HomeMy WebLinkAbout2002-02 COLUMBIA HEIGHTS HOUSING AND REDEVELOPMENT AUTHORITY RESOLUTION NO. 2002-02 RESOLUTION ACCEPTING TRANSFER OF CERTAIN PROJECTS AND PROGRAMS FROM THE COLUMBIA HEIGHTS ECONOMIC DEVELOPMENT AUTHORITY; APPROVING PURCHASE OF SERVICES AGREEMENT. BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City of Columbia Heights ("Authority") as follows: Section 1. Background. 1.01. The City Council previously adopted Resolution No. 96-01 (Enabling Resolution) providing for the creation of the CHEDA pursuant to Minnesota Statutes, Sections 469.090 to 469.1081 (EDA Act). 1.02. By resolution, dated January 8, 1996, the City transferred the control, authority, and operation of all projects operated by the Housing and Redevelopment Authority in and for the City of Columbia Heights (HRA) from the HRA to the CHEDA, and approved a Purchase of Services Agreement between the City and the CHEDA. 1.03. By resolution approved January 29, 1996, the HRA approved the transfer of HRA contracts, programs, and property from the I-IRA to the CHEDA and CHEDA officials were directed to execute and deliver quit claim deeds for all real property owned by the HRA to the CHEDA. 1.04. Quit claim deeds for all real property owned by the HRA were never executed and delivered to the CHEDA, and therefore, title to those properties remains in the HRA. 1.05. By Ordinance No. 1442 (Allocation Ordinance) adopted by the City Council on October 22, 2001, the City allocated powers under Minnesota Statutes, Sections 469.001 to 469.047 (HRA Act) related to housing for low and moderate income person from the CHEDA to the HRA, as authorized by Section 469.094 of the EDA Act. 1.06. To implement the Allocation Ordinance and clarify the powers of the EDA under the Enabling Resolution, the City further adopted Resolution No, 2001-62 on October 22, 2001, which is an amended and restated Enabling Resolution. 1.07. By Resolution 2001-18 approved November 20, 2001, the EDA transferred the control, authority and operation of all housing programs and projects to the HRA, in accordance with the Allocation Ordinance and the modified Enabling Resolution. Section 2. Acceptance of Transferred Projects and Programs. 2.01. The HRA accepts responsibility for the control, authority and operation of all projects and programs transferred by the EDA to the HRA. 2.02. The HRA covenants and pledges to assume all of the duties and responsibilities of theEDA regarding programs and projects transferred to the HRA. Section 3. Purchase of Services Agreement. 3.01. The Authority approves the purchase of service agreement between the Authority and the City in substantially the form on file at City Hall, subject to modifications approved by the Mayor, the Chair of the Authority and the City Manager, whose signatures on the agreement will be conclusive evidence of their approval. Section 4. Other Proceedings. 4.01. The Executive Director and staff are authorized and directed to take whatever steps are necessary to give effect to this Resolution. The Chair and Executive Director are authorized and directed to execute, deliver and accept on behalf of the HRA any and all documents and instruments necessary to give effect to this Resolution.
