HomeMy WebLinkAboutOrdinance 1326ORDINANCE NO. 1326 BEING AN ORDINANCE CREATING SECTION 10.108 (7) OF THE COLUMBIA HEIGHTS CITY CODE WHICH MAKF.~ UNLAWFUL THE POSSESSION OF TOXIC SUBSTANCES LISTED IN MINNESOTA STATUTES CHAPTER 609.684 BY PERSONS UNDER THE AGE OF 18 WHEREAS, state law makes it unlawful to sell certain toxic substances to persons under the age of 18: and WHEREAS, it is logical that persons under the age of 18 should not possess these same toxic substances. NOW THEREFORE BE IT ORDAINED by the City Council of the City of Columbia Heights that section of the Columbia Heights Code be created to read as follows: Section Possession of Toxic Substances: S.u. bd. !. For .purposes of this section "toxic substance" means: (1) ~lue, cement, or aerosol paint containing toluene, benzene, xylene, amyl nitrate, butyl nitrate, nitrous oxide, or containing other aromatic hydrocarbon solvent& but does not include glue, cement, or paint contained in a packaged kit for the construction of a model automobile, airplane, or similar iteml (2) butane or a butane lighter or (3) any similar substance declared to be toxic to the central nervous system and to have a potential for abuse, by a rule adopted by the commissioner of health under chapter 14. Subd. 2. It shall be unlawful for any person under the age of 18 years to possess any toxic substance except while these persons are under the direct supervision of a parent or guardian[ or, are engaged in employment or educational activities that require the use of these toxic substances. Subd. 3. A violation of this section is a petty misdemeanor and violators may be required to p.articipate in a community service proiect in addition to a fine.
