Attached are the proposed bus~uess License fees for the 1994 license year and a
resolution for the same.
All fees v£11 reBain the tame except for the folloving~
1. The change t~ the re-inspection fee for Nultiple Dvell~nss from $40 to $50 as
recommended by the F£re Departments F~forcenent Officer.
2. The change Luthe re-Lnspection fee for Rental Housing (one and two untts) from
$25 to $40 as recommended by the Fire Departments Enforcement Officer.
The addition of a $500 investigation fee upon application for an Arcade license.
4. The addition of a $500 investigation fee upon application for a Pool Hall
license.
$. The addition of a $1500 investigat~on fee upon application for a Precious Hetals
Dealer license.
6. The ~ncrease of a Paenbrokers license fee from $500 to $12,000 plus the addition
of a $1500 investigation fee upon application.
7. The addition of a $100 investigation fee upon application for a Hatsage
Therapist license.
8. The addition of a $1500 investigation fee upon application for · Hastage
Therapist Business license as vell at an increase of the license fee from $200 to
$3,000.
I~ems f~ through f8 are recommendations ~ade in conjunction v~th the Police
Department after revieving fees charged by turroundin~ comnunit£es and also bated
on the amount of Staff tiJe involved in the inveetlsationprocese.
It is imperative the City Council act on the license fees for 1994 as loon as
possible at reneval applications mutt be Bailed by the end of October.

RESOLUTION NO. 93-
ESTABLISHING 199/~ BUSINESS LICENSE FEES
WHEREAS, Ordinance No. 853, City Code of 1977, pertaining to
coe~nerclal licensing regulations provides for the
establishing of annual license fees~ and,
WHEREAS, the Clty has participated In a survey of metropolltan
munlcipalitles regarding business license fees charged
by other communltles; and
WHEREAS, the City ls attempting to malntain business licenses
which are comparable; and
WHEREAS, the City annually reviews lts business license fee
schedule;
NOW, THEREFORE BE IT RESOLVED that the attached proposed license
fee schedule be adopted and effective January 1, 19~4.

AND SERVICES*
Sec. 15-181. Purpose.
The purpose of this article is to regulate escort services,
massage parlors, rap parlors and sauna pazlor~ (Ord. 1~o.
429, § 1, 8-8-78)
Sec. 15-182. Def'mitions.
Whenever the following terms appear in this article, they
shall have the meanings assigned to them in thi~ section:
(a) Escort: To escort, accompany or provide companion-
ship to another person.
(b) Escort service: Premises at or in which escort is
advertised, offered or performed to or for members of the
public or a private club.
(c) Massage:. The method of treating the superficial parts
of the human body by rubbing, rolling, pressing, stroking,
kneading, tapping, pounding, vibrating or stimulation with
the hands or any instrument for the exclusive purpose of
relaxation, physical fitness or beautification and for no
other purposes.
(d) Massage parlor: Premises at or in which massage is
advertised, offered or performed to or for members of the
public or a private club.
(e) Garage: To own, manage or conduct.
(f) Person: Any individual, corporation, firm, partnership
or association.
(g) Rap: Unlimited verbal conversation in an endeavor to
arrive at a mutual understanding or agreement on a
particular subject.

Sec. 15-184. Business license required.
No escort service, massage parlor, rap parlor or sauna parlor
shall be operated within the city unless such business is cur-
rently licensed in accordance with the provisions of this article.
A separate license shall be required for each place conducted,
operated or maintained by any person engaged in the licensed

Sec. 15-185. Personal oeFvice license required.
No person shall perform or provide any service in conjunc-
tion with the operation of an escort service, massage parlor,
rap parlor or sauna parlor within the city unless such person
is currently licensed in accordance with the provisions of this

Sec. 15-186. Term of ficense~
A license shall terminate on the last day of the calendar year
during which 'such license was issued. (Ord. No. 429, § 1,
8-8-78)
Sec. 15-187. License fees.
The license fees shall be established by resolution and shall
not be prorated. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-188. Payment of license fee.
The license fee shall be paid when the application is sub-
mitted, and no fee shall be refunded. (Ord. No. 429, § 1,
8-8-78)
Sec. 15-189. License nontransferable.
No license shall be transferred to any other person or
premises. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-190. Age of applicants.
An applicant for a license must be at least twenty-one (21)

any training or experience in providing the type of
service for which the license is requested; and the same
information shall be required of the manager if the
applicant is a partnership.
(c) If the applicant is a partnership, the names and ad-
dresses of all partners and all information concerning
each partner and the manager as is required of an in-
dividual applicant in subparagraph (b) a~ove; the name
of the managing partner(s); and the interest of each
partner in the business. A true copy of the partnership
agreement shall be submitted with the application, and
if the partnership is required to file a certificate as to a
trade name under the provisions of M.S.A. chapter 333,
a copy of such certificate, certified by the clerk of the
district court, shall be attached.
(d) If the applicant is a corporation or other organization,
the name and if incorporated, the state of incorporation;
a true copy of the certificate of incorporation, articles
of incorporation or association agreement, and bylaws
shall be attached to the application, and if a foreign
corporation, a certificate of authority, as described in
M.S.A. chapter 303 shall be attached; the name of the
manager and all information concerning said person
as is required by subparagraph (b) above; a list of all
parties who control or own an interest in excess of five
(5) per cent in such corporation or organization who
are officers of the corporation or organization; and all
information concerning said person(s) as is required
by subparagraph (b) above.
(e) Whether the applicant is licensed in other communities
and if so, where.
(f) The names of those individuals to be licensed and work-
lng for the applicant who may work in the City of New
Brighton.
(g) Whether the applicant has previously been denied a
license to conduct the type of business for which a
license is requested.

officer thereof. The application shall be verified by a duly

Sec 15-195. Investigation fee.
At the time of submission of an application for a license,
an applicant shall pay in full an investigation fee of three
hundred dollars ($$00.00). No investigation fee shall be re-
funded. The investigation fee may be waived in case of re-
newal. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-196. Conditions of license.
No license shall be issued, renewed or continue in effect
unless there is compliance with the minimum conditions and
requirements as set forth herein. Failure to maintain com-
pliance shall be cause for denial, suspension or revocation of
said license. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-197. Construction requirements.
(a) Janitor closets shall be provided for the storage of
cleaning supplies. Such closet shall be equipped with a mop
and sink and shall have mechanical ventilation with ten (10)
cubic feet per minute per square foot of floor space.
(b) Restrooms shall be provided with mechanical ventilation
and two (2) cubic feet per minute per square foot of floOr area,
a washing sink equipped with hot and cold running water under
pressure, and a sanitary towel dispenser and soap dispenser.
(c) Individual lockers shall be provided for the use of pa-
trons with separate keys for locking.
(d) Rooms in the licensed premises, including but not lira-
ired to the sauna room, massage rooms, restrooms, janitor's
closet, hallways and reception area, shall be illuminated with
not less than thirty (30) footcandles of illumination.
(e) Massage par]ors and sauna parlors shall be constructed
of material which is impervious to moisture, bacteria, mold and

(b) No escort service, massage parlor, rap parlor or sauna
parlor shall be operated within twenty-six hundred
(2600) feet of any other escort service, massage parlor,
rap parlor or sauna parlor.
(c) lqo escort service, massage parlor, rap parlor, or ~atma
parlor shall be operated within six hundred (600) feet
of any residentially zoned district, a church, a nursery,
elementary, junior high or high school, or any estab-
lishment frequented by juveniles. (Ord. No. 429, § 1,

Sec~ 15-200. Persons ineligible for license.
lqo license shall be issued to an applicant who:
(a) Is under twenty-one (21) years of age;
(b) Is an alien;
(c) Has been convicted of any crime which involves moral
turpitude or which relates directly to such person's
ability, capacity or fitness to perform the duties and
discharge the responsibilities of the licensed activity;
or
(d) Within five (5) years prior to the date of application,
has had a similar license revoked, denied or suspended.

Sec 15-201. Operating hours.
No licensed premises shall be open between the hours of
10:00 p.m. and 8:00 a.m. of the following day, and no business
shall be operated on Sunday. (Ord. 1%. 429, § 1, 8-8-78)
Sec~ 15-202. List of current employees required.
The business licensee shall at all times be responsible :~or the
safety and operation of the licensed business and premises and
shall furnish the city manager with a list of current em-
ployees. Said list shall include the name, address, date of birth
and any other requested information for each employee. Only

Sec. 15-203. Public solicitation prohibited.
No person shall solicit business in any public place or in any
licensed liquor establishment. (Ord. No. 429, § 1,
Sec. 15-204. Service to member of opposite sex restrieted.
No person who has been issued a personal service license
shall solicit business or offer or agree to perform any licensed
service to any member of the public who is of the opposite sex,
except that this section shall not apply to any person who has
a personal service escort license when said person is perform-

Sec. 15-205. Clothing requirements.
Any person who shall receive the services licensed herein
shall at all times have the sexual or genital parts, or any
portion thereof, covered with a nontransparent covering; and
any person who shall have a personal service license shall at
all times while in the employ thereof have the upper and lower
parts of the body completely covered with a nontransparent
covering. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-206. Business manageF.
A manager must be assigned for the licensed premises, and
said manager must have a valid personal service license for
that type of service, and no manager shall be employed in any
other like business. The business licensee shall designate a
person as manager, and the manager shall be responsible for
the conduct of the business until another suitable person has
been designated in writing by the licensee. The licensee shall
promptly notify the city manager in writing of any changes,
said notice indicating tb.e name and address of the new man-
ager and the effective date of such change. (Ord. No. 429, § 1,

Sec~ 15-207. Training r~uirement.
An applicant for a personal ~rvice massage license shall
furnish a diploma or c~ificat~ of ~raduation from a recog-
nized school. (Ord. No. 429, § 1, ~-$-?$)
Kec. 15-208. Issuance of licen~.
(a) ~n.~s l~e~e. No business license shall be issued
except pursuant to council resolution, after a hearing, declar-
ing that public convenience and necessity require the proposed
business. Council declaration of public convenience and neces-
sity shall not be necessary for the renewal of an existing
business license; provided that failure to apply for renewal
at least thirty ($0) days before the expiration of the existing
license shall be considered an abandonment of the right to
renewal and a council hearing may be ordered. The council
may grant or deny any license request in its discretion.
(b) Per~o~l sea,ice license. Applications shall be for-
warded to the director of public safety and to such other city
officials as the city manager may deem necessary. At the
earliest practicable time thereafter, the city manager shall
issue or deny the request for a license.
(c) Right o! appeal. The decision of the city manager may
be appealed to the city council if such appeal is made in writ-
ing within ten (10) working days following the date of issu-
ance or denial of the license. When appealed, the city council
may set aside the decision of the city manager. (Ord. No. 429,

Sec. 15-209. Right of inspection.
Applicants and licensees shall allow a proper official of the
city to inspect and periodically examine the premises for the
purpose of ascertaining that said premises conform to all re-
quirements and regulations pertaining to health, fire and
sanitation, and to ensure the preservation of the good order
and peace of the city. Any refusal on the part of the applicant
or licensee to allow such inspection or examination shall be

de'creed as sufficient grounds upon which the city manager
may deny, suspend or revoke a license. (Ord. No. 429, § 1,

Sec. 15-210. Display of license.
While in force, a business license shall be posted in a con-
spicuous place on the licensed premises. A personal service
license shall be carried by the licensee on the licensee's person,
and the licensee shall present said license for inspection when
so requested by a proper official of the city. (Ord. No. 429, § 1,
8-8-78)
Sec. 15.211. Physics] contact.
No person shall, while on the licensed premises, place his or
her hand or hands upon or touch with any part of his or her
body or fondle in any manner a sexual or genital part of any
other person. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-212. Minimum age.
No person under the age of eighteen (18) years of age
shall be permitted at any time on the licensed premises as a
customer or guest unless accompanied by a parent or guardian.

Sec. 15-213. Liquor on premises.
No nonintoxicating or intoxicating liquors shall be allowed
on any licensed premises at any time. (Ord. No. 429, § 1,
8-8-78)
Sec. 15-214. Insurance required.
Each applicant for a business license shall file with the city
a public liability insurance policy, insuring the applicant against
any and ali loss arising out of the use, operation or main-
tenance of the place of business. The policy of insurance shall
be in limits of not less than one hundred thousand dollars
($100,000.00) for injury or loss to one person, three hundred

thousand dollars ($300,000.00) for each occun'ence, and twenty-
five thousand dollars ($25,000.00) property damage. No can-
cellation of any policy shall be valid except upon thirty (30)
days prior written notice to the city manager. Failure to keep
in force and effect, the insurance required shall be grounds for
revocation of the license. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-215. Right of denial
No license sh~ll be granted or renewed' on any premises on
which taxes, assessment or other financial claims of the city,
county or state are due, delinquent or unpaid. In the event
an action has been commenced pursuant to the provisions of
Minnesota Statutes chapter 278, questioning the amount or
validity of taxes, the council may, on appeal by the applicant,
waive strict compliance with this provision; no waiver may be
granted, however, for taxes or any portion thereof which re-
main unpaid for a period exceeding one year after becoming
due. (Ord. No. 429, § 1, 8-8-78)
Sec. 15-216. Suspension and revocation of license.
A license may be revoked by the council for cause pursuant
to a hearing, such hearing to be held after five (5) days notice
to the licensee. A license may be suspended temporarily by the
city manager, and suspension shall continue until otherwise
ordered by the council providing that the charges of the city
manager be delivered in writing to the licensee and that the
council afford the licensee a hearing at its first scheduled
meeting immediately following the suspension order. Upon
hearing, the council may continue the suspension for a specific
period or may terminate ~ame or may continue the license in
effect based upon any additional terms, conditions and stipula-
tions which the council may in its sole discretion impose. (Ord.

THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS AS
FOLLOWS:
Section 1. New Brighton Code Section 15-197, paragraph (d) is amended as
follows:
(d) Rooms in the licensed premises, including but not l~m~ted to the sauna
room, massage rooms, restrooms, janitor's closet, hallways and reception
area, shall be illuminated with not less than *.hir'.y ten (S4110) footcandles of
illumination.
Section 2. New Brighton Code Section 15-204 is deleted.
Section 3. New Brighton Code Section 15-199, paragraph (c) is amended as
follows:
(c) No escort service, massage parlor, rap parlor, or sauna parlor shall be
operated within six hundred (600) feet of any residentially zoned district, a
church, a nursery, elementary, ~unior high or high school, or any estab-
lishment frequented by juverdles.
The provisions of this para~:raph (c) shall not apply to a massage parlor
which is accessory to a.primary use of the licensed premises as a barber
shop, or hair or beauty salon~ provided all of the followin~ conditions
are met:
(1) the primary use has at least the equivalent of two
full-time employees en~a~ed in the primary, business use.
(2) no more than fifteen (15) percent of the premises is
devoted to the massage use.
(3) the primary use has a capital investment in
furniture, fixtures and equi~pment of at least thirtlr
thousand dollars ($3(~000).
(4) the primary use has been in business in the City for
at least three (3) years.

From the discussion at the last work session on Sheffield, City staff understands that the following
issues are outstanding:
1. Research further the capabilities and fee structures of Affordable Suburban Housing
2. Identify ways to lessen the City investment of $1.2 million in the project
3. Finalized local lender participation in the construction financing or mortgage takeout financing
of the perspective buyers
4. Provide comparison of duplex homestead/rental program with other redevelopment alternatives
such as land clearance, etc.
5. Identify other companion projects that could work in unison with the thirty-two duplex
homestead project
Following is an update of City staff's effort to address the above concerns and issues:
1. Other Development Scenarios--Enclosed please find four various tables and tax increment
information that compares the proposed homestead rental concept with other development
alternatives such as land clearance.
2. Jim Larson Tour--Jim Larson has invited us on a tour of the 20 duplex Hawthorne's
neighborhood, the Stevens' Court project, and an 18-unit department project which he has
renovated. I need to have a couple of late afternoon dates that the City Council could
participate in a City bus tour of the properties.
3. Hawthorne Project- -As I stated previously, Don Schneider and myself did discuss neighborhood
revitalization with Northside Housing and also supplied you with further information regarding
Northside and Mr. Larson's participation in the Hawthorne project.
4. Local Bank Involvement--I am currently receiving information from the banks regarding their
construction financing and mortgage takeout financing for the project. I expect all the
information to be in within the next week to ten days.
5. Rchab.ilitation Cost/Fees--I have asked Affordable Housing to "fine tune" their rehabilitation
costs and consultant fees for the project, so as to take advantage of any savings so as to lessen
the City's financial participation in the project.
6. MHFA Meeting--Wayne Simoneau has offered to host a meeting between Jim Solem of the
Minnesota Housing Finance Agency in order to determine if greater levels of participation could
be made available by MHFA.
7. AFL-CIO Inv~stmen~ Tr~lst--Councilmember Nawrocki previously identified the availability
of funding from the AFL-CIO Investment Trust. A packet of information has been forwarded
to the City by union officials. It appears their participation will be linked to union job creation
and will likely come in the form of mortgage financing.
8. Citizen Update--City staff is in the process of preparing a short article for the next City
newsletter and a short cable production that updates the citizens on the status of the Sheffield
Neighborhood.

9. Exclusive Contract Expiration--As a point of information, the redeveloper's exclusive contract
will expire on November 16, 1994.
10. Other Fllndin_~ Source--To lower the City's participation in the project, some have suggested
soliciting participation by Anoka County, contracting the project with ACCAP, applying for
excess Section 8 funds for use in the project, apply for rental rehabilitation funding through
MHFA, etc.
11. Other Neighborhood Red0velopment- -Identify other companion projects for the neighborhood
such as r~habilitation of single family homes, or rehabilitation/conversion of the larger
apartment buildings using revenue bonds/MHFA programs.

Attached please find four separate tables that review the development costs, private/public investment,
and tax impact of undertaking the different redevelopment scenarios in the Sheffield Neighborhood.
For comparison and illustrative purposes, we've only compared undertaking a redevelopment of twenty
duplexes on the Pierce/Fillmore block. In the case of the homestead duplex program, it involved
thirty-two properties. Similarly, I suspect that the other scenarios would involve more than just the
twenty buildings on Pierce/Fillmore block in order to address the problem. In order for the
development scenarios to be truly cost effective, a combination of the above programs would also have
to be in place for the redevelopment of the properties beyond the Pierce/Fillmore block.

RE: Sheffield Tax Increment Projections
As requested, attached is a copy of three tax increment projections for the Sheffield Development.
The first assumes 20 duplexes or 40 units of total housing with half of the units assessed as rental
units and half as homestead units. The second projection assumes 50 units of owner-occupied
townhomes valued at $75,000 each. The third projection assumes 20 residential homes valued at
$80,000 each. All of the runs assume that the units are constructed in 1995 and that the type of tax
increment district would be redevelopment. There is a local government aid penalty associated with
redevelopment districts established after 1990 which is equal to approximately 15 percent of the total
tax increment. The only type of tax increment district which is not subject to the LGA penalty is a
qualified housing tax increment district. This type of district, however, carries fairly significant
income restrictions and may not be applicable to this project.
Below is a summary of the net tax increment which the City could realize from each of the
projections at an assumed rate of 7 percent interest after a 5 % administrative fee is deducted for the
administration of the district:
