Han"~ BY: 2006 SEAL COAT PROGRAM PROJECT 0601 DATE: 3/2/0 DATE: Background The City Council accepted the feasibility report and ordered an Improvement Hearing for March 6th at their meeting of January 23, 2006. Zone 1A is bounded by Reservoir Blvd on the east, 37th Avenue on the south, Central Avenue on the west and 45th Avenue on the north. All local bituminous streets in Zone 1A are included, except those streets that have been improved as part of the street rehabilitation program. Also included is University Avenue Service Drive, 44th to 53rd Avenues and 41 5t Avenue, 6th Street to alley east of 7th Street. Ana Iysis/C 0 n cIusio ns: Distributed at the January 23,2006 regular City Council meeting was the Feasibility Report that details the scope of work and estimated costs for the Seal Coat Program in Zone 1A. Prior to seal coating, concrete curb and gutter is repaired where feasible and the street surface is patched. Seal coat is an application of emulsion by mechanical sprayers immediately followed by spreading F A-3 granite or trap rock as a cover aggregate. The road surface is finished by roIling with a tire-based roller for proper aggregate penetration and distribution. . The following is a listing of streets recommended for seal coat: 1. 41st Avenue 2. Circle Terrace Blvd 3. 42nd Avenue 4. 42Y:z Avenue 5. Fillmore Street 6. Pierce Street 7. University Avenue Service Drive 8. 41st Avenue East of Central Avenue 40th Avenue to Reservoir Blvd Central Avenue to Reservoir Blvd Cul-de-sac to Cul-de-sac 42nd Avenue to 42Y:z Avenue 42Yz Avenue to 43Y:z Avenue 44th Avenue to 53rd Avenue 6th Street to Alley east of 7th Street . Assessment Methodology: Street Rehabilitation Zones 1,2 and 3 all followed the existing assessment policies for each area. Under the 1999 Alley Construction Program and the Zone 4 through 6 Street Rehabilitation Program, a "unit" assessment methodology was employed rather than using a "front foot" rate basis. The area of Columbia Heights west of Central Avenue is essentially a block type development pattern with streets and avenues. The existing assessment policy for this area would involve "street" assessments and "avenue" assessments. The "street" frontage (typical front of property or where driveway access is) would pay a particular rate for the full frontage on that street. That same parcel would pay a reduced rate for the avenue for the full frontage. Staff is recommending a unit basis assessment methodology in reconstruction areas as it has been my experience that the court system has accepted this rationale from an appeal basis, in that residential parcels generally benefit equally from the same improvements. Going to a unit basis methodology would still create different rates for half a block; dependent upon the type of treatment the adjacent avenues receive. Hansen BY: 2006 SEAL COAT PROGRAM PROJECT 0601 DATE: 3/2/06 DATE: ZONE 6 PUBLIC IMPROVEMENT HEARING Continued - Page 2 · Financing: The Seal Coating project will be 100% assessed on a Street and Avenue parcel basis. Avenue assessments are 1/3 of the street rate extending Y2 block in either direction of the Avenue. This assumes that all parcels benefit equally for the strategy in front of their property or abutting it, in the case of the Avenue. The estimated unit cost assessment is $213.00 per Street parcel and $71.00 per Avenue parcel. · Past Assessments: Prope'rty owners assessed for a street or avenue parcel as part of the Street Rehabilitation program in Zone 1 may be assessed an avenue or street unit, respectively for seal coat. Recommended Motion: Move to waive the reading of Resolution No. 2006-30, there being ample copies available for the public. Attachments: Resolution Assessment Rates Map Public Improvement Hearing Notice I COUNCIL ACTION, RESOLUTION NO. 2006-30 BEING A RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS FOR ZONE 1A SEAL COATING CITY PROJECT 0601 WHEREAS, pursuant to Resolution 2006-15, adopted by the City Council on January 23rd, 2006, fixed a date for a Council hearing on the proposed improvements bounded on Reservoir Blvd on the east, 37th Avenue on the south, Central Avenue on the west, 45th Avenue on the north, and 41 51 Avenue, 6th Street to Alley east of 7th Street, and University Avenue Service Drive, 44th Avenue to 53rd Avenue. AND WHEREAS, ten days' mailed notice and two published notices of the hearing a week apart were given, and the hearing was held thereon the 6th day of March, 2006, at which all persons desiring to be heard were given an opportunity to be heard thereon, WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF COLUMBIA HEIGHTS, MINNESOTA: 1. The City Engineer, Kevin Hansen, is hereby designated as the engineer for this improvement. The engineer shall prepare plans and specifications for the making of such improvement.
