The next step is to purchase the equipment, and/or use the overtime traffic enforcement hours, specified on your Plan for Grant Form. Then mail the receipt(s) along with the claim form, that was mailed to you earlier, to me at the address below. Please remember to obtain the appropriate signatures before mailing. If your contract includes reimbursement for overtime enforcement hours and fringe benefits, complete the Claim Form, O.T. Cost Form, and O.T. Report that were included with the previous mailing. Again, please remember to obtain. the appropriate signatures on the Claim Form before sending the documents. If you misplaced any of the above mentioned forms, please notify me via e-mail. All Safe & Sober Challenge claims for reimbursement must be submitted before June 30, 2007. Thanks far all that you do to enhance traffic safety in your area! Gordy Pehrson Office of Traffic Safety 444 Cedar Street, Suite 150 St. Paul, MN. 55101-5150 (~51)z01-7o7z gardy.pehrson~a state. .us EOUAL OPPORTCJNITY EMPLOYER STATE OF MINNESOTA ANNUAL PLAN GRANT CONTRACT This Annual Plan Grant Contract is between the State of Minnesota, acting through its Commissioner of Public Safety, Office of traffic Safety 444 Cedar Street Suite 150 St Paul Minnesota 55101-5150 ("State") and the Columbia Heights Police Dept. 559 MiII St. Columbia Heights, MN. 55421 ("Grantee"). Under Minn. Stat. § 299A.01, Subd 2 (4), the State is empowered to enter into this Annual Plan Grant Contract. By written acceptance below, the Grantee agrees to perform the work within the terms and conditions in this Annual Plan Grant Contract, including Attachment A, which is attached and incorporated into this Annual Plan Grant Contract. The Grantee must sign its approval in the designated signature block and return the original signed Annual Plan Grant Contract and its attachments to the State's address shown above, prior to the commencement of services. Contract Begin Date: January 15, 2007 Contract End Date: June 30, 2007 The services to be provided under this Annual Plan Grant Contract are awarded for the Safe & Sober Challenge Grant Program: The Grantee, who is not a state employee, will: 1. Purchase, maintain, and use the following equipment: -Stop Sticks 2. Schedule and conduct approximately 60 hours of overtime traffic enforcement patrols. The Grantee will be reimbursed an amount not to exceed $3,000.00 for the above services performed under this Annual Plan Grant Contract. The Grantee must submit one itemized invoice upon completion of the above services to the State's Authorized Representative. Expenditures must be complete by June 30, 2007 and invoices must be submitted by August 1, 2007. Budget. The Grantee will be reimbursed from federal funds up to the maximums set forth in the following budget table: Item Amount E ui ment $420.00 Overtime Enforcement Hours and Frin e Benefits $2,580.00 Ex enses Related to Travel to conference or trainin $0.00 Tatal $3 000.00 The Grantee will submit a revised budget for any deviation of at least 10% or $200.00, whichever is greater, between approved budget lines when more than one budget line is included in this grant contract. The revision must be approved by the State's Authorized Representative in writing before any expenditure maybe made based on the revised budget. The State's Authorized Representative is Gordv Peterson State Pros?ram Administrator 444 Cedar Street, Suite 150, St. Paul Minnesota, 55101-5150, (651) 201-7072, or his/her successor, and has the responsibility to monitor the Grantee's performance and authority to accept the services provided under this grant contract. If the services are satisfactory, the State's Authorized Representative will certify acceptance on each invoice submitted for payment. STATE AGENCY SFY d7 OTS Annual Plan Grant Contract Page 2 ATTACIIMENT A 1. Conditions of Payment All services provided by the Grantee under this Annual Plan Grant Cantract must be performed to the State's satisfaction, as determined in the sole discretion of the State's Authorized Representative and in accordance with all applicable federal, state, and local laws, ordinances, rules and regulations. The Grantee will not receive payment for work found by the State to be unsatisfactory, or performed in violation of federal, state or local law. 2. Cancellation This Annual Plan Grant Contract maybe canceled by the State at any time, with or without cause, upon thirty days' written notice to the Grantee. Upon termination, the Grantee will be entitled to payment, determined on a pro rata basis, for services satisfactorily performed. 3. Amendments Any amendment to this Annual Plan Grant Contract must be in writing and will not be effective until executed and approved by the same parties who executed and approved the original Annual Plan Grant Contract, or their successors in office. 4. Assignment The Grantee may neither assign nor transfer any rights or obligations under this Annual Plan Grant Contract without the prior consent of the State and a fully executed Assignment Agreement, executed and approved by the same parties who executed and approved this Annual Plan Grant Contract, or their successors in office. 5. Liability The Grantee must indemnify, save and hold the State, its agents, and employees harmless from any claims or causes of action, including attorneys' fees incurred by the State, arising from the performance of this Annual Plan Grant Contract by the Grantee or the Grantee's agents or employees. This clause will not be construed to bar any legal remedies the Grantee may have for the State's failure to fulfill its obligations under this Annual Plan Grant Contract. 6. State Audit Under Minn. Stat. § 16C.05, subd. 5, the Grantee's books, records, documents, and accounting procedures and practices relevant to this Annual Plan Grant Contract are subject to examination by the State and/or the State Auditor or the Legislative Auditor, as appropriate, for a minimum of six years from the end of this Annual Plan Grant Contract. 7. Federal Funds (Where applicable, if blank this section does not apply) Payments under this Annual Plan Grant Contract will be made from federal funds obtained by the State under the U.S. Department of Transportation's State and Community Highway Safety Program CFDA number 20.600. The Grantee is responsible for compliance with all federal requirements imposed on these funds and accepts full fmancial responsibility for any requirements imposed by the Grantee's failure to comply with federal requirements. 8. Federal Audit The Grantee will comply with the Single Audit Amendments of 1996 and Office of Management and Budget Circular A-133. Federal Audit Requirements is incorporated by reference. 9. Government Data Practices Act The Grantee and the State must comply with the Minnesota Government Data Practices Act, Minn. Stat. Ch. 13, as it applies to all data provided by the State under this Annual Plan Grant Contract, and as it applies to all data, created, collected, received, stored, used, maintained, or disseminated by the Grantee under this Annual Plan Grant Contract. The civil remedies of Minn. Stat. § 13.08 apply to the release of the data referred to in this clause by either the Grantee or the State. In the event the Grantee receives a xequest to release the data referred to in this clause, the Grantee must immediately notify the State. 10. Publicity Any publicity regarding the subject matter of this Annual Plan Grant Contract must identify the State as the sponsoring agency and must not be released without prior written approval from the State's Authorized Representative. For purposes of this provision, publicity includes notices, informational pamphlets, press releases, research, reports, signs, and similar public notices prepared by or for the Grantee individually or jointly with others, or any subcontractors, with respect to the program, publications, or services provided resulting from this Annual Plan Grant Contract. 11. Worker's Compensation The Grantee certifies that it is in compliance with Minn. Stat. § 176.181, subd. 2, pertaining to workers' compensation insurance coverage. The Grantee's employees and agents will not be considered State employees. Any claims that may arise under the Minnesota Workers' Compensation Act on behalf of these employees and any claims made by any Third party as a consequence of any act or omission on the part of these employees are in no way the State's obligation or responsibility. 12. Data Disclosure Under Minn. Stat. § 270C.65, and other applicable law, the Grantee consents to disclosure of its social security number, federal employer tax identification number, and/or Minnesota tax identification number, already provided to the State, to federal and state tax agencies and state personnel involved in the payment of state obligations. These identification numbers may be used in the enforcement of federal and state tax laws which could result in action requiring the Grantee to file state tax returns and pay delinquent state tax liabilities, if any, or pay other state liabilities. 13. Jurisdiction and Venue Minnesota law, without regard to its choice-of--law provisions, governs this Annual Plan Grant Contract. Venue for all legal proceedings out of this Annual Plan Grant Contract, or its breach, must be in the appropriate state or federal court with competent jurisdiction in Ramsey County, Minnesota. 14. Equipment Purchase of equipment by the Grantee shall comply with all procurement procedures and laws that apply to the Grantee's purchase of similar equipment in the performance of its duties other than its duties under this grant contract. Equipment purchased under this agreement shall be used primarily for traffic safety purposes during the life of the equipment. The Grantee may not dispose of any equipment unless it has first obtained written permission from the State's Authorized Representative. The Grantee shall be responsible for the operation, maintenance, and repair costs of equipment purchased under this grant contract unless otherwise specified.
