Special Purpose Fence - Linda Mehner. 4055 Jefferson Street The Council approved the six (6) foot high special purpose solid board privacy fence for 4055 Jefferson Street. Special Purpose Fence - Sidney Anderson. 3931 Ouincy Street The Council approved the five (5) foot high solid board privacy fence at 3931 Quincy Street. Roll call: All ayes Se Councilmember Nawrocki inquired if the concerns expressed regarding signage approved for the alley between 46th and 47th Avenues'~was clarified to the resident who brought this matter to the Council. The City Manager responded that it has been clarified and the resident understands. The City Manager introduced James Hoeft, the new City Attorney. e PUBLIC HEARINGS/RESOLUTIONS/ORDINANCES a. ~ublic Hearing - Revocation/Suspension of a License. 5049\51 jaCkson Street Northeast REGULAR COUNCIL MEETING AUGUST 8, 1994 PAGE 4 The City Manager noted that the resolution contains the Findings of Fact and Council Conclusions. This public hearing was established at the July 26, 1994 Council Meeting. Currently, one half of this building is occupied by a tenant. This is an ordinance violation as it is not presently licensed. The owner and the tenant were notified by mail of this public hearing and advised they would have an opportunity for input and rebuttal. The City Manager read all of the violations identified on the report from the Inspector. He summarized all of the occasions when the premises was tagged for non-compliance. Problems with this property date back to 1991. Ms. Haugen, representing ROI Properties, advised that her firm manages the property. She noted that about $4,000 of improvements have been done on the occupied side of the building. She was not aware there was no license. She acknowledged there are still deficiencies in the unoccupied side. The last time she spoke with the owner, he indicated he currently has no funds to do any further improvements. The City Manager stated there are still improvements to be made in the common areas of the building. If the resolution is adopted the tenants will have sixty days to move out. The Inspector advised the last inspection was made in July of 1994. At that time, he was told by a workman on the premises no further improvements would be made as there was no more money available. Motion by Ruettimann, second by Peterson to waive the reading of the resolution there being ample copies available for the public. Roll call: Ail ayes Councilmember Ruettimann felt adoption of the resolution was justified in thatthe management firm representative commented there are no funds available to do further repairs. Pertaining to the Housing Ma'intenan~e Code as it Relates to Inspection and Enforcement Councilmember Nawrockiquestioned the need for delineating the authority to. inspect owner/occupied dwellings. He noted there has always been the option to acquire a court order for this purpose if a problem appeared to exist. The Fire Inspector advised that such problems have existed and the acquisition of court orders has been done to enter the premises. REGULAR COUNCIL MEETING AUGUST 8, 1994 PAGE 7 Councilmember Nawrocki read the ordinance deleting the language he wanted removed. ORDINANCE NO. 1291 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO THE AUTHORITY OF THE CITY TO INSPECT PROPERTIES The City of Columbia Heights does ordain: Chapter 5A, Article III, Section 1, Subsection 1, (5A.301[1]) of Ordinance No. 853, City Code of 1977, which currently reads as follows, to wit: 5A.301(1) Inspection and Enforcement Section 1: Enforcement and Inspection Authority The City Manager and his/her designated agents shall be the Building Official who shall administer and enforce the provisions of the Ordinance. Resolution No. 94-46; ApDroving. an Occupancy Permit for the Columbia Heights School District at.4001 Central Avenue The City Manager addressed the purpose of the indemnification agreement. The School District's attorney feels they cannot legally indemnify the City on the grounds stated in the agreement. The City Attorney spoke to his memo regarding the location of the Early Childhood Program in the mall. He also reviewed the concern expressed about renewal or reapplication for the liquor license currently held by a tenant of the mall. REGULAR COUNCIL MEETING AUGUST 8, 1994 PAGE 16 Councilmember Nawrocki inquired if it would be allowed for another business to locate in the mall to operate a restaurant with a liquor license. The City Attorney responded this would not be allowed. Granting of this request would preclude the issuance of a liquor license in the future to anyone within 300 feet of the school. Councilmember Nawrocki recalled how the community has hoped that a decent restaurant would locate in the downtown area. He felt the approval of this resolution would eliminate the possibility for this to happen. He noted that the "balancing of interests", as cited in the City's Comprehensive Plan, will not be satisfied with the passage of this resolution. He also stated he has no problem with the usage of the space but finds it difficult to believe there were no other suitable locations to be found. Councilmember Ruettimann observed that the ordinance could be amended if a bar/restaurant situation were to occur. He also noted that the last paragraph of the resolution referenced the indemnification agreement. He suggested this should be deleted. He felt it was rather early and noted that the water looked rather clear. He wondered why this was done. The City Manager will follow up on this matter. d. Street Rehabilitation Program Information regarding the upcoming street projects will be included in the next edition of the City newsletter. Councilmember Nawrocki requested he be given a draft copy of the articles regarding this before it is printed. The City Manager will give a draft copy of the material to all members of the City Council. 8. OLD BUSINESS a. Zaidan Holdinas Negotiations The City Manager addressed certain features of the Negotiated Agreement with Zaidan Holdings. He explained this is a non- binding agreement on the part of all of the participants. It is not a Settlement Agreement. Councilmember Nawrocki questioned the inclusion of subsection (b) which reads as follows: "Zaidan will use its best efforts to seek abatment of taxes, penalties and interest on the office prOPerty to the extent authorized by Minnesota statutes and County policies." The City Manager explained the reason for its inclusion. He recommended it be removed before the agreement is approved. Councilmember Nawrocki feels there is no need for this agreement and fears it may be a scheme to avoid tax liabilities. He observed there is nothing in the agreement to make this building a viable project. He noted that the tax forfeiture clock is running and the building owners have paid nothing at this point in time. REGULAR COUNCIL MEETING AUGUST 8, 1994 PAGE 23 A representative of Zaidan Holdings advised that there has been no profit realized from the building. He explained what is currently being done regarding maintenance and improvements. The impact of this agreement was discussed relative to the tax levy and the TIF bonds payoff. This matter will be considered at a Council work session. Councilmember Nawrocki does not feel the agreement is in the best interest of the city of Columbia Heights and will not support this agreement. He also brought up a request received from another property owner regarding tax abatement. There was no action taken on this request. Sale of City-Owned Lot on Maiden Lane Councilmember Nawro~ki recalled that the sale of a lot on Maiden Lane was approved about five years ago. He noted that the purchaser has not yet received clear title to the lot although he paid the purchase price. The City Manager advised that court action is necessary to clear the title. c. Complaints Regarding Garbage/Refuse Hauling Councilmember Nawrocki has been made aware that property owners ~with complaints regarding their garbage are being referred to call the hauler directly. He had understood that the original contract with the hauler specified these complaints would be handled by City staff. He also recalled the contract stated someone from the hauling company would come into City Hall each business day to follow up and pick up complaints. These practices were changed administratively bya former City Manager. If there is an on-going problem City staff handles it. REGULAR COUNCIL MEETING AUGUST 8, 1994 PAGE 24 d. Mill Street Project Councilmember Nawrocki has been advised that the Mill Street reconstruction project has been delayed until next year. He inquired as to the reason for the delay. The Public Works Director responded staff desired additional time to evaluate watermain replacement on Mill Street. Another reason for the delay was to coordinate the time of the construction relative to Murzyn Hall bookings. NEW BUSINESS a. Award Contract for Storm Sewer Improvements at LaBelle Pond Only one bid was received. The Public Works Director indicated there would be no problem with delaying this issue. Roll call: Ail ayes e. Recycling Containers Mayor Sturdevant requested staff to pursue the possibility of having the green recycling containers picked up every other week rather than weekly. During his tour of National Night Out a~tivities, many residents mentioned to the Mayor they never fill these containers completely full every week. It was felt there may be a possible cost savings for the resident. Councilmember Nawrocki recognized there may be a potential cost savings with bi-weekly pick ups but noted that some of the associated costs are related to where the recycled materials are taken by the hauler. I stated that if you did not want to re- pair/replace the wall, a structural engineers inspection, findings (report) and acceptance of the wall, as to being structural sound and safe, is needed. At this time you requested that Evelyn Nygaard, my supervisor, review my findings and give her opinion. On 11-15-93 Erie and myself again inspected the wall and she concurred with my findings. Erie states that she has spoken to you and several contractors but as to date, no application for'a buildingpermit has been submitted, indicating no immediate activity is planned. As over a month has lapsed since Evie and my last inspection and since your being warned of the structural instability of this wall, I am concerned that the seriousness of this issue is not fully appreciated. With the onset of winter, it is of special concern that blowing snow may fill the void between the brick veneer and its backing material and through freeze/thaw cycles (expansion and contraction) would cause the collapse of the wall assembly. Also, there are areas of the parapet portion where large sections of the brick veneer are literally Just 'sitting' there'(totally loose) and may become dislodged and fall, causing sever injury, or worse, to pedestrians passing below. Included in this goal/plan is redevelopment/reu=ilization of residential proper=les in the area of moderate income housing and redevelopment of the commercial area so as to establish clear delineations or buffers between Central Avenue commercial development and the housing units along Tyler Street. BUYER shall have ten (10) business days after receipt of the Commitment for title ln~m&--ance to provide SELLER with a copy of the Commitment and written objections. BUYER shall be deemed to have waived any title objections not made within the applicable ten (10) day period for above, except that this shall not operate as a waiver of SELLER's covenant to deliver a statutory Warranty Deed. 7. Title Corrections and Remedies. SELLER shall have 120 days from receipt of BUYER's written fide objections to make fide marketable. Upon receipt of BUYER's tide objections, SELLER shall, within 10 business days, notify BUY'ER of SELLER's intention to make title marketable within the 120 day period. Liens or encumbrances for liquidated amounts which can be released by payment or escrow from proceeds of closing shall not delay the closing. Cure of the defects by SELLER shall be reasonable, diligent, and prompt. Pending correction of dale, all payments required herein and the closing shall be postponed. SELLER shall be liable for any and all expenses related to the correction of tide, including, but not by way of limitation, Page 2 costs in bringing an action in Proceeding Subsequent, court costs, attorneys fees, and recording fees. a. If notice is given and SELLER makes title marketable, then upon presentation to BUYER of documentation establishing that title has been made marketable, and if not objected · to in the same time and manner as the oHgiual title objections, the closing shall take place within ten business days or on the scheduled closing date, whichever is later. b. If notice is given and SELLER proceeds in good faith to make title marketable but the 120 day period expires without title being made marketable, earnest money shall be refunded to BUYER. c. If SELLER does not give notice of intention to make title marketable, or if notice is given but the 120 day period expires without title being made marketable due to SELLER's failure to proceed in good faith, BLrY'EK may seek, as permitted by law, any one or more of the following: i. Proceed to closing without waiver or merger in the deed of the objections to title and without waiver of any remedies, and may: (1) Seek damages, costs, and reasonable attorney's fees from SELLEP, as permitted by law (a~rnages under this subparagraph (1) shall be limited to the cost of curing objections to title, and consequential ~mages are excluded); or, (2) Undertake proceedings to correct the objection to title; ii. Rescission of this Purchase Agreement by notice as provided herein, in which case the Purchase A. greement shall be null and void and all em-nest money paid hereunder shall be refunded to BUYER; iii. Damages from SELLER including cost and reasonable attorney's fees, as permitted by lavf, iv. Specific performance within six months after such right of action arises d. If title is marketable, or is made marketable as provided herein, and SELLER. defaults in any of the agreements herein, BUYER may, as permitted by law: i. SELLER covenants that all ex/sting leases, whether they be oral or written, have been terminated or, if not terminated, will expire by their term-q as of the date of execution of this Purchase Agreement. SELLER further covenants that as of the date of closing no persons, whether tenants or otherwise, will occupy the subject properties. d. SELLER agrees to refrain from encumbering the subject properties with leases of any length, either by way of new leases or the renewal or extension of existing leases, from thc date hereof until closing. e. SELLER agrees to refrain for collecting damage deposits covering the subject properties and further warrants that ail damage deposits have been reft.reded to tenants. SELLER agrees to hold harmless and indemnify the BIJYER from any claims for damage deposits ar/sing out of the subject properties. f. SELLER acknowledges that the warranties and representations made herein by SELLER a.re a material inducement to BUW'ER's entering into this Purchase Agreement and that BUW'ER is entitled to rely upon these warranties and representations despite independent investigation undertaken by BLrYER. Should SELLER have misrepresented any mater/al fact, or actively failed to disclose a material fact disclosed under this Section 7, then SELLER agrees to pay any and all costs of relocation arising out of the sale of the subject properties. g. SELLER acknowledges that BLrYER and SELLER will be employing the services of a title imqnmnce/closing company to facilitate the closing of this transaction. SELLER agrees to prompdy furnish said closing company with ail documents requested and further agrees that if said closing company should, by error, collect an amount of money insufficient to meet pa.voff obligations to ex/sting creditors, then SELLER will refund, within five (5) days of receiving oral or written notice, whatever amount necessary to satisfy the outsZ~nctlng obligations. 9. Possession. Fire Dama_*e. In the event of any damage prior to ctosing to the subject properties and improvements thereon or the personal property due to fire or other casualty, SELLER shall promptly notify BLrY'ER and BLrY'ER may, within 10 days after notification, elect to terminate this Purchase Agreement, in which event BLrYER's earnest money shall be returned forthwith, BUYER and SELLER shall be released from any further liability hereunder and this Purchase Agreement shall be null and void. If BUYER does not elect to terminate this Purchase Agreement, this Purchase Agreement shall remain in full force and effect and at closing SELLER shall assign to BLrYER all SELLER's fight, fide and interest in and to any insurance proceeds paid or payable for such damage, but the amount of assignment due from SELLER shall be limited to the purchase price as set forth herein. The city is completing the acquisition and removal of the former two-family residences that occu- pied this block. The city will provide a map of the redevelopment block which includes the location of existing n'ees and cun'ent platted lot lines. PROPOSAL CONTENT: The City requests each of the following items be provided, to enable, to the extent possible a fair assessment of a proposer's intent, and the ability to achieve the stated goals. A copy of recommended Design Guidelines are provided as further evidence and a description of the City's intent to determine the outcome of this redevelopment and to establish relatively high design stan- dards and expected end results. A verifiable statement of builder/developer's experience in markets comparable to the Sheffield Neighborhood. A list of properties by address including new home construction and/or refurbishing completed in the last five years. A list of new home construction by address within the last five years including sale price and names and phone numbers of the original and cun'ent owners. In addition the developer/builder will be required to provide cun'ent market and assessed values for each of the referenced homes, along with at lease one adjoining property for comparison purposes. -1- REQUEST FOR PROPOSALS (continued) A verifiable statement as to the builder/developer's longevity, range of residential market consn-uction experience and financial stability. The developer/builder will be required to provide a written statement as to his/her ability to construct within the parameters of the Sheffield Neighborhood Recom- mended Design Guidelines. o The developer/builder will be required to submit photographs of new home and/or refurbished home construction along with photographs of adjoining properties in order to assess the builder/developer's ability to design and construct homes consis- tent with the character and appearance of a specific neighborhood. The developer/builder will be required to submit a minimum ofttu'ee home floor and elevation plans representative of past work and/or plans considered appropriate for the Sheffield Neighborhood. o The developer/builder will be required to submit a written statement as to his/her approach in dete~Tnining the most appropriate floor plan and elevation consistent with the 4600 block of Fillmore/Pierce Avenues and to state estimated construction cost and market value of a proposed new home within the 4600 block of Fillmore/ Pierce; the propose is to establish a method for determining new house construction value within the target block. The developer/builder will be required to state his/her approach to marketing new homes and explain their specific marketing and sales strategies (paint-you-way-in for instance). The proposer is required to itemize various physical improvements he/she intends to provide including, but not limited to, braying overhead utilities, on and offsite screen- ing/tandscaping, street lighting, etc. The above items are requested as a means to determining whether a specific developer/ builder is willing, interested and capable of comprehending the subtleties of design, consta-ucting and marketing a new home within the neighborhood. The above referenced written statements, house plans, photographs and list of projects will provide a means of evaluating a builder/developer's experience, interest and abilities. CONTRACT ADMINISTRATION: Ultimately the selected builder/developer will contract for the acquisition of the property. An alternate for a single reduction differential would be specified (a double reduction differential is specified currently) to allow staff to evaluate the benefits vs. cost for a double reduction differential. The scale is very unreliable and, as a result, the City is paying more for postage than is necessary. The postage machine was purchased as a postage machine and "moistener" for envelopes. At the time this machine served its purpose but, at the present time, there is a need for an envelope sealer as well as a postage machine. The City is also experiencing increased maintenance costs due to the age of the machine. The 1994 budget contains $5,600 for the purchase of a postage machine and an elco:tronic scale in the Capital Equipment Replacement Fund. Quotes have been received from Friden Neopost and from Pitney Bowes. Staff has observed demonstrations of both machines. The quality and construction of the Pitney Bowes machine surpassed that of Friden Neopost. Pitney Bowes is also willing to provide one-year's free maintenance and a reduced meter rental rate for the first year. Long-term factors such as maintenance and supplies are less with Pitney Bowes. Staff is recommending purchase of the postage machine and electronic scale from Pitney Bowes based on the quality of their machine, the lower maintenance and supply cost, and the excellent service that has been experienced with the current machine. Although the initial cost of the Pitney Bowes machine at $5,696 is greater than that of the Friden Neopost machine, it is felt that in the long-term the Pitney Bowes machine will result in lower costs due to lower maintenance and supply costs. The setting of a date for the Truth in Taxation Hearing will be an action item on the September 12, 1994, council agenda. 5) SIDEWALK REMOVAL AT 4301 5TH STREET (EAST-WEST SIDEWALK ALONG 43RD AVENUE) A resident has recently questioned several staff (and may be bringing it up at Open Mike) as to why the sidewalk was removed from 4301 5th Street (east-west sidewalk along 43rd Avenue). The owner of the property at 4.301 5th Street had inquired of the City if it could be removed. The Public Works Division examined the property in question. Over 50% of the sidewalk was found to be hazardous. The half block of sidewalk was not part of a continuous section of sidewalk. There were no plans to add additional sidewalk on each side of it. The property owner agreed to pay removal costs. Myself, as well as several officers and sergeants, were involved visiting the neighborhood parties. The parties ranged from just a simple gathering to a full fledg~d picnic. This was our eighth year of participation, joining 8,900 communities nationwide with an estimated 27 million participants. The objective, as you know, is to develop relationships within the neighborhoods so residents feel more comfortable with police, as welt as each other. Police personnel presented the message of future policing in Columbia Heights whereby the neighborhoods will be served directly by sergeants who will be assigned specific portions of the city. The long range goals of these plans being development of community police partnerships, providing a liaison to the neighborhood, teaching probtem solving skills, and to provide conflict resolution strategies. In Columbia Heights we attended 35 parties, with a total participation of 709 residents. Casey, Director of Recreation RE: Closing of Silver Lake Beach DATE: August 16, 1994 Silver Lake Beach has historically operated from the day after the last day of school (June 10, 1994) to the first week in August (August 3, 1994). This timetable was set up prior to my arrival (1990) and has been followed ever since. Each January the summer schedule is set up, including the days of operation for Silver Lake Beach. Also the number of days of operation is budgeted to coincide with the estimated lifeguard hours for the season. Once the lifeguards are not on duty for the rest of the season, the buoys are removed. Staff feels the city is at a lesser risk if the beach doesn't have an appearance that a lifeguard could be on duty. MSC/jlm MEMO TO: Linda Magee FROM: Jean Kuehn RE: Weekly vs.Bi-weekly Recycling Option/Reporting Missed Pick-Ups DATE: August 18, 1994 The question was raised regarding the desirability of every-week collection of recycling and if there would be any cost savings by reducing collection to every other week or perhaps just twice each month. I discussed this possibility with representatives of BFI/Woodlake, and was given the following information. Columbia Heights is currently recycling an average of 260,000 lbs per month. This requires two trucks each day of the week, just for recyclables. The trucks have specific routes and are generally full when they leave the city. If recycling were to occur only every other week, it would require 4 trucks each day on those weeks. The number of man hours and the number of trucks would not be reduced. Therefore any cost savings would be minimal. Labor considerations would be very difficult, one week,. 4 drivers would be needed and the next week, none. In addition, the confusion for the resident and the necessary re-education of the residents would be time consuming and carry a cost of its own. Also, Anoka County is currently encouraging other cities to look at weekly collection for recyclables, since it is the cities with weekly collections that have the highest tonnages per person for recycling collection. Regarding missed collections, the contract states that the hauler is required to have sufficent staff to handle all reports, complaints and special orders Mon -Fri. 8 AM to 4 Pm and on Sat. from 8 - 10 AM. And they are to keep a log of all complaints etc, which we have access to at any time. While it had been the general practice for city staff to accept and relay complaints to the hauler, the previous City Manager felt it would be more effective and efficient for the residents to call the company directly. This is the policy staff had been following. Currently, when a residents calls the report is taken and relayed or if they wish they may call directly. To avoid delays in reporting, the voice mail does give the company's phone number and instructions for reporting misses so residents can be serviced during those times when staff is not available to accept the call.
