Item: Change Order No. 1 for Limited Site Investigation for Waste Oil Tank Removal
Background:
The City's underground waste oil tank was removed May 20, 1999 by Detterman Tank. A site
inspection revealed minor petroleum contamination in the soils surrounding the tank. In
accordance with State rules, the Minnesota Pollution Control Agency was contacted to discuss a
course of action. Due to the minor amount of contamination, the PCA instructed that the existing
soil be backfilled and restoration continue as originally planned. The PCA has instructed the City
to conduct a limited site investigation. The City hired the firm of Thatcher Engineering to
perform the work.
Through the Limited Site Investigation, the presence of gasoline was found in one of the borings.
The PCA was contacted, reviewed the boring data and instructed the City on a course of action.
Additional borings and testing were ordered by the PCA in the vicinity of the boring where
gasoline was found.
Through the State Petrofund Program, up to 90% of this Change Order work is reimbursable.
The remaining costs may be funded by the City Refuse Fund.
Requested Action: Authorize Change Order No. 1 to Thatcher Engineering in the amount of
$4,747.50 for conducting additional boring investigation at the MSC with 10% of the funding
appropriated from Refuse Fund 603-49950-3050.

Background:
The City of Columbia Heights has had a custodial service contract which covers City
Hall, the Municipal Services Center, and the Public Library, with Town and Country Office
Cleaning since September 1, 1989. The original contract expired September 1, 1990, and service
has continued to the present on a pay-by-the month basis. At the 5/24/99 Council meeting staff
obtained permission to obtain requests for proposals for custodial services at all three buildings.
Analysis:
Specifications were prepared by representatives of the various departments, who formed a
committee of nine people. Thirty packets were sent out to companies which had been contacted
by phone to verify interest, address, and contact person. Thirteen firms toured the facilities and
ten requests for proposals (RFP's) were received (see attached). The ten RFP's were reviewed
by the committee, and four were invited to be interviewed. Interviews were conducted by a sub-
committee and reference checks were made. The findings were presented to the full committee,
and tw0~companies were selected for final review.
Conclusion:
Fidelity Building Services and Mid-City Cleaning Contractors were compared for a final
selection. Based on the following, staffis recommending Fidelity Building Services:
· met all specifications as outlined by departments
· depth of employees (number employed as cleaners and floaters available to cover
absences)
· accountability (log books in each building, automated check-in system, on-site
inspections, written reports)
· excellent references (cleaners for Immaculate Conception School and Columbia Park
Clinic)
· rate of $4,399/month guaranteed for one year
· either party may terminate with 30-days written notice
· renewable at a defined cost adjustment if desired
Recommended Motion:
Move to accept th,e,, written proposal for cleaning services at City Hall, the Municipal
Services Center, and the Public Library as made by Fidelity Building Services, Inc. and to
authorize the Mayor and City Manager to enter into an agreement for the same.

BACKGROUND
The U. S. Department of Justice has granted the Columbia Heights Police Department an equipment block
grant in the amount of $23,945. To accept this grant, the City must agree to a match of $2,661. The
Department would like to use this money to pay for equipment we could not normally afford. This would
include miscellaneous training equipment, computer equipment, squad car equipment, officer safety
equipment, etc.
ANALYSIS/CONCLUSION
At the present time it appears there would be adequate funds available in the 1999 Police Department
budget to cover the match. The grant will be available to us early in 2000.
RECOMMENDED ACTION: Direct the Police Chief to place this item on the August 23, 1999,
consent agenda.

BEING A RESOLUTION ACCEPTING LOCAL LAW ENFORCEMENT
EQUIPMENT BLOCK GRANT AND APPROPRIATING MATCHING FUNDS
WHEREAS, the City of Columbia Heights Police Department has been granted $23,945 in an
equipment block grant from the U.S. Department of Justice for the purpose of funding equipment,
and
WHEREAS, a condition of the grant is that the City provides $2,661 in local match for this
grant, and
WHEREAS, the City of Columbia Heights Police Department has provided the U.S.
Department of Justice a proposal for implementation of funding for this grant,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Columbia Heights
that:
The City of Columbia Heights enter into a cooperative agreement with the U.S.
Department of Justice for the project entitled "Local Law Enforcement Equipment Block
Grant Program" for the period October 1, 1999, to September 30, 2000.
2. That $2,661 be appropriated from unexpended funds in the Police Department 1999

Item: Gateway Design Update
Background:
The Gateway Committee had met approximately four weeks ago to discuss the gateway concept
as proposed by the Minnesota Design Team. It was felt that 37~ Ave. and Central should be the
initial focus area since a small tract of land was deeded to the City from the AutoWorld
Development. The landscape architectural firm of Vanney Associates was instrncted to provide
site layout/landscaping options for the committee to review.
Bob Vanney of Vanney Associates Architects has prepared three alternates for a site layout and
landscaping design, attached herein for review. The Gateway Committee, Public Works staff and
the Planning staff have reviewed the site layout alternates and are recommending "Scheme A".
Bob Vanney will be present at the work session to discuss the planning and thought process for
each site layout scheme.
The group also discussed the selection process of a gateway sign or monument. It is the Gateway
Committee's recommendation to have Vaney Associates prepare 4-6 design layouts, based upon
input and general criteria from the committee and City Council, and then determine the process
for final selection, including the level of public involvement. Discussions with the Gateway
Committee are recommending the following schedule:
August 16th: Select site layout
Mid September: Public Works will provide sod, edging, perimeter plantings of
tree and shrubs and temporary material for walking.
Mid-winter 1999/2000: Gateway monument selection process.
Spring/summer 2000: Bidding process for remaining site landscaping, including
Gateway monument.
Work completed: Mid/late smmner 2000
Requested Action:
Accept the Gateway Volunteer Committee recommendation for site plan
scheme "A" and proposed schedule. Provide direction for the final
selection process of a Gateway Sign/Monument.

Issue Statement: The enclosed information represents the bids received on the sale of two City owned
duplexes, 4519/4521 Taylor Street and 4642/4644 Taylor Street Columbia Heights, MN. The bids were opened
and read aloud in the City Council Chambers on August 12, 1999 at 11:30 am. The bidding process has now
been completed and the City Council may now consider awarding the bids.
Background: The City currently owns two vacant duplexes located at the above Taylor Street addresses. The
unit at 4519/4521 Taylor was purchased in January, 1994, for $53,000. After the purchase, a total of $22,840.43
was used for rehabilitation for a total investment of $75,840.43.
The other unit, 4642/4644 Taylor Street was purchased in 1990 for $85,250 with an additional $2,000 invested
for rehabilitation issues. Last summer, the EDA Board determined that they should not be in the rental business
and would like to see the property owner-occupied. At the April 26, 1999, City Council meeting, City staffwas
authorized to take all necessary steps to advertise the properties for sale in "as is" condition. In addition, the
successful bidder on 4519/4521 Taylor Street would be required to construct a two stall garage (minimum size
20 ft. x 20 ft.) that complies to all City and State codes. The City Councils priority use for these units was
focused on: (A) conversion to single family, or (B) owner-occupied/rental duplex. Bidders proposing absentee
ownership of the duplex units would also be considered, but with less priority.
In order to get maximum public exposure on the advertisement for bids, staff posted notices at City Hall, the
Library, Murzyn Hall, on the local cable channel, sent notices to local realtors, advertised for three weeks in the
Focus News real estate showcase, and one week in the Minneapolis Star Tribune. This generated interest from
over 40 requests for bidding packets.
Analysis: Pursuant to Minnesota Statute 412.211 and 410.22, cities have the power to sell land they no longer
need. The City Council has extreme latitude on how they dispose of smplus property and is not bound to sell to
the highest bidder. Their decision on who to sell to may be based on local plans and policies which have the best
interests of the public in mind.
On August 12, 1999, the City closed bids for the two duplex units on Taylor Street. A total of twelve bids were
received. Seven bids for 4642/4644 Taylor Street and five bids for 4519/4521 Taylor Street. Two of the bidders,
Mr. Gregory Huber and Mr. Samuel A. Nyaktmdi, did not submit bid bonds or deposits because they are unable
to secure mortgage financing and are requesting rent/purchase agreements. To be fair to the participants who
met all bidding requirements, I will not include these two proposals in my review but will include them in the
packets for your information.
Option #1 - Based on best financial return to the City with owner occupant duplex status.
Ms. Phoua Lee submitted the high bid for 4642/4644 Taylor Street in the amount of $91,000. Ms. Lee
plans to have her parents live in one half of the duplex and provide day care for her children while she and
her husband would occupy the other half.
Mr. Ernest Payan submitted the next highest bid in the amount of $85,000 for 4642/4644 Taylor Street but
indicated he would be interested in the 4519/4521 Taylor Street duplex if that was available. He would

occupy one side and rent the other to his brother-in-law. By approving this proposal the City would
receive the best financial return ($176,000) and maintain owner-occupant status.
Option #2 - Based on highest quality and value improvements to the units, higher rents, and general
neighborhood upgrade with absentee owner duplex status.
To accomplish this scenario, Mr. Ivan Priem has submitted bids oh both units in an mount of $72,900
respectively ($145,800 total). Mr. Priem has a strong history of renovation ability and proposes to make
significant upgrades throughout both units. He has prior experience with a 4-plex on Madison Street
which received high grades from the City Fire and Inspection Departments.
The Swervo Development Corporation has submitted bids on both units as well. This proposal is
somewhat different in that their first priority would be to convert both units into townhomes (individual
owned) thus creating four independently owned units ( see attached memo from Joe Hollman). Their
second priority would be similar to Mr. Priems, however, I do not believe the proposed improvements
would be as extensive. Their bid on 4519/4521 Taylor Street was $66,350 and on 4642/4644 it was
$71,350 for a total bid of $137,700.
As mentioned earlier, the City Council has great flexibility in the sale of these units. I have outlined the above
two options based on the discussion the City Council had at its April 26, 1999, meeting. In addition, the City
staff is in the process of analyzing the impact of the Community Development Block Grant dollars that were
used in acquiring these units. A complete review of that issue will be forwarded to the City Council after Anoka
County completes our request for information.
Recommendation: Both options, as I have outlined above, have merit and bring benefit to the City. If the
Council feels that their highest priority is for the City to have owner-occupants in these units and receive the
greatest return on investment, then Option #1 would best meet that goal. However, if the City Council feels that
a higher quality of improvements to the units (total upgrade to interior as well as exterior) is the most desirable
issue, the Option #2 should be considered. A side issue in Option #2 is the townhouse concept - numerous
questions remain relating to the organizational documents of the owner association and the general legal
responsibilities for the operation of the condominium/townhomes.
Recommended Motions:
Move to waive the first reading of Ordinance #, there being ample copies available to the public.
Move to establish September 13, 1999, at approximately 7:00 p.m. as the second reading of Ordinance No.,
being an ordinance amending Ordinance No. 853, City Code of 1977, authorizing the conveyance of certain real
estate at 4519/4521 and 4642/4644 Taylor Street NE.

Zoning Issues Regarding 4642/4644 and 4519/4521 Taylor Street NE
The following provides a summary of zoning issues pertaining to the sale of the two Taylor Street
duplexes listed above.
4642/4644 Taylor Street NE is currently zoned R-3, Multiple Family Residential, and 4519/4521
Taylor Street NE is zoned R-2, Single and Two Family Residential.
Single family and two family dwellings are permitted in both the R-2 and R-3 Districts.
The minimum lot size for a two family dwelling is 8,400 square feet and neither of the two
subject properties meet this requirement. Both properties are currently used as two family
dwellings and can continue to be used as such. However, should the structures be damaged in an
amount that is 50% or more of its fair market value the property would not be allowed to be
reconstructed as a two family dwelling.
Conversion of the structures into single family dwellings would bring existing nonconforming
properties into compliance. Allowing the structures to remain as duplex units is permitted, but
they would remain nonconforming.
The possibility of converting the properties into single family condominium/townhouse units raises a
number of issues which are outlined below.
The units would be considered single family attached dwellings which are defined as a dwelling
which is joined to another dwelling at one or more sides by a common wall. They could also be
considered as townhouse dwellings which are defined as attached dwelling units, each with a
separate entrance to front and rear yards. Note that the Zoning Ordinance does not address
condominiums.
The R-2 District does not address townhouses and the R-3 District allows townhouses as a
permitted use provided they contain three to eight units. Single family attached dwellings and
two unit townhouses are not addressed in any of the zoning districts.
Two family dwelling is not defined in the Zoning Ordinance. Because two unit to~vnhouses and
single family attached dwellings are not specifically addressed, it is my opinion that they can be
considered two family dwellings and are permitted in both the R-2 and R-3 Districts.
The project will need to comply with the Uniform Condominium Act (Minnesota Statute 51 SA)
and/or the Minnesota Common Interest Ownership Act (Minnesota Statute 515B) if the units are
converted into townhouses/condominiums.
Note that pursuant to Minnesota Statute 462.356 the Planning and Zoning Commission moved to support
the action of the Columbia Heights City Council to sell the property at 4519/4521 Taylor Street NE and
4642/4644 Taylor Street NE, provided the final development remains consistent with the City
Comprehensive Plan. The City Comprehensive Plan designates both properties for future low density
residential development which includes single and two family residential development. The proposal
will be consistent with the Plan regardless of whether the property stays as two family or is converted to
single family.

This cover letter is to introduce myself and my
family,also hopefully explain the reasoning behind my bid.
My name is Greg Huber. I have never written a bid on a
home before so please excuse my ignorance. I have been
searching for a home in Columbia Heights for about six
months now and been in contact with your housing office.
Your office has been very helpful and professional with my
search. Personal reasons forced me into starting my own
business less than six months ago. There is good and bad
with this, the good is I have legal and full custody of my
children and the bad is it is tough getting a full home loan.
Myself and my children very much enjoy the city of
Columbia Heights, my oldest daughter is one of your
current princesses and a former princess 97/98. My other 3
children have solid roots in Heights as well, friends, school
are very important to them as it is to myself. This is the
main reason we are in search for a home, Heights is our
home and we are willing to do what ever it takes to get us
back. I would like to thank you for allowing me to submit
this bid and I will answer any questions or concerns you
may have.

2. The price I am offering is $99,000.00 but ! cannot come up with the funds at this
time for 2 reasons, First, my bad credit and the second are because of my recent
self-employment. But what I can offer the City of Columbia Heights is a family
who carts about their home and their city. Since being a part of the royalty we
have learned more about the city, such as the recycling that is done also the
SECA program and the Heights food shelf. In which we have been involved.
The school program has been a very important part especially to me. How often
will a parent have kids who tike their schools? I guess as I get older the more
c/tits minded I get.
Okay to get to the nuts and bolts Pm offering the City a 12-month lease and a lease
payment of $800.00 to $1,000.00 per month. Contractionly signing all work in prior
pages is completed and City shall over see all construction. At end of lease I (buyer)
will ~et a mortgage in the sum of $99,000.00 payable to the City of Columbia
Heights. I m personally not concerned about the construction getting completed
but more concerned about building credit to obtain a mortgage. ! will also agree to
say terms the City may have in completing the project. In addition to giving a
month Icone payment on top of bid price if for say reason I (buyer) sbo-ald sell the
home within ~ years after 12-month lease and completion of project any funds over
$129,000.00 are split fl0/~0 with homeowner and City of Columbia Heights.

from the time I was 20 to the age 26. Duties included painting,

NOTICE TO BIDDERS
The City of Columbia Heights will be accepting bids on
the sale of the following two residential duplex properties:
4519/4521 Taylor Street and 4642/4644 Taylor Street. These
properties are offered in nas is" condition.
Sealed bids will be received by the City of Columbia
Heights, Community Development Department, 590 40~h Avenue
N.E., Columbia Heights, MN, 55421 until 11:30 a.m.C.D.S.T.
on Auqust 12, 1999, at which time they will be publically
opened and read out loud in the City Council Chambers.
Each bid shall be accompanied by a bidder's bond naming the
City of Columbia Heights as obligee,or a certified check
payable to the City of Columbia Heights, or an irrevocable
letter of credit or a non interest bearing cash deposit
equal to at least five percent (5%) of the amount of the
bid. If bidder is selected by the city and fails to enter
into a contract, bidder shall forfeit said 5% deposit.
The City Council reserves the right to retain the deposit of
the three most competitive bidders for a period not to
exceed 45 days after the date and time set for the opening
of bids. Each bid must indicate either ~4642/4644 Taylor
Street" or ~4519/4521 Taylor Street" on the front of the bid
envelope. A separate bid envelope shall be submitted for
each property.
The City Council reserves the right to reject any and all
bids, or a portion thereof, to waive irregularities and
informalities therein, further negotiate terms of the
proposals, and reserves the right to award the contract in
the best interest of the City.
The successful bidder(s) must comply with the following
sales conditions:
1.A minimum 20ft x 20ft two stall garage must be
constructed at 4519 / 4521 Taylor Street complying to all
city and state codes. Construction time lines and letters
of credit shall be required.
2. If used for rental, all units must be licensed and comply
with the City Housing Maintenance Code.
Intended Scope Of Use:
1. The City has an interest in converting these duplex units
into single family homes so as to be consistent with the
neighborhood. Any bid proposals for such a modification
to single family would be given serious priority
consideration by the City.**
2. If the bidder proposes to use the unit(s) as duplex
residential, the City would give higher consideration to
an owner occupied proposal.
3. Bidders proposing absentee ownership of the duplex units
will also be considered, but with less priority.
**To facilitate comparison of proposals in converting a
duplex unit into a single family, the bidder shall submit
with his / her proposal a descriptive statement, (100 words
or less) outlining the proposal modifications, together with

Department is not currently in place in any other cities besides Col,rmbia Heights.

BACKGROUND: The City currently owns a vacant duplex located at ~519/4521 Ta~tlor Strict. The
City purchased the property in January, 1994 for $53,000. After the purchase, a total of $22,840.43 was
used for rehabilitation for a total investment of $75,840.43.
The City also owns 4642/4644 Taylor Street. This building was purchased in 1990 in good condition for
$85,250. At the time of purchase, a minimal amonnt ofrehabihtafion of approximately $2,000 was
needed for this property. This building is also completely vacant. The EDA Board determined last
summer that we should not be in the rental business and would like to see the property owne~ccupied:.
At previous meetings, the EDA Board discussed several options for the buildings and recommended that
staffresearch some options including selling the property to a developer for a single family home,
selling the property at a reduced rate so conversion to a single family home could be done, or contracting
with a local community college as a class project.
Staffcontacted several schools to inquire about entering into a contract to convert the properties into
single family homes. Only one school, North Hennepin Technical College conducted such projects.
Unfortunately, they only do new construction, not rehabilitation of existing buildings. A contractor has
just completed minor cleanup and repairs to a damaged ceiling in both buildings.
ANALYSIS: Since contracting with community colleges to convert the duplexes into single family
homes is not an option, staff recommended the following options to the EDA:
Option 1: To sell both duplexes and require them to be converted to single family homes. In order to
accomplish this, the City would have to sell the duplexes at a reduced price.
Staff contacted William Mattson Conslxmction, the contractor who rehabilitated 4519/4521 Taylor Street
when it was originally purchased, to determine whether or not he thought a contractor would purchase
the duplex and convert it to a single family home. Without actually walking through the property at
4519/4521 Taylor and giving a bid, he thought it might cost about $50,000 to upgrade the unit, convert
the unit to a single family home, and construct a two-car garage. Given that information, if the building
were sold for $75,000 (the amount invested in the property), a contractor would have to be able to sell
the home for $135,000.
He did not think that was realistic. However, if the City was interested in selling the property at a
reduced rate, a contractor may be interested in purchasing and converting the duplex to a single family
home.
In the case of 4642/4644 Taylor Street, it may not be feasible to consider this option due to the total
investment in the property. The property was purchased in 1990 for $85,250. The property already has
a two car garage on the site. However, there are signs of roof damage and mold/mildew on the sheetrock
walls in the upper, southeast bedroom unit. Staff submitted an insurance claim to determine the amount
of reimbursable damage to the roots of both units.

According to the North Metro Realtor's Association, the average four or five bedroom house in
Columbia Heights sells for $109,6.00. This figure was determined by taking an average of the actual sale
price of four and five bedroom homes in Columbia Heights in the past 180 days (summer 1998).
Option 2: I/the City is interested in getting a remm on their investment, the City could probably spend
a minimal amount to upgrade the building and sell the property as a duplex. This option would be
feasible for both duplexes. According to the North Metro Realtors Association, the average sale price
for a duplex was $100,000.
Option 3: The City could sell the property at 4519/4521 Taylor Street to a developer for conversion
into a single family home and sell the property at 4642/4644 Taylor Street as a duplex for rental
property.
The property tax statements for taxes payable in 1999 is attached for both properties. The taxable
market value for 4519/22 Taylor Street NE is $72,200 and 4642/44 Taylor Street NE is $74,800. John
Utke is a rental property owner of twelve sites in Minneapolis and Columbia Heights (1). He is willing
to purchase the properties in accordance with the te~ms of the last alternate motion below.
ACTION REQUESTED: Staffis seeking direction as to whether or not we should I) sell both
properties at a reduced rate and continue with the efforts in the Sheffield Neighborhood by converting
the duplex to a single family home thereby increasing the number of single family, owner-occupied
housing units, 2) sell both buildings as duplex rental properties thereby getting the highest return on our
investment, or 3) sell 4642/4644 Taylor Street as a rental property and sell 4519/4521 Taylor Street to a
developer for conversion to a single family home. The EDA considered these options and adopted the
following motion last summer. However, these properties are in title of the City and require Council
approval.
EDA RECOMMENDED MOTION: Move to authorize staff to advertise the sale of the property
located at 4519/4521 Taylor with a list price of $50,000 and 4642/4644 Taylor Street with a list price of
$70,000, subject to conversion of the existing structures to single family homes and construction of a 22

The City currently owns a vacant duplex located at 4519/4521 Taylor Street NE which was
purchased in January, 1994, for $53,000. The City also owns 4642/4644 Taylor Street NE which
was purchased in 1990 for $85,250.
The City Council has taken action to sell both of these properties. Council moved to authorize
staffto take all steps necessary to advertise the "as is" sale of the property at 4642/4644 Taylor
Street and 4519/21 Taylor Street subject to the construction ora minimum 20 foot by 20 foot
garage. Preference will be given to any buyer who wishes to purchase both properties or is
willing to modify the units to single family residences or to modify with a rental unit and owner
occupied unit. Note that the sale of the two properties will be advertised within the next couple
weeks.
Minnesota Statute 462.356 requires that ifa City has a Comprehensive Plan, it must notify the
Planning Commission of the intent to purchase or sell land, and await comment from the
Planning Commission.
The City Comprehensive Plan designates both properties for future low density residential
development which includes single and t~vo family residential development. The proposal will
be consistent with the Plan regardless of whether the property stays as a duplex or is converted to
single family.
Recommended Motion:
Move to support the action of the Columbia Heights City Council to sell the property at
4519/4521 Taylor Street NE and 4642/4644 Taylor Street NE, because the proposal is consistent
with the City Comprehensive Plan.

set as it would with a straight building line, and the appearance would also be diminished. The addition would
possibly require the removal of a bedroom window as well as the basement window if constructed at the seven foot
setback. Should the variance be denied, the applicant would not need to construct the addition as shown on Option
2. It could be redesigned so that the eastern wall of the addition were aligned with the eastern wall of the existing
garage which would eliminate the need to remove any windows. However, this would not meet the needs of the
applicant as well as the design proposed in Option 1.
Mr. Hollman noted that a letter was submitted by the neighboring property owner at 1145- 50"' Avenue NE
stating that she does not object to the variance application. Also, staff researched setback information for ten
properties within the same block as the subject property. Of these ten properties, seven of the principal structures
were constructed at a five foot setback for at least one of the side yards.
Motion by Yehle, seconded by Fransen, to recommend to the City Council the approval of a side yard setback
variance of two feet at 1165- 50"' Avenue NE to allow an addition to the attached garage because topography on
the property creates a hardship. Voice Vote: A~I Ayes.

STAFF REPORTS:
A. Mr. Hollman informed the Commission of the proposed sale of city-owned property located at 4519/21 Taylor
Street and 4642144 Taylor Street. He stated that the City Council has taken action to sell these properties and to
advertise the "as is" sale of these properties subject to the construction of a minimum 20' x 20' garage at each
site. He informed the Commission that the Council also stated that preference would be given to any buyer who
wishes to purchase both properties or is willing to modify the units to single family residences or to modify the
structures with a rental unit and an owner occupied unit. Mr. Hollman stated that State Statute requires
notification of the Planning Commission of the intent to seg or purchase land.
Motion by Yehle, seconded by Fransen, to support the action of the Columbia Heights City Council to sell the
property at 4519/21 Taylor Street and 4642144 Taylor Street because the proposal is consistent with the City
Comprehensive Plan. Voice Vote: All Ayes. Motion Passed.
B. Mr. Hollman presented a working draft of the Comprehensive Plan. He reviewed the Land Use Section of the
Plan as he felt that section was the most pertinent to what the Planning and Zoning Commission dealt with. He
stated that most of the changes were in commercial areas and on 40'h Avenue in the RB Districts. The RB areas

thereto at its option. Wherever in this charter there is a requirement
of the publication of any measure or matter, it shall be understood

authorize any violation of the constitution or the statutes of the
state in any matter which is of state concern or which is exclusively
under state control.
Section 109. CITY PROPERTY NOT LOST BY ADVERSE POSSESSION. No
right, title, estate or easement of the city in any property shall be
lost by adverse possession or occupant, and no statute of limitations
shall operate against :he city in favor of any person occupyin~ any
public property or highway, whether such highway shall have been
improved or not.
Section 110. SA/~ES OF REAL PROPERTY. No real property of the
city shall be disposed of except by ordinance. The proceeds of any
such sale shall be used as far as possible to retire any outstanding
indebtedness incurred by the city in the purchase, construction, or
improvement of this or other property used for the same public purpose,
but if there be no such outstanding indebtedness, then the council may
by a resolution adopted by a four-fifths vote designate some other
public use for such proceeds.
Section 11!. VACATION OF STREETS. No street or alley within the
city shall be discontinued except by ordinance approved by a four-
fifths vote of the council and subject to popular referendum. A record
of such vacation shall be made in the office of the Register of Deeds
of Anoka County.
Section 112. DAMAGE SUITS. No action shall be maintained against
the city on account of any injuries or damages to persons or property,
unless such action shall be co~znenced within one year from the
occurrence of such injury or damage, nor unless notice shall have been
given in writing to the city clerk within thirty days of the occurrence
of such injury or damage, stating the time when and the specific place
where, and the circumstances under which the same occurred, and that
the person injured or damaged will claim damages of the city therefore.
Section 113. RECOVERY OF JTlDGMENT FOR DAMAGES. If any judgement
shall be recovered in any action against the city for any injury or
damage caused by any obstI-uction, excavation, openin~ or defect in any
street or public ground caused or occasioned by the act or omission of
any person or corporation, the city shall have the right to recover the
amount of any such judgment from the person or corporation so
responsible for such obstruction, excavation, opening, or defect; and
such person or corporation is hereby declared to be liable to the city
in the amount of such damages.

Item: Change Order No. 1 for Limited Site Investigation for Waste Oil Tank Removal
Background:
The City's underground waste oil tank was removed May 20, 1999 by DettermarfFank. A site
inspection revealed minor petroleum contamination in the soils surrounding the tank. In
accordance with State rules, the Minnesota Pollution Control Agency was contacted to discuss a
course of action. Due to the minor amount of contamination, the PCA instructed that the existing
soil be backfilled and restoration continue as originally planned. The PCA has instructed the City
to conduct a limited site investigation. The City hired the firm of Thatcher Engineering to
perform the work.
Through the Limited Site Investigation, the presence of gasoline was found in one of the borings.
The PCA was contacted, reviewed the boring data and instructed the City on a course of action.
Additional borings and testing were ordered by the PCA in the vicinity of the boring where
gasoline was found.
Through the State Petrofund Program, up to 90% of this Change Order work is reimbursable.
The remaining costs may be funded by the City Refuse Fund.
Requested Action: Authorize Change Order No. 1 to Thatcher Engineering in the amount of
$4,747.50 for conducting additional boring investigation at the MSC with 10% of the funding
appropriated from Refuse Fund 603-49950-3050.

Background:
The City of Columbia Heights has had a custodial service contract which covers City
Hall, the Municipal Services Center, and the Public Library, with Town and Country Office
Cleaning since September 1, 1989. The original contract expired September 1, 1990, and service
has continued to the present on a pay-by-the month basis. At the 5/24/99 Council meeting staff
obtained permission to obtain requests for proposals for custodial services at all three buildings.
Analysis:
Specifications were prepared by representatives of the various departments, who formed a
committee of nine people. Thirty packets were sent out to companies which had been contacted
by phone to verify interest, address, and contact person. Thirteen fn-ms toured the facilities and
ten requests for proposals (RFP's) were received (see attached). The ten RFP's were reviewed
by the committee, and four were invited to be interviewed. Interviews were conducted by a sub-
committee and reference checks were made. The findings were presented to the full committee,
and two-companies were selected for final review.
Conclusion:
Fidelity Building Services and Mid-City Cleaning Contractors were compared for a final
selection. Based on the following, staff is recommending Fidelity Building Services:
· met all specifications as outlined by departments
· depth of employees (number employed as cleaners and floaters available to cover
absences)
· accountability (log books in each building, automated check-in system, on-site
inspections, written reports)
· excellent references (cleaners for Immaculate Conception School and Columbia Park
Clinic)
· rate of $4,399/month guaranteed for one year
· either party may terminate with 30-days written notice
· renewable at a defined cost adjustment if desired

BACKGROUND
The U. S. Department of Justice has granted the Columbia Heights Police Department an equipment block
grant in the amount of $23,945. To accept this grant, the City must agree to a match of $2,661. The
Department would like to use this money to pay for equipment we could not normally afford. This would
include miscellaneous training equipment, computer equipment, squad car equipment, officer safety
equipment, etc.
ANALYSIS/CONCLUSION
At the present time it appears there would be adequate funds available in the 1999 Police Department
budget to cover the match. The grant will be available to us early in 2000.
RECOMMENDED ACTION: Direct the Police Chief to place this item on the August 23, 1999,
consent agenda.

Background:
The Gateway Committee had met approximately four weeks ago to discuss the gateway concept
as proposed by the Minnesota Design Team. It was felt that 37t~ Ave. and Central should be the
initial focus area since a small tract of land was deeded to the City from the AutoWorld
Development. The landscape architectural firm of Vanney Associates was instructed to provide
site layout/landscaping options for the committee to review.
Bob Vanney of Vanney Associates Architects has prepared three alternates for a site layout and
landscaping design, attached herein for review. The Gateway Committee, Public Works staffand
the Planning staff have reviewed the site layout alternates and are recommending "Scheme A".
Bob Varmey will be present at the work session to discuss the planning and thought process for
each site layout scheme.
The group also discussed the selection process of a gateway sign or monument. It is the Gateway
Committee's recommendation to have Vaney Associates prepare 4-6 design layouts, based upon
input and general criteria from the committee and City Council, and then determine the process
for final selection, including the level of public involvement. Discussions with the Gateway
Committee are recommending the following schedule:

Mid September: Public Works will provide sod, edging, perimeter plantings of
tree and shrubs and temporary material for walking.
Mid-winter 1999/2000: Gateway monument selection process.
Spring/summer 2000: Bidding process for remaining site landscaping, including

INTRODUCTION
INTRODUCTION
The Capital Improvement Plan is a schedule of proposed public projects and purchases, according
to priorities, over a five-year period. A Capital Improvement is defined as a capital expenditure of
Sxx,000 or more which has a life expectancy of five-years of longer. Capital Improvements are
projects which require the acquisition, construction, or replacement of various facilities, including
public buildings, streets, utilities, and parks. The Capital Improvement Plan also addresses levels
of service since it includes the purchase of equipment and vehicles.
The purpose of the Capital Improvement Plan is four-fold:
(1) .Identifies capital expenditures which will be requested over the five-year period.
(2)
Establishes priorities among a variety of competing requests by ranking them
according to objectives adopted by the City Council.
(3) Determines sources of funding for the requests.
(4) Provides an oppommity for long-term planning.
The Capital Improvement Plan is a planning and financial tool. It is a planning tool since it projects
into the future, establishes policies and priorities, and analyzes various requests in a comprehensive
fashion. It also plans for facilities such as streets, utilities, and parks to serve existing and proposed
development. Many of the objectives used to rank specific projects relate to goals found in.the
Comprehensive Guide Plan. The Plan is a financing tool since it establishes sources and levels of
funding and provides the basis for looking at long-range financial options. To that extent, the Plan
will be used in preparing current and future budgets and financial policies.
An effort has been made to make the Capital Improvement Plan a practical document which is
subject to implementation. As such, the Plan is more than a simple "wish list" but rather a Plan
which should be achievable and realistic, given various financial constraints.
PROCEDURE
PROCEDURE
The preparation of the Capital Improvement Plan is a complicated process involving many
participants, each with their own responsibilities. The City Council l~rovides direction through
development of the objectives and subsequent review and adoption ofth~ final document. Planning
and Park Commission's review and comments are also incorporated in the Plan. The various
departments provide information on individual project requests, review and comment on objectives,
and rate individual projects. The Department of Finance prepares revenue and expenditure
projections. The Department of Public Works and the Department of Finance develop the forms and
schedules, analyze the requests and funding, prepare the final document, and coordinate all activities.
The process involves the following steps:
- Schedules and forms are reviewed and prepared.
- Draft objectives are prepared and reviewed by Department Heads.
- Draft objectives are reviewed and ranked by the City Manager.
- Individual project requests are prepared and submitted.
- Preliminary analysis of the requests is performed.
- Additional information and clarification of the project requests are submitted.
- Selected project requests are rated against the Comprehensive Plan(s).
- Total rankings for individual project requests are tabulated.
- Five-year revenue and expenditure projections are prepared.
- Draft Capital Improvement Plan is reviewed by Park Commission.
- Draft Capital Improvement Plan is reviewed by Planning Commission.
- Proposed Capital Improvement Plan is reviewed and adopted by Council
The effectiveness of the Capital Improvement Plan is determined, at least in part, by its flexibility.
Assumptions may change or situations may develop which require the Plan to be modified to remain
effective and realistic. Therefore, it is understood that the Capital Improvement Plan may
occasionally be modified by Council resolution.

provide the tools for discussion and analysis by outlining the requests in different order.

Summary 2 - Requests by Year, By Funding Source
This summary is first sorted by year, within each year by funding source.
This summary provides the basis for financial analysis as outlined in the next section.
Summary 3 - By Department, By Year
This summary is first sorted by department. Within each department section, the projects
are listed in year order. This provides an overview of each department's requests. The
department was chosen based on either requesting party, percent usage or level of
responsibility. In some cases more than one department requested a piece of equipment
or a vehicle. In these cases a percent usage or level of responsibility was used. The
ratings have been added as informational.
Summary 4 - By Type, By Rating, Or Number
Summary number four provides an overview of the total requests by type. It also
indicates the rating order.
Sununary 5 - Rating
The last summary provides a listing of those projects which were rated by the staff in
order or rating.
The ratings were provided from the adopted objectives. There are separate objectives for
rating equipment and vehicles. Not all projects were rated because of time constraints
and a consideration of usefulness of the information. For example, projects which are
assessable will be included in the improvement process and feasibility/importance rated
at that time.

Store at Central Valu Shopping Center. Please have all three copies signed and notarized,

Regarding your concerns about Rainbow Foods, I added a termination option that you
can exercise if Rainbow leaves. The Landlord will have 180 days to replace Rainbow,
but during this period your rent will drop by 33%. If Rainbow is not replaced during this
period, you can terminate the lease. This clause applies for the initial term and the
renewal period.
It is hereby expressly understood that this agreement is not a contract, nor is it intended to
bind, in any way, Landlord or Tenant until fully executed by both parties.

This Lease Amendment is made this day of , 1999, by and between Bradley
Operating Limited Parmership, a Delaware Limited Parmership (hereinafter referred to as "Landlord') and City
of Columbia Heights (hereinai~ar referred to as UTenant'.)
Whereas, Landlord and Tenant are parties to a lease dated September 13, 1984 and amended on March 21,
1994, between City of Columbia Heights and Kraus Anderson, Inc., whose interest was sold to Bradley
Operating Limited Partnership, (the "Lease") for Suite 3 consisting of approximately 11,838 square feet at the
Central Valu Center, Columbia Heights, Minnesota, and whereas, the parties desire to amend the Lease as
follows:
1) The Landlord is now known as Bradley Operating Limited Partnership.

The term of the Lease set forth in Article 1 of the Lease shall be extended to a term commencing on
January 1, 2000 and ending on December 31, 2004.

conditions:
(a) The improvement allowance shall be applied to the cost of making improvements to the demised
premises;
(b) Tenant shall not make any improvements to the demised premises without obtaining Landlord's
prior written consent;
(c) Landlord shall not be obligated to pay Tenant any part &the improvement allowance until such
time as Tenant has furnished to Landlord unconditional signed lien waivers for all work and
materials provided in connection with said improvements.
Lessee shall have the option to extend the term of this Lease for one (1) additional period of five (5)
years ("the Extended Term"), upon and subject to all of the following terms and conditions.
(a) Lessee shall have given Lessor notice of its exercise of each option not less than one hundred
twenty (120) days prior to the expiration of the original term and not more than one hundred
eighty (180) days prior to the expiration of the original term as specified in Section 2.1.

any Event of Default on the part of the Lessee, nor shall this Lease have been terminated (and no
notice of termination shall have been given) for any reason provided for herein other than the

Provided Tenant is not in default under the terms of the Lease Agreement, Tenant shall have the
option of terminating the Lease Agreement if Rainbow Foods vacates their premises within Central
Vain Center. Tenant's option shall be available during the initial term and any renewal thereof. If
Rainbow Foods does vacate its premises, Landlord shall have 180 days to cure the vacancy. Once
said vacancy has been cured, Tenant's right to terminate shall be deemed null and void. Tenant's
Minimum Rent during the period of such a vacancy shall be reduced by 33%.
Exculpation. It is agreed that no partner or shareholder, officer, director, or agent of any partner, including,
Bradley Real Estate, Inc., shall be personally liable under any of the representations, covenants or agreements
of the Landlord expressed herein or implied hereunder, or otherwise because of anything arising from or
connected with the use and occupation of the premises by the Tenant, and the Tenant agrees that any and all
claims arising or accruing to the Tenant hereunder shall be enforced and satisfied only against the Shopping
Center and not in any case against any other assets of Landlord nor against the partners thereof or shareholders,
officers or agents of the partners thereof or any of them or their successors individually.
Except as amended herein, all the terms and conditions of the Lease and any and all previous Amendments
shall remain in full force and effect and unaltered hereby.

U S WEST ISDN PRIMARY RATE SERVICE AGREEMENT
INCLUDING RATE STABILIZED DID TRUNKS OR UAS OPTION
This is an Agreement between City of Columbia Heights ("CUSTOMER"), and U S WEST
Communications, Inc. ("USWC"), for the provision of U S WEST Integrated Switched Digital Network
("ISDN") Primary Rate Service ("Service" or "PRS").
1. SCOPE.
1.1 USWC shall provide and CUSTOMER shall pay for Service which provides a digital intraLATA,
intrastate, switched local exchange telecommunications service transporting and distributing voice, data,
image, and/or facsimile communications separately or simultaneously over the public switched local
exchange network, as defined herein. USWC shall provide Service in accordance with the applicable State
Tariff, Price List, and/or Catalog ("Tariff") which governs Service in the state Service is provided, incorporated
herein by this reference.
1.2. Service operates at 1.544 megabits per second (Mbps). It is comprised of 23 B channels and one
D channel. Each B Channel transmits voice or data at 64 kilobits per second (Kbps). The D channel
carries signaling information at 64 Kbps.
1.3. Subject to availability, a second PRS may be equipped at the same location to provide 24 B
channels only (24B) or to provide 23 B channels plus 1 back-up channel (23B+BUD).
1.4. Customer has also elected to rate stabilize the Direct Inward Dial ("DID") trunks or Uniform
Access Solution ("UAS") option.
2. TERM.
2.1. This Agreement will commence on the latest signature date, provided mandatory filing
requirements are met. The term of this Agreement will expire sixty (60) months from the first installation
date of Service (as evidenced by USWC's records).
2.2. Should USWC continue to provide Service after this term without a further agreement, the Service
charges will convert to the applicable month-to-month rate under the terms and conditions of the
applicable Tariff, or, in its absence, this Agreement.
3. SERVICE PROVIDED. USWC will provide and maintain the Service terminating at the locations and
in the quantities noted in Section 4 below.

5. BILLING FOR SERVICE. CUSTOMER shall pay each bill in full by the payment due date. If late
payment charges ara applicable and permitted by law, they may be assessed and billed at 1 1/2 percent per
month or the highest lawful rate, whichever is tess, on the unpaid balance.
6. SERVICE CHANGES.
6.1. MOVES. CUSTOMER may move the physical location of all or part of Service to another location
within the same USWC intrastate intraLATA serving area as this Service provided the following conditions
for the move ("new service") are met; 1) the new service is provided to CUSTOMER by._USWC;
2) CUSTOMER advises USWC that the requested new service replaces existing Service;
3) CUSTOMER's requests for the disconnection of the existing Service and the installation of the new
service are received by USWC on the same date; 4) CUSTOMER requests USWC to install the new
service on or prior to the disconnection date of the existing Service; and 5) Customer agrees to sign
appropriate agreements and to pay all then current recurring and nonrecurring charges related to the new
service.
6.2. ADDITIONS TO SERVICE. CUSTOMER may raquest additions to Service and USWC will supply
such additions to CUSTOMER, subject to the following conditions: 1 ) USWC commercially offers such
additions and necessary facilities are technically and practicably available; 2) the charges for additional
Service will be charged according to the following criteria: (a) if term equals thirty-six (36) months, Service
may only be added through month 18 and CUSTOMER will be charged at the rates specified herain and
CUSTOMER will raceive a fifty percent (50%) discount on nonracurring charges for such additions to
Service, or (b) if term equals sixty (60) months, Service may only be added through month 36 and
CUSTOMER will be charged at the rates specified herein through month 36 of this Agreement and
nonracurring charges for such additions to Service will be waived. Service added after the 18th month or
36th month respectively may be added as follows: 1) Customer and USWC may renegotiate and execute
a new term Agraement that would include existing Service plus additional Service, 2) Service may be
orderad under a new and separate agreement, or 3) Service may be orderad under the month-to-month
tariff rates then in effect.
6.3. USWC and CUSTOMER agree to execute written amendments to this Agraement for such
additions.

7. TERMINATION.
7.1. Either party may terminate this Agreement for cause provided written notice specifying the cause
for termination and requesting correction within thirty (30) days is given the other party and such cause is
not corrected within that thirty (30) day period. Cause is any material breach of the terms of this
Agreement. If USWC terminates this Agreement for cause or if CUSTOMER terminates this Agreement
WITHOUT cause, CUSTOMER shall pay early termination charges. If termination is prior to installation of
Service and after execution of this Agreement, early terrnination charges shall be those reasonable
expenses incurred by USWC through the date of termination. If, during the Minimum Service Period of 12
months, CUSTOMER disconnects all or part of Service after installation, CUSTOMER shall pay a
termination charge of 100% for the months remaining in the Minimum Service Period, plus fifty percent
(50%) for the remaining term of the Agreement; plus the balance of all billed but unpaid recurring and all
outstanding nonrecurring charges. If CUSTOMER disconnects all or part of Service after the Minimum
Service Period, CUSTOMER shall pay a termination charge equal to fifty percent (50%) of the monthly
rate for Service terminated multiplied by the number of months, or portion thereof, remaining in the term of
this Agreement; plus the balance of afl billed but unpaid recurring and all outstanding nonrecurring
charges.
7.2. A termination charge will be waived when the CUSTOMER discontinues Service(s) and ALL of the
following conditions are met: 1) CUSTOMER signs a service agreement for any other USWC provided
new service(s). All applicable nonrecurring charges will be assessed for the new service(s); 2) Both the
current Service and the new service(s) are provided solely by USWC; 3) The order to discontinue Service
and the order to establish new service(s) are received by USWC "within thirty (30) calendar days of each
other" if service is in New Mexico and "at the same time" if service is in any other state; 4) The new
service(s) installation must be completed within thirty (30) calendar days of the disconnection of Service,
unless such installation delay is caused by USWC; 5) The total value of the new service(s), excluding any
special construction charges, is equal to or greater than one hundred fifteen percent (115%) of the
remaining value of this Agreement; 6) A new Minimum Service Period, if applicable, will go into effect
when the new service(s) agreement term begins; and, 7) CUSTOMER agrees to pay any previously billed,
but unpaid recurring, and any outstanding nonrecurring charges--these charges cannot be included as
part of the new service(s) agreement.
7.3. New service is defined as a newly installed service placed under a new service agreement(s), or
newly installed additions to an existing service agreement(s), but does not include renewals of expiring
service agreement(s), renegotiations of existing service agreement(s) and conversions from month-to-
month service to contracted service.
8. OUT-OF~RERVlCE CREDIT. If USWC causes a Service interruption, an out-of-service credit will
be calculated under the state local exchange tariff. If there is no applicable tariff and the interruption lasts
for more than twenty-four (24) consecutive hours after USWC receives notice of it, USWC will give
CUSTOMER credit calculated by: (a) dividing the monthly rate for the affected Service by thirty (30) days;
and then (b) multiplying that dally rate by the number of days, or major fraction, that Service was
interrupted.
9. OWNERSHIP AND PROVISIONING OF SERVICE. Title to, and ownership of, all equipment and
facilities USWC uses in supplying Service is and remains with USWC. USWC will provision and supply
Service described in this Attachment in any manner and by means of any equipment, software, and facilities
USWC chooses. The method of provisioning of Service is a matter within USWC's sole discretion.
10. SERVICE SUSPENSION/MAINTENANCE. USWC may from time to time suspend Service for
routine maintenance or rearrangement of facilities or equipment. USWC will give CUSTOMER advance
n. otification of the Service suspension. Such Service suspension is not considered an Out-of-Service
condition provided Service is restored by the end of the periocf specified in the notification.
11. PERSONAL INJURY; PROPERTY DAMAGE. Each party shall be responsible for any actual
physical damages it directly causes in the course of its performance under this Agreement, limited to

damages resulting from personal injuries, death, or properly damage arising from negligent acts or
omissions; PROVIDED HOWEVER, THAT NEITHER PARTY SHALL BE LIABLE FOR ANY INCIDENTAL,
CONSEQUENTIAL, INDIRECT, OR SPECIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT
LIMITED TO ANY LOSS OF USE, LOSS OF BUSINESS, OR LOSS OF PROFIT.
12. LIMITATION OF LIABILITY. USWC SHALL NOT BE LIABLE TO CUSTOMER FOR ANY
INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND INCLUDING BUT
NOT LIMITED TO ANY LOSS OF USE, LOSS OF BUSINESS, OR LOSS OF PROFIT. EXCEPT AS
PROVIDED IN THIS AGREEMENT, ANY USWC LIABILITY TO CUSTOMER FOR ANY DAMAGES OF
ANY KIND UNDER THIS AGREEMENT SHALL NOT EXCEED, IN AMOUNT, A SUM EQUIVALENT TO
THE APPLICABLE OUT-OF-SERVICE CREDIT. REMEDIES UNDER THIS AGREEMENT ARE
EXCLUSIVE AND LIMITED TO THOSE EXPRESSLY DESCRIBED IN THIS AGREEMENT.
13. NO WARRANTIES. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING
BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE.
14. UNCONTROLLABLE CONDITIONS. Neither party shall be deemed in violation of this
Agreement if it is prevented from performing any of the obligations under this Agreement by reason of
severe weather and storms; earthquakes or other natural occurrences; strikes or other labor unrest; power
failures; nuclear or other civil or military emergencies; acts of legislative, judicial, executive or
administrative authorities; or any other circumstances which are not within its reasonable control.
15. DISPUTE RESOLUTION.
15.1. Other than those claims over which a regulatory agency has exclusive jurisdiction, all claims,
regardless of legal theory, whenever brought and whether between the Parties or between one of the
Parties to this Agreement and the employees, agents or affiliated businesses of the other Par~, shall be
resolved by arbitration. A single arbitrator engaged in the practice of law and knowledgeable about the
subject matter of the dispute shall conduct the arbitration in accordance with the then current rules of the
American Arbitration Association ("AAA").
15.2. mi expedited procedures prescribed by the AAA shall apply. The arbitrator's decision shall be
final and binding and judgment may be entered in any court having jurisdiction thereof.
15.3. Other than the determination of those claims over which a regulatory agency has exclusive
jurisdiction, federal law (including the provisions of the Federal Arbitration Act, 9 U.S.C. Sections 1-16)
shall govern and control with respect to any issue relating to the validity of this Agreement to arbitrate and
the arbitrability of the claims.
15.4. If any party files a judicial or administrative action asserting claims subject to arbitration, and
another party successfully stays such action and/or compels arbitration of such claims, the party filing the
action shall pay the other pa~y's costs and expenses incun'ed in seeking such stay or compelling
arbitration, including reasonable attorney's fees.
16. LAWFULNESS. Tills Agreement and the parties' actions under this Agreement shall comply with
all applicable federal, state, and local laws, rules, regulations, court orders, and governmental agency
orders. Any change in rates, charges or regulations mandated by the legally constituted authorities will
act as a modification of any contract to that extent without further notice. This Agreement shall be
governed by the laws of the state where Service is provided.
!7. SEVERABILITY. In the event that a court, governmental agency, or regulatory agency with
proper jurisdiction determines that this Agreement or a provision of this Agreement is unlawful, this
Agreement, or that provision of the Agreement to the extent it is unlawful, shall terminate, If a provision of
this Agreement is terminated but the parties can legally, commercially and practicably continue without the
terminated provision, the remainder of this Agreement shall continue in effect.

18. GENERAL PROVISIONS.
18.1, Failure or delay by either party to exercise any right, power, or privilege hereunder, will not
operate as a waiver hereto.
18.2. This is a retail end user contract. It may be assigned only with the consent of USWC. It may not
be assigned to a reseller or a telecommunications carrier under any circumstances.
18.3. This Agreement benefits CUSTOMER and USWC. There are no third party beneficiaries.
18.4. This Agreement constitutes the entire understanding between CUSTOMER and USWC with
respect to Service provided herein and supersedes any prior agreements or understandings.
18.5 If a party retums this Agreement by facsimile machine, the signing party intends the copy of this
authorized signature printed by the receiving facsimile machine to be its original signature.
19. EXECUTION. The parties hereby execute and authorize this Agreement as of the latest date
shown below. Notices concerning this Agreement may be sent to USWC's CUSTOMER billing address of
record or to CUSTOMER's Address for Notices specified herein, if any.

NOTICE TO BIDDERS
The City of Columbia Heights will be accepting bids on
the sale of the following two residential duplex properties:
4519/4521 Taylor Street and 4642/4644 Taylor Street. These
properties are offered in ~as is" condition.
Sealed bids will be received by the City of Columbia
Heights, Community Development Department, 590 40~h Avenue
N.E., Columbia Heights, MN, 55421 until 11:30 a.m.. C.D.S.T.
on Aucust 12, 1999, at which time they will be publically
opened and read out loud in the City Council Chambers.
Each bid shall be accompanied by a bidder's bond naming the
City of Columbia Heights as obligee,or a certified check
payable to the City of Columbia Heights, or an irrevocable
letter of credit or a non interest bearing cash deposit
equal to at least five percent (5%) of the amount of the
bid. If bidder is selected by the city and fails to enter
into a contract, bidder shall forfeit said 5% deposit.
The City Council reserves the right to retain the deposit of
the three most competitive bidders for a period not to
exceed 45 days after the date and time set for the opening
of bids. Each bid must indicate either "4642/4644 Taylor
Street" or "4519/4521 Taylor Street" on the front of the bid
envelope. A separate bid envelope shall be submitted for
each property.
The City Council reserves the right to reject any and all
bids, or a portion thereof, to waive irregularities and
informalities therein, further negotiate terms of the
proposals, and reserves the right to award the contract in
the best interest of the City.
The successful bidder(s) must comply with the following
sales conditions:
1.A minimum 20ft x 20ft two stall garage must be
constructed at 4519 / 4521 Taylor Street complying to all
city and state codes. Construction time lines and letters
of credit shall be required.
2. If used for rental, all units must be licensed and comply
with the City Housing Maintenance Code.
Intended Scope Of Use:
1. The City has an interest in converting these duplex units
into single family homes so as to be consistent with the
neighborhood. Any bid proposals for such a modification
to single family would be given serious priority
consideration by the City.**
2. If the bidder proposes to use the unit(s) as duplex
residential, the City would give higher consideration to
an owner occupied proposal.
3. Bidders proposing absentee ownership of the duplex units
will also be considered, but with less priority.
**To facilitate comparison of proposals in converting a
duplex unit into a single family, the bidder shall submit
with his / her proposal a descriptive statement, (100 words
or less) outlining the proposal modifications, together with
a floor plan layout.

BACKGROUND: The City currently owns a vacant duplex located at ~519/4521 Taylor Street. The
City pm'chased the property in January, 1994 for $53,000. After the purchase, a total of $22,840.43 was
used for rehabilitation for a total inveslment of $75,840.43.
The City also owns 4642/4644 Taylor Street. This building was purchased in 1990 in good condition for
$85,250. At the time of purchase, a minimal amoullt of rehabilitation of approximately $2,000 was
needed for this property. This building is also completely vacant. The EDA Board determined last
summer that we should not be in the rental business and would like to see the property own~ccupieck.
At previous meetings, the EDA Board discussed several options for the buildings and recommended that
staff researoh some options including selling the property to a developer for a single familyhome,
selling the property at a reduced rate so conversion to a single family home could be done, or contracting
with a local community college as a class project.
Staff contacted several schools to inquire about entering into a contract to convert the properties into
single family homes. Only one school, North Hennepin Technical College conducted such projects.
Unfortunately, they only do new conswaction, not rehabilitation of existing buildings. A contractor lids
just completed minor cleanup and repairs to a damaged ceiling in both buildings.
ANALYSIS: Since contracting with community colleges to convert the duplexes into single family
homes is not an option, staffrecommended the following options to the EDA:
Option 1: To sell both duplexes and require them to be converted to single family homes. In order to
accomplish this, the City would have to sell the duplexes at a reduced price.
Staffcontacted William Mattson Conslruction, the contractor who rehabilitated 4519/4521 Taylor Street
when it was originally purchased, to determine whether or not he thought a contractor would purchase
the duplex and convert it to a single family home. Without actually walking through the property at
4519/4521 Taylor and giving a bid, he thought it might cost about $50,000 to upgrade the mt, convert
the unit to a single family home, and construct a two-car garage. Given that information, if the building
were sold for $75,000 (the amount invested in the property), a contractor would have to be able to sell
the home for $135,000.
He did not think that was realistic. However, if the City was interested in selling the property at a
reduced rate, a contractor may be interested in purchasing and converting the duplex to a single family
home.
In the case of 4.642/4644 Taylor Street, it may not be feasible to consider this option due to the total
investment in the property. The property was purchased in 1990 for $85,250. The property ah'eady has
a two car garage on the site. However, there are signs of roof damage and mold/mildew on the sheetrock
walls in the upper, southeast bedroom unit. Staff submitted an insurance claim to determine the amount
o f reimbursable damage to the rot fs o f both units.

According to the North Metro Realtor's Association, the average four or five bedroom house in
Columbia Heights sells for $109,6.00. This figure was det=,,~ined by taking an average of the actual sale
price of four and five bedroom homes in Columbia Heights in the past 180 days (summer 1998).
Option 2: If the City is interested in getting a return on their investment, the City could probably spend
a minimal amount to upgrade the building and sell the property as a duplex. This option would be
feasible for both duplexes. According to the North Metro Realtors Association, the average sale price
for a duplex was $100,000.
Option 3: The City could sell the property at 4519/4521 Taylor Street to a developer for conversion
into a single family home and sell the property at 4642/4644 Taylor Street as a duplex for rental
property.
The property tax statements for taxes payable in 1999 is attached for both properties. The taxable
market value for 4519/22 Taylor Street NE is $72,200 and 4642/44 Taylor Street NE is $74,800. John
Utke is a rental property owner of twelve sites in Minneapolis and Columbia Heights (I). He is willing
to purchase the properties in accordance w/th the t~ms of the last alternate motion below.
ACTION REQUESTED: Staffis seeking direction as to whether or not we should I) sell both
properties at a reduced rote and continue with the efforts in the Sheffield Neighborhood by converting
the duplex to a single family home thereby increasing the number of single family, owner-occupied
housing units, 2) sell both buildings as duplex rental properties thereby getting the highest return on our
investment, or 3) sell 4642/4644 Taylor Street as a rental property and sell 4519/4521 Taylor Street to a
developer for conversion to a single family home. The EDA considered these options and adopted the
following motion last summer. However, these properties are in title of the City and require Council
approval.
EDA RECOMMENDED MOTION: Move to authorize staffto advertise the sale of the property
located at 4519/4521 Taylor with a list price of $50,000 and 4642/4644 Taylor Street with a list price of
$70,000, subject to conversion of the existing structures to single family homes and construction of a 22
foot by 22 foot garage at 4519/4521 Taylor Street.

purchased in Ianuary, 1994, for $53,000. The City also owns 4642/4644 Taylor Street NE which
was purchased in 1990 for $85,250.
The City Council has taken action to sell both of these properties. Council moved to authorize
staffto take all steps necessary to advertise the "as is" sale of the property at 4642/4644 Taylor
Street and 4519/21 Taylor Street subject to the construction of a minimum 20 foot by 20 foot
garage. Preference will be given to any buyer who wishes to purchase both properties or is
willing to modify the units to single family residences or to modify with a rental unit and owner
occupied unit. Note that the sale of the two properties will be advertised within the next couple
weeks.
Minnesota Statute 462.356 requires that ifa City has a Comprehensive Plan, it must notify the
Planning Commission of the intent to purchase or sell land, and await comment fi.om the
Planning Commission.
The City Comprehensive Plan designates both properties for future low density residential
development which includes single and two family residential developmem. The proposal will
be consistent with the Plan regardless of whether the property stays as a duplex or is converted to
single family.
Recommended Motion:
Move to support the action of the Columbia Heights City Council to sell the property at
4519/4521 Taylor Street NE and 4642/4644 Taylor Street NE, because the proposal is consistent
with the City Comprehensive Plan.

set as it would with a straight building line, and the appearance would also be diminished. The addition would
possibly require the removal of a bedroom window as well as the basement window if constructed at the seven foot
setback. Should the variance be denied, the applicant would not need to construct the addition as shown on Option
2. It could be redesigned so that the eastern wall of the addition were aligned with the eastern wall of the existing
garage which would eliminate the need to remove any windows. However, this would not meet the needs of the
applicant as well as the design proposed in Option 1.
Mr. Hollman noted that a letter was submitted by the neighboring property owner at 1145- 50~' Avenue NE
stating that she does not object to the variance application. Also, staff researched setback information for ten
properties within the same block as the subject property. Of these ten properties, seven of the principal structures
were constructed at a five foot setback for at least one of the side yards.
Motion by Yehte, seconded by Fransen, to recommend to the City Council the approval of a side yard setback
variance of two feet at 1165- 50~" Avenue NE to allow an addition to the attached garage because topography on
the property creates a hardship. Voice Vote: All Ayes.

STAFF REPORTS:
A. Mr. Hollman informed the Commission of the proposed sale of city-owned property located at 4519/21 Taylor
Street and 4642/44 Taylor Street. He stated that the City Council has taken action to sell these properties and to
advertise the "as is" sale of these properties subject to the construction of a minimum 20' x 20' garage at each
site. He informed the Commission that the Council also stated that preference would be given to any buyer who
wishes to purchase both properties or is willing to modify the units to single family residences or to modify the
structures with a rental unit and an owner occupied unit. Mr. Hogman stated that State Statute requires
notification of the Planning Commission of the intent to sell or purchase land.
Motion by Yehle, seconded by Fransen, to support the action of the Columbia Heights City Council to sell the
property at 4519/21 Taylor Street and 4642/44 Taylor Street because the proposal is consistent with the City
Comprehensive Plan. Voice Vote: All Ayes. Motion Passed.
B. Mr. Hogman presented a working draft of the Comprehensive Plan. He reviewed the Land Use Section of the
Plan as he felt that section was the most pertinent to what the Planning and Zoning Commission dealt with. He
stated that most of the changes were in commercial areas and on 40"' Avenue in the RB Districts. The RB areas

city shall be disposed of except by ordinance. The proceeds of any
such sale shall be used as far as possible to retire any outstanding
indebtedness incurred by the city in the purchase, construction, or
improvement of this or other property used for the same public purpose;
but if there be no such outstanding indebted.ness, then the council may
by a resolution adopted by a four-fifths vote designate some other
public use for such proceeds.
Section lll. VACATION OF STREETS. No street or alley within the
city shall be discontinued except by ordinance approved by a four-
fifths vote of the council and subject to popular referendum. A record
of such vacation shall be made in the office of the Register of Deeds
of A.noka County.
Section 112. DAMAG~ SUITS. No action shall be maintained against
the city on account of any injuries or damages to persons or property,
unless such action shall be commenced within one year from :he
occurrence of such injury or damage, ncr unless notice shall have been
given in writing to the city clerk within thirty days of the occurrence
of such injury or damage, stating the time when and the specific place
where, and the circumstances under which the same occurred, and that
the person injured or damaged will claim damages of the city therefore.
Section 113. RECOVERY OF JUDGMENT FOR DAMAGES. If any judgement
shall be recovered in any ac:ion against the city for any injury or
damage caused by any obstruction, excavation, opening or defect in any
street or public ground caused or occasioned by the act or omission of
any person or co.--potation, the city shall have the right to recover the
amount of any such judgment from the person or corporation so
responsible for such obstruction, excavation, opening, or defect; and
such person or corporation is hereby declared to be liable to the city
in the amount of such damages.

Issue Statement: The enclosed information represents the bids received on the sale of two City owned
duplexes, 4519/4521 Taylor Street and 4642/4644 Taylor Street Columbia Heights, MN. The bids were opened
and read aloud in the City Council Chambers on August 12, 1999 at 11:30 am. The bidding process has now
been completed and the City Council may now consider awarding the bids.
Background: The City currently owns two vacant duplexes located at the above Taylor Street addresses. The
unit at 4519/4521 Taylor was purchased in January, 1994, for $53,000. After the purchase, a total of $22,840.43
was used for rehabilitation for a total investment of $75,840.43.
The other unit, 4642/4644 Taylor Street was purchased in 1990 for $85,250 with an additional $2,000 invested
for rehabilitation issues. Last summer, the EDA Board determined that they should not be in the rental business
and would like to see the property owner-occupied. At the April 26, 1999, City Council meeting, City staff was
authorized to take all necessary steps to advertise the properties for sale in "as is" condition. In addition, the
successful bidder on 4519/4521 Taylor Street would be required to construct a two stall garage (minimum size
20 ft. x 20 ft.) that complies to all City and State codes. The City Councils priority use for these units was
focused on: (A) conversion to single family, or (B) owner-occupied/rental duplex. Bidders proposing absentee
oxvnership of the duplex units would also be considered, but with less priority.
In order to get maximum public exposure on the advertisement for bids, staff posted notices at City Hall, the
Library, Murzyn Hall, on the local cable channel, sent notices to local realtors, advertised for three weeks in the
Focus News real estate showcase, and one week in the Minneapolis Star Tribune. This generated interest from
over 40 requests for bidding packets.
Analysis: Pursuant to Minnesota Statute 412.211 and 410.22, cities have the power to sell land they no longer
need. The City Council has extreme latitude on how they dispose of surplus property and is not bound to sell to
the highest bidder. Their decision on who to sell to may be based on local plans and policies which have the best
interests of the public in mind.
On August 12, 1999, the City closed bids for the two duplex units on Taylor Street. A total of twelve bids were
received. Seven bids for 4642/4644 Taylor Street and five bids for 4519/4521 Taylor Street. Two ofthe bidders,
Mr. Gregory Huber and Mr. Samuel A. Nyakundi, did not submit bid bonds or deposits because they are unable
to secure mortgage financing and are requesting rent/purchase agreements. To be fair to the participants who
met all bidding requirements, I will not include these two proposals in my review but will include them in the
packets for your information.
Option #I - Based on best financial return to the City with owner occupant duplex status.
· Ms. Phoua Lee submitted the high bid for 4642/4644 Taylor Street in the amount of $91,000. Ms. Lee
plans to have her parents live in one half of the duplex and provide day care for her children while she and
her husband would occupy the other half.
· Mr. Ernest Payan submitted the next highest bid in the amount of $85,000 for 4642/4644 Taylor Street but
indicated he would be interested in the 4519/4521 Taylor Street duplex if that was available. He would

occupy one side and rent the other to his brother-in-law. By approving this proposal the City would
receive the best financial return ($176,000) and maintain owner-occupant status.
Option #2 - Based on highest quality and value improvements to the units, hieher rents, and general
neighborhood upgrade with absentee owner duplex status.
· To accomplish this scenario, Mr. Ivan Pr/em has submitted bids on both units in an amount of $72,900
respectively ($145,800 total). Mr. Priem has a strong history of renovation ability and proposes to make
significant upgrades throughout both units. He has prior experience with a 4-plex on Madison Street
which received high grades from the City Fire and Inspection Departments.
The Swervo Development Corporation has submitted bids on both units as well. This proposal is
somewhat different in that their first priority would be to convert both units into townhomes (individual
owned) thus creating four independently owned units ( see attached memo from Joe Hollman). Their
second priority would be similar to Mr. Priems, however, I do not believe the proposed improvements
would be as extensive. Their bid on 4519/4521 Taylor Street was $66,350 and on 4642/4644 it was
$71,350 for a total bid of $137,700.
As mentioned earlier, the City Council has great flexibility in the sale of these units. I have outlined the above
two options based on the discussion the City Council had at its April 26, 1999, meeting. In addition, the City
staff is in the process of analyzing the impact of the Community Development Block Grant dollars that were
used in acquiring these units. A complete review of that issue will be forwarded to the City Council after Anoka
County completes our request for information.
Recommendation: Both options, as I have outlined above, have merit and bring benefit to the City. If the
Council feels that their highest priority is for the City to have owner-occupants in these units and receive the
greatest return on investment, then Option #1 would best meet that goal. However, if the City Council feels that
a higher quality of improvements to the units (total upgrade to interior as well as exterior) is the most desirable
issue, the Option #2 should be considered. A side issue in Option #2 is the townhouse concept - numerous
questions remain relating to the organizational documents of the owner association and the general legal
responsibilities for the operation of the condominium/townhomes.
Recommended Motions:
Move to waive the first reading of Ordinance #, there being ample copies available to the public.
Move to establish September 13, 1999, at approximately 7:00 p.m. as the second reading of Ordinance No.,
being an ordinance amending Ordinance No. 853, City Code of 1977, authorizing the conveyance of certain real
estate at 4519/4521 and 4642/4644 Taylor Street NE.

The following provides a summary of zoning issues pertaining to the sale of the two Taylor Street
duplexes listed above.
4642/4644 Taylor Street NE is currently zoned R-3, Multiple Family Residential, and 4519/4521
Taylor Street NE is zoned R-2, Single and Two Family Residential.
Single family and two family dwellings are permitted in both the R-2 and R-3 Districts.
The minimum lot size for a two family dwelling is 8,400 square feet and neither of the two
subject properties meet this requirement. Both properties are currently used as two family
dwellings and can continue to be used as such. However, should the structures be damaged in an
amount that is 50% or more of its fair market value the property would not be allowed to be
reconstructed as a two family dwelling.
Conversion of the structures into single family dwellings would bring existing nonconforming
properties into compliance. Allowing the structures to remain as duplex units is permitted, but
they would remain nonconforming.
The possibility of converting the properties into single family condominium/townhouse units raises a
number of issues which are outlined below.
The units would be considered single family attached dwellings which are defined as a dwelling
which is joined to another dwelling at one or more sides by a common wall. They could also be
considered as to~vnhouse dwellings which are defined as attached dwelling units, each with a
separate entrance to front and rear yards. Note that the Zoning Ordinance does not address
condominiums.
The R-2 District does not address townhouses and the R-3 District allows townhouses as a
permitted use provided they contain three to eight units. Single family attached dwellings and
two unit townhouses are not addressed in any of the zoning districts.
Two family dwelling is not defined in the Zoning Ordinance. Because two unit townhouses and
single family attached dwellings are not specifically addressed, it is my opinion that they can be
considered two family dwellings and are permitted in both the R-2 and R-3 Districts.
The project will need to comply with the Uniform Condominium Act (Minnesota Statute 515A)
and/or the Minnesota Common Interest Ownership Act (Minnesota Statute 515B) if the units are
converted into townhouses/condominiums.
Note that pursuant to Minnesota Statute 462.356 the Planning and Zoning Commission moved to support
the action of the Columbia Heights City Council to sell the property at 4519/4521 Taylor Street NE and
4642/4644 Taylor Street NE, provided the final development remains consistent with the City
Comprehensive Plan. The City Comprehensive Plan designates both properties for future low density
residential development which includes single and two family residential development. The proposal
will be consistent with the Plan regardless of whether the property stays as two family or is converted to
single family.

with this, the good is I have legal and full custody of my
children and the bad is it is tough getting a full home loan.
Myself and my children very much enjoy the city of
Columbia Heights, my oldest daughter is one of your
current princesses and a former princess 97/98. My other 3
children have solid roots in Heights as well, friends, school
are very important to them as it is to myself. This is the
main reason we are in search for a home, Heights is our
home and we are willing to do what ever it takes to get us

Police and Fire Reserve Annual Appreciation Event

Background
Each year the City Council has hosted an annual appreciation night for members of the Civil Defense
Police and Fire Reserve Units and their guests. Plans are now being finalized for the 1999 appreciation
event. Council action is required to spend money necessary for advance reservations, etc. There are
funds available in the Recognition/Special Events budget fund 101 Department 45050.
Analysis/Conclusion
The Police Reserve Unit requested the appreciation night be held at the Chanhassen Dinner Theatre
again and selected Saturday, September 18, 1999, as the most convenient date. Due to production
scheduling at Chanhassen Theatre, productions this fall are limited and the group has chosen "Can
Can." The cost is $59.00/person, and based on past history, we anticipate about 50 persons will attend.
Due to the short turnaround time for invitations to be sent and returned, and the deadline set by
Chanhassen Theatre of August 30 for final count and payment, we are requesting verbal approval of
the Council prior to the August 23 Council meeting so that we may send out the invitations and
information to our guests this week.
RECOMMENDED MOTION: Move to authorize the expenditure of up to $4,100 from the Special
Events budget to host an annual appreciation night for the Fire and Police Reserve Units, and that the
Mayor and City Manager are authorized to enter into contracts as needed for this event.
