PETITION AND WAIVER OF SPECIAL

Attached please find a Petition and Waiver form that the City of Faribault uses to allow property
owners to use City contract prices and specially assess the cost of miscellaneous improvements such as
water/sewer service repairs, sidewalk repairs, or additional elective work requested by a property
owner in conjunction with a special assessment project ordered under normal procedures.
Each year, Faribault received bids for various miscellaneous concrete work and sewer/water service
repair work. If a property owner requested to utilize the contract rates, then an estimate was provided
and a Petition and Waiver form is executed. After the work was performed, the property owner
received normal notice of the payment due and allowed thirty days for payment submittal. In the event
the bill was not paid within thirty days, the item was automatically certified after adoption of a
miscellaneous assessment roll by the City Council.
Please review the Petition and Waiver form and give me your thoughts on implementing a program of
this nature in Columbia Heights.

TO THE MAYOR AND MEMBERS OF THE COLUMBIA HEIGHTS CITY COUNCIL,
COLUMBIA'HEIGHTS, MINNESOTA:
For and in consideration of the utilization of certain
contract rates negotiated by the'City of Columbia Heights, the
undersigned legal owner (owners) of the property located at
and legally described as
respectfully petition the Columbia Heights City Council for the
followingdescribedpublicimprovement:
The undersigned hereby waive (waives) all rights with
reference to a hearing or other formalities to which the
undersigned would be entitled under Minnesota Statute S 429.011 et
seq, Minnesota Statute § 435.193 to 435.195, under the City Code
Sections 4.101, 4.102, 4.103 and Under the Columbia Heights City
Charter Sections 76-86. Further; the undersigned specifically
waives the formal Notice of Making Assessments; Notice for
Confirmation; and the right to appeal as provided in Minnesota
Statutes 429.036 and 429.081 or any other applicable law. The
undersigned also consents to paying the interest rate set by the
City Council if the installment method of paying for the
improvement is elected by the undersigned.

Dear Linda:
Enclosed please find Hilltop's check in the amount of $365.10 in
payment of acknowledged cable commission expenses. Based on the
number of cable subscriptions in our respective communities, it
appears that Hilltop's cost factor is seven percent. I am
therefore tendering seven percent of the following amounts:
$1987.68 of travel/conference/etc.; $2,339.65 of subscriptions/
memberships/etc.; $36.35 of postage/telephone; $12.06 of advertis-
ing; and $840.00 for the cable commission secretary. These
expenses total $5,215.74. I computed the cable commission
secretarial expense as $70.00 x 12 monthly meetings.
Mayor Shear returned from a cable commission meeting with an
understanding that Columbia Heights was contemplating a very
substantial six figure investment to facilitate and improve the
quality of televising the Columbia Heights Council. It was Mayor
Shear's belief that this proposed significant investment would not
result in any future claim to the City of Hilltop. If our
understanding of the situation is in any way incorrect, would you
please write to me for clarification.
I have suggested to Mayor Shear that he discuss with the cable
commission the possibility of holding at least one commission
meeting annually in the City of Hilltop to facilitate communication
and input between the commission and Hilltop subscribers.

Dear Ms. Magee:
I have been asked to respond to your letter of March 31, 1993 to
the Hilltop City Clerk. Seemingly, each year, at least for the
past few years, we have gone through a perhaps rancorous process
regarding cable television expense billing. Each year, Hilltop has
complained that the billing has been lacking in any detail and
particulars, and I think in most years we have eventually reached
a compromise. While we have agreedito pay a proportionate share of
the expenses of the cable commission, Hilltop has never agreed to
pay Columbia Heights for a share of the City Manager's salary or
the salary of any other employee of Columbia Heights. Hilltop has
never agreed to pay any portion of legal expense that Columbia
Heights may incur. An exception'would be the cable commission
secretary who may otherwise be 'a full-time Columbia Heights
employee. We understand that her compensation is $70.00 per
commission meeting. :
Not only did we not authorize or agree to the apportionment of
services in 1992 wherein the Columbia Heights City Manager spent
10% of his time on cable television matters and the Assistant City
Manager spent 15% of her time on cable matters, we simply cannot
fathom how or why the cable system Should require hundreds of hours
and thousands and thousands of dollars of top administrative time
and talent. For instance, what did you do in 1992 that caused you
to spend 15% of your time on cable television matters? Whatever it
may have been, it assumedly had nothing to do with the City of
Hilltop, was not for Hilltop's benefit, and was certainly not
requested by the City of Hilltop.

If the billing is meant to reflect time spent by Columbia Heights
on the cable franchise transfer, then it is necessary for you to
understand that the City of Hilltop went through the same process
of approving the transfer and its council, clerk and city attorney
likewise devoted substantial amounts of time to the franchise
transfer including the preparation and adoption of ordinances.
Both cities had to essentially go through the same process of
approval of the transfer.
It simply has never occurred to the City of Hilltop to attempt to
charge back its administrative time and costs to either the
commission or the City of Columbia Heights.
To the best of our knowledge, while we are being billed for a
proportionate share of the 50% of time spent by the special
projects coordinator, I don't believe that the Hilltop Council even
knows who that individual is but certainly that person has never
worked on a special project for Hilltop. Either we have a very
substantial breakdown in communications or the person in question
works exclusively on Columbia Heights projects. To the best of our
knowledge, neither Hilltop nor any of its citizens have ever used
the access channels. Each community has essentially dealt with
cable television as it deemed best. Columbia Heights may make
substantial use of access channels for its council, commissions and
for its citizen projects. Philosophically, Hilltop has only
attempted to provide cable service to its residents.
It would appear that Hilltop should certainly share on a
proportional basis the $70.00 per meeting expense of the cable
commission secretary. Likewise, Hilltop should share in the
$1987.68 of expense for travel/conferences/schools, $2339.65 of
expense for subscriptions/memberships/miscellaneous charges and
$36.35 of expense for postage and telephone assuming that the
latter expenses were generated by the cable commission and/or its
secretary. As your letter points out, the commission attorney
services were reimbursed in the Hauser transfer. In fact, since
the total attorney fees for 1992 were $23,836.62 both for the
commission attorney and the Columbia Heights City Attorney, it
appears that the reimbursement for attorney cost of $24,969.52 was
in excess of the commission attorney costs and the Columbia Heights
attorney costs. Was the balance meant to compensate Hilltop for
its legal expense in approving the franchise transfer?
Unfortunately, Hilltop and Columbia Heights seem to have almost an
endless number of matters in controversy. It is my sincere wish
and intent to not find one more thing to argue about or litigate.
Unfortunately, this cable matter has dragged on through the years.
I believe that there have even been years when Hilltop requested a

breakdown of expenses and we then heard nothing furthe~ from
Columbia Heights. As I recall, in another year, we argued about
legal costs when Columbia Heights decided to sue the cable company.
In another year, we simply settledlthe expense matter by allowing
Columbia Heights to keep the entire proceeds of a bond.
As with most problems that afflict us, this problem may result
primarily from a failure to communicate. I can tell you however
that the Hilltop Council feels veryuncomfortable when it is billed
for a proportionate share of the salaries of Columbia Heights
employees. For instance, as to the 15% of employee services you
rendered to cable television, what was it that you did, why did you
do it, what input did Hilltop haVe, and what benefit inured to
Hilltop? It is possible that the Columbia Heights administration
and council were totally unaware that Hilltop had to go through the
very same franchise approval process as did Columbia Heights. We
had the same cable company attorneYs and representatives appearing
at Hilltop Council meetings as appeared in Columbia Heights. I
spent significant amounts of time meeting with the cable company
attorney working on the details of the necessary Hilltop resolution
and ordinance.
One long term solution may be to have Hilltop participate in the
administration process. Another'solution may be to create an
offset by having Hilltop charge back its personal services related
to the cable commission and cable television. Since the franchise
has been in place for a number of years, a partial solution may be
better communications wherein Columbia Heights explains why such
significant amounts of time and effort are being devoted to
administering cable television. For you to be spending more than
one hour of each working day on cable television matters is
absolutely mind-boggling unless the cable system is so screwed up
that there is a daily problem of crisis proportions. This is
particularly true where the city manager is spending more than 45
minutes each day on cable television matters. Likewise, Mr.
Anderson's secretary was also allegedly devoting more than one hour
of each working day to cable television matters.
Unless the system is totally out of control, the Hilltop Council
simply does not understand what is going on.
Finally, the expenses and cost distribution being at issue, I
assume that you will not be claiming service charges until such
time as we can resolve the amount in dispute. I would be happy to
meet with you and/or representatives of the finance department to
seek some clarification and resolution of this issue. Also, if the
Columbia Heights Council has direct'ed staff any significant amounts
of time in 1993 on cable television related matters, could you

You questioned what services were provided by legal counsel totaling over $23,000.
These services were provided by Tom Creighton, the Attorney for the Cable Commission.
The reason it was relatively higher this year than in the past is because of the time
involved in the transfer of ownership of the cable system. It should be noted, however,

As can be seen from this breakdow~ costs are being distributed between the two
communities on the basis of the average annual number of subscribers between our
two communities. The costs are pro-rated on the basis of the number of subscribers
within each community as compared !to the total number of subscribers in the cable
service territory. The results of this calculation is that the City of Hilltop is
responsible for $3,370.03 of the total cost as previously indicated.
I would appreciate the City Council authorizing reimbursement of $3,370.03 as the
City of Hilltop's net share of rehted expenses associated with administering the joint
cable communications franchise. For your information, I have attached a more
detailed explanation of expenses associated with each major object of expenses.

PURPOSE
The City of Col,-~hia Heights and the City of H~11top desire to act Jointly ~n
the study, preparation, and granting of a cable commun/cations franchise. Granting
of said franchise shall be pursuant to the rules and procedures of N/nnesota Cable
Connnunications Board, and the approval of the respective Cities.
II. METHOD
In order to carry out the purpose of this Agreement, the parties hereto, agree
to appoint a Jo/hr Cooperative Co~ssionwhich shall be representative of all parties
hereto.
III. R~CHTS AND DUTIES
It shall be the duty of said Co~m;ssion to act on mutual behalf of all parties
hereto.
The Joint Cooperative Co-~ssionmay act or cause others to act at their discretion
/n any manner regarding the study, preparation and sranting of said cable communications
franchise to the extent authorized herein and hereafter by the Council of the said
Cities.
The Joint Cooperative Co~t=sion shall consist of seven (7) mmbers appointed by
the City Councils of those parties hereto. There shall be five (5) members appointed
by the Col,-.hia Heights City Council and two (2) members appointed by the H~lltop
City Council. The seven member Joint Cooperative Cow~ssion shall include one council
person for each City.
Each member of the Co~ssion 8hall serve for a term of two (2) years. All
terms shall begin as of the date of execution of this Agreement. At such time as
a term ex, Ires, it shall be fllled by an appointment from the~,m~c~paltty whom
the member formerly represented.
If a seat on the Cc.~8sion becomes vacant before the terms of said seat has
expired, it shall be filled by an appo/ntuent from the Bember formerly represented.
IV. SHARING OF EXPENSES
All expenses incurred pursuant to this Joint ~ooperative Asreement &nd expenses
incurred as of the date of this asreement bY the Col,-~ia Heights - Hilltop Cable TV
Advisory Committee shall be shared by the Cities on a proportional basis determined by
the population of the respective Cities according to the ~ost recent United States Census.
V. Tm~IINATION
This A~re~ment stroll continue in effect until such tim~ ~s the parties ~utually
agree to the termination of their rights, duties, and obligations hereunder or until
such time as the Joint Cooperative Commission shall indicate to the parties Zhat the
purpose of this A~reement is unattainable. !
Upon termination of the existence of the Joint Cooperative Cc,,~esion, all property
or funds held by the Joint Cooperative Commission shall be distributed to the parties
of this Asreement in the same proportion ag they have agreed to share expenses

The purpose of the hearing was to consider elimination of the
HRA and the creation of an Economic Development Authority. The
Council directed staff to incorporate the record keeping
functions of the HRA into the City's and to schedule a joint
meeting between the City Council and the HRA for further
discussion.

Approved January 11, I993 as the date for a public hearing to
receive input on the criteria for the City Manager position.
Authorized the purchase of a closed circuit tv sewer
inspection system from Aries Industries of Sussex, Wisconsin

AGREEMENT FOR BUILDING INSPECTION/REHABILITATION
SPECIFICATION WRITING SERVICE
This agreement made this__day of , 1993, by and
between the Housing and Redevelopment Authority of Columbia
Heights, a body corporate and politic, organized and existing under
and by the virtue of the laws of the State of Minnesota,
hereinafter called the "HRA" and the City of Columbia Heights,
hereinafter referred to as the "City".
Whereas, the HRA desires to avail itself of certain building
inspection and rehabilitation specificationwriting services;
Now, therefore, the HRA and the City do mutually agree as
follows:
1. RENTAL ASSISTANCE PROGRAM INSPECTIONS:
I~itial Le~se-uu insDec_tions: The initial lease-up
inspections are to be completed within two (2) days of
the request placed by the HRA. These inspections wilt be
coordinated by the Occupancy Specialist/Housing
Coordinator, hereinafter referred to as the "HRA staff
member." If violations of the program Housing Quality
Standards are found, the Assistant Building Inspector,
hereinafter referred to as "City Inspector," is to
immediately notify the owner of the property being
insDected via a copy of the inspection report and a
written indication as to what work must be performed on
the property in order to meet HQS requirements.
Further, within twenty-four (24) hours after being
notified by the owner that the required repairs have been
completed, the City Inspector is to complete a folloW-up
inspection. If the work meets all specifications, a
final inspection report is to be furnished to the HRA.
The City Inspector shall continue to inspect the property
until such time as the property meets all HQS
requirements and a final inspection report has been
furnished.
Special/Interim Inspections: If a tenant of a unit being
assisted through the Rental Assistance Program requests
that a special inspection be performed on the rental
unit, the City Inspector shall inspect ~aid unit within
two (2) working days after receipt of the request. If
the unit is in violation of HQS requirements the City
Inspector shall notify the proper=y manager/owner of the
violations and normally indicate that they have thirty
(50) days in which to correct the violations and meet the
HQS requirements. The unit is to be reinspected until
such time as the violations have been corrected and the

unit meets all HQS requirements. A copy of the
inspection report and all subsequent correspondence on
the matter is to be provided to the HRA.
Annua~ NOS Inspection: The City Inspector shall perform
an annual HQS inspection of each of the Rent Assisted
Units. The HRA staff person will provide the city
Inspector with a comprehensive list 'of the names,
addresses, and phone numbers of the tenants and landlords
who require an annual HQS inspection. 'The inspections
are to be scheduled, by the city Inspector, with each
tenant, and are to be completed within ten (10) days of
the date of the request from the HRA ~taff member.
Property owners/ managers are to be notified immediately
cf any HQS violations and will normally be allowed thirty
(30) days in which to correct any violations. The City
Inspector shall reinspect the units as necessary and
until such time as all violations are corrected.

~.ama~eInspectlon: Upon request of an owner, and within
twenty-four (24) hours of the owner's request, the City
Inspector shall complete a damage inspection of any
vacated units where the owner anticipates that damages to
the unit will exceed the. damage deposit for the unit.
The City Inspector will record the inspection report of
the required Metro HRA Damage Inspection Fo~m. The
original of t_he completed inspection .form is to be
furnished to the HRA staff member within 24 hours of the
completed inspection.
HOUSING REHABILITATION PROGRAM INSPECTIONS/WORKWRITE-UPS:
The City Inspector, upon request of the HRA staff member and
within three (~) workdays of the request, shall complete an
inspection of any and all houses and rental buildings/units
being proposed for rehabilitation with funds: provided by or
through the HRA. Within three (3) days of the completion of
the inspection, the City Inspector shall provide a written
specification of the work that must be completed.
Additionally, the City Inspector will provide bid alternatives
as necessary.
The HRAstaff member will coordinate the receipt of bids. The
City Inspector will review and comment on the bid~ received,
as necessary. As necessary during, and upon completion of the
rehabilitation, the City Inspeotor will inspect the work. The
city Inspector will sign the necessary Certificate of
Completion when the work on the property is completed.
ADMINISTRATIVE MATTERS
A. ~ The City Inspector shall use all required Metro
KRA forms and furnish copies of all completed forms and
letters to the HRA staff person.
B. ouality. Controll Metro HRAcompletes 5% Quality control
~QS inspections each year to insure that units are being
properly inspected. Additionally, the HRA staff person
will be allowed to accompany the City Inspector for.the
purpose of completing rent comparisons.
C. ~ The city Inspector shall attend any required
Metro HRA HQS training/workshop.
REIMBURSEMENT BY HRA TO CITY OF COLUMBIA HEIGHTS
In consideration for the above-listed services the HRA shall
reimburse the City of Columbia Heights, on a monthly basis,
forty percent of the salary and benefits of the City
Inspector. Further, the City of Columbia Heights shall, as
far as possible between the aate oft his contract and December
31, 1993, track the hours expended by the City Inspector on
the tasks outlined above. The purpose of this tracking is to
enable the parties to better evaluate the reimbursement
provisions of this agreement.

Recently an inspection was made of a rented dwelling unit in your
building at q010 Hayes Street N.E. Columbia Heights, UN. Listed below
aru the code violations which were found according to the C|ty~s Housing
t~aintenance Code. Reference City Code 6.202, Ordinance 921 effective
11/lq/80. Uniform Housinq Code 1979 editlan.
1. S03(a). Habitable space not including kitchens, halls, and bathrooms,
must have a minimum ceiling height of 7'6" for at least t~o-thlrds of
the area. Not less than 7' for the rest of the area is required
except that projections shall not extend beiog a height of 7' in
any of the floor
Presently the bedroom has a ceiling heights of 7 feet with projections
measuring 6'7'6. These measurements do not meet code.
SOS(a). Every d~eiling unit shall be provided with a bathroom equipped
with facilities consisting of a water closet, lavatory, and either a
bath tub or shower.
This dwelling unit has a ~ater closet but not a lavatory. This does not
meet code.
SOS(c). Every kitchen shall be provided with a kitchen sink.
This kitchen has a lavatory which does not ~neet this requirement.
SOS(f). A room In which a water closet ls located shall be separated

Following receipt of my letter dated July 13, 198/1 to Marcia Schlaeger, a
Mr. B.D. Rohna stopped at ¢lty Mall to see me. Hr. Bohns is · consulting
engineer that has been ~orking with Ms. Schiaeger. He requested information
as to what could be done to resolve the prob)em. It was my understanding
that Ms. $¢hlaeger would be contacting the adjoining property ~ners
regarding the possibility of · .joint rezonlng request for kO00, kO10, kO20
and /t030 Hayes Street. The four lots would meet the mlnlmum square footage
requirements for a duplex. It *is anticipated that she wlli be submitting

unit been occupied by more than three unrelated adults.The rent from this

Uf~er the divorce settlement, since the Appellant is no longer residing
et the property, the husband ts forcing the sale in accordance with the
dtforce decree. The hous~ has been listed continuously for sale since ,luly,
19~4. First with Coldwell Bonker, then with £dina Realty and currently with
Stafford Re41ty. In this period the asking price h~s been reduced from $115000
to $105900. However no offers have I~.n received because of the Indefinite
statu~ of toe single family vs duple~ problem with the City. The current
Realtor advises that because ofthe proble~ with the City tt~re is nochance
to sell the house as a duplex. The current estimated sales price as a single
family hone is $89000.
7. In this ctrc~nstance the Appellant appeals the stop order on completion of
the co~lverston to duplex in accordance with tile plans Ortgirally filed and
approved. Copies of these plans are attached.
If this appeal is denied the Appellant will procuea to ~ell the house as a .

Mr. Goranson explained the appeal request of Ms. Schlaeger regarding a "Stop

Schlaeger to convert the single family home to a duplex ~lth a 12'x22' addition
onto the rear of the home. Upon eerie,41 of the plans submitted, It hid been
deLernlned that 4010 Hayes Street wis located in an R-2, T~o Family Residential
District according to the zoning ap utilized et that time by the Zoning
Administrator's off]ce.
On June 25, Ig84 a fom~l "Stop blork" order ~as issued to tis. Schlaeger. Thls
came about due to investigations conducted after receipt of complaints from
residents In the area. It wes found that the original zoning map in the ~onlng
Administrator's office v~s Incorrect lad that the area bounded by Polk Street
on the ~est, 41st Avenue on the north, 40th Avenue on the south and Hayes Street
on the east ~$ actually supposed to be Included in the R-1 zoning district
according to the zoning map adopted on August 12, 197&.
Ms. Schlaeger vas told In the letter dated June iS, 1~8~ that an alternative
to th~ denial of the construction of the duplex at 4010 Hayes uould be to
petition the City Councll for t change in the zoning from R-I to R-2 to allow
for a duplex.
Hr. Goranson re-Iterated that the "Stop Idork" order was Issued June 25, 198q.

Mr. Goranson presented the rezoning case for Lots 1-5, Block 18, Auditor's Subdivision
of Walton's 2nd Sub., which included all property bounded on the south by 40th
Avenue, on the west by Polk Street, on the east by Hayes Street and on the north
by 41st Avenue. The rezoning proposed wou]d be to change the area from R-l, Single
Fami]y Residential, to R-2, Two-Family Residential. Mr. Goranson informed the
Commission that the minimum lot area required to have a duplex in a R-2 area wou]d
be 8,400 square feet. Of the fifteen parcels located within the area in question,
eight (8) have the adequate land area for a two-family dwelling. He a]so stated
there was one existing dup]ex at 4000 Hayes that was grandfathered-in.
A number of residents from the area were present to voice their disapproval of the
rezoning proposal. Marv Simonson of 4040 Hayes Street presented a petition with
nineteen (19) signatures of residents from the area that are opposed to the rezoning.
He felt the change in zoning would lower the value of the properties in the area. He
also stated there was a problem with vehicles being parked in the street and on the
front yard at 4010 Hayes Street due to the lack of sufficient parking being provided
for the illegal duplex. -
Jo Wieczorek of 4047 Hayes Street wanted to know why the rezonlng is being requested
again when the area's residents "shot down" a previous request some years back. It
was explained that residents change as do the needs of the neighborhood, and the
public hearing was held to find out the feelings and opinions of the residents.
A daughter of Mrs. Antochy, 4000 Hayes Street, was in attendance representing her
mother and was concerned about the status of the existing duplex. Mr. Goranson
explained the non-conforming status and also explained that the duplex was
"grandfathered-in" from the previous R-2 zoning from the 1950's.
Motion by Nixon, seconded by Harkow, to recommend to. the City Council the denial
of the rezoning request. Roll Call: All Ayes.

· Conditional Use Permit, 1420 Molan Terrace, Kenneth Kottom
fir. Kottom is requesting a condltlonal use permit to allow the construction of a
14' x 20' accessory structure at 1420 Molan Terrace. The structure w111 be located
in the rear yard along the northwest side property line and 23' from the rear pro-
per:y mine. ~wo neighbors spoke in opposition to this matter. Counciimember Peterson
stated that the Planning and Zoning Corr~lsslon had recormnended approval based on
certain stipulatlons and noted that Mr. Kottom could build a garage without a condi-
tional use permit. Mayor Nawrocki had concern with access if a garage were constructed.
The Building Inspector noted there would be access. Councilmember Peterson suggested
that an approval motion include that the use of the structure was for storage only.
Motion by Peterson, second by Carlson to approvea conditlonal use permit with the
following stipulations:
a. Maximum height of structure - 12' from floor to peak of roof
b. Haxlmum width of door - 6 feet
c. Color to match dwellings
d. Building must be secured to ground
e. Building to be used for storage only.
Councilmember Carlson stated he would support the motion only because a garage could
be constructed without a conditlonal use permit.

4. Rezoning of Property Bounded by 40th Avenue, 41st Avenue, Polk Street and Hayes
Street - First Reading of Ordinance No. 1128
The Building Inspector gave the details of this rezoning. The rezoning request had
been made to the Planning and Zoning Commission and after holding a publlc hearing
>.~ the r~tter the Commission recommends denial of the rezoning. Legal counsel for
the owner of the property in question reviewed the history of the request to change
the property from a single family dwelling into a duplex plus an addition. It was
noted by the Building Inspector that the addition had not been completed nor had
a certificate of occupancy been issued. The Building Inspector had receive information
from a former resident stating that this property was in a R-1 zone and not an R-2
therefore making a duplex in the area non-conforming. He issued a stop order on
July 13, 1~84. It was noted by a party who had worked on the construction that this
buildlng had been occupied as a duplex since February'of 1~84. A property owner in
the area stated that a request to change this build|ng into a duplex had been made
many years ago and had been denied based on the negative responses of the neighbor-
hood residents at that time.
£ouncilmember Paulson inquired what changes in the building could be applicable to
a single family dwelllng. The builder responded that it could be converted back to
a single family dwelling but could not suggest any specific changes which could be
applied back to the betterment of the home. It had been the Intention of the owner
to sell the property and a real estate agent reviewed the activlty that has been
generated In this area.
Hotion by Paulson, second by Peterson to deny the rezoning request based on the
recon~nendation of the Planning and Zoning Commission. Roll call: All ayes
Ordinance No. 1128 which had been prepared if a rezoning were granted was not read.
c. Request by Resident of 4615 Taylor Street Regarding Alley Approach
The tenant at 4615 Taylor Street, Steve Ronkowski, sent a letter to the City Manager
requesting Improvements on the alley behind thls address as well as an improvement
to the alley approach to 46th Avenue. The City Hanager requested Council direction
regarding a public hearing on this project. He.had driven this alley and noted no
problem with "bottoming out" with his light weight vehlcle. Mayor Nawrockl had
6~i~en the a~e¥ and had experienced "bottoming out". It was noted that the street
is shaped In such a manner to accommodate drainage needs.
The owner of the property at 4615 Tayler Street, Steve Thorsen, suggested that
