MOTION: Move to Adopt Resolution 2005-03, a Resolution Approving a revision of the
Occupancy Policy for Parkview Villa South.
B. Annual Planned Maintenance Agreement
MOTION: Move to Approve the proposal from Cummins Npower in the amount not to
exceed $1,325.44 per year, for the Planned Maintenance Agreement at Parkview Villa;
and furthermore, to authorize the Chair and Executive Director to enter into an agreement
for the same.
C. Summer Lawn Care Contract
MOTION: Move to Approve the lowest proposal amount of$536.76 (not to exceed that
amount) to TruGreen ChemLawn for six (6) fertilization applications for the spring,
summer and fall.

CALL TO ORDER - The Regular Meeting of the Columbia Heights Housing & Redevelopment
Authority (HRA) was called to order by Chair, Tammera Ericson at 7:05 pm, January 25,2005, in
the Parkview Villa Community Room B, 965 40th Avenue NE, Columbia Heights, Minnesota.
ROLL CALL
Commission Members Present:

PLEDGE OF ALLEGIANCE
Oath of Office- Walt Fehst conducted the Oath of Office to the reappointed Commissioners Bruce
Nawrocki and Bobby Williams.
ELECTION OF OFFICERS
Chair- Williams nominated Nawrocki, second by Ecklund. Kelzenberg nominated Ericson, no
second. Ericson nominated Kelzenberg, second by Jindra.
Upon Vote by Poll: Votes for Nawrocki: Ecklund, Jr., Williams, Nawrocki, Jindra,
Kelzenberg
Votes for Kelzenberg: Ericson
Nawrocki was elected Chair with a five to one vote.
Nawrocki then took over the duties of Chair.
Vice Chair- Ericson nominated Kelzenberg, second by Williams.
Motion by Ericson, second by Williams, to appoint Kelzenberg for Vice Chair. All ayes. Motion
Carried.
Secretary/Treasurer-Ericson nominated Jindra, second by Williams.
Motion by Ericson, second by Williams to appoint Jindra for Secretary/Treasurer. All ayes.

CONSENT AGENDA
Approval of Minutes
Motion by Ericson, second by Williams, to approve the minutes of October 19 and December 16,
2004, amending the December 16th minutes, Termination of Lease, paragraph two to read as
follows:
Nawrocki stated he heard from the family of a resident that went into the hospital the
end of October and died in early November, the family was told they had to pay the
rent for December, as the personal belongings were not removed from the apartment.
All ayes. Motion Carried.
REPORT OF MANAGEMENT COMPANY
Welke went over the October, November and December monthly reports she provided to the board
and stated the waiting lists for both the north and south buildings continue to grow. Staff is
waiting on the last proposal for the 9th floor water pipe leaks, and that the physical, REAC
inspection is scheduled for February 15, 2005.

Nawrocki stated he understood there was a 20-year old, women placed in the south building, and
asked if the south building wasn't just for seniors. Welke stated she had a vacancy in the south
building and did receive prior approval from Mr. Streetar. Streetar stated he did give her
approval as there was a vacancy in the south building, the young lady has a disability and there
would be a unit available for her soon in the north building.
Nawrocki stated he wrote a letter and had discussed with Mr. 0 'Donnell at walker his
dissatisfaction with the kind of service provided to the residents, and did not want to see any
problems come out of this for staff or for residents at Parkview villa. Welke stated Terry Busch
and her are currently signed up for a Tenant and Resident Training Course they will be taking
soon. Ericson stated she had asked Welke to address a situation she was made aware of and both
the resident and her were very satisfied with the way she handled the situation.
RESIDENT COUNCIL MINUTES
Jindra stated she provided minutes for the months of November, December and January, asked if
there were any questions. There were none.
CITIZENS FORUM
Lynn Miner, Unit 202, asked why the building has so few amenities for residents, no gyms, etc.
Nawrocki stated this building wasn't built to accommodate these kinds of amenities and wasn't
sure that HUD would pay for them either.
Mrs. Brody, 3805 Reservoir Blvd., daughter of Adeline Schafer stated her mother died, they gave
notice on November 8th, Parkview Villa management wants the family to pay the December rent.
They wrote down and submitted a complaint stating they would not be paying the rent. When her
aunt received a termination of lease notice, which was different than the one that she was given,
they felt they shouldn't be responsible for the rent. A walk through was done on December 30th,
Welke stated the unit was going to be occupied the first of January, but they haven't received their
damage deposit back yet. Nawrocki stated the board has researched this policy for Parkview Villa
and determined it wasn't a good policy. Streetar stated Welke, will be bringing a new lease
agreement before the board where this issue is addressed. Welke stated she didn't rewrite the
lease for the south building yet. Nawrocki suggested the board take action to cancel the December
months rent.
Motion by Williams, second by Kelzenberg, to cancel the December rent payment from Adeline
Schafer. All ayes. Motion Carried.
Marilyn Beers, unit 124, stated she has a handicapped sticker, but is parked the farthest from the
building, and wondered if there is someone canceling their handicap spot, if she could get it.
Welke stated she does have a waiting list of residents that want to use the handicap spots and has
given Marilyn Beers the form to fill out.

ITEMS FOR CONSIDERATION
Resolution 2005-01. Amend and Restate the Bvlaws
Nawrocki stated this Resolution is to change the meeting dates from the third Tuesday of the month
to the Fourth Tuesday of the month.
MOTION by Ericson, second by Williams, to Adopt Resolution 2005-01, a Resolution to Amend
and Restate the Bylaws of the Columbia Heights Housing & Redevelopment Authority. All ayes.
Motion Carried.
Policv for Unden!round Parkin2 Access
Welke stated this policy is being presented to the board for approval to better service the residents
of Parkview villa that are handicap, to be able to access the building from the garage.
Nawrocki asked if the Parkview Villa south residents get first choice for renting the garage space.
Welke stated she has been questioned about this, but there wasn't any policy in place that she
could find. Nawrocki stated the south building residents should have first choice parking spots, as
the garage was built for that building. Welke will write up a policy for board approval.
Ecklund stated residents pay $35 deposit and $15 per year, what is the $35 fee for. Welke stated
the $35 is a deposit for the door opener and is returned when they give up their parking spot.
Ecklund asked why they couldn't pay the $15 per year as residents in the south building are also
on a limited budget. Nawrocki stated the one time deposit fee, is an incentive to return the opener
and keys after they aren't using the spot. Williams suggested a $1.00 yearly feefor use of the
garage space.
MOTION by Williams, second by Kelzenberg, to Approve the Underground Parking Garage
Access Policy with the amendment of$1.00 per year instead of$15.00. All ayes. Motion
Carried.
Community Room Policv and A2reement
Welke stated this was brought to her attention as there are many residents that are using the
community room and not leaving the room clean, this policy would require a fee for rental that
would be returned to them if the room was left clean.
Nawrocki asked about the groups such as the prayer groups that meet every Saturday night in this
room, would they need to obtain a permit also. Welke stated that would be up to the board
to clarify this. Jindra stated it should be used if a resident wants to use the room for a birthday
party and would get their deposit back if it is left clean, the prayer group is for all residents and
so they shouldn't have a special permit. Bob Lindig, Walker stated maybe the policy could state
the deposit will be required only if the function is not a management function. Ecklund stated we
should go by anything on the calendar for the month. Welke stated there was only one time in the
past year were a church used the room and left it in a mess, otherwise, it is used for residents and

management junctions. Nawrocki suggested the resident council approve what functions would
require a deposit.
MOTION by Ericson, second by Jindra, to Approve the Community Room Policy and Agreement
with the amendment of the Resident Council determining the functions on the Parkview Villa
calendar to be excluded from the deposit. All ayes. Motion Carried.
Policv for Internal Transfers
Welke stated she rewrote this policy per the HRA board direction at the last meeting.
Ecklund asked if she rented all of the two bedroom units and someone comes into the building that
is married, is there some clause where the two bedroom units need to be occupied by two people.
Welke stated it goes by the waiting list, which doesn't specify any difference in occupancy, it is just
if they have the money. Streetar asked if any of the two bedroom units specify they have to be
occupied by a handicap person. Welke stated it does not.
Carol Hinrich, Unit 710, asked if there is a waiting list for the south building. Welke stated there
is a waiting list, which is out about 6 months to a year. Nawrocki asked if Carol was on the
waiting list. Welke stated she was given an application, and currently there are 13 people on the
waiting list.
MOTION by Williams, second by Kelzenberg, to Approve the Policy on the Internal Transfers at
Parkview Villa North and South Buildings. All ayes. Motion Carried.
Tenant Handbook & House Rules
Welke ask the board if they had any questions on the Tenant Handbook & House Rules.
Nawrocki stated the cover page states Parkview Villa is managed by walker but should also say
owned by the Columbia Heights HRA, and it states residents are charged for an extra proxy key,
what about the door keys. Welke stated she has in the past issued extra keys.
Lynn Meier, Unit 202 there is a problem with so many of us using our computers, then when
someone calls us to get in the building, we can't hear the ring. Terry stated there is a way to set
your computer up so when someone calls you, the computer will automatically shut you down from
the internet and your phone will ring and that he could give her some instructions on how to do it.
Jindra stated there isn't pet policy in the document and should be added. Ericson stated there are
some areas that need to be edited and maybe staff could bring the document back to the board
after it has been revised. Streetar suggested he work with Welke on making the corrections, and
suggested if board members have any comments or corrections they should contact him.

Parkview Villa North Lease Revision
Welke stated she was notified, by our HUD representative that the Lease needs to be updated to
state standards. Such corrections as we cannot deny anyone that qualified to rent per HUD
requirements ,the current lease reads month to month, it should be one year and then after that
month to month, added late fee charges or NSF fees charged at $25, security deposit went from
$100 to $200, and on page 4, letter !, was added stating residents are responsible for actions of
their visitors.
Fehst stated we would hope walker keeps the waiting lists up so that people who are not seniors
are not able to get into the building. Welke stated they tell people that are not seniors the waiting
list for that isn't a senior is approximately 7 years.
Nawrocki stated in the case of a death, we would expect payment of rent for that month, what if
they died on the 28th of the month. Ericson stated what about leaving the policy as it is in place
and leaving this board to make that decision. Nawrocki asked how the family would know about
this. Welke stated she makes it very clear to new residents what the requirements are according to
the lease. Fehst stated the important thing would be that the unit be ready for the next tenant to
rent as soon as possible. Ericson stated ifwe don't leave that specification in the policy. you could
say someone dies on November 8th and staff calls the next person on the waiting list to see if he
can move in on December 1st, but he can't so we move down the list and if we don't have this in
place we would move down the list fast, which would allow non-seniors to occupy the unit. Welke
stated in most cases the family is happy about having the extra time to clean up the unit. Williams
suggested we leave the policy as is and let this body handle the appeals. Kelzenberg would like to
see that part highlighted stating they wouldn't need to pay for the extra months rent unless they
need time to clean out the unit.
MOTION by Ericson, second by Kelzenberg, to Approve the Parkview Villa North Lease
Revision. All ayes. Motion Carried.
Nawrocki asked if the board would be reviewing the south lease soon. Welke stated it would come
before the board at a later date.
ACOP (Admission and Continued Occupancv Policv)
Welke stated her HUD representative updated this document as there were so many changes.
Welke added a couple of things like the square footage, page 16 the drug related information has
been updated, and a security deposit was added. Typically it is held for damage but she added if
the resident pulls out of the apartment without notice. we would keep the deposit.
Ericson asked whether or not staff has gotten a legal opinion, and gave an example: the near
elderly section of the policy was omitted in the new policy, with a legal opinion they could tell us if
there is some areas that we can specify our preferences that would be different from the HUD
guidelines. This would possibly help us specify seniors only. Streetar asked Ericson if she is asking
for attorney review to see ifwe can specify senior preference. Ericson stated she is.

MOTION by Williams, second by Ericson, to Approve the ACOP (Admission and Continued
Occupancy Policy), subject to legal review by Kennedy and Graven Chartered. All ayes. Motion
Carried.
Community Service and Self Sufficiencv Policy
Welke stated this policy was not initiated in 2003 as required by HUD and states persons 62 or
older are exempt from this policy, residents under age 62 would have to have it verified by a
doctor that they cannot do 8 hours of community service per month, are working 30 or more hours
at ajob or they would be required to turn in a signed Community Service sheet at their annual
recertification time, and if they don't complete the 8 hours per month their lease could be
terminated.
Nawrocki stated this should be addressed at the Resident Council meeting. Welke stated she has
met with Ecklund, posted a notice in the Library for 30 days, brought it before the Resident
Council and that her HUD representative told her she could sign off on community service hours,
as walker is a non-profit organization.
MOTION by Kelzenberg, second by Jindra, to Approve the Community Service and Self
Sufficiency Policy, which would be in effect on April 1, 2005 when approved. All ayes.
Motion Carried.
ADMINISTRATIVE REPORTS
Streetar suggested Mr. Lindig from walker go over his financial report that is in the EDA packet
so he doesn't have to stay for the EDA meeting
Financial Report for Parkview Villa
Bob Lindig went over some of the areas of interest in the financial report for the board.
Motion by Ericson, second by Williams to approve the Parkview Villa portion of the EDA
financial report. All ayes. Motion Carried.
ADJOURNMENT

CALL TO ORDER - The Special Meeting of the Columbia Heights Housing & Redevelopment
Authority (HRA) was called to order by Chair, Bruce Nawrocki at 7:07 p.rn., Monday, March 7, 2005, in
Conference Room 1, City Hall, 590 40th Avenue N.E., Columbia Heights, MN

Kelzenberg, and (Tammera Ericson arrived 7: 13pm)

PLEDGE OF ALLEGIANCE
Nmvrocki stated when he received the call regarding this special meeting, he went to Parkview Villa's
office at approximately 9:45 am to discuss it with Dana only to find the door was locked and the sign said
they would be open at 9am, he returned to the office after stupping by City Hall to talk to staff about the
meeting. He expressed his concern that the office wasn't open at 9am and that Dana sat on the bids for 3
'weeks. Fehst stated he did follow-up with the engineer to make sure he got the bid specs and would have
the report to stafffor this meeting, which he stated he did get that week.
ITEMS FOR CONSIDERATION
8th Floor Apartment Modernization Bids
Lisa Toms stated Dana Welke was out sick today, so she would be presenting the information to the board.
The remodeling will include the same items as the 91h floor (doors, cabinets, appliances, lighting, shelving,
countertops, etc) and carpetingfor the 81h and 9lhfloors. Funding will come from the FY2003 and
FY2004 HUD Capital Fund Program, 'which must be obligated prior to September 30, 2005 deadline.
Staffrecommends approval of the bidfrom UniCorp, Inc. in the amount of$79,200.00, which is the same
company used for the 91hfloor modernization.
Nawrocki asked if there would be painting done and was it necessary to replace the carpet. Toms stated
they are contracting some of the paint out and staffwill he doing the rest and the carpets need to be
replaced due to normal wear and tear and water leaks from the 91h floor.
Motion by Williams, second by Kelzenberg, to Approve the bids and award the contract for Phase 2 of
Parkview Villa North Apartment Modernization Project to UniCorp for an amount not to exceed
$79,200.00. All ayes. Motion Carried.
Ecklund, Jr. asked if the medicine cabinets would be replaced and the water leaks on the 9th floor fixed
prior to doing any work on the 8th floor. Toms stated she did not know if the medicine cabinets would be
replaced, but would check into it and that the water leaks should be fixed first.
8th Floor Appliance Purchase
Toms stated Greg Oppegard with Walker Services obtained the bids for the appliances, using Walkers
buying power and recommends approval of the bidfrom All, Inc. in the amount of $9,007.00 for
refrigerators, ranges, range cords, ducted range hoods, backsplashes, brackets, removal of old
appliances, delivery and labor.
Ericson stated we could save $240 by using the free appliance pick up service through the City garbage
service. Toms stated she wasn't aware of that option and could certainly check into it.
Motion by Williams, second by Kelzenberg, to Approve the bid from All, Inc. for the sth floor appliances
in an amount not to exceed $9,007.00, minus $240 for removal of old appliances, ifthe City garbage
service can remove them for free. All ayes. Motion Carried.

Carpet Bids
Toms stated this motion is to approve bids for carpet replacement in the 1st floor common areas at
Par~"view Villa and the office area due to roof leaks last spring, using fimds left over from the 2003
Capital Improvement fimds.
Motion by Williams, second by Kelzenberg, to Approve the bid from Jerry's Floor Store to complete the
I st floor carpet replacement. All ayes. Motion Carried.
Resolution 2005-02. Mana2ement Assessment for Public Housin2 A2encies
Streetar stated this is an annual HUD document the board has to approve by resolution, and is
transmitted electronically through the REAC system. The MASS report includes the vacancy rate, unit
turn around time, modernization, rent collected, work orders, annual inspection of units, financial
management, resident sen1ices and Communi~v building and security.
Motion by Ericson, second by Williams, to Adopt Resolution 2005-02, a Resolution of the Columbia
Heights Housing & Redevelopment Authority confirming approval of the Management Assessment for
Public Housing Certification for 2005; and furthermore, to direct the Executive Director to forward same
to the U.S. Department of Housing and Urban Development. All ayes. Motion Carried.
Other Business
Nawrocki expressed his concerns about the management at Parkview. He found out last weekend that Pat
and Rueben Baker, the caretakers at Parkview resigned, felt it was due to a continued problem with
management and stated he would be in favor o/discontinuing management by Walker. He stated he was
expressing his opinion and would like the board to think about it.
Ecklund, Jr. stated he has talked to Toms about schooling to help Dana deal with these problems, which
she has attended, but he hasn't seen any improvement. Williams asked Ecklund if he has discussed this
...vith the Residents Council. Ecklund, Jr. stated he has.
Toms stated Joe Goodman is moving out ofParkview, stated he wasn't moving because of Dana, but that
his kids bought him and his yvife a townhouse next to Parkview, and that he would still like to work part
time for Walker. This was agreed upon by Walker staff alread),' to keep him and have tried the pager to
make sure it works at his new home, which it does.

leases so they are in compliance with the Federal Law and State Laws. We are
looking forward to continuing on completing more great changes in the next quarter
here at Parkview Villa.

The REAC inspection received a score of 76% which I believe is passing.
The fire department came and completed their own inspection on the building on March 2
and pasted us with flying colors. There were no deficiencies noted. GREAT JOB to the
staff here at Parkview Villa.
The City attorney is still reviewing and completing the North and South ACOP and leases
so they are in compliance with the Federal Law and State Laws. Weare looking forward
to continuing on completing more great changes in the next quarter here at Parkview
Villa. All move ins on the South are on hold until these are completed.

3. Residents stated the pull chains are not working in apartments. Jindra questioned why this
shouldn't be a #1 priority to fix. Lisa Toms said it wasn't a top priority and suggested
residents by Life Line for safety. Jindra stated the HRA Commission should be made aware of
the failure in the system.

ISSUE
Whether the HRA intended Parkview Villa South to provide housing for extended family
members of a senior tenant, including potentially minor grandchildren?
EXECUTIVE SUMMARY
Although somewhat ambiguous, the Occupancy Policy for Parkview Villa South arguably allows
extended family members, including minor children, to live with a tenant who is over 62 years of
age. If the HRA intends to exclude extended family members from the facility, the Occupancy
Policy must be amended to clearly articulate such intent in order to comply with both State and
Federal law.
ANALYSIS
Staff was recently faced with a prospective tenant at Parkview Villa South who wanted to live in
the senior housing facility with two of minor grandchildren. The eligibility requirements set forth
in the Occupancy Policy for Parkview Villa South only requires that one household member be
62 years of age or older to qualify for admission, without any other apparent limitation for any
other household member. Although the prospective tenant was denied admission because the
total number of household members exceeded the occupancy standards of the facility, staff now
questions whether the HRA intended Parkview Villa South to provide housing for the extended
family members of a senior resident, including minor grandchildren -- a situation which has
become somewhat more common with more children are being raised by their grandparents.
HRA staff has put an administrative hold on all rental decisions until the Board clarifies the
policy of the HRA with respect to this issue. The purpose of this memorandum is to outline
various options available to the HRA in light of the discovery of this ambiguity in the Occupancy
Policy along with some of the legal implications related thereto.

Status Quo
After a review of the organizational and operational documents for Parkview Villa South, it is
not clear whether the HRA intended the facility to house elderly tenants with their extended
family members including their minor grandchildren. It seems more likely that the issue was
simply not addressed in the policy and elderly persons who apply with either adult children
and/or their minor grandchildren could arguably be eligible for admission under the current
policy. Such a policy would obviously not violate any State or Federal laws but raises a number
of practical and operational issues for the HRA to consider. Parkview Villa South does not have
facilities typically associated for families with young children (i.e. playgrounds). In addition,
other residents will undoubtedly be surprised and/or frustrated by the addition of children as
permanent residents to the building. Finally, from a business perspective, the HRA must
consider the impact that young children in the facility could have on marketing and getting
elderly persons to choose Parkview Villa South as their home.
If the HRA chooses to specifically exclude minor children and/or extended family members from
the facility, it must amend its policy and practices to comply with both State and Federal law.
Both the Minnesota Human Rights Act and Federal Fair Housing Act prohibit discrimination in
housing based on familial status. Eligibility criteria that prohibit minor children as part of a
rental household violate the foregoing anti-discrimination laws unless the facility qualifies as
"housing for older persons" as defined under the law. A facility is deemed to be "housing for
older persons" if it is:
1) provided under a State or Federal program that is specifically designed
and operated to assist elderly persons;
2) intended for, and solely occupied by, persons 62 years of age or older; or
3) intended and operated for occupancy by persons 55 years of age or older
subject to certain occupancy and administrative requirements.
If the HRA does not intend for Parkview Villa South to house the extended family members or
grandchildren of a senior tenant, the Occupancy Policy must be amended to fall within one of the
foregoing exemptions. Since Parkview Villa South does not operate under an established State
or Federal program for elderly housing, the HRA must comply with one of the other two
exemptions in order to ban children from the facility - either limit admissions exclusively to
persons at least 62 years of age or limit admissions to persons at least 55 years of age subject to
certain administrative requirements. Each of these exemptions has unique limitations and
requirements which the HRA should consider in deciding whether to amend the eligibility
criteria for tenants at Parkview Villa South.
62 and Over Exemption
Housing facilities that are reserved exclusively for tenants that are 62 years of age or older are
exempt from claims of discrimination based on familial status under both State and Federal
housing discrimination laws. This exemption, however, requires 100% compliance by the
housing facility with no exceptions. For example, applicants with a spouse under age 62 could
not be admitted to the facility without losing the exemption. In addition, tenants would not be

allowed to live with their adult children if the HRA chose this exemption. Although generally
easy to administer, the exemption could significantly reduce the size of the prospective tenant
market for the facility.
55 and Older Exemption
The second exemption is less strict but may require more administration on the part of
management. In order to qualify for this exemption, at least 80% of the occupied units of facility
must be rented to at least one person who is 55 years of age or older. In addition, the housing
facility must publish and adhere to policies and procedures that demonstrate a clear intention to
fall within this exemption. Finally, the housing facility must also comply with certain
administrative requirements established by HUD for purposes of verifying compliance, either
through the completion of tenant surveys or affidavits.
The primary advantage of this exemption is the flexibility that it provides to Parkview Villa
South and its management. The exemption only requires one member of each household to be
over 55 years of age to qualify as a unit occupied by an elderly person and also allows up to 20%
of the occupied units to rented to households without any elderly person. Although a housing
facility can aspire to 100% occupancy by older tenants, the "55 and older" exemption allows for
exceptions within a facility under certain circumstances. By implementing this exemption, the
HRA would be significantly increasing the pool of prospective tenants who could qualify for
admission to Parkview Villa South within the community. Each of the foregoing exemptions
would allow the HRA to exclude extended family members and/or minor grandchildren from
Parkview Villa South without any risk of being liable for claims of discrimination based on
familial status.
RECOMMENDATION
Whether to allow extended families to reside at Parkview Villa South is a decision which
implicates issues of law, business and public policy. Regardless of the HRA's position with
respect to this issue, immediate clarification of the HRA's Occupancy Policy is necessary in
order to assist in the efficient and effective management of Park view Villa South.
If the HRA Board decides to exclude extended families (including minor grandchildren) from the
housing facility, we would recommend that the Board take the following action:
1. Approve tenant eligibility criteria that exclude extended families from the senior housing
facility and direct staff to prepare policies that would qualify Parkview Villa South for
"housing for older persons" pursuant to the "55 and over" exemption. In particular, the
revised policy would require incoming households at Parkview Villa South to consist of
at least one person over the age of 55 and the other occupant must either be a spouse or
an unrelated adult. This limitation would exclude both adult children as well as minor
grandchildren from living in the facility. The proposed policy should also include
language that provides the HRA with the discretion to allow limited exceptions to the
tenant eligibility criteria, for example the death of the senior tenant, handicapped tenants
and/or other specific situations.

2. Until the revised policies are approved by the HRA Board, new rentals at Parkview Villa
South should temporarily be limited to tenants who are 62 years of age and older in
order to qualify for the over 62 years of age exemption. Records indicate that all current
occupants of Parkview Villa South are 62 years of age or older. This interim policy
would allow the HRA to lift the current administrative hold on rentals and yet comply
with State and Federal law until the administrative requirements for the "55 and over"
exemption are approved by the Board and implemented by staff.

WHEREAS, the Housing and Redevelopment Authority of Columbia Heights, Minnesota
("the HRA") owns a housing facility at 965 40th Avenue NE in Columbia Heights, Minnesota,
known as Parkview Villa South; and
WHEREAS, Parkview Villa South was constructed by the HRA for purposes of
providing housing opportunities for elderly and handicapped residents of Columbia Heights and
surrounding areas; and
WHEREAS, Parkview Villa South IS operated and administered pursuant to an
Occupancy Policy adopted by the HRA; and
WHEREAS, State and Federal law exempt housing facilities for older persons from
claims of discrimination based on familial status;
WHEREAS, a facility qualifies as "housing for older persons" under State and Federal
law when it is:
1) operated under a State or Federal program that is specifically designed to
assist elderly persons; or
2) intended for, and solely occupied by, persons 62 years of age or older; or
3) intended and operated for occupancy by persons 55 years of age or older
subject to certain occupancy and administrative requirements.
WHEREAS, staff seeks clarification from the Commissioners of the HRA with respect to

BACKGROUND: Upon Walker Methodist coming on to the site there was no log of the
time and dates the generator was tested in the past years. As of 2/1 0/05 only 66.9 hours
were logged on generator use from Walker Methodist's maintenance engineer. All
generators should be tested on a weekly basis.
The backup generator for the North building was installed in 1994. A contractor was
called in to replace (2) batteries, top off oil level and checked the antifreeze level. They
recommended draining and replacing the antifreeze, oil and filters. Also recommends
replacing the air filter. Increase current block heater from 1500 watts to 3000 watts to
keep the engine warm in the event the generator would be required. Water temperature
light is on due to a possible bad board. The above items are in need of repair or services
due to the generator not being properly maintained and tested in the past years.
Recommends an annual maintenance agreement to be in place.
Attached you will find three proposals obtained for the back up generators for electricity
for Parkview Villa North and South. The first proposal was obtained from Cummins
NPower, LLC in the amount of $1325.44. The second proposal was obtained from
Ziegler in the amount of$2130.00. The third bid was obtained from Allied in the amount
of$3225.00.
RECOMMENDATION: Staff recommends the approval of the lowest proposal for this
the planned maintenance agreement from Cummins NPower, LLC in the amount of
$1325.44 per year, for the annual planned maintenance agreement.
RECOMMENDED MOTION: Move to approve the proposal from Cummins Npower
in the amount not to exceed $1,325.44 per year, for the planned maintenance agreement
at Parkview Villa; and furthermore, to authorize the Chair and Executive Director to enter
into an agreement for the same.

and fall lawn fertilization. Each contractor has listed six (6) treatments to the lawn to help control the
broadleafweeds and crabgrass control.
RECOMMENDATION: Staff recommends the approval of the summer lawn care contract to the
lowest proposal received by TruGreen ChemLawn in the amount of$536.76. T&D Landscaping, Inc.
had a proposal amount of$700.00. Green Stuff had a proposal amount of$906.32.
RECOMMENDED MOTION: Move to approve the lowest proposal amount of$536.76 (not to
exceed that amount) to TruGreen ChemLawn for six (6) fertilization applications for the spring,

BACKGROUND: Since December 2004 we have had a consistent problem with the emergency pull
cord system in the building. Since December 2004 we have spent a total of $3891.69 in trying to
repair the existing problem and the contracted company has not been able to determine exactly what
the problem is and get it repaired. I brought this to Lucy Beckwell's (who is our HUD representative)
attention and she felt it would be in the residents best interest to disable the entire system until the
HRA Board could vote on what they would like to do as the cost to continue to repair could have an
endless dollar amount and a new system is quite costly (see attached examples). HUD does not
require this type of system in an independent housing facility, it either needs to be in place working or
removed completely.
Meanwhile for the safety of the residents Management has called in companies that offer a mobile
body emergency button. Lifeline came out on Monday, April 11 to give a presentation there were a
total of 12 residents that attended. On Tuesday, April 12 Health East Health Alerts came and gave a
presentation for the residents, were a total of 3 residents that attended. Anoka County Sheriffs Office
will also be here in May to provide any and all residents that come to the presentation a free cell
phone. The cell phone only requires a recharging cord; there is no monthly fee for service, as it is not
required to have service in order to call 911 from a cell phone. We would like to open the table [or
discussion as each of the above has advantages and disadvantages and vote on the best option for the
residents.
RECOMMENDATION: Staff recommends reviewing and determining if replacing the entire
system is what the Board and Community of Park view Villa would like to do or move ahead in
removing the system entirely, and using alternate emergency call systems.
RECOMMENDED MOTION: Move to discuss options and give staff direction.

We are having a problem with the emergency call system that is in the
building. (pull cords in each of your units).
As of March 4,2005 at 4:00 p.m. we are going to disconnect the system
until it can be determined ifit can be repaired or ifit will need to be
replaced.
For your safety, we are advising you to not use the pull cord system.
Should you need medical or any other kind of assistance you will need to
call 911 from your telephone.
Do not use the emen?:ency pull cord system until further notice.

BACKGROUND: Due to the liability of packages in the Parkview Villa office and the
possibility of them becoming missing and/or misplaced, we would like to remove that
liability from Management. Each resident that may receive items/packages on a regular
basis should sign this form in the event they would not be available to receive the
package at the time of initial delivery. There would be a notice from the delivery
company on his or her mailbox or his or her voice mail, indicating that there is a package
for them in the Parview Villa office. They would be able to get it when it would be
convenient for them.
RECOMMENDATION: Staff recommends the approval of the Release of Liability to
the Parkview Villa Management office form. (see attached)
RECOMMENDED MOTION: Move to approve the Release of Liability to the
Parkview Villa Management office.

RELEASE OF LIABILITY
TO THE P ARKVIEW VILLA MANAGEMENT
This form serves as a release of responsibility from the Management at
Parkview Villa when packages are brought to the office for residents that are
not home to receive their package when it is initially delivered.
Should the Postal Carrier, speedy delivery, UPS or any other type of
delivery company not make contact with you and your item(s) are brought to
the office, we will hold it in the far office behind the Manager's desk. We
will not call you to come get it, as you should have already received a notice
from the delivery company that it has been left in the office. It is your
responsibility to come to the office and pick up your package/item(s). The
on-site caretaker may assist you after office hours.

BACKGROUND: On February 15, 2005 Parkview Villa building was inspected by REAC a
department ofHUD. The physical condition of the building and the unit was all inspected.
During the inspection the North emergency exit door off of the first floor was sighted as a
deficiency due to the rust had decayed the frame and created holes on the inside of the
building and the outside of the building. Therefore, this door is in need of being replaced to
stay in compliance with HUD.
Three (3) contractors were contacted and we received bids from each of them, they read as
follows:
Gardner Hardware $2,462.45.
Construct-all corporation $3,980.00
Watson-Forsberg Co. $10,342.00
This is for the removal of the old door, install new, and re-use the panic bar with the removal
of all debris and caulking around the new frame.
RECOMMENDATION: Staff recommends the approval of the lowest proposal for this
repair to be completed by Gardner Hardware Co. in the amount of $2,462.45.
RECOMMENDED MOTION: Move to approve the proposal from Gardner Hardware Co
not to exceed the amount of $2,462.45 at Parkview Villa and furthermore, to authorize the
Chair and Executive Director to enter into an agreement for the same.

1.) Remove existing detex alarm device and keyed cylinder from door. (To be re-used)
2,) Remove existing door and frame assembly and haul away.
3.) Prep existing opening.
4.) Install new hollow metal frame.
5.) Install insulated glass into new metal frame.
6.) Install new full view hollow metal door.
7.) Install new threshold, sweep and jamb weatherstrip.
8.) Caulk perimeter as required.
9.) Install existing detex alarm and keyed cylinder.
TOTAL COST.......................................................................................................$ 3,980.00
Add $375.00 to paint new door and frame.
