Motion by Hosch seconded by Kuutson, that the bid of Sebco, Inc. ~be accepted for the new Liquor store, an~ that it be agreed in the contract that he will supervise the inst,31~tion of the mechanicals, an~ make consideration for the height of the basement. Moticu by Knutson secouded by Hosch, that the bids ~ mechanicals f~r the new Liquor Store, be rejected and the City Manager be authorized to re-advertise fc~ Heating, Ventilating, plumbing and electrical work. Roll 0_~_3'1 - All Ayes. Motion by Hosch seconded by Knutson, that Montgomery Construction Co., be awarded the bid o~ water and sewer for the Anderson Addition and Arthur Street Roll Call - Ail Ayes. ' Motion by J,~l~owski seconded by Knutson, that the City Manager be instructed not te execute a contract with Montgomery Construction Co., until such time as Paul Anderson has executed au agreement with the City of Columbia Heights, for the payment of special assessments to be levied for sewer and wa~er in the Anderson addition. Motion by Hosch seconded by Kuutson, that the City Manager be authorized to proceed with the installation of Curb and Gutter on 6th Street between 46th and 47th. Roll Call - Ail Ayes. A Petition was received for paving of alley between 5th & 6th St.,4Oth to 41st. Motion by Hosch seconded by J~,~l~owski, that the City Manager be authorized to advertise for a Hearing at the August 9th meeting, for paving of alley between 5th and 6th ~treet from 40th to 41st Street. Second reading of Ordinance No.348, Being au Ordinance amending Ordinance No.171, being an Ordinance for the purpose of promoting health, safety, order, convenience and general welfare, by regulating the use of land, the location and the use of buildings anA~ the use of buildings and th$ arrangement of building lots, and the density of population in the City of Columbia Heights. Lots 4.5.6.7.8. and 9, Block 1, Rearrangement of Block "A", Columbia Heights Annex to Minneapolis. Motion by Julkowski, seconded by Hosch, that a special meeting be held at 7:30 on Tuesday, August 2nd, for the discussion of 0~dinance No.348. Roll Call - All AyES. Preamble to ~Ordinance No.349,°~e~g ~ur~n~ce~°~h' secon~e~Len~m~±e~bY ~t~onance authorizing the sale by ~he City Treasurer of $76,000.00 Emergency Debt Certificate." WHEREAS, it became necessary to properly car~y on the functions of Municipal Government of the City of Columbia Heights to proceed with~the local improvement; and ~HEREAS, there are insufficient monies in the city treasury to pay costs currently due, and the city is therefore without funds to pay for contract payments now due; THE COUNCIL hereby and under this preamble declares an emergency exists for the preservation of the public safety and that in order to promptly meet said emergency it is necessary to paSS Ordinance Ne.349 as au emergency ordinance. The City Manager reported that Ordinance No.345 had been signed by the Mayor ~t_ filed with the Secretary of the Council and published in the official newspaper, and that the period for fLl&ug of referendum petitions would expire on July 28. He a~_ne re- ported that it was important for the City to oroceed with the bond ~issue ce~templated by said ordinance so that funds would be available when needed to make payments on existing improvement contracts. C~uncLlman Hosch introduced %he following resolution and moved its adoption, which resolution was thereupon read im full in words and figures as follows: RE~OLUTI(N PROVIDING FC~ PUBLIC SALE OF PERMANENT IMPRGVEMENT RE~OLVING FUND B(2~DS BE IT RESOLVED by the City Council of the City of Col;_~bia Heights, Minnesota, as ~follows: ~l. Unless the proceedings shall be delayed by the ftl~t~g of a referandum petition respecting Ordinance No.345 of the City, this Council shall meet at the time and place and for the purpose specified tm the form of notice of Bond sale hereinafter set forth and to take such further action in respect te the bends therein described as shall then be found desirable or expedient. 2. The City Manager is hereby authorized and directed te give notice of the time, place, and purpose of said meeting by causing notice thereof to be published one issue ef Col_~mbia Heights record and i~ one issue of Commercial West, a ~inancial periodical published at Minneapolis, Minnesota, each of such publications to be at least ten days prior to the date of said meeting, and which notice shall read substantially as follows: NOT3DE OF SALE OF $350,000 PERMANENT IMPROVE~T REVOLVING FUND BONDS CITY OF COLUMBIA HEIGHTS, MINNE3OTA NOTICE~I$ NER~Y GIVe.that the City Council of the City of Columbia Heights~ Minnesota, w~ meet at the City Offices 530 Northeast Mill Street, in said City, on Tuesday, August 23, 1955, at $:00 o'clock P.M., to rPceive open, amd cmasider bids for the purphase of $350,000 general obligation Permanent Improvement Revolving Fund Bonds of the City to be issued to provide funds for improvement of a lasting character, including installation of paving curbs, gutters, storm sewers, and water line and sewer line extensions. The bonds will be dated as of September 1, 1955, and in dencmnbuatiom of $1000 each, and w~ bear interest at~a rate or rates specified by the successful bidder, payable March 1, 1956, and semiannuall~ thereafter on each September 1 and March 1. Principal and interest will b® made payable at any suitable b~?~g institutie~ in the United States designated by the successful bidder, the City agreeing to pay the reasonable and customery charges of such institution for the receipt and disbursement of the principal and interest moneys. Said bonds wf11~ be numbered serially from 1 to 350, inclusive and will mature serially in the amount of $35,000 on March 1 in each of the years 1957 through 1966, all without option or.prior payment. The City w~l furnish without cost to the nurchaser, the printed and executed bonds and the ~ unqualified approv- ~ legal opinion of Dorsey, Colman, Barker, ~cott & Barber, Minneapolis, Minnesota, together with the customary no-lit~giation certificate and ~ delivery thereof will ~e made within forty da~s after acceptance of bid. Such delivery will be made in Minneapolis, or St.Paul, Minnesota, or Chicago, Illinois,. without cost to the purchaser; delivery elsewhere to be at the purchaser's ~se. ~ealed bids marked "Bid for Permanent Improvemaut Revolving Fund Bo~ds" may be mailed or otherwise delivered to the undersigned, but must be received prior to the time of said meeting. Each bid must be unconditional except as to the bonds being issued and delivered with said opinion and certificate, in conformity with this notice, and each bid must be accompanied by a certified check or cashier's check payable to the order of "The City Treasurer of Columbia Height, Minnesota" drawn on a responsible bank, in the amount of at least $7000, to be forfeited as liquidated dam~ges in case the bid is accepted and the bidder shall fail to comply therewith. Bids must specify the desired interest rate, or not to exceed three rates, each in an integral multiple of 1/4 or 1/i0 of one per ~ent per ~uum, the rate to be uniform for all bOnds of a c~on maturity. In addition therete$ any bid may call for additional interest, to be represented by separate coupons, o~ any or a~l of the bonds, payable on any above specified interest due date or dates. The bid offerin$ the lowest net interest cost (total iuterest to maturity less any premium offered) will be deemed the most favorable. No oral bid or bid of less than par plus accrued interest from September 1, 1955 to the date c~ bend delivery will be considered.
