ORDINANCE NO. 863
BEING AN ORDINANCE REGULATING AND LICENSING THE REMOVAL AND
TREATMENT OF TREES AND PROVIDING PENALTY FOR VIOLATION
THER[OF
The City Council of the City of Columbia Heights does ordain:
Section 1. No individual, partnership or corporation may cut,
trim, prune, remove, spray or otherwise treat trees for financial
renumeration within the City of Columbia Heights withcut first having
secured a license from the City to conduct such business unless such
individual, partnership, or corporation is the owner of the property
on which such tree is located.
Secti on 2.
(a) Application. Application for a license under this ordinance
shall be made at the office of the City Clerk of the City.
(b) Application Form. The application for a license shall be
made on a form approved by the City which shows, among other things,
the name and address of the applicant, the number and names of the
employees of the applicant, the number ef vehicles of applicant,
together with a description and license number of each vehicle, the
type of equipment proposed to be used, and a description of the primary
disposal site for any trees to be removed.
(c) Liability Insurance. No license or renewal shall be granted,
nor shall the same be effective, until the appiicant shall file with
the City Clerk proof of a public liability insuranc_~ policy covering
all operations of suci; appi'icant under this o~dinance for the sum of at

shall have been replaced. No individual, partnership or corporation
required to be licensed under this ordinance may cut or chemically
treat trees within the City of Columbia Heights without first having
filed the liability insurance required by this section.
(d) Worker's Compensation Insurance. Each license applicant
shall file with the City Clerk a Certificate of Insurance of Worker's
Compensation when such insurance is required by State Statute. No
individual, partnership or corporation required to be licensed under
this ordinance may cut or chemically treat any trees within the City of
Columbia Heights without having first filed the Certificate of Worker's
Compensation Insurance required by this section.
(e) Disposal. No license shall be granted to any applicant if the
primary disposal site for trees is not approved by the Minnesota
Pollution Control Agency. Upon request of the City Clerk or his
representative, any licensee shall forthwith supply evidence that such
licensee has dumped or disposed of all diseased trees only at sites
approved by the Minnesota Pollution Control Agency. Should such
evidence not be supplied within ten days of such request, said license
shall be suspended until such evidence shall be supplied.
(f) The annual license fee shall be set by Resolution by the
Council. In the absence of such Resolution, the annual license fee
shall be $25.00. The license year shall be from January 1 to
December 31 of each year. License fees shall not be prorated.
Section 3. Penalty. Any person violating any provision of this
ordinance shall, upon conviction, be fined not to exceed three hundred
dollars ($300) or imprisoned for a term not to exceed ninety (90) days,
or both.
Section 4. Effective Date. This ordinance shall be in full force
and effect from and after thirty (30) days after its passage.
