Proclamation - National Home Care Week Mayor Sturdevant read the proclamation designating November 27 to December 3, 1994 as National Home Care Week. Comments Regarding Property at 675 47th Avenue Neighbors in the area of 675 47th Avenue were in attendance at the ~ouncil Meeting to express their interest and/or concerns regarding the future of this property. Mar~ Gilbertson,. a spokesperson for the neighborhood, submitted a petition from area property owners, which addr'essed their support for having this property purchased and given to Habitat For Humanity for development. She advised the Council of the current poor condition of the property. She also mentioned the neighbors' opposition to having this property be sold and used for rental purposes. DisCussion followed regarding possible assistance available for the purchase of the property, demolition of the house and marketing strategies. Rublic Hearing - License Revocation for Rental Property at 3849 Jackson Street The Enforcement officer advised that the property owner occupies half of this double bungalow. He noted there is some progress being made to bring the units into compliance. He recommended that the revocation be held until next summer. Roll call: All ayes RESOLUTION NO. 94-75 RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF COLUMBIA HEIGHTS APPROVING REVOCATION PURSUANT TO ORDINANCE CODE SECTION 5A.408(1) OF THAT CERTAIN RESIDENTIAL RENTAL LICENSE HELD BY STUART S. MERZ (HEREAFTER "LICENSE HOLDER"). WHEREAS, license holder is the legal owner of the real property located at 4539 Fillmore Street N.E., Columbia Heights, Minnesota, and WHEREAS, pursuant to Columbia Heights Code Section 5.104(1)(A), written notice setting forth the causes and reasons for the proposed Council action contained herein was given the license holder on November 7, 1994, of a public hearing to be held on November 14, 1994. REGULAR COUNCIL MEETING NOVEMBER 14, 1994 PAGE 10 NOW,i THEREFORE, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights, the ICity Council of the City of Columbia Heights makes the ~T~ following: FINDINGS OF FACT 1. That on July 6, 1994, Enforcement officer, Matthew D. Fieid, for the City of Columbia Heights, inspected the real property and incidental buildings located thereon at 4539 Fillmore Street N.E. within the City of Columbia Heights, M~nnesota, and owned, according to the application for rental license on file for the above-described real property by Stuart S. Merz. 2. ~ased upon said inspection of the Enforcement Officer, the' following conditions and violations of the City's Housing Maintenance Code and Licensing Rental Units were found to exist, to wit. See Attached Compliance Order 3. That all parties, including the license holder and any occupants or tenants, have been given the appropriate notice of this hearing according to the provisions of the City Code Section 5A.306(1) and 5A.303(1)(d). CONCLUSIONS OF COUNCIL 1. That the building located at 4539 Fillmore Stre.et N.E..is in Violation of the provisions of the Columbia Heights City Code as set forth in the Compliance Order attached hereto; 2. That all relevant parties and parties in interest have been duly served notice of this hearing, and any other hearings relevant to the revocation or suspension of the license held by license holder. 3. :That all applicable rights and periods of appeal as relating to the license holder, owner, occupant, or tenant, as the' case may be, have expired, or such rights have been exercised and completed. The first issue was about election date changes. It was noted that Fridley and Hilltop have decided to hold their elections in even years. A tentative date of December 7th was selected for a joint meeting of the City Council and the School Board. Use of .City water Tower for Antennas: The City Manager received a request to place an antenna on the City's water tower. Truth In Taxation Hearing: Councilmember Nawrocki inquired what publicity this hearing has received. The city Manager responded it was highlighted in the City's September newsletter. A management agreement has been developed and approved by the HRA Board of Commissioners (November 15). That agreement covers the management of 4519-21 Taylor and 4642-44 Taylor. The approval of the agreement was subject to future approval of the "Management Plan" for both duplexes. As per the Management Agreement between the City of Columbia Heights (City and the Housing and Redevelopment Authority of Columbia Heights (HRA), the HRA will manage the occupancy, maintenance and tenant relations on the City- owned duplexes at 4642 Taylor and 4519 Taylor Street N.E. At the option of the HRA Board of Commissioners, the HRA staff will lease both of the units at 4642-44 Taylor and either one or both of the units at 4619-21 Taylor. Due to concerns about population density in the neighhor- hood, either one or both of the units at 4519 Taylor could be leased. Prior to lease up of 4519-21 Taylor Street, the units will have to be upgrad- ed to meet Rental Assistance Program Housing Quality Standards and minimums required for receiving the City Rental License. Cost are estimated at $5,000 per unit, plus approximately $3,000 of work on the exterior and yard (total estimated costs of approximately $13,000). On 4642-44 Taylor Street minor renovation costs of approximately $1,000 are expected upon move out of the Way to Grow House facility from the three bed- room upper portion of the duplex. The HRA will finance these renovations from reserve funds and then receive reimbursement (plus 6% interest) from the rent proceeds. HRA Commissioners will consider and approve any costs for renovations that exceed the Executive Director's $1,500 purchase limit. A family will be selected for the lower unit at 4642 Taylor to provide care- taking service for both 4642 Taylor and 4519 Taylor. There is a garage at 4642 Taylor in which is stored HRA owned lawn mower and trimmer. The duplex at 4519 Taylor does not have a garage. In return for maintaining the yards at both properties during the spring, summer and fall months, removal of snow at 4642 Taylor, coordinating of emergency repairs during non-HRA office hours on both properties, the caretaker would receive a $100 monthly reduction in rent. The Kiwanis have been very dedicated and extraordinarily dependable in this service. (Letter attached) Currently, they receive only the proceeds from the sale of the materials at the Center,and those proceeds have decreased as curbside service has increased. W/lile the Kiwanis support the community service aspect of this endeavor, they began the project with a dual purpose-- service and fundraising for their other community service projects. Decreasing proceeds make the effort less appealing for them, as they must then, do other fundraising projects to meet the needs of their program for Columbia Heights youth. For the past several years Columbia Heights has been unable to utilize all of the money available to the city because we did not have enough eligible expense to claim all of the allotted funds. Those funds were then redistributed to other Anoka County cities who subsidize their recycling programs and who made significant improvements at their Recycling Centers, and pay for the staffing of their Recycling Centers. If we hired an individual to staff the Recycling Center, the cost would be comparable to what the Kiwanis are requesting. In addition, we will most likely be asking the Kiwanis to take on additional responsibilities in view of the new State ban on oil filters in the regular trash as of Jan 1, 1995, and the mandate to recycle fluorescent bulbs as of August 1, 1994. It was originally intended by each of the clubs to look at this effort as a fundraiser for our youth activities in the community, along ~ith providing some civic club support to the City for a pro~ect they wanted to start. Over the years, the financial benefits of the Club's efforts have substantially been reduced and are at a present level where both clubs are having serious thoughts about looking for a ne~ project to meet their financi'al needs. We realize ~ith curb-side pick-up being implemented by the City a lot of our past volume has been reduced. However, the hours our members man the facility have stayed the same and the number of people still using the Center both on a personal and business basis seems to warrant the Center staying open. It is the two Kiwanis Club's desire to ~ork with the City management in continuing to keep the Center open if it is felt this service is needed. However, each club needs to be assured of a financial benefit adequate to help fund youth activities in our community. An example is our annual "Youth Leadership Conference", held for four days in the summer for our local high school students moving into leadership roles in the coming school year. The cost alone on this event has run around $9,000, which Kiwanis arranges to fund. We would like to suggest the City consider paying each club $1,000.00 annually, plus continue to pay the clubs the percentage on volume ~t the Center as it has done in the past. The clubs would continue to man the Center for the City in ~ professional manner ~nd receive enough income to support youth activities in our community. Lessor shall permit Tenant to use the basketball baskets now in place on the premises. Lessor shall provide routine maintenance and cleaning services for the gymnasiums. 5. Tenant's Equipment Responsibilities Tenant shall provide all equipment of every kind needed for its use of the gymnasium except for those items for which lessor is responsible pursuant to paragraph 4 above. 6. Supervisor Tenant covenants that it will provide adequate adult supervision of all activities at all times it is leasing the leased premises. 7. Tenant's Responsibility_ for Damage Tenants shall be responsible for the costs of repair of any damages occurring to the gymnasiums and lockers during its leasing of the same, excepting normal wear and tear. Tenant shall promptly notify Lessor of any damage that occurs during Tenant's use of the leased premises. Lessor shall promptly notify Tenant of any damage which Lessor observes and which occurred during the use of the leased premises by Tenant. Lessor shall repair such damage and bill the cost of said repair to Tenant, who shall promptly pay the same. Tenant further covenants and agrees not to waste or misuse water, electricity, or any other utility which is or may be furnished by Lessor. 8. Compliance with Laws Tenant covenants that it will not use said leased premises or permit the same or any part thereof to be used for any purpose or in any way contrary to the laws, ordinances, or regulations of the United States of America, the State of Minnesota, or the City of Columbia Heights, or of any boards or officers of said city. 9. Condition of Premises Tenant acknowledges the receipt of the demised premises and the same to be in good and sanitary condition, and in good repair, and the taking of possession of the demised premises by the Tenant shall be conclusive evidence that the demised premises and all equipment, plumbing fixtures, and other items appurtenant thereto, were in good clean and tenantable condition and in all respects were satisfactory and acceptable to Tenant, at the time Tenant took possession of the lease premises. 10. Subleasing Tenant agrees not to sublease the demised premises, or any part thereof, or assign this lease or any interest therein, or permit any such lease to become transferred by operation of law or otherwise, and Tenant agrees that no act or acts will be done or permitted whereby the same may be or become sublet or assigned in whole or in part, unless the written consent of the Lessor endorsed thereon is first obtained in each and every case of subletting or assignment. The Lessor shall have sole and absolute discretion to refuse or approve any particular subletting or assignment. 11. Liability of Lessor and Tenant Tenant agrees that the Lessors shall not be liable for any damage, either to persons or to property or the loss of property sustained by the Tenant or by any other person, arising out of the state of repair of or a defect in the leased premises, or due to any accident, or due to the actions or negligence of the Tenant. Tenant covenants that it will purchase at its own expense general liability insurance in the amount of at least $200,000.00 per person and $600,000.00 per occurrence, which insurance will cover any person or persons in or on or using the eased premises during the time the leased premises are used by Tenant. Said policy shall name NEI College of Technology as an additional insured under said policy. A copy of said policy containing the endorsement will be provided to NEI College of Technology prior to the commencement of Tenant's use of the lease premises. 12. Fire It is further agreed between Lessor and the Tenant that if during the term of the lease the leased premises shall be damaged or destroyed by fke or the elements, or through any other cause, so as to render the leased premises unfit for Tenant's use of the leased premises as stated herein, or to such an extent that the premises cannot be repaired with reasonable diligence within thirty days from the occurrence of such damage, then the Lessor may terminate this lease and the Tenant shall immediately surrender the demised premises and all interest therein to the Lessor. If, however, the leased premises is not rendered unfit for use by the Tenant for its activities as a result of said damages, then the Lessor shall repair the same with reasonable promptness. 14. Quiet Enjoyment The lessor agrees and covenants that the Tenant shall and may peaceably and quietly have, hold and enjoy said leased premises for the term of this lease as set forth herein. 15. Right of reentry Lessor and Tenant agree that this lease is made upon the condition that if the Tenant shall neglect or fail to keep, observe, and perform any of the covenants and agreements contained in this lease which it is obligated to keep, observe, or perform, or if the leasehold interest of the Tenant shall be taken on execution or other process of law, or if the Tenant shall cease to exist as a legal entity, or if the Tenant shall vacate said premises or abandon the same during the term of this lease, then and in any of said cases the Lessor may at its election, and upon written notice to the Tenant, declare this lease forfeited and void, and may thereupon reenter and take full and absolute possession of said premises as the owner thereof, free from any right or claim of the Tenant or any person or persons claiming through or under the Tenant; and such reentry shah be and constitute an absolute bar to any right by the Tenant. 16. Access to Premises Tenant shall have access to the premises at all hours necessary for it to carry on its occupancy thereof. The Lessor shall designate the entrances, stairways, and halls of the building in which the leases premises are located which Tenant shah use in entering and leaving the leased premises. The use of such entrances, stairways, and halls shall not be exclusive, nor shall it be unreasonable in nature. 4 17. Right of Inspection The Lessor shall at all times have the right to enter upon the leases premises to inspect their condition and, at its election, to make reasonable necessary repairs thereon for the protection and preservation thereof. 18. Rent As and for rent for the premises, Tenant shall pay to Lessor the sum of $1.00 on or before July 1. 19. Use of Gymnasiums After May 31, 1995. This lease terminates unconditionally and absolutely as of the end of May 31, 1995. However, Lessor expresses its willingness to negotiate with Tenant upon the termination of this lease, for a new lease of the premises for the period from September 1, 1995 to May 31, 1996. The attached cash flow schedule prepared by Publicorp, Inc. reveals that $400,000 of tax increment can be collected through the year 2009. The schedule assumes a variety of issues that will need to be resolved during the approval process. Please note under the new tax increment laws, the City will be subject to a $30,705 LGA/HACA penalty. This is the total amount of the penalty during the life of the tax increment district. The penalty can be offset with a 10% administrative charge against the tax increments. City staff will be meeting with Publicorp officials in the very near future to research the possibility of approving the plan with the provision that it accommodates special legislation to waive the LGA/HACA penalty. Last year, special legislation of this nature was approved for Brooklyn Park and Brooklyn Center. Another feature of the TIF Plan (still under research) could include provisions for a scattered site tax increment program. Under this concept, properties would be identified throughout the City and could be eligible for voluntary acquisition over a five year period through the Community Development Block Grant Program. Richfield is using a similar process to acquire and redevelop substandard properties. As these properties are acquired, demolished, and resold for private construction, the tax increment would be accumulated on the property. The tax increment dollars from the new structure would go back into a revolving pool to recapture the CDBG investment and utilize it for further housing needs. Further details will be developed on this concept as details of the TIF plan are finalized. BE IT RESOLVED BY THE BOARD OF COMMISSIONERS (the "Board") OF THE HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA (the "Authority") AS FOLLOWS: WHEREAS, the Authority proposes to establish the Sheffield Tax Increment Financing District pursuant to and in accordance with Minnesota Statutes, Sections 469.001 through 469.047 and Minnesota Statutes 469.174 to 469.179, inclusive, as amended; NOW, THEREFORE, be it resolved by the Board of Commissioners of the Housing and Redevelopment Authority of the City of Columbia Heights, Minnesota as follows: The Authority hereby requests that the City council call for a public hearing on January 23, 1995, to consider the proposed establishment of the Sheffield Tax Increment Financing District, and to cause notice of said public hearing to be given as required by law. The Authority directs the Executive Director to transmit copies of the Tax Increment Financing Plan for the Sheffield Tax Increment Financing District (the "Plan") to the Planning Commission of the City and requests the Planning Commis- sioner's written opinion indicating whether the proposed adoption of the Tax Increment Financing Plan is in accordance with the Comprehensive Plan of the city, prior to the date of the public hearing to be called by the Council. The Executive Director of the Authority is hereby directed to submit a copy of the Plan to the Council for its approval. The Authority directs the Executive Director to transmit the Plan to the school district in which the Sheffield Tax Increment Financing District is located and to the County and the County Commissioner in whose district the District is located not later than 30 days prior to the public hearing. The purpose of the agreement is to clear up facility reservation procedures and policies, and to more efficiently utilize each other's space for programming needs. Attached please find a copy of the letter to be sent to Dr. Holt on this issue. 3) LEAGUE OF MINNESOTA LEGISLATIVE POLICY MEETING Enclosed within your packets were a series of handouts prepared by the League of Minnesota Cities concerning property taxes and governmental financing. Hopefully, these handouts will be beneficial in understanding the financing and property tax structure of City, County, School District, and State Government. When the final draft of the League of Minnesota Cities policy priorities for the next legislative session become available, I will forward report to the City Council. 4) MEETING WITH AREA LEGISLATORS As the beginning of 1995 Legislative Session nears, I suggest the City set up a meeting with the area legislators. Besides emphasizing the policy issues of the League of Minnesota Cities, Association of Metropolitan Municipalities, and the North Metro Mayors Association, I believe we should address a couple of local issues including the LGA/HACA penalty on the Sheffield Project and the funding level of the Volunteer Fire Relief Association. It appears that the funding level and structure of Local Government Aid will be a key issue in this year's legislative session. As you are aware, a substantial cutback or restructuring will have a severe impact on Columbia Heights. The budget forecast will be released in December, and may serve to set the tone for the LGA discussions. 5) 675 N.E. 47TH AVENUE Attached please find an inspection report conducted by the Fire Department and the Building Inspector concerning the condition and compliance of the property with the minimum housing standards. A copy of this report will be filed with the realtor and property owner. 6) RIGHT-OF-WAY RELATED DISPUTES AND ISSUES Attached please find a memorandum from the Public Works Department concerning problems concerning the maintenance and use of public right of ways, including: Private irrigation systems in the boulevard Contractors' washing/cleaning out their equipment in the street Maintenance of boulevards Maintenance o~ sidewalks It is my intent to schedule discussion of this item at a future work session. November 23, 1994 City Manager's Report for November 28, 1994 Page 2 7) SUMMARY/ABBREVIATED MINUTES City staff is Currently preparing a couple of examples of abbreviated or summary minutes that can be published in the paper. The objective to this would be two-fold: 1) the overall size of the minutes by publishing only a summary version of resolutions and ordinances in the context of the minutes; and 2) the old system of posting first or second readings of ordinances would be reintroduced, as opposed to publishing each and every copy. As an added measure, we will also consider using the character generator on cable TV to announce and highlight ordinance changes, public hearings, and hearings. A full report on this change will be filed with the Council in the next few weeks. 8) SHEFFIELD OFF-BLOCK DUPLEX STATUS As you are aware, the City is in the process of leasing one duplex at 4519 Taylor Street and the Way to Grow House in the very near future. This leaves one duplex on the 4500 block of Taylor Street and the 4500 block of Fillmore Street. Otting House Movers has expressed their interest to remove the outlying duplexes for $1 each. One of the original lottery home perspective purchasers has indicated their interest to pursue a purchase in the Sheffield neighborhood. The perspective purchaser has qnalified for'the first-time home buyer mortgage. As you recall, First Choice Homes proposed a program whereby the foundations of the off-block duplexes could be utilized for a starter home. City staff will be meeting with the perspective home buyer and First Choice Homes to finalize a proposal. I will keep the Council apprised of any progress. 9) TELEPHONE CHANGES I have directed a number of changes in the phone answering system at City Hall. First, a number of published phone numbers that do not go through central switchboard seem to go unanswered during non-office hours. I've been here on weekends, evenings, and holidays when the phones to these departments ring regularly, I presume, because citizens are calling for example about a building permit, r ' i . ecychng, etc~.N, ow all these pubhshed phone numbers will be forwarded to a voice mailbox that will indicate City tiall office hours o_.~r forwarded to their own voice mail that provides an opportunity to leave a message. The central switchboard number is switched each evening to a voice mail message. Another change involves persons that are put on hold when calling the central number. Currently, if a person calls, the central number and asks for a line that happens to be busy, the receptionist will indicate that the line is busy, and will ask if the person wants to hold. If so, the person is put on hold for a total of three minutes. After three minutes is up, the phone will automatically ring back to the receptionist a~ a prompt to ask if the person wishes to continue to hold. Three minutes was established by the phone Company, as the average length of time of a business call. Now, we will change the ring back prompt t° approximately 90 seconds. Currently when ISD #13 requests the use of Murzyn Hall or any city park, their request is forwarded to the Park and Recreation Commission and responded back to in a maximum of thirty (30) days. It is safe to say that in a majority of the requests, the Commission gives the Director the flexibility to work out the details between the city and the person making the request. The Commission and staff feel that there is not equity in the response back to the requester between the city and ISD #13. In order for the city to professionally deliver quality programs the Recreation Department needs to secure dates and times and offer the programs accordingly. The structure has a basement under the main portion of the house, however, the addition to the kitchen lacks proper footings. The s~ructure has only 624 square feet and is, therefore, non-conforming as to required minimum size. Construction methods and materials used were substandard to begin with and a general deterioration is evident throughout: corners missing from siding, windows generally in PoOr condition; old double hung missing caulk, some don't stay open; one window has broke~ glass, window in south and north walls of kitchen addition have crooked frames due to foundation sag (no frost footings). Roof cave/edge trim loose in some areas, roof appears to have been leaking, needs checking (no ladder). Storm. door to kitchen in poor condition, entry doorway to kitchen has no interior trim. Front, side and rear yard has many volunteer trees, weeds, long grass. No garage. Small shed in rear yard with a pile of junk beside it. Basement stair has nine (9) inch risers, open both sides and no handrail. An old oil tank is still in the basement. Strong fuel oll smell is noticeable upon entering house. Basement floor is rough in some places, no evidence of water problems. Floor system is comprised of columns, beams and joists. Joists are true 2x6, 24 inches on center. Beams and joists have been notched and cut in several areas.. Minor deflection is noted. No smoke detector in basement. Open sewer pipe under unconnected laundry tub. Unplugged gas line (for diyer?). Strainer is off one floor drain. Bathroom is small.. Toilet rank is not mounted flush with bowl. It tilts to one side. Toilet is loose. Ball cocl~lush tank is not installed according to Plumbing Code Mn. rules 4715.2150(subp 2). No shut-offs on water lines. Improper fittings used on drain/waste from tub. Window was in poor condition. Piece of trim was missing from window assembly. Plastic water lines were used as connectors to fixtures (not approved), no shut offs to fixtures. Bedroom (n.c. rear): slope ceiling, trim loose at ceiling, recessed fixture in ceiling with no cover. Bedroom (n.w. rear): electrical outlets test (open-hot) window in poor condition, gaps in framing, floor slants. Electrical: new reset panel 50 amp, no permit, no inspection; mixed wiring throughout, some Greenfield, mostly Romex #14 wire. Water heater: relief valve discharge must be piped full size and run to within 18 inches of floor (Mn. rules 4715.2210 Subp. 4), improper water line connector, no shut-off valve on supply line. Improper (flex) gas line to water heater, no drip tee. Heating and gas piping: old furnace, rusty, owner says it was serviced by Minnegasco in the Spring of 1994. No tag or inspection sticker, sticker on furnace was dated 1981, service/inspection. Fuel oil tank still in corner of basement, heavy fuel oil smell upon entering structure. Contents unknown. Old solar panel on front exterior wall (south) and extractor with fan (disconnected) in basement, receptor on front wall is in poor condition. Kitchen: broken receptical (electric) by counter, window over sink does not stay open and does not shut tight, flex gas line on stove, no shut off within three feet, shut off below floor, improper trap on kitchen sink. The subject property does not pose an immediate danger although hazardous elements exist on the property. In summary, it is substandard and deteriorated to the point of being economically impractical for rehabiltation. Its size and age preclude achieving total code compliance. MF:cf 94-205 Note: For November 28th Council Meeting TO: FROM: SUBJECT: DATE: CITY OF COLUMBIA HEIGHTS Public Works Department PAT HENTGES CITY MANAGER MARK WINSON PUBLIC WO~S DI~O~CITY ENG~ER VARIOUS RIGHT-OF-WAY RELATED ITEMS NOVEMBER 22, 1994 The Public Works staff has surveyed several neighboring communities to determine how they handle the following right-of-way related items: Private irrigation systems in the boulevard Contractors washing/cleaning out their equipment in the street Maintenance of the boulevard Maintenance of sidewalks The survey was done as staff was looking for ways to handle these types of problems, some of which are not directly covered by existing ordinances or in the City Code. Private irrigation systems in the boulevard. This issue is a problem when the City or contractors are doing work within the right-of-way. As these systems are not covered by the Gopher State One-Call systems and many property owners do not know the exact location of their system, they are often damaged especially when curb and gutter and/or sidewalk is replaced. A majority of the neighboring cities allow private irrigation systems in the boulevard, with a few requiring that the property owner maintain and repair any damage. Staff would like to see either the banning of private irrigation system piping in the boulevard or if allowed, the permit to install specifically outline that the property owner be responsible for repair if the system is damaged, even if the damage is caused by street maintenance or reconstruction. Contractors washing/cleaning their equipment in the street. Many neighboring cities actively enforce an ordinance prohibiting contractors, especially concrete and plaster contractors, from washing out their equipment into the street and storm sewers. Staff originally was looking to toward a specific ordinance prohibiting this activity. Instead we will use State Statute 609.68, (attached) when this activity is observed. Recent questions by property owners regarding the property owners responsibility to maintain the boulevard and sidewalks adjacent their property have lead staff to discover that these responsibilities are not directly addressed in the City Code. In order to clarify these issues and continue the existing City policies staff is recommending that Section 5A.207 of the City Code be modified as indicated on the attached draft. The modification would then allow staff to apply the weed ordinance to the boulevard area and clarifies that the property owner is responsible for the repair of the adjacent sidewalk. Staff requests that these issues be placed on an upcoming Council Work Session agenda in order to receive direction from the council on how to proceed. (a) Definitions. For the purposes of this Section, the following terms shall have the meaning stated: (I) Fence. Any partition, structure, wall, or gate erected as a divider marker, barrier, or enclosure, and located along the boundary or within the required yard. (II) Landscape, Site amenities, including trees, shrubs, ground covers, flowers, fencing, berms, retaining walls, and other outdoor finishings. (III) Mechanical Equipment. Heating, ventilation, exhaust, air conditioning, and communication units integral to and located on top, beside, or adjacent to a building. (tV) Retaining Wall. A wall or structure constructed of stone, concrete, wood, or other materials, used to retain soil, as a lope transition, or edge of a planting area. (V) Screening. A barrier which blocks all views from public roads and differing land uses to off-street parking areas, loading areas, service and utility areas, and mechanical equipment. (b) Every yard of any premises on which a dwelling or dwelling unit is located shall have installed and maintained landscaping in accordance with the provisions of this section: (I) Sodding and Ground Cover. All exposed ground area surrounding the principle building and accessory buildings, which are not devoted to driveways, parking areas, sidewalks, or patios, shall be sodded or landscaped with shrubs, trees, gardens, or other ornamental landscape material. No landscaped area shall be used for the parking of vehicles or storage or display of materials, supplies or merchandise. (ii) Slopes and Berms. Final grades with a slope ratio of greater than three (3) to one (1) will not be permitted without special approved treatment such as special seed mixtures or reforestation, terracing, or retaining walls. Berming used to provide required screening of parking lots and other open areas shall not have slopes in excess of three (3) to one (1). (III) Maintenance. Any dead trees, shrubs, ground covers, and sodding shall be replaced in accordance with this code. landscaped areas, including the adjacent boulevard, shall be maintained in a healthy, safe and nuisance-free condition by the property owner. Ail loading, service utility, mechanical equipment, and outdoor storage areas for dwelling of three (3) or more units shall be screened from all public roads and adjacent differing land uses. All parking lots for dwellings of three (3) or more 'units if the property on which the lot is located abuts a differing land use and is not separated from the differing land use by a pUblic street, roadway or alley shall be screened from d]acent, differing land uses. Screening shall consist of any combinat!ion of the earth mounds, walls, fences, shrubs, compact evergreeln trees, or dense deciduous hedge six (6) feet in heights. Hedge materials must be at least three (3) feet in heights, and trees must be at least six (60 feet in height at planting. IThe heights !and depth of the screening shall be consistent with the height and size of the area for which screening is required. When natural materials, such as trees or hedge, s are used to meet the screeninlg requirements of this sub-section, density and species of planting, shall be such to achieve seventy-five percent (75%) opacity Year round. Rapid Graphics printed over 8,000 brochures addressed to "carrier route pre-sort, current resident." The brochures were mailed 3rd class bulk rate Rapid Graphics counted out the number of addresses per route and delivers it to the Minneapolis Post Office on October 19, 1994. I contacted the Columbia Heights Post Office for a map of the Columbia Heights routes, but they were not allowed to give that out. I was then directed to the downtown Minneapolis main office. The main office did not have a map, but gave me the "Carrier Route Information Report." Ail the Columbia Heights routes are on pages 615 through 620. On page 618, Polk Place is listed on route ~13. Rapid Graphics were then contacted and confirmed that 125 brochures were counted out for route ~13. Tom Peterson, manager of the Columbia Heights Post Office, confirmed with the mail carrier of route ~13 that all 125 brochures were delivered to residents of route ~13 on October 20, 1994.
