Location of Meeting: COUNCIL CHAMBERS Purpose of Meeting: SPECIAL COUNCIL MEETING AGENDA 1) 2) Roll Call Ordinance No. ., Being an' Ordinance Amending Ordi- nance 853, City Code of 1977, Chapter 9, Land Use Zoning, to Include Small Engine Repair, Salzs and Service and Other Similar Uses as a Permitted Use Within the "CBD" Business District on first reading. 3) RECOMMENDED MOTION: Move to waive the reading of the ordinance, there being ample copies available for the public. As background, the current zoning ordinance and its various districts are very specific in the description of uses that are permitted or conditionally permitted within the various zoning districts. Typically, ordinances are more generalizedinwhat is permitted within each zoning district, (in other words, identifying general descriptions for similar uses) and then more specific on listing uses that require conditional use permits. In comparing the current list of uses in the ordinance to the use now in place, many uses within the Central Business District would either be not permitted or would be considered currently non-conforming. The City has received a request by A & C Small Engines now located at 3638 Central Avenue, Minneapolis, to relocate their business to 3816 Central Avenue. The property was recently the location of cabinet/countertop business (which was also not permitted) and in the past was site of the Honda dealership (which was non-conforming). Additionally, the 4000 block of Central Avenue also is the location of a chain saw sales and service business (that is non- conforming). In order to facilitate the move, I have set up a special meeting to commence after the Cable Commission meeting on Thursday, October 20, at approximately 9 P.M. At that meeting, a first reading of the ordinance will be presented amending the permitted uses within the Central Business District to include small engine repair, sales and service, and other similar uses. It is recommended that a second reading of the ordinance be established for the regular Council meeting of October 24, 1994. In a larger sense, the Planning and Zoning Commission should be requested to review the appropriateness of all of the uses within the various zoning districts. It is hoped that the Commission can come up with language that will facilitate many of the various commercial and industrial requests that we receive on a regular basis, yet be discriminating through the conditional use permit process, to those uses that should fall under the special review of a conditional use permit. BEING AN ORDINANCE AMENDING ORDINANCE 853, CITY CODE OF 1977, CHAPTER 9, LAND USE ZONING TO INCLUDE SMALL ENGINE REPAIR, SALES AND SERVICES AND OTHER SIMILAR USES AS A PERMITTED USE WITHIN THE 'CBD' BUSINESS DISTRICT The City of Columbia Heights does ordain: SF_.CTION 1: An amendment to Section 9.112(1) of the Land Use Zoning Ordinance adding the following: (qqq) Small engine repair, sales and service, or similar uses, provided there is no exterior storage of parts or equipment outside of the principal building. S~CTION 2: This ordinance shall be in full force and effect from and after thirty (30) days after its passage.
