WHEREAS. the position of City Manger will become vacant on April 1. 1993. due to the retirement of Stuart W. Anderson, and, WHEREAS, the City Council has, with the assistance of a consultant, conducted an extensive search for candidates for City Manager, and, WHEREAS, after a thorough process to select a finalist from among · group endorsed by the consultant, tho Council has selected Patrick L. Hentges, and, WHEREAS, discussions with Patrick L Hentgas have provided mutually acceptable terms and conditions of employment; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Columbia Heights does hereby appoint Patrick L. Hentgas, City Manager of the City of Columbia Heights, effective April 1, 1993; and, City Manager Designate no earlier than March 8, 1993 nor later than March 22, 1993, under the following terms and conditions of employment: 1. The City Manager shall be compensated at the annual rate of $72,000. Upon completion of six months employment, the City Council will provide a performance evaluation and once again upon completion of twelve months of employment. Subject to satisfactory review, the Council may adjust the base salary pins may grant perform·ncc merit pay. 2. The City Man·gar shall receive a car allowance of $250 per month. 3. The City Manger shall earn vacation, holidays and deferred compensation as is authorized for other non- union essential and confidential employees. 4. The City Manager shall receive S260 a month for 1993 for use of insurance benefits and deferred compensation as is authorized for aH other non-union essential and confidential employees. 5. The City Mangar shall be granted an immediate thirty day bank of sick leave. The City Manger shall earn one day per month of sick leave against this bank and will not accumulate an excess of thirty days until the entire initial bank has been returned. The City Manager may draw against that sick leave beak. 6. The City Manger is authorized, subject to budget and Council approval, reasonable expenses for professional development in the area of dues and subscriptions, attendance at conferences and seminars, etc. These items include the International City Management Association, the Minnesota City/County Management Association, Metropolitan Area Management Association, and the League of Minnesota Cities. 7. The City shall pay up to S2,000 for expenses incurred by the City Manger in connection with relocation of his residence from Faribault, Minnesota, to Columbia Heights, Minnesota. g. In the event that the City Man·gar is discharged without cause, he shah receive thirty dayS' advance notice and severance pay based on the following schedule: a. Within the first year of employment, five months; b. Within the second year of employment, four months; c. Donald ~lurzyn, Jr., M~o~ ~/ CITY OF COLUMBIA HEIGHTS TO: MAYOR AND CITY COUNCIL FROM: PAT HENTGES, CITY MANAGER DATE: MARCH 9, 1994 RE: IN HOUSE LEGAL STAFF SERVICES Pursuant to our last discussions on legal services, this memorandum explores a combination in-house legal system for general legal representation and contractual city prosecution services. As was examined previously, in-house city prosecution of misdemeanors and gross misdemeanors demands a staff of at least two attorneys and a paralegal. The basis for this staffing level is more a product of scheduling conflicts with court appearances, than the work load. With the addition of a clerical position, it is possible for the city to accomodate in-house for both prosecution and general legal representation activities at the expenditure level currently budgeted for outside contract services. However, the expertise of legal staff may require from time to time that the city contract with outside firms in law areas involving human rights litigation, employment law, real estate/economic development, or specialized litigation. Accordingly, you requested that I prepare the information on organizing an in-house staff to handle only the general legal representation activities. The in-house staff may also have some responsibility to oversee or assist in the administration of a contract with a private firm handling the city prosecution activity. Of the four cities contacted (Minnetonka, Coon Rapids, Shakopee, and West St. Paul), only West St. Paul has a combination in-house city attorney/contract prosecuting firm. West St. Paul's city attorney was a former private practice attorney who in the later years of his practice developed a full time arrangment with the city. That arrangement will expire or be terminated in the near future. The City will determine if they continue in-house or begin contracting for general legal services. In reviewing the typical staffing requirements of the four cities, the attorney with the higher competency or managed attorney handles the general legal work of the city, and the lower level associate concentrates on the prosecution activities. Thus, we could expect to pay over $60,000 to employ and retain a comparable lead attorney and between $30,000 and $45,000 for an associate attorney with entry level to two years experience. In preparing a preliminary budget for in-house general legal representation, I assume hiring one attorney with a minimum competency level of two years experience and a 3/4 time legal secretary. I assumed starting the City Attorney at approximately $45,000 per year, but I suspect that we may pay between $50,000 and $60,000 to retain competent legal representation. The proposed annual budget for in-house general legal services is as follows. BUDGET FT- City Attorney $45,000. Fringe Benefits $11,500. 3/4 T- Legal $18,710. Fringe Benefits $ 4,680. $79,900. Start up costs for desks, computers, legal software, and a basic legal library would be approximately $18,000. Currently the City does not have adequate office to house a legal department, but the court office area would be available towards the end of December, 1995. This person is an assistant to the City Attorney with responsibility for the prosecution of criminal misdemeanor charges within the City; to advise and direct the City departments and contract cities with enforcement duties as to the legality of their actions and prepare leqal opinions; and to answer questions from the public concerning ordinances and state laws. JOB DUTIES: Assistant City Attorney 1. Prosecutes criminal misdemeanor charges: Reviews all criminal complaints made to the police or City Attorney's office by citizens and, criminal complaints demanded by defendants as a result of charges, determining in which cases complaints should be issued and for what charges. b.
