WINSON /~4 ~ PUBLIC WORKS DIRECTOR/CITY ENGINEER PUBLIC HEARING - MARCH 21, 1994 PROJECT g0401 - SOUTHWEST QUADRANT SEALCOAT PROJECT #9103 - LABELLE EAST BANK EROSION CONTROL MARCH 18, 1994 Sealcoat Per the Council's recent decision, engineering and administration costs are not included in the assessable costs for the project. The engineering and administration costs are shown in the breakdown for reference only. Applicable engineering costs will be charged to the MSAS and City of Fridley portions of the project. The estimated cost for curb and gutter repair and :3urface repair are higher than last year's project due to the greater age and relatively poorer condition of the streets in the Southwest Quadrant as compared to the streets in the Northwest Quadrant. o City crews will be skin patching before sealcoating that portion of the University Avenue Service Road where there have been complaints regarding vibration due to bus and truck traffic. The problem is due to previous repairs to transverse cracks that have left ridges in the street. The combination of a thin skin patch and the sealcoat should smooth the surface enough to greatly reduce the problem. There is an indication that residents along 43rd Avenue from Quincy St. to Central Avenue will be requesting that the street not be sealcoated as it was overlayed in 1990. Staff is recommending that it be sealcoated in 1994 as under current City practices, it if is not sealcoated now, it would not be done until 2000. Staff feels that 8 years should be the maximum time between sealcoats. Memorandum to Patrick Hentges March 18, 1994 Page 2 LaBelle The Minnesota National Guard has sent our request for assistance on this project to three companies for review. Their response is not expected before April 25, 1994. It was indicated that if they were to assist, it would probably be in the areas of clearing and grubbing and removal of existing retaining walls. Based on the Engineer's Estimate, the Guard's assistance could reduce the project cost to $188,100 and reduce the assessment to $1,680.99. o The City has received commitments for grants from the Anoka Soil & Water Conservation District for 1992 and 1993 of appro:dmately $30,000 each. If the City does not begin work on this project before July 1, 1994, the 1992 grant will be lost. Work would include selective concrete curb and gutter replacement, bituminous surface patching and sealcoat application. Estimated total project cost $371,419.10 Proposed assessment period of 1 year. P.I.R. 898 - Municipal Proiect 9103 - LaBelle Park East Bank Erosion Control Installation of erosion control materials on the east bank of LaBelle Park from 1207 to 1337 Circle Terrace Blvd. Work would include clearing of underbrush and selective cutting of trees, seeding with low maintenance shade- tolerant vegetation, and installing an erosion control blanket. Estimated total project cost $270,308.71 Proposed assessment period of 10 years. Auxiliary aids for handicapped persons are available upon request when the request is made at least 96 hours in advance. NOW, THEREFORE, IT IS HEREBY RESOLVED: 1. That the City Nanager shall proceed with taking of bids for the improvements, or portions of the improvements as stated herein. These improvements shall also be known as P.I.R. t889 - Project 9401. If the cost, after receiving the bids, exceeds 10l of the estimate, the public hearing will be reopened. Sealcoating consists of spraying an asphalt emulsion on the street and immediately covering the emulsion with small rock (pea gravel). The rock is pushed into the emulsion with rollers. The emulsion acts like a glue between the street surface and the rock. The excess rock is swept up within two weeks. The finished thickness of the sealcoat is about ~" Prior to sealcoating, City crews will repair major cracks and potholes. Why sealcoat? Sealcoating provides a protective surface for the street. Sunlight and summer heat "dry" out the surface of bituminous street, leading to the failure of the pavement over time. The asphalt emulsion helps to keep the original surface in good shape. The rock provides a rougher surface to improve traction. Sealcoats provide little structural[ strength to the pavement, yet timely sealcoating can double the useful life of a street. It is generally recognized that streets and roads should be sealcoated every 6 to 8 years in our climate. The City of Columbia Heights' policy is to sealcoat every 6 years. When will sealcoating be done? Sealcoating is usually done between July 15 and August 15. The actual procedure generally takes about one week for the area proposed. Signs would be posted the day before a particular street is sealcoated as a reminder not to park on the sm:et the next day. Streets will be closed temporarily (less than 1 hour) during the sealcoating operation. CITY OF COLUMBIA HEIGHTS GENERAL ASSESSMENT POLICY SYNOPSIS SEALCOATING CHARGES ARE ARRIVED AT THIS WAY-- Front Footage Formula Street feet = full cost per foot plus Avenue feet = 1/3 cost per foot All property within an assessment sealcoat project boundaries are subject to both a street and avenue charge based on front footage. The street in front of the property is at the full rate (street feet) and at a one third rate for their nearest side street (avenue feet). Or, in the case of a coroer property the short side will be considered the frontage at full rate and the long side plus the frontage minus 40 feet will be at the one third rate. Diagram will be presented on the overhead screen. Adiustment for Irregular Conditions Adjusted front footage is used for odd or irregular shaped lots. The City's policy is to give the property owner the benefit of footage that would result in the least assessment cost to them. The adjusted footage may be arrived at by taking the square footage of the parcel and dividing it by 130 feet, or by averaging front and rear. A parcel with a street on both its back and front is assessed for the street in back at the avenue rate (1/3 rate). State/County Aid Roads Streets that are state or county aid are not charged to the property owner as long as aid funds are available. Terms/Conditions of Payment: Sea/coat of streets is a one year levy. The levy heating usually takes place the later part of November. Payment of the assessment may be paid in part or in full without interest for 30 days following the levy hearing. Any unpaid amount at the end of the 30 days will have interest added (currently. 9.5%) with payment due by September 15th the next year. After September 15th any unpaid amount becomes delinquent and a 10% penalty is added. This unpaid amount plus penalty is certified to the real estate taxes payable the following year. Columbia Heights, MN 55421 Subject: Proposed Sealcoat Project Dear Mr. Fury: The City Manager has asked me to respond to your recent letter regarding the proposed 1994 Sealcoat Project #9401. If the project is approved by the City Council, University Avenue Service Rd. will be patched and sealcoated. Sealcoating pre,rides a protective surface for the road. The preparation work involves patching any potholes and wide cracks with blacktop. Sealcoating consists of spraying an asphalt emulsion on the road and immediately covering the emulsion with small rock (pea gravel). The rock is pushed into the emulsion with rollers. The emulsion acts like a glue between the road surface and the rock. The finished thickness of the sealcoat is about ~4". This will be like the work done last year on 51st Avenue between University Avenue Service Rd. and Washington Street. The work done on 51st Avenue between Washington Street and Central Avenue was an overlay. This consists of spot patching the road and then paving over the entire surface with 2" of blacktop. The only changes made to these projections were in the projected 1993 column. I have updated the actual 1993 expenditures and revenue to what should be very close to the final audited tigm'e. There have been some fairly significant increases to revenue. These increases were primarily for revenue received in January, February, and March. As you are aware, January utility bills are for October, November, and December of the prior year; February bills are for November, December, and Janutu~; March bills are for December, January, and February. This additional revenue has been booked to 1993, and was considerably higher than my original estimates. In addition, there were questions raised about the significant :increase from 1993 to 1994 in item 1, City overhead costs. The 1993 information on the attached schedule is the actual 1993 expense. The 1994 information is the actual 1994 budget. There are two reasons for the approximately $50,000 increase: firsl, the 1994 budget for City overhead expenses increased by $27,000 from 1993 budget; secondly, the 1993 budget was underexpended by approximately $25,000. The following highlights significant areas where the 1993 budget was underexpended and includes the 1994 budget increase. At the Tuesday Work Session, I would like the City Council to resolve the following: Extension of current services. Attached please find the previously submitted letter from Greg Woods concerning transition and extension of current services. It seems logical that the litigation would remain with Woods for the time being at the rate specified. Moreover, a firm could provide general legal services until such time a City Attorney is appointed. With regards to city prosecution services, I am recommending that his offer to extend services for a six month period (with a 90 day cancellation clause) be authorized. The extension would require a $3,000 retainer for paralegal/case coordination and a $90 per hour partner/S80 per hour associate attorney rate. This transition arrangement enables the City to resolve the general legal service appointment as a first priority and then resolves the matter of city prosecution appointment over the next 90 days. Approve general legal services. Attached please find my preliminary evaluation of general legal services proposals. I have ranked firms in an attempt to narrow to a short list of firms to interview. I recommend that three to five firms be interviewed on Tuesday, March 29, between 7 and 9 P.M. The interviews enable the City to become more familiar with the firm, the characteristics of the lead attorney, and further negotiate fees/retainer. It is hoped the final appointment or selection could occur during the month of April. o In house City Attorney. At the last meeting, I submitted material on in house staffing of the general legal service activity. In the event the City Council wishes to pursue this alternative further, the City Council would have to take action in April to finalize a budget, approve job descriptions, and set salary ranges. The recruitment process would take at least 90 days to complete. Accordingly, the City Attorney in house staff would not be available until about August 1, 1994. City prosecution services. In order to effectively evaluate the city prosecution services, I am recommending that the police staff be given an opportunity to interview the firms involved. Accordingly, I recommend that a similar process be established whereby the City Council, City Staff, and the police department could have an opportunity to interview the proposing firms. I expect that this process could occur over the next sixty days and a final decision to appoint one of the eleven firms could be finalized after that date. The City bus does get used, at no charge, by resident groups on a fairly regular basis. Usage in 1992 was 33 trips and in 1993 was 48 trips. The Mayor-Council budget for 1994 allocates $500 for fuel and $2500 for maintenance. Due to the construction of our present bus, the cost to repair the structure of the bus will be very expensive. The liability involved in a structural failure of the bus leads me to agree with Tom Hosch's indication that the bus not be recerfified. I suggest that the Council be made aware of the bus' condition and a determination made as to whether the City should continue to provide this service:. If the Council wishes to continue this service, Staff would like some direction on whether to pursue repairs or look for another vehicle either from the MTC or a used school bus. MAW:jb 94-123 Attachment TO: Mark Winson, Public Works Director From: Tom Hosch, Shop Foreman ~(~ Subject: 1961GMC Bus #401 Date: February 25, 1994 As requested the bus was inspected as to the condition of the unit. The drive train including the engine, transmission, and differential appear to be in good working condition. These components have been rebuilt over the years we have had the bus. The suspension air bags are in good condition, however the mounting and support for them are badly rusted. The steering is in good condition. There are no exhaust leaks. The outside appearance is fairly good, however there is some body damage as will be noted below. The tires are showing wear on the two outside rear duals. The interior is in good condition with the exception of some tears in the seats which are presently taped up. The major problem with the bus, in my opinion, is the condition of the frame members of the bus. The bus does not have a steel frame with members, as usually found on conventional trucks and buses, but more of a unibody construction. The underside is very corroded to the point that we should consider taking the unit out of service. Much of the underside members are corroded to a point that, short of a complete rebuild, there is no solution to the problem. The sides of the bus are becoming wavy indicating that the whole body is shifting. The wear, which was noted, on the outside of the rear duals is caused by the rear wheels dog tracking, which also indicates the support for the rear axle is not solid. The Annual Vehicle Inspection required by the State expires in May 1994. I would not be able to inspect and certify the bus under the current inspection requirements for the upcoming year due to these conditions. Listed below are all the problems which we are aware of: 1. Rear outside tires are worn due to rear axle being out of alignment. 2. Fuel tank has leak at flange where fuel outlet is connected and leaks if completely filled and bus leans during storage. 3. Front door does not seal with steps, 1 to 2 "gap under door. 4. Floor is breaking up/buckling and has been repaired near rear wheels. 5. Six seats are torn and have been taped up to make serviceable. 6. Body side scrapped on right side rear 1/3 of bus. 7. Rear bumper corner torn/cracked.. 8. Dent in front Just below windshield 9. Thank you. cb RESOLUTION NO. 94-13 SUPPORTING LEGISLATION TO ALLOW FOR THE TEMPORARY STORAGE OF SPENT FUEL BY NORTHERN STATES POWER AT THEIR PRAIRIE ISLAND NUCLEAR POWER PLANT WHEREAS, Northern State's Power Company's Prairie Island Power Plant has produced safe, low cost electricity for more than twenty years and consistently ranks as one of the lowest cost, safest, most productive and efficient nuclear plants in the country; and WHEREAS, the Nuclear Regulatory Commission has repeatedly recognized the Prairie island Plant as one of the best run nuclear facilities in the country; and WHEREAS, if the Prairie Island Power Plant is forced to close, the loss of this safe and ]ow cost base load twelve-hundred mega watt electric generating plant would cost not only NSP customers more in higher rates, but remove an efficient power source from the Mid- Continent Area Power Pool (MAPP) and thereby adversely affect all upper midwest electric consumers; and WHEREAS, the Prairie island Power Plant contributes substantial annual real estate tax payments, thereby reducing and in some cases elimi~lating traditional educational and local government aids, and tk;e shut down of this plant with resulting lost tax base would cost the State and other cities and school districts millions of dollars in increased State-Aid payments thereby affecting adversely the vast majority of Minnesota taxpayers; and WHEREAS, the Prairie Island Power Plant will reach maximum capacity of its temporary storage facility for spent fuel in ]994 and all necessary permits and approvals from State and federal regu]atcry agencies have been obtained so as to allow for the temporary storage of older spent fuel in dry casks;, a method safely utilized by at least six other nuclear power plants; and WHEREAS, the Prairie Island Power Plant is located within the City of Red Wing and the City and the vast majority of residents strongly favor approval of State legislation to permit this temporary spent fuel storage and further that the City has requested the support of other cities. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Columbia Heights that it supports the City of Red Wing's efforts to seek approval in the Legislature to allow on-site temporary storage of spent nuclear fuel from the Prairie Island Plant until the U.S. Department of Energy meets its obligations to complete a national high-level permanent waste repository. Resolution No. 94-13 page 2 BE IT FURTHER RESOLVED that the City Administrator is hereby authorized and directed to forward a signed copy of this resolution to the Governor and State legislators representing the City in the State Legislature and in like manner notify the City of Red Wing of the City's adoption of this resolution.
