report for the months of bills for January, February and March 2007, on Resolution 2007-03. Nawrocki stated he would like to commend who ever was putting the financial reporl together for its read ability is a lot better than it used to be. Bob Lindig stated he submits the reporls to Cher Bakken and it is her that should be commended. The board thanked her. Motion by Williams, second by Jindra, to adopt Resolution 2007-03, a Resolution approving the Financial Report and payment of bills for the months of January, February and March 2007. All ayes. Motion Carried. HRA RESOLUTION 2007-03 RESOLUTION OF THE COLUMBIA HEIGHTS HOUSING & REDEVELOPMENT AUTHORITY (HRA) APPROVING THE FINANCIAL STATEMENT FOR JANUARY FEBRUARY AND MARCH OF 2007 AND PAYMENT OF BILLS FOR THE MONTHS OF JANUARY, FEBRUARY AND MARCH OF 2007. WHEREAS, the Columbia Heights Housing and Redevelopment Authority (HRA) is required by Minnesota Statutes Section 469.096, Subd. 9, to prepare a detailed financial statement which shows all receipts and disbursements, their nature, the money on hand, the purposes to which the money on hand is to be applied, the HRA's credits and assets and its outstanding liabilities; and WHEREAS, said Statute also requires the HRA to examine the statement and treasurer's vouchers or bills and if correct, to approve them by resolution and enter the resolution in its records; and WHEREAS, the financial statement for the months of January, February and March of 2007 and the list of bills for the months of January, February, and March of 2007 are attached hereto and made a part of this resolution; and WHEREAS, the HRA has examined the financial statement and the list of bills and finds them to be acceptable as to both form and accuracy. NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the Columbia Heights Housing & Redevelopment Authority that it has examined the attached financial statements and list of bills, which are attached hereto and made a part hereof, and they are found to be correct, as to form and content; and BE IT FURTHER RESOLVED the financial statements are acknowledged and received and the list of bills as presented in writing are approved for payment out of proper funds; and BE IT FURTHER RESOLVED this resolution and attachments are to be made a part of the permanent records of the Columbia Heights Housing & Redevelopment Authority. Housing & Redevelopment Authority Minutes April 24, 2007 Page 2 of3 BUSINESS ITEMS Report of Management Company Gravemann asked if there were any questions on his reports for the months of January, February and March. Nawrocki asked about the current staff changes at Parkview Villa. Gravemann stated two of his staff members retired; Mary and Lee and that he is in the process of hiring a full-time position to replace Mary in the office and a caretaker position. Nawrocki asked why the pop machines have been removed. Gravemann stated he felt they needed to upgrade the machines from two to three machines, with more selections, with a coin changer, 10 selections versus the 8 selections, and the third machine for sandwiches, pizzas and other items. Ecklund stated in the future the residents would like to be addressed about the changes. Nawrocki asked Gravemann to provide a report from the last three months stating if all of the new move-in's were Columbia Heights residents. Gravemann stated he would provide this information to him this week. Resident Council Minutes Jindra stated in the April meeting minutes, I wrote down there was a vote on the vending machines, but it wasn't and asked for the correction to be made to the minutes. Citizen Forum Ken Block, unit 315, stated residents were talking about garbage trucks picking up dumpsters in the middle of the night, can anything be done about this. Fehst stated he checked into this in the past. They shouldn't be out there before 6 am, but he would look into this again. Barb Camp, Unit 608, stated the Walker staff have improved a lot and are easy to work with. Approve 6th Floor Modernization Bids and Contract Gravemann stated in 2004 the HRA board approved plans to begin an eight-phase project to modemize all floors of Parkview Villa North with new entry doors, kitchen cabinets, appliances, lighting, countertops, bathroom vanities, kitchen and bathroom faucets and new carpeting on each floor. The request for bids was advertised in six different newspapers. Funding will come in part from the FY2005 and FY2007 HUD Capital Fund Program years. Of the four bids received I have listed the three lowest bidders. They were Unicorp in the amount of $101,400; Merit Building in an amount of $108,000; and Jansen Builders in an amount of $109,000. All bids include rehab of all 12 units on the 6th floor and the carpet in the main hallways. Staff recommends approval of the bids and awarding the contract for Phase 4 of Parkview Villa North Modernization Project to Unicorp in an amount not to exceed $101,400. Gravemann stated they were about the same with the usual wage increases only. Motion by Kelzenberg, second by Williams, to approve the bids and award the contract for Phase 4 of Parkview Villa North Apartment Modernization Project to Unicorp for an amount not to exceed $101,400.00; and furthermore, to authorize the Chair and Executive Director to enter into an agreement for the same. All ayes. Motion Carried. HRA Update Fehst stated they extended the contract with Walker until the beginning of next year. Staff is putting together the packets for the RFQ's. He also stated he felt that Nick and the Walker staff has done a very good job, and appreciates hearing good comments from residents. Nawrocki stated he isn't in agreement that they are doing a good job. They could do better. Walker has changed their requirements since the contract was approved four years ago. He felt we should also look into having City staff run the building again. Motion by Nawrocki, second by Jindra, to direct staff to prepare a request for quote (RFQ) for outside management and prepare documents as to what it would cost to have City staff manage the building. All ayes. Motion Carried. Diehm directed staff to provide the RFQ's a little in advance of the July meeting so they can review the documents a little longer. Absent: Patricia Jindra. Pledge of Allegiance BUSINESS ITEM ReQuest for Proposal (RFPI for Parkview Villa NorthlSouth ManaClement Services Schumacher stated you are looking at a Draft Request for Proposal for Management Services for Parkview Villa North and South. The current agreement with Walker expires on January 31, 2008. On the second page there is a timetable for the process. A pre-submission conference and tour of the properties would be held September 1 ih, proposals would be due on October 15 by 4pm, there would be a 30-day review by the HRA board, with a special meeting to be held approximately the third week in November to conduct interviews and make a final decision. Ecklund stated the current contract was for three years and in this draft it states five years. Schumacher stated he and Streetar talked about the time it takes to go through the bidding process and felt it would be beneficial to go with a longer period of time, again this is a draft so you could change that. Ecklund stated he would like to see a three-year agreement with a two-year extension. Nawrocki stated on page 3, item 6, full responsibility for hiring and firing of staff, and staff training. With our past experience of hiring, he requested to be one of the people to interview the new candidate for management and wasn't able to do so, Diehm and Jindra did it. He felt in his view, there isn't good, managers at Parkview. Diehm asked if any of the other commissioners received a hand written letter from a resident stating Nick has been the best manager that has ever been in the building. Szurek, Williams and Kelzenberg stated they did receive it. Nawrocki stated on page 4, H, the second paragraph, it says the agency will utilize the selection process, and asked who would make those decisions. Diehm stated under number I, General Information, A. Introduction/Background section, "The Columbia Heights Housing & Redevelopment Authority (HRA), hereinafter referred to as the Agency or Owner", that is us. Nawrocki asked on page 5, under number two, General Requirements, letter A, who is the contract manager. Diehm stated it is the manager. Nawrocki stated he felt it was the independent contractor, was concerned about the person that has the day-to-day position in the building and that we have been weak in that area. Diehm stated the heading under two, General Requirements of Management Agent, the next line says management company, then the rest of the items under that say contract manager. She suggested Schumacher make all of them the same phrase. Housing & Redevelopment Authority Minutes August 28, 2007 Page 2 of2 Nawrocki asked Streetar if he had any recommendations. Streetar stated he would recommend they put in two things: 1) what is your cost for operating the building, which includes labor, training, mileage; and 2) what do you propose your management fee to be. Schumacher stated he already made those changes. Motion by Williams, second by Ecklund, to Approve the Request for Proposal for Property Management Services for Parkview Villa North and South, with the amendment to Section II as discussed. Designated fund of $500 is set aside for purchasing materials for lap robes. 200 have been donated to Fort Snelling Hospital from Park View Villa ladies to date. Committee reports was given by Priscilla Cross, Jackie Ovshak, and Lenny- accepted. Denny acknowledged those who contributed money towards plantings in the traffic circle. Bazaar is scheduled for October 6,2007, from 9 a.m. to 2 p. m. Jessie will do tickets and crafts. Dorothy- kitchen, Sharon- baked goods and signs, Ken for outdoor, and Jean for white elephant sale. Garage painting was started and thanked residents for moving cars to the ramp, . In August, traffic surface will be repaired, Please move cars away at that time, . June 20th -Window cleaners will be here, . Residents were urged to keep A & B rooms picked up and to report spilling to management report finished, Secretary's Report- was read and approved, Treasurer's Report- As of Checking $4,819.49 and Savings $2,242,67, Lions Club donated $100 for materials to make lap robes, Sunshine- Helen Haley at Catholic Elder Care and is re-cooperating from surgery, Denny and Terri White visited her. Entertainment: Pizza Party announced August 8th Men's picnic for residents 6:00 pm they will provide meat, people to bring potluck, Wednesday, August 15th, Chicken Dinner with Mary Hall to entertain, Bingo Report- Jackie Ovshak stated the balance was $51,50, Coffee Fund- Leonard reported was $64.40, Pricilla reported Saturday there will be Potluck and church service activity $25,00, Ruth H, said Sunday Bingo monies even out with pay offs, Resident Council paid out $162,00 for circle planting and hanging baskets, Bill Cross confronted Denny Ecklund over argument over Council Authority, our donation without sanction of council. Pledge Allegiance to the Flag Secretary's Report- Minutes of the previous meeting and the executive board meeting was read and approved. Ecklund stated the items to be discussed tonight are the problem with new stoves and shrubbery by driveway need to be trimmed. The Parkview Villa Resident Advisory Board, as well as Anoka County, has been sent the Plan for comment. Walker ElderCare Services, Inc. provides management services to PVVN. Expenditures The proposed 2008 budget for PWN is 1$845.3871. The amount includes $417.156 for capital outlays. Of that amount, we expect to fund $157,156 from 2007 and 2008 CFP funds. The balance - $260,000 - will be drawn from fund balance reserves. This latter amount will be used to update the plumbing system (replace the 11 remaining vertical risers not yet replaced, at an estimated cost of $114,000) and to paint the exterior of the building (estimated cost $120,000). Supplies and Services are generally held at the 2007 budgeted levels. Overall, Supplies and Services costs are expected to increase about 2.2% over prior year. Utility costs are expected to increase 5% over the 2007 budget (which is approximately 15% more than the 2007 year-end estimate). Expenditures The proposed 2008 budget for PWS is 1$271,5171. This represents an 11.9%, or $28,878 increase over last year's budget. Of that amount, $37,000 represents increases in capital outlays. This increase in capital outlays is offset, in part, by a reduction in PilOT obligations to Anoka County. The new PilOT payment calculation is based on 5% of shelter rent less utility costs; in prior years the obligation was calculated at 10%. Supplies and Services are generally expected to increase about 1.5% over 2007. Utility costs for 2008 are expected to be 1.5% lower less than the 2007 budget, which nonetheless represents an increase of 13.3% over estimated year-end actual costs for 2007. Revenues Proposed gross revenues are 1$ 292,9321 and include rents of 1$278,06~ investment income of 1$2,500, land other miscellaneous charges. The rent budget takes into account the limited rent increase proposal approved at the July 2006 HRA meeting. That proposal mitigates the impact of rent increases otherwise due to be implemented for residents who would be severely and adversely affected by the final transition to the new rent structure approved in 2004. Tenants whose rents already reflect the approved rent structure will increase 3.0%, others 4.35%. RECOMMENDATION MOTION: Staff recommends adopting Resolution 2007-07 the 2008 PWS Budget. Based on my latest version of the public housing lease, I would recommend that the Board approve the following modifications to the lease: I. Section VI(M) should be revised as follows: M. CrIminal and Drug-Related Activity Tenant, members of Tenant's household, guests or other person's under Tenant's control shall not: a. engage in any criminal activity that threatens the health, safety, or right of peaceful enjoyment of other residents, neighbors or Management persOlmel; or b. engage in any drug-related criminal activity on or off Matlagement property (The term "drug-related criminal activity" means the illegal manufacture, sale, distribution, use or possession with intent to manufacture, sell, distribute or use a controlled substance or drug paraphernalia.); or c. engage in any abuse or pattern of abuse of alcohol that may interfere with the health, safety, or right of peaceful enjoyment by other residents, neighbors or Management persOlmel. It is understood and agreed that a violation of this cause for termination of the Lease, 321625v\ RAACLlGO-8\ violence, dating violence, or stalking engaged in by a member of a tenant's household or any guest or other person under the tenant's control, shall not be cause for termination of the tenancy or occupancy rights, if and only if the tenant or immediate member of the tenant's family is a victim of that domestic violence, dating violence, or stalking. The terms "domestic violence", "dating violence" and "stalking" are defined in Section_ herein. Not withstanding the foregoing, or any Federal, State, or local law to the contrary, Management may bifurcate the Lease 01' remove a household member from the Lease without regard to whether a household member is a signatory to the Lease in order to evict, remove, or terminate occupancy rights of any individual who is a tenant or lawful occupant and who engaged in criminal acts of physical violence against family members or others without evicting, removing, or terminating occupancy rights or otherwise penalizing the victim of such violencc who is also a tenant or lawful occupant. Such eviction or removal of occupancy rights shall be effected in accordance with the procedures prescribed by Federal, State, and local law. Nothing in this Section: a) limits Management form honoring court orders addressing rights of access or control of the property, including civil protection orders issued to protect th~ victim and issued to address the distribution or possession of property among the household members in cases where a family breaks up; b) limits Management from evicting a tenant for any violation of a lease not premised on the act or acts of violence in question against the tenant or a member of the tenant's hO\lsehold, provided that Management does not subject an individual who is or has been a victim of domestic violence, dating violence, or stalking to a more demanding standard than other tenants in determining whether to evict; c) limits Management to terminate the tenancy of any tenant if Management can demonstrate an actual and imminent threat to other tenants or those employed at or providing service to the property if that tenant is not evicted; d) supersedes any provision of any Federal, State, 01' local law that provides greate~ protection than this section for victims 'of domestic violence, dating violence, or stalking. 2. For the purposes of this Section and this Lease, the following definitions apply: "domestic violence" includes felony or misdemeanor crimes of violence committed by a current 01' fonner spouse of the victim, by a person with whom the victim shares a child in common, by a person who is cohabitation with or has cohabitated with the victim as a spouse, by a person similarly situated to a spouse of the victim under domestic or family violence laws, 01' by any other person against an adult or youth victim who is protected form that person's acts under the domestic 01' family violence laws; "dating violence" is defined as violence committed by a person who is or has been in a social relationship of a romantic or intimate nature with the victim; and where the existence of such a relationship shall be determined based on a consideration of the length of the relationship, the type of the relationship, and the frequency of interaction between the persons involved in the relationship; "stalking" is defined as following, pursuing, 01' repeatedly cOlmnitting acts with the intent to kill, injure, harass, 01' intimidate another person; 01' placing under surveillance with the intent to kill, injure, harass, 01' intimidate another person; and, in the course of, or as a result of, such following, pursuit, surveillance, o~ repeatedly committed acts, placing a person in reasonable fear of the death of, or serious bodily injury to, 01' causing substantial emotional harm to that person; II member of the immediate family of that person; 01' the spouse 01' intimate patine( of that person. After further investigation, we learned that in fact the windows were not leaking but the panels above and below them were. At that time a solutions to correct problem was put in to place by caulking all effective windows around the panels. The solution seemed to work until late summer 2007, at which time a resident reported her windows, had again started leaking. Again, we investigated the problem and learned that once more the panels have began to separate from building. We again, re- caulked the effective areas until a more viable solution could be found. At this time, staff contacted several siding contractors to get their opinion on how to fix this problem. After having four siding contractors inspect the site, all four contractors found the same larger problem, severe water damage to the building. Attached you will find just a few pictures of the water damage that has started because of the type of panels we have installed on to the building. As a result of these failing panels, water damage is not only occurring to the outside of the building, but internally as well. At this time there is no way to know how severe the damage really is until we pull every panel off the building and inspect. The only solution to this very large problem is to replace every panel above and below all windows on the south building. All four contractors that we contacted submitted the same recommendation; to remove all panels, sheeting and trim, repair any damage found, install new plywood sheeting, add house wrap for added protection from water leaks and install vertical aluminum siding. Below are the bids to repair the south building. MJ Construction and Remodeling submitted a bid to include all materials, labor and clean up for a total amount of $25,700. Pagel Exteriors submitted a bid to include all materials, labor and clean up for a total amount of $27,000. D.S. BAHR Construction submitted a bid to include all materials, labor and clean for a total amount of $28,200. RECOMMENDATION: Staff recommends approval of MJ Construction's bid for an amount not to exceed $25,700.
