HomeMy WebLinkAboutOrdinance 877OPd)INA~NCE NO. 877 BEING /~ ORDINANCE 7d~EkqPII,;G OPJPIN/~NCE NO. 853, CITY CODE OF 1977, PERTAINING TO ZONING REGULATIOh~ OF I~ON-CONFOPd,~ING USES The City Council of the City of Columbia Heights does ordain: Section 1: Section 9.~0~~ of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which reads as follows: "Alterations may be made to a building containing non-conforming residential units when the alteration will improve the livability thereof, provided it will not increase the number of dwelling units nor the outside perimeter of the t. uilding." is herewith amended to read as follows: "Alterations may be made to a building containing non-confoz~ing residential units when the alteration will improve the livability - 'thereof, provided it will not increase the nur~bar of dwelling units nor the outside per~eter of the building. Provided, however, that such alterations increasing the perimeter may be made when the alteration will improve the livabi!ity thereof and provided that a variance is obtained pursuant to Section 9.503, et. seq. In addition to the variance criteria contained in Section 9~503 (~)~ the Board of Appeals and Adjustments may consider the need for fire protection, sanitary facilities, and general safety of the subject building. No such alterations shall be made to buildings which are not structurally sound." Section 2: This ordinance shall be in full force and effect from and after thirty (30) days after its passage.
