HomeMy WebLinkAboutOrdinance 1285ORDINANCE NO. 1285 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, AND PERTAINING TO HOME OCCUPATIONS The City of Columbia Heights does ordain: Section 1' Section 9.103 (31) of Ordinance 853, City Code of 1977, which currently reads as follows, to wit: 9.103 (31) Home Occupations: Any gainful occupation or profession engaged in by an occupant of a dwelling unit. Such use must be clearly incidental and secondary to the principal use of the dwelling for residential purposes and shall not change the residential character of the dwelling or have an adverse effect on adjacent properties nor constitute a nuisance or safety hazard. Section 2: Section 9.107 (3) (d) of Ordinance 853, City Code of 1977, which currently reads as follows, to wit: Home Occupations subject to the following conditions: No outside storage of products, materials, or equipment connected with the home occupation is permitted. The home occupation must be conducted within the principal building or residential garage. If the home occupation is conducted in a garage, the minimum amount of required garage parking spaces shall be maintained for parking. o The home occupation shall meet all applicable fire and building codes as well as any other applicable City, State, or Federal regulations. At no time shall the home occupation generate traffic or parking that exceeds the type and level which typically service single family residences. Traffic and parking which exceeds the type and level typically servicing single family residences shall be deemed to constitute a nuisance and/or safety hazard. No use of mechanical equipment or process shall be used which generates noise, fumes, odor, smoke, glare, vibration, electrical interference, waste or puts a strain on public utilities other than is reasonable for a residential zoning district. An additional person or persons, other than the occupant of the dwelling, may report to the residence for work purposes, but only if the reporting of the additional person (s) is clearly incidental and secondary to the principal use of the dwelling for residential purposes and does not change the residential character of the dwelling or have an adverse effect on adjacent properties nor constitute a nuisance or safety hazard. Signage pertaining to the home occupation will be allowed on the premises not to exceed two square feet and provided it be attached to the wall of the structure and not be inlluminated. Any home occupation shall be subject to a one-time registration, with the fee for such registration as determined by the City Council. Each registration will include, as a minimum, the address of the home occupation, the name of the occupant, and the occupation or profession involved. Any home occupation which does not meet these specific conditions for a permitted home occupation shall not be permitted. Section 3: Section 9.107 (2) (g) of Ordinance No. 853, City Code of 1977, is hereby deleted in its entirety. Section 4: This Ordinance shall be in full force and effect from and after thirty (30) days after its passage.
