HomeMy WebLinkAboutOrdinance 938NO ACTION TAKEN ORDINANCE NO. 938 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, RELATING TO BOULEVARD PARKING The City Council of the City of Columbia Heights does ordain: Section l: -Section 7.202(6) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which currently reads as follows, to-wit: "No person shall park or stand any vehicle on a boulevard or allow a vehicle to remain on a boulevard within the City, except: (a) When authorized by the Chief of Police on an emergency basis, or (b) When permitted by action of the Council during, repairs of adja- cent streets." is herewith amenhed to read as follows, to-wit: "No person shall park or stand ~ny vehicle on a boulevard or .allow a vehicle to remain on a boulevard within the C~ty, except: (a) When authorized by the Chief of Police on an emergency basis; ?" (b) When permitted by action of the council during repairs of adja- cent streets; ~c) When issued a permit by tha Cf.ty Council, The City Council may only issue suck permits to applicants meeting the following conditions: (i) The City Council determ/nes that the applicant cannot park at any other place on the property on which his residence is lo- cated without violating the zoning laws relating to pe=mitted offstreet parking; (ii) The City Council determines that permitting such parking will not impede the plowing, removal or storage of any snow, ice or waste from the public right of way; (iii) The City Council determines that permitting such parking will not obstruct the normal flow of pedestrian traffic from adjoin- ing properties and will not obstruct the delivery of emergency services to the affected property or any other property; (iv) (v) The permit will only allow the parking of vehicles at such lo- cation as is designed by the City Council; The permit may be revoked by the City Council if the City Council later discovers that the subject vehicle will impede the plowing, storage or removal of snow, ice or waste from or at the location of the vehicle; provided, however, that the City Council shall give notice of such revocation by post- ing a notice to that effect on the subject vehicle for not less than two (2) hours; (vi) No permit shall be valid for a period in excess of ten hours; (vii) No more than five (5) such requests in any calendar month may be made for the s~ame address; (~iii) No permit shall be valid unless clearly displayed upon the permitted vehicle; (ix) No permit shall be issued except between November 1 of any year and April 15 of the next succeeding year; (x) Any act of the designated representative of the City Council shall be construed as the act of the City Council for pur- poses of this Section 7.202(6). (d) Issuance of a permit by Council action shall in no event ever allow boulevard parking retroactively. Section 2: This Ordinance shall be in full force and effect from and after thirty (30) days after its passage.
