BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY 0ODE OF 1977,
VACATING A CERTAIN EASEMENT
The City of Colmnbia Heights does ordain:
Section 1:
The City of Columbia Heights herewith vacates the roadway and
utility easement over, across, and under the following described
property, to-wit:
Beginning at a point located at the Northeast corner of Lot 1,
Block 84, Columbia Heights Annex, proceeding West 107 feet along
the North property line of said Lot 1, Block 84; then North 4 feet;
then East 107 feet on a line parallel to the North lot line of said
Lot 1, Block 84 and South 4 feet to the point of beginning, all
according to the recorded plat thereof on file and of record in the
office of the Register of Deeds in and for Anoka County, Minnesota.
Section 2: This Ordinance sh~ll be in full force and effect from and after
thirty (30) days after its passage.

At the May 26th Council Meeting, the City Manager submitted a letter received
from Mr. Walter Thorsen, previous owner at 3856 Quincy Street requesting
vacation of an easement along 39th Avenue. In addition, the City Attorney
also indicated the results of a phone conversation conducted with Mr.
Thorson's attorney. As a result of the May 26th Meeting, the Council
instructed staff to prepare an ordinance calling for the vacation of a five
foot easement along 39th Avenue.
As has been discussed with the City Council in the past, staff does not
recommend vacation of the five foot easement since it will place the City in
an adverse situation regarding State Aid funding for Bgth Avenue. Presently,
39th Avenue is a State Aid Designated Roadway, which requires a minimum 60
foot right-of-way. However, as you may recall, the City Attorney suggested
that an ordinance be drafted and submitted to the City Council for its
consideration as a means for fulfilling the requests of Mr. Thorsen, his
attorney, and/or the mortgage companies to clear title for this parcel.
However, staff is recommending that the ordinance be denied, either at the
first reading or at the second reading.
The City Attorney may have additional comments to offer regarding this
matter.
RECOMMENDED MOTION: Moved and seconded to waive the reading of the ordinance
there being ample copies available.
(If the above motion is adopted, a second reading of the ordinance would be
scheduled for June 22, 1987.)
Alternative - RECOMMENDED MOTION: Moved and seconded to deny the first
reading of Ordinance No. 1150 since it would not be in the City's best
interest to vacate any portion of the easement for 39th Avenue.
