Set Public Hearing for the 2006 Public Housing Authority (PHA) Plan Review MOTION: Move to set a Public Hearing date of Tuesday, October 25,2005, at 7:00 p.m. at Parkview Villa for the purpose of receiving public input on the 2006 Public Housing Authority (PHA) Plan. B. Approve Elevator Contract MOTION: Move to approve the Schindler Elevator Contract in the amount not to exceed $755.00 per month. C. Approve Lead Base Paint Inspection MOTION: Move to approve the low bid from Midwest Environmental Consulting LLC not to exceed the amount of$2,805.00. HOUSING & REDEVELOPMENT AUTHORITY REGULAR MEETING MINUTES OF APRIL 26, 2005 CALL TO ORDER - The Regular Meeting of the Columbia Heights Housing & Redevelopment Authority (HRA) was called to order by Chair, Bruce Nawrocki at 7:00 p.m., April 26, 2005, in the Parkview Villa Community Room B, 965 40th Avenue NE, Columbia Heights, Minnesota. ROLL CALL Commission Members Present: Bruce Nawrocki, Tammera Ericson Diehm, Bobby Williams, Dennis Ecklund Ir., Patricia Jindra, and Bruce Kelzenberg PLEDGE OF ALLEGIANCE CONSENT AGENDA Approval of Minutes Motion by Ericson Diehm, second by Williams, to approve the minutes from January 25 and March 7,2005, meetings as presented in writing. All ayes. Motion Carried. REPORT OF MANAGEMENT COMPANY Welke stated in January there were seven police calls, with 19 local applicants on the waiting list from Columbia Heights for the north building. The South building had 13 Columbia Heights residents on the list. In February there were 4 police calls and more unit turns. In March there were four police calls with the waiting list larger. Nawrocki asked from the February and March waiting lists, how many were Columbia Heights residents and what is the reason for people not taking the openings available for the south units. Welke stated some of the waiting list people for the south building were not residents of Columbia Heights and the reasons why people aren't taking the openings she will get the information to him. Nawrocki expressed his unhappiness with Welke's work at Parkview Villa and wanted to know what actions are being taken to alleviate the problems. Welke stated she is taking some classes and has been spending more time talking with residents. Williams commended Welke on her efforts to connect with residents and to straighten out all of the problems in the building. Lyn Miner, unit 202, stated that all of the issues she has asked Dana to deal with have been handled in a timely matter and was very happy working with her. Marge Bruczenski, unit 410 stated she has seen big improvements to the building, it is cleaner, the garage area is clean, and the maintenance problems are handled promptly and efficiently. When she had water coming in from the electrical box at night, she called Walker and within a matter of 20 minutes the maintenance staffwas there to deal with the problem. Motion by Ericson Diehm, second by Kelzenberg, to approve the minutes as written. All ayes. Motion Carried. Housing & Redevelopment Authority Minutes April 26, 2005 Page 2 of6 RESIDENT COUNCIL MINUTES Jindra stated she was not available to come to the April meeting as she was in the hospital. She was concerned with the emergency pull cords not working. Nawrocki stated the minutes say walker hired a security company, what was thatfor? Welke stated she did hire the service as they had problems with people streaking in the building. The police could not identify them so the security service was hired to monitor over an 8-hour period, for one weekend. Citizens Forum Lynn Miner, unit 202, asked why the cable companies are allowed to violate federal laws, they charge different people in the building different amounts, how can the City allow this. Nawrocki stated no one has come before the City Council to provide this information yet. The original cable service, the City went out for bids for a couple of years before we actually signed an agreement. In 1996 the government gave the cable companies the right to basically steal from residents, the federal government said they passed this so that they could open this us for competition. Comcast is trying to work out some kind of deal with Time Warner, if this goes through, it will be even more of a monopoly. Miner asked if they were allowed to have dish tv in the building. Fehst stated he didn't know for sure. Williams stated other cities have an agreement that everyone has to have cable and only pay a small amount a month of like $10.00. Nawrocki asked if walker had any experience with this. 0 'Donnell stated this is possible, but everyone has to have the cable set up and pay for it if they want it or not. Nawrocki suggested this be brought up at the resident council meetingfor discussion. Priscilla Cross, unit 303, with the noise in the alley she was told to call 911. The earliest she heard noises was 4:30 am, which was a garbage truck. She asked if there is anything the City can do about this. Fehst stated the garbage service is hired by the business and we should send a letter to the owner of the business in regards to this matter and that there is a noise ordinance that this should come under. Cross also stated she was one of the organizers for the dinner the Sun Focus article addressed stating the chicken and pop were provided by Mr. Williams and that she did not realize this was provided during the campaign period and did not feel this was considered a bribe. Ruth Hillestad, unit 310, stated things are improving and that the new maintenance man is wonderful to work with. However, residents do not understand why the maintenance man has his office in with the Dana. The old maintenance person did not have their office there. She also wanted to pass along a message from Pat and Rueben Baker saying thanks for making their party so wonderful. Elvira Stieren, Unit 421, asked why something couldn't be done with the musicfrom Star Central, as she has called the police, but nothing has changed. Housing & Redevelopment Authority Minutes April 26, 2005 Page 3 of6 ITEMS FOR CONSIDERATION Adopt Resolution 2005-03. South Buildine: Ae:e Consideration Bob Alsop, Kennedy & Graven, stated the resolution tonight is for a revision in the A COP Policy to change the age requirement of residents entering the south building. The current policy only states one member has to be of 62 years of age. Therefore, this would allow children to occupy the building. The board needs to decide: 1) Do you want minor children in the building; 2) What age would you like to specify; 3) Do you want the seniors living with minor children or extended family members and 4) What do you want to do in the meantime. Right now we have an administrative hold on rentals in the south building. Williams asked Ecklund, as resident council president, what has he heard the residents in the south building would prefer. Ecklund stated they would like 62 years of age and up. Ecklund asked how many times has this situation come up. Welke stated she has a half a dozen people on the waiting list that this falls under. Ericson Diehm stated we could set the policy at 55, with the methods a little more comfortable for us, like specifying no children or grandchildren. Alsop stated if we chose 55 and over that would eliminate the children occupying the units and therefore, you would not have to specify no children or grandchildren in the policy. Kelzenberg stated he didn't feel it was a problem to rent to the 55 year olds and over. O'Donnell stated all of the Walker units are 55 and over and they would never restrict only to spouse under a certain age, they would be setting themselves up for a law suit. Williams polled the residents from the south building in attendance to raise their hand if they preferred the 62 and over- 15 ayes, 55 with spouse-O ayes, or 55 and over- 1 aye. Ruth Hillestad, Unit 310, stated a lot of people don't want to come into this building because of the north building being attached with younger residents in it. Ericson Diehm asked if we put in place 62 and over, would we have 100% compliance. Alsop stated we would. Nawrocki polled the board on having the policy at 62 and over with no exemption- Ericson Diehm-nay, Jindra-nay, Kelzenberg-nay, Williams-nay, Ecklund Jr. -yes, Nawrocki-yes. Nawrocki polled the board on having both residents being over 55 years of age-Ericson Diehm- yes, Jindra-yes, Williams-nay, Kelzenberg-yes, Ecklund Jr. yes, Nawrocki-nay. Motion by Ericson Diehm, second by Ecklund Jr., directing staff to develop a policy for 55 and over and to call for a special meeting next month to review and adopt the policy. Upon Vote: Ericson Diehm-yes, Jindra-yes, Williams-nay, Kelzenberg-yes, Ecklund Jr. yes, Housing & Redevelopment Authority Minutes April 26, 2005 Page 4 of6 Nawrocki-nay. Motion Carried. Annual Planned Maintenance A!!reement Welke stated this is because we have no generator maintenance plan in place in the building and due to problems with the generators, and need extensive repairs. Staff recommends approval of the contract with Cummins Npower. Motion by Ericson Diehm, second by Kelzenberg, to Approve the proposal from Cummins Npower an amount not to exceed $1,325.44 per year, for the Planned Maintenance Agreement at Parkview Villa; and furthermore, to authorize the Chair and Executive Director to enter into an agreement for the same. All ayes. Motion Carried. Summer Lawn Care Contract Welke stated she obtained three bids for 6 treatments to the lawn for crabgrass and fertilizing of the lawn. Staff recommends approval of the contract with TruGreen Chemlawn in the amount of $536.76. Motion by Ke1zenberg, second by Williams, to Approve the lowest proposal in the amount of $536.76 (not to exceed that amount) to TruGreen ChemLawn for six (6) fertilization applications for the spring, summer and fall. All ayes. Motion Carried. Emer!!encv Pull Cord System Welke stated we have had a problem since January with the emergency pull cords and have spent a total of $3,891.69 with the Simplex Grinnell Company not being able to find the problem. At this time, staffis askingfor direction from the board. Simplex has stated it could be due to the electrical system in the building, but it would be very labor intense cost to determine this. Greg Oppegard looked into a base line system that would provide a minimal system and asked if the board would like to have two in each unit, or just one in the bathroom, or just one in a central location in each unit. Parkview Villa currently has a wired system, the new system could be wireless. Nawrocki asked if it would be possible to disconnect and wire to individual apartments and has staff checked with other businesses that do this kind of system. Oppegard stated it would be possible to disconnect and wire individual units, but it would be very costly. Welke stated she has not checked with other businesses for consults as staff is recommending a wireless system and is asking for direction from the board. She also stated that she has organized presentations from Lifeline, Health East Health Alert and the Anoka County Sheriff's Office for different options to provide this kind of service to residents. O'Donnell stated Walker is involved with another building that they are only considering the wireless system as the wireless cell provides much faster assistance to residents. Housing & Redevelopment Authority Minutes April 26, 2005 Page 5 of6 Williams stated the Anoka County Sheriff's Office could provide the wireless phones, but wasn't sure if they could provide enough phones for all units. Welke stated she would check into this. O'Donnell stated he would recommend the board directing staff to look into the cost of a wireless system and bring back the bids to the board for approval. Nawrocki requested other businesses like Simplex Grinnell to take a look at the current system also. Motion by Ericson Diehm, second by Kelzenberg, to direct staff to look into costs of a wireless system and the option of getting free phones from the County. All ayes. Motion Carried. Release of Liability to the Parkview Villa Manal!ement Welke stated this policy was in place at the time Walker started managing Parkview and at the request of the board she has brought this item to the board for further review. Nawrocki felt it would be a common courtesy to call the resident when a package is received in the office. Williams asked why do we need a release of liability. Welke stated this came up because a resident received a package that was addressed to Lisa at Parkview Villa's address, she assumed it was for her boss, Lisa Toms and put it into her basket. It sat in her mailbox until she opened it the following week, as she did not know it was for a resident. Lisa Lindahl, Unit 705, stated this was her package, the ups man stated it had her name and address on it, she went down to Dana for the package, but was told she could not get the package until next week. Ericson Diehm asked Nawrocki if the wording was changed in paragraph two and five to read "we will call you ", would this satisfy his concerns with the policy. Nawrocki stated it would. Motion by Ericson Diehm, second by Jindra, to Approve the Release of Liability to the Parkview Villa Management office with the amendment to change the second and fifth paragraphs to read as listed above. All ayes. Motion Carried. North Buildinl! Exit Door Repair Welke stated during the REAC inspection in February preformed by HUD, they detected the North Emergency Exit Door off of the first floor was sighted as a deficiency due to the rust decaying the frame and creating holes on the inside of the building and the outside of the building. Staffreceived bids from Gardner Hardware at $2,462.45, Construct-All Corporation at $3,980 and Watson-Forsberg at $10, 342 for removal of the door, installation of the new one, re- use the panic bar and removal of all debris and caulking around the new frame. Staff recommends approval of the proposal from Gardner Hardware in an amount not to exceed $2,462.45. Motion by Ericson Diehm, second by Ecklund, Jr., to Approve the proposal from Gardner Hardware Company not to exceed the amount of $2,462.45 at Parkview Villa; and furthermore, to authorize the Chair and Executive Director to enter into an agreement for the same. Sixty-three residents attended the resident council meeting on June 13,2005 and 11 out of the 63 were interested in getting the reduced rate of cable, under the provision that there are 100% ofthe building hooks up to the cable provider. Therefore there were 52 residents not interested in it. Nine people out of 63 were interested in getting a craft day set up during the daytime on a weekly basis. There were no votes against having the craft day. We will continue to look into this for the residents. Parkview Villa has an excellent system of sprinklers throughout the building- safest place would be in your apartment unless fireman came to get you out. Elevators will be shut down and stairs would be only way out. New fire truck is equipped with ladders to reach top of building. Manaeers Report . Mary will be gone from the office lih and 13th on vacation. · Every Thursday a program titled "Laughing with Lee" at 3 p.m. · Cautioned people should not open windows in stairwells, as rain comes in and can flood stairways. · Complaint forms will be accessible outside of office. · The transition strip between old and new carpeting is being looked at for replacement, its hard for walkers and wheel chairs to pass over. Currently Schindler Elevator is continuing their services in this down time. Near the end of the contract (which was not known by staff, as there was not a contract here on site) they sent a letter increasing the amount they charge us. At that time Staff started to look at alternate companies for proposals, as we were not happy with Schindlers services. I set up a meeting with the representative of Schindler Elevator and communicated our experience with their company. The representative at that time guaranteed a change in service and sent 3 people out that same week and got our equipment up to par. I was very happy with the way they responded. Schindler has decreased the amount and is kindly taking care of our elevators in this down time of the contract. Staffhas seen a great change in their services. This proposal has been looked over by the City Attorney and is agreeing with the conditions and terms ofthe contract. RECOMMENDATION: Staff recommends the approval ofthe Schindler Elevator contract in the amount of$755.00 per month, to continue the good relations with this company who is familiar with our elevators and has serviced this building for the past 5 years. ThyssenKrupp Elevator also gave a proposal of $760.00 per month. Finally, Minnesota Elevator gave a proposal of $724.00 per month. You will be provided with a customer identification number, which must be referenced when a call is placed for your facility. Our dispatchers will have access to your building's service call records, and will promptly relay the details of your call to the assigned technician. Your cab telephone will be directly programmed to dial SCSN. You will also have access to Schindler SCORE CAROlV, through Schindler's website, which gives you instant access to the perfonnance history of your equipment covered by this Agreement. o .. G) i :c u en ADDITIONAL COVERAGES We will remotely monitor (rt applicable) those functions of the Equipment described above which are remote monitoring capable. Our remote monitoring system ("SRMj will automatically notify us if any monitored component or function is operating outside established parameters. We will. then communicate with you to schedule appropriate service calls. Monitoring will be perfonned on a 24 hour, 7 day basis and will communicate toll free with our Customer Service Network using dedicated elevator telephone service. The operation and monitoring of SRM is contingent upon availability and maintenance of dedicated elevator telephone service. You have the responsibility to install, maintain and pay for such telephone service, and to notify us at any time of any interruption of such telephone service. If requested, you will provide the proper wiring diagrams for the equipment covered. These diagrams will remain your property, and will be maintained by Schindler for use in troubleshooting and servicing the equipment. CALLBACK RESPONSE TIME We will respond to callbacks during regular working hours within an average of 4 hours of notification, and during overtime hours within an average of 12 hours of notification, unless we are prevented from doing so by causes beyond our control. HOURS OF SERVICE We will pertonn the Services during our regular working hours of regular working days. The Services include callbacks for emergency minor adjustment callbacks during regular working hours. If you authorize such callbacks outside regular working hours, we will absorb the straight time labor charges and you will compensate us for the overtime premium, plus materials not covered by contract, expenses and travel. All other work outside the Services will be billed at our standard billing rates. A request for service will be considered an "emergency minor adjustment callback- if it is to correct a malfunction or adjust the equipment and requires immediate attention and is not caused by misuse, abuse or other factors beyond our control. Neither party shall be responsible for any loss, damage, detention or delay caused by labor trouble or disputes, strikes, lockouts, fire, explosion, theft, lightning, wind storm, earthquake, floods, storms, riot, civil commotion, malicious mischief, embargoes, shortages of materials or workmen, unavailability of material from usual sources, government priorities or requests or demands of the National Defense Program, civil or military authority, war, insurrection, failure to act on the part of either party's suppliers or subcontractors, orders or instructions of any federal, state, or municipal govemment or any department or agency thereof, acts of God, or by any other cause beyond the reasonable control of either party. Dates for the performance or completion of the work shall be extended by such delay of time as may be reasonably necessary to compensate for the delay. 5. You will assign this Agreement to your successor in interest, should your interest in the premises cease prior to the initial or any renewal termination date. If this Agreement is terminated prematurely for any reason, other than our default, including failure to assign to a successor in interest as required above, you will pay as liquidated damages (but not penalty) onelhalf the remaining amount due under this Agreement. 6. The Equipment consists of mechanical and electrical devices subject to wear and tear, deterioration, obsolescence and possible malfunction as a result of causes beyond our control. The services do not guarantee against failure or malfunction, but are intended to reduce wear and prolong useful life of the Equipment. We are not required to perform tests other than those specified previously, to install new devices on the equipment which may be recommended or directed by insurance companies, federal, state, municipal or other authorities, to make changes or modifications in design, or to make any replacements with parts of a different design. We are responsible to perform such work as is required due to ordinary wear and tear. [Unless otherwise agreed], We are not responsible for any work required due to obsolescence; accident; abuse; misuse; vandalism; adverse machine room conditions (including temperature variations below 60 degrees and above 90 degrees Fahrenheit) or excessive humidity; adverse premises or environmental conditions, power fluctuations, rust, or any other cause beyond our control. We will not be responsible for correction of outstanding violations or test requirements cited by appropriate authorities prior to the effective date of this agreement. 7. Invoices (including invoices for extra work outside the fixed price) will be paid upon presentation, on or before the last day of the month prior to the billing period. Late or non-payments will result in: (a) Interest on past due amounts at 1%% per month or the highest legal rate available; (b) Termination of the Agreement on ten (10) days prior written notice; and (c) Attorneys' fees, cost of collection and all other appropriate remedies for breach of contract. 8. If either party to this Agreement claims default by the other, written notice of at least 10 days shall be provided, specifically describing the default. If cure of the default is not commenced within the ten-day notification period, this Agreement may be terminated. Any proprietary material, information, data or devices contained in the Equipment, or any component or feature thereof, remains our property. You will prevent access to the Equipment, including the SRM feature and/or dedicated telephone line if applicable, by anyone other than us. We will not be responsible for any claims, losses, demands, lawsuits, judgment, verdicts, awards or settlements (.claims") arising from the use or misuse of SRM, if it or any portion of it has been modified, tampered with, misused or abused. We will not be responsible for use, misuse, or misinterpretation of the reports, calls, signals, alarms or other such SRM output, nor for claims arising from acts or omissions of others in connection with SRM or from interruptions of telephone service to SRM regardless of cause. You agree that you will defend, indemnify and hold us harmless from and against any such claims, and from any and all claims arising out of or in connection with this Agreement, and/or the Equipment, unless caused directly and solely by our established fault. o .. Schindler Elevator Corporation is insured at all locations where it undertakes business for the type of insurance and limits of liability as follows: (a) Workers' Compensation and Employer's Liability - Equal to or in excess of limits of Workers' Compensation laws in all states and the District of Columbia. (b) Comprehensive Liability - Up to Two Million Dollars ($2,000,000.00) single limit per occurrence. 13. You hereby authorize us to produce single copies of the EPROM and/or ROM chips for each elevator subject to this Agreement for the sole purpose of archival back-up of the software embodied therein. The duplicate chip(s) for a given elevator shall be identified by serial number, or other means, and shall be stored on the building premises in a secured area in the elevator equipment room or you may retain possession. We agree that back-up chips are not for the benefit of purchase or sale, or for use in other elevator systems, and shall be used for no other purpose than the replacement of a defective or damaged chip on the particular elevator. In the event that the your continued possession of the computer program should cease to be rightful, we agree that all such archival copies shall be destroyed. 14. You acknowledge that certain replacement parts, such as printed circuit boards or control related parts, may be difficult to obtain. While we do not anticipate problems or delays obtaining such parts, it may be necessary or desirable for you to order such parts directly from the original equipment manufacturer ("OEM"). You agree, in such event, to order parts promptly from the OEM, at any time and from time to time, as specified by us. We agree to reimburse you for the reasonable cost of such parts (as covered by this Agreement) promptly upon receipt from you of copies of the invoice(s) together with appropriate payment documentation. 15. Should conditions arise requiring use of the OEM diagnostic tool, we will promptly notify you. You agree, in such event, to promptly contact the OEM for diagnostic service and repair. You will be responsible for all costs related to such service and repair. You further agree that we shall not be responsible for any delays, damage, costs or claims associated with you or OEM's failure to timely provide a diagnostic tool, and you will indemnify, defend and hold us harmless from any such delays, damage, cost or claim. We will perform governor and safety tests on traction elevators once every five (5) years and relief pressure tests on hydraulic elevators once per year. You agree to pay for any costs of the inspector or inspection fees. Service Hours & Service Requests During Normal Working Hours We will visit your elevators on a regularly scheduled basis. These visits will be performed during normal business hours, Monday through Friday, 8:00 am to 4:30 pm (except scheduled holidays). We will respond to service requests during these hours at no extra charge. Service requests are defined as minor adjustments or emergency entrapments that can be accomplished in two hours or less (excluding travel time). After Hours Service Requests On service requests outside of normal business hours for services covered under this Agreement, we will absorb the straight time costs of labor, and you will be responsible for the difference between the straight time costs and overtime costs of labor. You agree to provide ThyssenKrupp Elevator with current wiring diagrams that reflect all changes, parts catalogs, and maintenance instructions for the equipment covered by this agreement (exception: we will supply all of the above for new ThyssenKrupp elevators at no additional cost). You agree to authorize us to produce single copies of any programmable device(s) used in the equipment for the purpose of archival back-up of the software embodied therein. These items will remain your property. Safety. You agree to instruct or warn passengers in the proper use of the equipment and to keep the equipment under continued surveillance by competent personnel to detect irregularities between elevator examinations. You agree to report immediately any condition that may indicate the need for correction before the next regular examination. You agree to shut down the equipment immediately upon manifestation of any irregularities in operation or appearance of the. equipment, notify us at once, and keep the equipment shut down until the completion of any repairs. You agree to give us verbal notice immediately and written notice within ten (10) days after any occurrence or accident in or about the elevator. You agree to provide our personnel a safe place in which to work. We reserve the right to discontinue work in the building whenever, in our sole opinion, our personnel do not have a safe place in which to work. You agree to provide a suitable machine room including secured doors, waterproofing, lighting, ventilation and heat to maintain the room at a temperature of 500F minimum to gooF maximum. You also agree to maintain the elevator pit in a dry condition at all times. Should water or other liquids become present, you will contract with others for removal and the proper handling of such liquids. Other. You agree not to permit others to make alterations, additions, adjustments, or repairs or replace any component or part of the equipment during the term of this agreement. You agree to accept our judgment as to the means and methods to be employed for any corrective work under this agreement, including that you agree if ThyssenKrupp Elevator's inspection of a piece of equipment serviced under this Agreement reveals an operational problem which jeopardizes the safety of the riding public, ThyssenKrupp Elevator may shut down the equipment until such time as the operational problem is resolved. ThyssenKrupp Elevator will immediately advise you in writing of such action, the reason for such action, and whether the proposed solution is covered by the terms of this agreement. In the event of the sale, lease or other transfer of the elevator(s) or equipment described herein, or the premises in which they are located, you agree to;see 1hat such successor is made aware of this agreement and assumes and agrees to be bound by the terms hereof for the balance of the agreement, and subject to termination as herein . provided, or otherwise be liable for the full unpaid balance due for the full unexpired term of the agreement. Your duty to indemnify does not apply to claims or losses determined to be caused by or resulting from the negligence of ThyssenKrupp Elevator or our employees. You recognize that your obligation to ThyssenKrupp Elevator under this clause includes payment of all attorney's fees, court costs, judgments, settlements, interest and any other expenses of litigation arising out of such claims or lawsuits. Insurance. You expressly agree to name ThyssenKrupp Elevator as an additional insured in your liability and any excess (umbrella) liability insurance policy(ies). Such insurance must insure us for those claims or losses referenced in the above paragraph, and for claims or losses arising from the sole negligence of ThyssenKrupp Elevator or our employees. You hereby waive the right of subrogation. Items not covered. We do not cover cosmetic, construction, or ancillary components of the elevator system, including the finishing, repairing, or replacement of the cab enclosure, ceiling frames, panels, and/or fixtures, hoistway door panels, door frames, sills, car flooring, floor covering, lighting fixtures, ceiling light bulbs and tubes, main line power switches, breaker(s), feeders to controller, hydraulic elevator jack outer casing, buried piping, alignment of elevator guide rails, smoke and fire sensors, fire service reports, communication devices, security systems not installed by us, batteries for emergency lighting and lowering, air conditioners, heaters, ventilation fans and all other items as set forth and excluded in this agreement. In the event any component of the elevator becomes obsolete or outmoded, or is no longer manufactured by the original manufacturer, it shall be your obligation to replace the obsolete or outmoded component at your expense. We will not be obligated to install new attachments or parts upon the equipment as recommended or directed by insurance companies, any governmental agency or authority, or any third party. Should your system require any of the safety tests on the commencement date of this agreement, ThyssenKrupp Elevator assumes no responsibility for the operation of the governor or safeties on traction elevators, or the hydraulic system on hydraulic elevators under the terms of this agreement until the test has been made. We shall not be liable for damage to the building structure resulting from the performance of safety tests. Should the respective system fail any of the required tests, it shall be your sole responsibility to make necessary repairs and to place the equipment in a condition that will be acceptable for coverage under the terms of this agreement. ThyssenKrupp Elevator shall not be liable for any loss, damage or delay caused by acts of government, labor, troubles, strikes, lockouts, fire, explosions, theft, riot, civil commotion, war, malicious mischief, acts of God, or any cause beyond its control, and in no event shall ThyssenKrupp Elevator be liable for any damages, nor any consequential, special, or indirect damages. ThyssenKrupp Elevator shall automatically receive an extension of time commensurate with any delay regarding the aforementioned. In the event a third party is retained to enforce, construe or defend any of the terms and conditions of this agreement or to collect any monies due hereunder, either with or without litigation, the prevailing party shall be entitled to recover all costs and reasonable attorney's fees. ThyssenKrupp Elevator Maintenance Agreement Page 3 of 5 ThyssenKrupp Elevator Platinum Maintenance Agreement In the event any portion of this agreement is deemed invalid or unenforceable by a court of law, public policy or statute, such finding shall not affect the validity or enforceability of any other portion of this agreement. Our rights under this agreement shall be cumulative and our failure to exercise any rights given hereunder shall not operate to forfeit or waive any of said rights and any extension, indulgence or change by us in the method, mode or manner of payment or any of its other rights shall not be construed as a waiver of any of its rights under this agreement. Price. The price for the services as stated in this agreement shall be Seven Hundred and Sixty dollars ($760.00) per month, payable quarterly in advance. Term. This agreement is effective for Three (3) years starting May 1, 2005 and is non-cancelable, except with thirty (30) days written notice for reasons of non-performance. "Non-performance" is defined as our inability to remedy any deficiencies within thirty (30) days after receiving written notification from you. To ensure continuous service, this agreement will be automatically renewed for successive One (1) year periods, unless either party timely serves written notice upon the other party of its intention to cancel at least ninety (90) days before the end of the initial five (5) year period, or ninety (90) days before the end of any subsequent One (1) year renewal period. Notice shall be sent by certified mail, return receipt requested. Time is of the essence. Early Payment Discount. If you pay in advance for twelve (12) months of service on the units covered in this agreement, you may take a 3% discount from the annual price. Annual Price Adjustments. As the costs we incur for providing elevator service may increase, we will adjU6t the price of your service accordingly, annually, effective on the date a field labor increase is implemented. We will adjust your monthly price based on the percentage change in the average rate paid to elevator examiners. This rate consists of the hourly rate paid to examiners plus fringe benefits and union welfare granted in place of or in addition to the hourly rate. Fringe benefits include pensions, vacations, paid holidays, group insurance, sickness and accident insurance, and hospital insurance. Pricing may also increase or decrease in the event the equipment is modified from its present state. Overdue Invoices. A service charge of 1112% per month, or the highest legal rate, whichever is less, shall apply to overdue accounts. If you do not pay any sum within sixty (60) days from the billing date, we may also choose to do one of the following: 1) suspend all service until all amounts due have been paid in full, or 2) declare all sums for the unexpired term of this agreement due immediately and terminate this agreement. If ThyssenKrupp Elevator elects to suspend service, we shall not be responsible for damages or injuries to persons or property from the lack of service. Upon resumption of service, you will be responsible for payment to ThyssenKrupp Elevator of any costs we incur as a result of the suspension of service. Time is of the essence. Acceptance. Your acceptance of this agreement and its approval by an authorized manager of ThyssenKrupp Elevator will constitute exclusively and entirely the agreement for the services herein described. Midwest Environmental Consulting, L.L.C. (MEC) is pleased to furnish a proposal to provide HUD lead-based paint testing services for the Parkview Villa Apartment Complex located at 965 - 40th Avenue Northeast, Columbia Heights, Minnesota. MEC understands that the complex consists of one (1) apartment building with 101 individual residential units, nine (9) floors, one (1) Community Room and Kitchen, one (1) stairwell, four (4) public bathrooms, one (1) Library, a maintenance shop and two (2) elevators, one (1) laundry room and one (1) storage closet per floor, plus the exterior. MEC understands the required service and lead-based paint testing protocols using X- Ray Fluorescence (XRF) spectrum analyzers and the evaluation of lead hazards. We have experience with numerous lead-based paint inspection and risk assessment projects of similar size and scope. We look forward to working with you and your organization. SCOPE OF WORK MEC proposes to provide lead-based paint inspection services using the protocols as outlined in the 1995 Housing and Urban Development (HUD) "Guidelines for the Evaluation and Control of Lead-Based Paint Hazards in Housing" standard for multi- family developments and the 1997 revised Chapter 7 and elements of Appendix 12. The lead-based paint inspection protocols call for the random selection of residential units and testing of substrate combinations. The focus of the particular sampling protocol is to use approved testing methods to determine lead concentrations in representative painted surfaces in both units and common areas in pre-1978 housing. For the purposes of this evaluation, the following protocol will be used: The Parkview Villa Apartments: MEC will inspect 25 individual units, plus common areas in this complex. MEC will not test the following items during the inspection: the 8th and 9th floor kitchen cabinets, closet doors and bathroom vanities, which have been replaced within the last three years. 145 - 2nd Avenue SE '* Cambridge. On-site testing will be performed using a Niton@ XL 309 X-Ray Fluorescence (XRF) spectrum analyzer, serial number 528 or U2164, resourced in November 2004 or August 2004, respectively. Use of the spectrum analyzer and current program elements eliminates the potential for confirmatory samples and does not require substrate correction, according to the latest Performance Characteristic Sheet issued by EPA and HUD for this instrument. These factors will contribute to lower costs and reduced damage to tested surfaces. The XRF spectrum analyzer used for this project is licensed with the Minnesota Department of Health, Section of Radiation Control, Division of Environmental Safety. The radiation source in the XRF unit used for this project will be withi.n the appropriate age limits at the time of the field work. Upon completion of the inspection, MEC will provide a report for all dwelling units tested. This report will include the age and description of the structure, name and address and licensing of individuals performing the inspection, date of the inspection, all XRF readings from the spectrum analyzer, and a summary of test combinations found to exceed the Environmental Protection Agency (EPA), Minnesota Department of Health (MDH), and HUD action level of 1.0 milligrams of lead per square centimeter (mg/cm2). MEC is confident this project can be completed and a final report released within 15 days of completion of the field work. MEC will be available to being inspection services in Mid July, 2005, if the proposal is accepted. MEC understands the scope of work for the Parkview Villa Apartment Complex, which consists of 101 units, and constructed after 1960, but before 1978. Twenty-five (25) individual units will be inspected, plus common areas. The cost estimate provided is based on continuous accessibility to all housing units and common areas chosen for testing and sampling, and that all XRF inspections can be performed without delay. Also, drawings of the complex and of the units should be made available at the time of the inspection. Based on these parameters, MEC estimates the work to be approximately 5-6 days of on-site time to inspect each complex, plus travel, to complete the survey of selected units and common areas. A caretaker or manager should be available at the property on the days of the inspection to ensure access can be made available to areas as necessary. A unit will take approximately 45 minutes to an hour to complete for a one-bedroom unit, and up to 90 minutes to complete for a two-bedroom unit, providing that drawings are available. If drawings are not available, and additional 15 to 25 minutes may be needed. If fifteen percent (15%) or more, of like building components are found to contain lead at or above the MDH action level of 1.0 mg/cm2, the remaining like building components will not have to be tested and assumed to contain lead, unless required by the owner. Based on our telephone conversation, MEC understands that partial renovations have been done with the complex. Therefore the resident council president and Staff worked together to come up with a policy that would hopefully cover all topics or angles that may come up in a common area. There also has been a new coffee club formed everyday Monday through Friday and with the new carpet being installed we wanted to make a rule for open containers to try and prevent stains or stills. This policy also covers some other issues we are having with the trash chute areas. RECOMMENDATION: To read and review the attached Common Area Policy and gather more suggestions. \RECOMMENDED MOTION: Move to approve the Common Area Policy for Parkview Villa. ~RA ACTION: COMMON AREA POLICIES PLANTS: In the hallways outside of the elevators on the North building we will allow (2) two plants near the window and/or bench. * Ask Management for any exceptions to the rule for approval. In the South building there can be one plant at the end of each hallway 'l1e:rr the window and one plant on each wall of the 3rd floor sunroom. (not including the artificial plants) All plant must have the name of the owner somewhere on the pot .and that owner will be held responsible for the watering and care of the plant. The plant also must have the proper pot and pot saucer to prevent any damage to either a table or the carpet. Since December 2004 we have spent a total of $3891.69 in trying to repair the existing problem and the contracted company has not been able to determine exactly what the problem is and get it repaired. I brought this to Lucy Beckwell's (who is our HUD representative) attention and she felt it would be in the residents best interest to disable the entire system until the HRA Board could vote on what they would like to do as the cost to continue to repair could have an endless dollar amount and a new system is quite costly (see attached examples). HUD does not require this type of system in an independent housing facility, it either needs to be in place working or removed completely. Meanwhile for the safety of the residents Management has called in companies that offer a mobile body emergency button. Lifeline came out on Monday, April 11 to give a presentation there were a total of 12 residents that attended. On Tuesday, April 12 Health East Health Alerts came and gave a presentation for the residents, were a total of 3 residents that attended. Anoka County Sheriffs Office was here in May to provide any and all residents that come to the presentation a free cell phone. The cell phone only requires a recharging cord; there is no monthly fee for service, as it is not required to have service in order to call 911 from a cell phone. We would like to open the table for discussion as each of the above has advantages and disadvantages and vote on the best option for the residents. Looking at all of the medical calls from the beginning of the year, since the pull cord system has been down the calls show: in January there were 4 calls, February there were 3, March there was 1, April there was 1, May there was 1 and June there were 4. RECOMMENDATION: Staff recommends reviewing the three proposals obtained and determine if replacing the system with a wireless system is what the Board and community of Park view Villa would like to do. Performance Cabling's proposal came in at $55,419.41 +. Simplex Grinnell's proposal came in at $79,9600 and KnR Communication's proposal came in at $83,850.00. Tony Grabowski, Sales Engin~ {J MEMORANDUM To: HRA Board of Commissioners Bob Streetar, Director of Community Development From: Bob Alsop Kennedy & Graven Re: Update with respect to revisions of Admission and Continued Occupancy Policies (ACOP) and Leases for Parkview Villa North and South Dated: July 19, 2005 INTRODUCTION Over the last few months, I have reviewed the HRA's Leases and ACOP's for both Parkview Villa North and South. The purpose of my review was to: (1) to insure compliance with applicable Federal and State laws; (2) eliminate ambiguities and/or inconsistencies among the documents; (3) implement the Board's decision to change the tenant eligibility criteria for Parkview Villa South; and (4) incorporate provisions to assist in the operation of the buildings and enforcement of the lease provisions. This memorandum briefly summarize some of the changes contemplated for the Leases and ACOP's for both Parkview Villa North and Parkview Villa South. I. P ARKVIEW VILLA SOUTH - SENIOR HOUSING The following changes were made to the Lease and ACOP for Parkview Villa South: A. Eliminate Unnecessary Public Housing Provisions Both the Lease and the ACOP for Parkview Villa South are inundated with provisions that would typically be required under a Federal subsidized public housing program. Most of the provisions relate to the tenant's continued eligibility in the public housing program and require reporting of income and family composition information in order to determine continued eligibility or implement appropriate rent adjustments. Since Parkview Villa South is not a public housing facility, such provisions are not necessary in the Lease or the ACOP for Parkview Villa South and were removed in order to avoid confusion and potential liability for the HRA. There is no reason to collect and/or maintain income information on residents of the senior building if the information is not relevant to their continued eligibility as a tenant of Parkview Villa South. 1 B. Revise Tenant Eligibility Criteria The Lease and ACOP for Parkview Villa South were also revised to implement the Board's recent decision to change the tenant eligibility criteria for the senior building. At a quarterly meeting on April 26, 2005, the Board agreed to limit eligibility for the senior building exclusively to persons who are 55 years of age and older. The purpose of the 55 year old age limit is to qualify as a housing facility for "elderly persons" under both State and Federal law and be exempt from claims of discrimination based on age or familial status. Both the Lease and the ACOP are being revised to meet this requirement and comply with the applicable laws. C. Revisions to Assist Lease Administration A number of revisions were made to the Parkview Villa South Lease in order to assist in the operation of the facility and enforcement of the Lease. Some of these revisions include the following: . Add provision to avoid waiving lease violation by acceptance of rent by the HRA. . Add severability clause in order to avoid illegal contract upon the discovery of an unenforceable lease provision. . Add lease provision requiring tenant cooperation with implementation of Lease requirements. . Revise various lease provisions to be consistent with applicable law. . Add lease provision allowing HRA to collect attorneys' fees and costs associated with successful eviction and/or collection proceedings against a tenant. D. Re-formatting Lease The Lease for Parkview Villa South was dramatically re-formatted in order to improve the clarity of the document and the tenant's obligations there under. Typographical errors were corrected. Tenant obligations were expanded and clarified. Many provisions of the Lease were re-grouped with new headings in order to simplify the document. I also attempted to include similar provisions in both the North and the South buildings, to the extent possible, in order to assist management in the efficient operation of the two facilities. II. P ARKVIEW VILLA NORTH - PUBLIC HOUSING As a public housing facility, the Lease and ACOP for Parkview Villa South are governed by very strict Federal regulations with respect to their content. For example, certain lease provisions are mandated by the regulations and certain lease provisions are strictly prohibited by them. My primary goal in reviewing the Lease and ACOP for Parkview Villa North was to insure compliance with these regulations. Some of the changes resulting from this review of the Lease include the following: 2 Revise lease to include mandatory one year renewal period for lease term. Add provision allowing legal profit making activities in the unit with the consent of the HRA. Clarify and revise notification requirements for additional occupants and/or guests to stay in the unit. Add lease provision outlining HRA's obligation to advise tenant of any adverse action along with any grievance rights related thereto. Revise lease provisions related to criminal activity in order to coincide with obligations under the Federal regulations and avoid confusion with regard to the tenant's responsibilities. Review all tenant obligations under the Federal regulation and confirm inclusion of such obligations in the Lease. Add lease provision outlining tenant's rights if unit is rendered uninhabitable. Add lease provision advising tenant of his/her right to review tenant file In connection with a lease termination. In addition to the foregoing review and revisions, I also incorporated many of the changes made to the Lease for Parkview Villa South into the Lease for Parkview Villa North. As previously noted, these revisions were made to assist in the administration of the facility and also to improve the clarity and consistency for lease enforcement to the extent possible between the two buildings. CONCLUSION I will be attending the HRA Board meeting on July 26,2005, to answer any questions concerning the proposed changes to the Leases and ACOP's as spelled out herein. I also intend to update the HRA Board as to the status of the project and seek input from the Board with respect to a few proposed changes to both the leases and policies.
