Councilmember Jolly advised this is the third year that Columbia Heights has received a Tree city Award. Open Mike REGULAR COUNCIL MEETING APRIL 24, 1995 PAGE 3 The resident at 5001 Madison Street had two situations he wanted staff to address. The first concerned parking on his boulevard. He felt it is not safe to park his new vehicle on the street. The Acting Police Chief noted this is an ordinance violation. The second issue this resident had was with alley lighting. He noted his area is quite dark and suggested lighting could act as a deterrent to crime. Staff will follow up with this resident on this matter. Newly-Hired Staff Introductions The following new employees were introduced; Lenny Austin, Police Officer; Ed O'Donnell, MIS Coordinator; and, Randy Quale, Recreation Director. pUBLIC HEARINGS/ORDINANCES/RESOLUTIONS a. Being a Resolution for HRA Application for Rental Assistance Pro~ram Motion by Petkoff, second by Jolly to waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes RESOLUTION NO. 95-22 RESOLUTION OF CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA SUPPORTING HOUSING AND REDEVELOPMENT AUTHORITY (HRA) APPLICATION FOR HUD RENTAL ASSISTANCE PROGRAM UNITS TO REPLACE LIKE METRO COUNCIL UNITS AND TO HAVE THE LOCAL HRA TOTALLY ADMINISTER THOSE UNITS WHEREAS, currently the Housing and Redevelopment Authority of Columbia Heights (HRA) provides local administration for the 160 to 180 unit Rental Assistance Voucher and Certificate Program (Rental Assistance Program) under an administrative contract with the Metropolitan Council Housing and REGULAR COUNCIL MEETING APRIL 24, 1995 PAGE 4 Redevelopment Authority (Metro HRA) and has done so since the start of the Rental Assistance Program (Also, sometimes referred to as the "Section 8 Rental Assistance Program") in 1977; and WHEREAS, during fiscal year 1994 the HRA applied and received approval for 50 units of Rental Assistance Program from HUD and is now in the process of implementing that program; and WHEREAS, due to HRA and City's continuing desire to have total local control over the Rental Assistance Program and provide preference for residents of the City to receive assistance under the program; and WHEREAS, currently the HRA is receiving only $23.53 per unit of the $50.43 the Metro HRA receives from HUD for administering the Metro HRA units; and WHEREAS, the Federal Department of Housing and Urban Development (HUD) has invited applications for new units under the Fiscal Year 1995 Rental Assistance Program; and WHEREAS, an application has been prepared by the City Community Development staff for an additional increment of 50 Rental Assistance Program units to replace 50 Metro HRA units and such an application is due to HUD by May 2, 1995; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights, Minnesota that the City Council supports the application of the HRA for 50 additional Rental Assistance Program units for the City of Columbia Heights to be used to replace 50 of th Metro HRA units (to the extent possible). It is understood that within two years the HRA will (providing HUD provides the new units) replace all the Metro HRA Rental Assistance units with the Columbia Heights HRAproviding total administration for the program in Columbia Heights. Support of this application is contingent upon HUD granting approval of the local preference policy as included in the Administrative Plan. Passed this 24th day of April, 1995. Resolution No. 95-23 Being a Resolution Setting Rates on Sewage Disposal and Water Supply Motion by Jolly, second by Peterson to waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes RESOLUTION NO. 95-23 SETTING RATES ON SEWAGE DISPOSAL AND WATER SUPPLY IN THE CITY OF COLUMBIA HEIGHTS BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that: In accordance with the rate increase to be paid by the City of Columbia Heights to the Metropolitan Sewer District and the Minneapolis Water Department, the following rates shall be put into effect as of July 1, 1995 on all billings rendered thereafter: 1. Water Supply Rates: The water rate shall be a minimum of $13.20 per quarter on a quarterly basis per family unit for the first 600 cubic feet of water or less. The rate shall be $1.35 per cubic feet used for all water used beyond the 600 cubic feet minimum. 2. Sewer Disposal Rates: The minimum sewer disposal charge shall be $28.60 per quarter on a quarterly basis per family unit for the first 2200 cubic feet of water usage per quarter; and $1.30 per cubic feet thereafter to a maximum charge of $39.00 per quarter. The rate for commercial/industrial users shall be based on water consumption at $1.30 per 100 cubic feet. Any residential service hooked up to the Columbia Heights sanitary sewer system, that is not also hooked up to the Columbia Heights water distribution system, shall pay a flat quarterly sewer fee equal to the maximum quarterly sewer disposal charge in effect at the time a billing is rendered; unless a water meter reading is provided recording a lower reading than 3000 cubic feet in a quarter for which the current rate down to the minimum shall apply. REGULAR COUNCIL MEETING APRIL 24, 1995 PAGE 6 Senior Citizen Rate: For eligible senior citizens, the following minimum rates will be used. All usage over the minimum will be billed at the above rates. Minimum Sewage Disposal Minimum Water Use $14.10/quarter $ 8.55/quarter BE IT FURTHER RESOLVED that all foregoing rates are made in order to meet the additional cost to the City of Columbia Heights for these respective services. Roll call: All ayes RESOLUTION NO. 95-25 RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF COLUMBIA HEIGHTS REQUESTING REMOVAL OF A HAZARDOUS BUILDING LOCATED AT 3723 JACKSON STREET NORTHEAST WHEREAS, there is an abandoned building located at 3723 Jackson Street which has been vacant since April 1991, and WHEREAS, the property at 3723 Jackson Street Northeast has gone tax-forfeit and Anoka County intends to put it up for sale, and Wq4EREAS, Minnesota Statute 463.15 and 463.26 authorizes municipalities to address hazardous and substandard structures and properties, and WHEREAS, the City of Columbia Heights finds this abandoned property to be hazardous based on the following code violations as contained in the Findings of Fact: Findings of Fact Structural Hazards (5A.205(1)¢a)(b%(c)¢d}(g~(h)~ (a) Foundation - dirt walls under house, partial foundation (5A.205(1)(g) (b) Support walls for ceiling joist removed (5A.205(1)(g) (c) No header over patio door (5A.205(1)(g) REGULAR COUNCIL MEETING APRIL 24, 1995 PAGE 8 (d) Improper stair - exterior stair and deteriorated, hazardous (5A.205(1)(g) stoop very (e) Improper plumbing materials and methods. Piping and fittings for mobile home were installed. Water was on without a meter. (Mn. State Plumbing Code 4715.0420 Standards for plumbing materials) (f) New furnace installed using extension cord for wiring. Hazardous wiring throughout. (5A.203(1)(d) (g) Retaining wall in rear of property falling into alley (5a.207(i)(iv) (h) No parking area on site. Resident was driving over curb in front of house and crossing sidewalk to park on lawn. (5a.208(1)(a)(b)(c)(d)(e)(h) (i) Dirt from front yard is washing down onto sidewalk. (5A.207(b)(ii) NOW, THEREFORE, BE IT RESOLVED, based on the Building Inspector's conclusions that the structure at 3723 Jackson Street Northeast is substandard and seriously deteriorated, that it lacks minimum standards for habitable space per Ordinance No. 1281 of the Columbia Heights Zoning Code, and that the structure is non-conforming by its location and size, the Building Inspector is recommending the structure be removed and the lot regraded. BE IT FURTHER RESOLVED, that the City Council has approved the following Conclusions: CONC~USIONS OF COUNCI~ That all relevant parties have been duly notified that the Council will be considering this issue on April 24, 1995. That the vacant and abandoned structure on the tax-forfeit property located at 3723 Jackson Street Northeast is hazardous and in violation of many code and ordinance requirements. ORDER OF COUNCIL The property owner, Anoka County, is hereby directed to raze the hazardous structure located at 3723 Jackson Street Northeast and regrade the lot, pursuant to Minnesota Statute 463.15 to 463.26. MnDOT Notification on Removal of Central Avenue Median Fencing. 48th to 50th Avenues Various opinions as to the future of the fence were held by Councilmembers. It was felt it should be removed as the area was so poorly maintained. It was felt it should be maintained by MnDOT as it was installed by that State Office. Also, it was felt the fence should remain as it would serve as a deterrent to pedestrians who may be inclined to cross Highway #65 there. There was special concern for the safety of children with there being four schools in the area. Motion by Jolly, second by Peterson to direct staff to contact Mn/DOT, School District #13, City of Hilltop and adjacent property owners regarding removal and/or alternatives to the existing median fence on Central Avenue from 48th to 50th Avenues and to report back to the Council on May 8, 1995. Roll call: All ayes b. Columbia Heights Block Builders Fundraising Event Councilmember Ruettimann advised that the Columbia Heights Block Builders is hosting a talent show. It is being held on Friday, April 28th at the High School. c. City Hall Back-Up Generator Councilmember Jolly requested an explanation as to what areas in City Hall are served by the standby generator. Recently, there was a power outage in the City which affected City Hall and some employees had understood the standby generator would supply power to all of the City Hall building. REQUEST TO PAINT YELLOW CURB ON 40TH AVENUE AT DRIVEWAY ENTRANCE FOR 3991 HAYES STREET For the past several years, Howard Gibbs of 3991 Hayes St. has painted the curb next to his driveway yellow to prevent vehicles from parking in front of his driveway. Mr. Gibbs is on call "night and day" and can't afford to be blocked in by other vehicles. Acting Police Chief Olson indicated that yellow curbing means nothing without signs indicating no parking. If the resident has a problem, he can call the Police and they will come ~out and tag the vehicle. Public Hearing Conditional Use Permit Case//9505-13 Heights Auto Repair 5101 University Avenue Columbia Heights, Mn. Tina Goodroad presented the request of Ms. Sandra Belisle on behalf of Heights Auto Repair for a Conditional Use Permit to allow the operation of minor automotive repair at 5101 University Avenue. Heights Auto Repair is the new occupant of an already existing auto service shop and has been conducting business, doing MAJOR auto repair, which is a non- conforming use, since approximately February 1995 without the required Conditional Use Permit. She informed the Commission that Section 9.113(2)(g) of the Retail Business Section of the Zoning Ordinance requires a Conditional Use Permit for the operation of motor fuel stations (minor) and major fuel stations with minor repairs not to exceed four bays. She stated that this location would have three service bays. She also informed the Commission that MINOR motor vehicle repair is defined in Section 9.103(56) of the Zoning Ordinance as "the replacement of any part or repair of any part which does not require the removal of the engine head or pan, engine, transmission or differential; incidental body and fender work, minor painting and upholstery service when said service above stated is applied within an enclosed building". Ms. Goodroad stated that the Zoning Ordinance requires auto repair shops to have four parking spaces plus one space for each eight hundred square feet of floor area over the first PLANNING AND ZONING COMMISSION REGULAR MEETING - MINUTES MAY 2, 1995 PAGE 2 1,000 square feet. Based on this requirement, the service shop would require six off-street parking spaces. Nine parking spaces are provided on the site plan. Michael Balentar, Business Manager for Heights Auto Repair, informed the Commission that the business has closed pending completion of the approval process. He stated that vehicles left at the lot for more than three days after notification that work has been completed, will be towed to another location. The hours of operation would be from 8:00 a.m. to 6:00 p.m. Monday through Saturday. He stated that the contingency items addressed by Staff would be satisfied as required. Everett and Shirley Hill of 5042 N.E. 4th Street were present to express their concern with the amount of vehicles previously stored on the lot when the business was under other ownership. They also advised the new owner to provide lighting in and around the business so as to prohibit intruders. Tina Goodroad presented the request of New Image Neon, on behalf of Hollywood Video, for a variance of 60 feet to allow additional signage on the west and north side of the building located at 4849 Central Avenue. She indicated that Hollywood Video also has requested Site Plan Approval for a 150 linear foot of roof front extending above the roof line, constructed of metal panels that simulate the Hollywood Mountains. She explained that the roof front is proposed on the west and north sides with the proposed signage placed on this metal panel roof front. The highest point of the roof front panels would be ten feet and extends 87 feet across on the west side and 75 feet across on the north side. Ms. Goodroad stated that Section 9.117A(4)(h) of the Zoning Ordinance prohibits any roof top signs. Also, Section 9.117A(10)(b) of the Sign Ordinance for the Retail Business District requires any number of wall signs on any side of a building not to exceed one hundred square feet of total surface area for all wall sign surfaces and limited to one surface per sign. Ms. Goodroad informed the Commission that the reason for the variance request was the need for adequate advertising for Hollywood Video. However, she stated that the location of the proposed video store is on the west side of the shopping center facing Central Avenue having full visibility from traffic flowing both north and south on Central Avenue. It was Staff's recommendation that the variance be denied due to a lack of a hardship as defined in the Zoning Ordinance and lack of compliance with the Sign Ordinance. Greg Rust, representing New Image Neon, was present to propose a different plan of action for signage for Hollywood Video. It was Staff's determination that the new proposal would be within the requirements of the Sign Ordinance and a variance would not be required. The portion to be split is a 71.56 foot by 329.72 foot section that is to the rear of the Superamerica lot at 5000 Central Avenue legally described as that part of the north 165 Feet of Lot 14, "Revised Auditors Subdivision Number 15", lying west of the east 261 feet thereof, Anoka County, Mn. She explained that the reason for the request is to start construction of the restaurant on Parcel A while environmental issues are dealt with on Parcel B. Northstar Restaurants will be purchasing Parcel A to begin development, followed by the purchase of Parcel B, once environmental corrections to the soil are completed. She stated that Parcel B is necessary in order to provide adequate parking for the proposed use. The City Attorney, Jim Hoeft, stated tha he has been in discussion with counsel for Northstar Restaurants and has advised Northstar Restaurants that a perpetual easement over and across Parcel B for ingress and egress easements and parking easements would be required before the Subdivision request would be signed. He stated that Parcel B would continue to service Parcel A and would be the responsibility of the business operation to maintain the property (ie. snow removal, clean-up of debri, landscaping, etc.). Within one year of the environmental clean-up, the owner of Parcel B can force the sale to the owner of Parcel A. Mr. Jack Frerichs of 5013 Jackson Street was present to voice his concern regarding the deterioration and previous upkeep of the screening fence between the residences and the businesses. In September of 1985, there was a Conditional Use Permit approved by the City Council for the operation of a car cleaning service at 5101 University Avenue. One of the conditions with that approval was that there be no auto repair on the site. Section 9.116(4) of the Zoning Ordinance under Auto Repair requires four (4) parking spaces plus one (1) for each 800 square feet of floor area over the first 1,000 square feet. The carnival, operated by Serie Fun Shows this year, usually arrives a day or two before opening which would require closing off Jefferson St. on Monday afternoon, June 19th. Staff is requesting permission to close Jefferson Street from the alleyway on the north end of Huset Park to the railroad tracks north of 39th Avenue providing appropriate arrangements are made with various City departments including the application and payment of necessary licenses and permits and that appropriate deposits are submitted. The annual Jamboree Parade will be held on Friday, June 23, 1995, beginning at 6:30 P.M. The parade route is the same as previous years. Staff is recommending that the City Council authorize the Police Department to issue a parade permit for the Jamboree parade. Attached please find a memorandum from the Recreation Department regarding fireworks display in conjunction with the Jamboree. In the past, the City has coordinated and assisted financially with fireworks display on the 4th of July. The City of Columbia Heights along with VFW Post 230 and the Athletic Boosters have been a major supporter of the event. This year, the Columbia Heights Lion's Club has requested that the f'treworks display be moved to Saturday, June 24th, in conjunction with the Jamboree Celebration. They feel that the fireworks could be a major draw to improving attendance at Saturday's events. The Recreation Department, Fire Department, and the Lion's Club will work with the fireworks providers to properly size the £ureworks shells so as not to conflict with the crowd or the carnival activities. The annual Jamboree Parade will be held on Friday, June 23, 1995, beginning at 6:30 P.M. The parade route is the same as previous years. As part of their yearly celebration, a parade is held. This year it is scheduled to begin at 6:30 P.M. on Friday, June 23. We are requesting a parade permit for this activity. We have conducted this parade and necessary traffic control for many years without any difficulty. Our plan is to have the parade proceed south on Central Avenue, using both the southbound lanes from 45th Avenue to 40th Avenue. We detour both the north and southbound traffic into the northbound lanes. Each direction will be reduced to one lane of traffic. We place large advance warning signs approximately 1V2 to 2 blocks prior to the initial spot controlled for parade traffic which is at 39th and at 46th Avenues. At each of these locations we will have large stand-up street barricades, using plastic pylons to direct traffic into a single lane each direction. At each of these two locations there will be two uniformed officers and a marked squad car with red lights rotating. The entire length of the detour will have plastic pylons to separate the lanes of traffic and there will be at least one uniformed officer at every intersection to assist in the movement of traffic. All traffic signals are turned off during the parade. The parade usually gets off Central Avenue and the traffic restored to normal situation by 9:00 P.M. We have also advised MTC of the detour so that they can reroute their buses as needed. While the parade is moving south on Central, there is adequate room to allow for the free movement of all emergency vehicles. Enclosed is a map of the parade route. At the Council meeting of February 27, 1995, the City Council adopted an order tolling the initial thirty day period for the review of the proposed rates for an additional ninety days in order to complete an assessment of the proposed increase, and issued an interim order permitting the basic increase to go into effect April 1, 1995, subject to rollback and refunds. Staff and the cable attorney for the City have reviewed the proposed rate adjustment and have found everything to be in order. Thus, at their meeting of April 20, 1995, the Columbia Heights/Hilltop Cable Communications Commission passed a motion recommending that the City Council approve the adjustments to the rates for basic and other franchise fees, effective April 1, 1995. Specifically, in the event the Commission has not completed its assessment of the proposed increase and/or decrease within the initial 30-day review period, we would request that the Commission adopt both a tolling order permitting the Commission to continue its review of the increase and an interim order permitting the basic increase to go into effect April 1, 1995, subject to rollback and refunds. This street is a designated Municipal State Aid route. The reconstruction will include new base and pavement courses, concrete curb and gutter, sidewalks and ornamental lighting. Minor improvements will be made to the existing storm sewer system and the existing brick sanitary sewer manholes will be replaced with concrete units. The existing watermain has been evaluated and although there is some sealing in evidence, staff does not feel that the main needs to be replaced at this time. Some minor landscaping, paving and curb and gutter improvements will be made on City property as part of the project. The overall estimated construction cost is $290,000. It is anticipated that State Aid will cover $280,000 of the cost and the City will be responsible for the remaining $10,000. The City costs break out as follows: Manhole replacement $7,000 Hydrant relocation $3,000 Staff is awaiting approval of the plans by Mn/DOT. Approval is expected within the next 90 days and it is anticipated that a contract would be let in late August with construction in September. If there are significant changes in the plans or cost participation based on Mn/DOT review, staff will bring the project back to the Council. The City meter shop is equipped to test residential meters for accuracy but is not able to test the larger meters, greater than 1" that are used by commercial and industrial customers. Without the ability to test these larger meters and verify their accuracy, it is difficult to have these larger customers replace inaccurate meters. As meters age, they tend to under-read the volume that passes through them, resulting in the potential for underbilling. Staff proposes to identify the meters that are most likely to be inaccurate and have them tested by a fn'rn equipped to do the testing. Staff has completed the plans for the installation of a sidewalk along 44th Avenue from Tyler Place to Reservoir Boulevard. As this portion of 44th Avenue is a designated Municipal State Aid Street, the costs associated with the project will be reimbursed by MSAS. The sidewalk will be five feet in width adjacent to the north curb line. Due to existing grade changes, there will be some extensive retaining wall and driveway reconstruction through portions of the project. A Public Hearing for this project was held on May 23, 1994. Of those in attendance, it was fairly evenly split between opposition and approval of the project. At the hearing, a motion was passed by the City Council authorizing the project and authorizing staff to seek variances to the MSAS rules in order to obtain MSAS funding for the project. These variances were granted in September of 1994. In order to install the sidewalk, additional right-of-way is needed at 955, 967 and 981 44th Avenue. A motion was passed by the City Council on October 10, 1994, authorizing staff to acquire the needed right-of-way. This right-of-way acquisition is still being negotiated with two of the owners. An informational meeting for property owners affected by this project was held on April 12, 1995. The meeting was attended by seven owners along the north side, all of whom were in opposition to the project. Staff presented the details of the project and attempted to address the property owners' concerns. Specific concerns dealt with driveway grades and landscaping. These concerns can, for the most part, be addressed in the design. The largest concern was responsibility for snow removal. Staff recommends that sidewalk snow removal become the City's responsibility due to the arterial nature of the street and the proximity of the sidewalk to the curb. Approval of the plans by MSAS is expected within the next 90 days. Staff is in the process of obtaining temporary construction easements from all properties along the sidewalk installation. If MSAS approval and easement acquisition are completed in a timely manner, bids would be let in August with September/October construction. One legislative body has passed Columbia Heights' special bill, whereby the other legislative body has passed a similar measure applicable to all tax increment projects. There is, however, a question as to the approval date of our tax increment project in relationship to the date in which the provisions of the "blanket" bill would become effective. PubliCorp, Inc. is monitoring the legislation, and will keep the City updated on any developments. 4) CITY SURPLUS LOT MARKETING Proposals must be submitted by May 15th on individual or group lot acquisitions. City staff distributed approximately 50 packets to developers, builders, and individuals. We also have placed a newspaper ad and received a few inquiries asking for information and met with Habitat for Humanity regarding the donation of a lot. City Staff will file a report with the Council at the May 30th council meeting and will further discuss the award proposals at the first work session in June. 5) STRATEGIC PLAN DOCUMENT City Staff is currently working on a final draft of the strategic plan that addresses priorities outlined in the recent Council planning session. I'll present a final draft document at the Tuesday, May 16th, 7 p.m. work session. Please note that the calendar went out to the City Council identified a May 15th work session. That was in error, as in the Work session was changed to May 16th because of the Columbia Heights Boosters' Awards Dinner. 6) KENNETH BOTHUN, 5001 MADISON STREET, RESPONSE As you recall, Mr. Bothun appeared at the April 24, 1995, Council meeting to discuss the City's policy on boulevard parking and the lack of a mid-block light on the 5000 block of Madison. Attached please find a response from the Public Works Director regarding the mid-block light. Additionally, Mr. Bothun has made arrangements to install an additional driveway pad on his property. In the meantime, the Police Chief has worked out a solution to accommodate Mrs. Bothun's parking needs until the driveway pad is completed. 7) AREA LION'S CLUB BEAUTIFICATION PROJECT, STINSON/37TH Be advised that the area Lion's Clubs intend to donate $3,000 to expand the Beautification Project at the corner of Stinson Boulevard and 37th Avenue. Events/Accomplishments Heights Pride Week in May was an item of discussion and planning in the Police Department. Staff has been planning and setting up several activities for the community, including the open house of May 18, the children's bicycle rodeo, noon on Saturday, the 20th, and the crime prevention seminar segment planned for the afternoon of May 20th during the business fair. Bo The C.O.P. staff attended part two of the community police training scheduled throughout 1995. The training is presented by the Anoka Police Institute and will be comprised of five parts. This training is the framework for the innovative community police programs we have already started, and it provides the direction for planning and focus for other programs about to begin. Co The Police Department budget process began with several staff members planning and submitting budget suggestions for the 1996 allocations. Areas such as training, crime prevention, and DARE required some intense scrutiny. Preliminary forecasts were due the end of the month and those timelines were accomplished. II. Projects/Goals mo The use of "Your Speed Is" radar device is drawing some positive comments from our community since we received it and we will try to have the unit out as much as possible. It is an excellent tool to educate the motoring public that uses our streets. Bo I received a letter from the VFW Post 4/230 in Columbia Heights requesting permission and support so they may host the Veterans of Foreign Wars, 7th District, Loyalty Day Parade on Saturday, April 27, 1996. I have the Mayor's approval and with anticipated approval from the Council, will budget for the staffing necessary to accomplish this request. RENTAL ASSISTAi~CE PROGRAM: ko Under the Section 8 Rental Assistance Program, we through the Metro HRA, assisted 158 very low income families with rental of decent, safe, and sanitary dwelling units in Columbia Heights and Hilltop through Certificates (116 families) and Vouchers (42 families). As of month end the HUD Area Office was still considering the "local preference" portion of our Administrative Plan for our new 50 units of Rental Assistance. Ce An application for 50 additional new units was approved by the HRA Board of Commissioners and City Council and submitted to the HUD Area Office. 7. OTHER: ao MHFA Minnesota City Participation Proqram (MCPP) First Time Home-buyer Program: We are still awaiting an invite from MHFA to apply for the FY1995 Program. B. Sheffield Neiqhborhood Redevelopment: (1) Ail four remaining "Target Block" duplexes have been removed from the foundations and are ready to be moved. Movement off the block has been delayed due to road restrictions which are expected to be lifted as of May 15. (2) Nedegaard Construction (First Choice Homes) has taken out a total of five building permits for new houses in the Sheffield Neighborhood. They have completed construction of the model house and are in the process of constructing four other homes (Three in "Target Block" and one at 4531 Fillmore). Scott Dahlberg, sales agent, indicated that 3 more of the new lots in the Target Block are sold on purchase agreements and several others are in process. Scott indicated that First Choice will have a house in the Target Block in the annual Fall Parade of Homes. (3) The duplexes at 4501-03 and 4555-57 Taylor Street are in the process of having the upper portions removed and the foundations removed or used as foundations for new single family homes. The new single family homes are to be sold to new homeowners under MHFA First Time Homebuyer program terms/limits. The single family deteriorated house at 4612 Taylor Street was cleared by Thomas Contracting. A City of Columbia Heights Police Sergeant has moved into the 2 bedroom unit (4642 Taylor) and is acting as caretaker for that building, 4519-21 Taylor St. N.E. and 4535-37 Taylor St. N.E. As of May 1, 4644 Taylor (upper half) was rented to a retiring U.S. Air Force NCO and his family (wife and 3 children). CITY OPEN HOUSE/HOUSING FAIR: On Thursday, May 18, from 4:00 - 7:00 p.m., the Community Development Department will participate in the City Hall Open House. Staff will have "How To" videos on constructing decks, porches and three season porches. Brochures and other information on permits, construction, housing and community and economic development will be available to the public. Staff will be available to answer questions and provide information about Community Development Department programs. On Saturday, May 20, the City is holding a Community and Housing Fair from 11:00 a.m. to 4:00 p.m. Community Development staff and Paul Bushman (City Intern) are coordinating the Housing Fair activities at Murzyn Hall. Four-Plex at 4607 Tyler Street: The HOME Program application which was submitted includes $40,000 for ren- ovation of this building. We expect to know about that funding within one or two months. Presently one family lives in Apartment #3 and is acting as resident caretaker for a $40 per month reduction ($545 to $505) in rent. Ge Sale of City/HRA Owned Lots: Staff prepared a request for proposals on the sale of 16 City/HRA owned lots. Proposals are due on May 15th. Columbia Heights, MN 55421-3878 (612) 782-2800 April 26, 1995 Mr. Kenneth Bothun 5001 Madison St. Columbia Heights, MN 55421 Subject: Mid-block Light Dear Mr. Bothun: This letter is in response to your inquiry at the City Council Meeting of April 24, 1995, regarding mid-block lighting. NSP had identified the location between 5032 and 5040 Madison as the best location in the middle of the block to install a light due to access to existing power poles along the rear property lines. Per the City policy, a letter was sent to the two properties either side of the proposed installation and the two properties directly across the street. In response to those letters, two residents (one directly adjacent to the proposed location and one across the street) notified the Engineering Department that they were not in favor of installing a light at this location. Our policy then is to try and identify an alternate location and in doing so we determined that locations where there would be good access to existing poles were either too far north or too far south of the middle of the block to provide proper lighting coverage. As there wasn't any good acceptable locations, a letter was sent:,.to the resident adjacent to the proposed location who objected to the light requesting that he collect signatures from more than 50% of the residents living within the 150' of the proposed location who were not in favor of installing a street light. The petition was returned to the City in June of 1994 with signatures against the installation of the light from 7 of the 12 properties within 150' of the proposed location. When First Bank Systems acquired Marquette Bank, new agreements should have been signed with First Bank Systems; however, First Banks did not submit these agreements to the City and the City continued to operate under the assumption that whatever agreements we had with Marquette were adequate. At this time, First Trust is requiring that we have a new investment/custody agreement with First Trust and a resolution related to the fee arrangements and disclosures for all accounts that hold First American investment funds. In essence, these two documents are required because of the strict banking regulations that are placed on trust-type funds. The Agent may act on oral instructions which the Agent reasonably believes to be issued by me or my authorized agent. The Agent has no authority or responsibility to recommend or evaluate investment policies or particular investments with regard either to investment merit, or as to suitability for my investment guidelines. 3. Cash Receipts and Investments. The Agent shall collect all dividend interest or other income payable on account assets and all principal due on called or matured bonds. On a daily basis the Agent shall invest cash receipts in the following type of money market mutual fund (check one): Treasury Obligation Money Market Funds A mutual fund (including a mutual fund managed and/or otherwise serviced by the Agent or any affiliate of the Agent) may be utilized. This type of mutual fund invests only in U.S. Treasury Obligations issued by the United Slates Government, its agencies or instrumentalities which are fully guaranteed as to payment of principal and interest by the United States. Government Obligations Money Market Funds A mutual fund (including a mutual fund managed and/or otherwise serviced by the Agent or any affiliate of the Agent) may be utilized. This type of mutual fund invests in U.S. Government securities issued or guaranteed by the U.S. Government~ its agencies or instrumentalities. The fund investments can include securities backed only by the right of the issuer to borrow from the U.S. Treasury under certain circumstances and instruments backed by the credit of the agency issuing the obligation. Institutional Money Market Funds A mutual fund (including a mutual fund managed and/or otherwise serviced by the Agent or any affiliate of the Agent) may be utilized. This type of mutual fund may invest in the type of inve~t,,ents described for a Trr, asury Obligation fund and a Government Obligation fund as well as commercial paper rated A-I by Standard & Poors Corporation, or Prime-! by Moody's Investor Service and other money market instruments which are unrated but of comparable quality, instruments of domestic and foreign banks and savings and loans denominated in dollars, and short term obligations of sovereign entities rated AAA by Standard and Poors or Aaa by Moody's denominated in dollars. The particular money market mutual fund utilized for each category for the investment of' cash will be periodically reviewed and may be changed from time to time based on criteria selected by the Agent. I relieve the Agent of any duty to recommend any sale, retention or purchase of any First Bank System, Inc. stock or debt securities. Successors.
