Roll Call - All Ayes. Preamble to Ordinance No.313 offered by Deeble seconded by Holm, Being an Ordinance entitled "An Ordinance authorizing the sale by the City Treasurer of $15,O00. Emergency Debt Certificate." ~qEREAS, it became necessary to properly carry on the Functions of Municipal Gover~ent of the City of Columbia Heights~ to proc~.ed with the Permanent Improve- ments; and, WHE~AS, there are insufficient monies in the city treasury to pay costs currently due, and the city is therefore without funds to pay for contract payments now due; THIS COUNCIL hereby and unde~ this preamble declares an~ emergency exists for the preservation of the p~blic safety and that in order to promptly meet said emergency it is necessary to pass Ordinance No.313 as an emergency Ordinance. Counci]mmn ~eble introduced the following resolution and moved its adoption, ~hich resolution was thereupon read in full in words ~d figures as follows: RESOLUTION PROVIDinG FOR P~LIC SALE CF PE~T ~APRO~T HEVOLViNG FUND BONDS BE IT RESOLVED by the City Council of the City of Columbia Heights,~Ninnesota, as follows: l~ This Council shall meet at the time ~nd place and for the purpose specified in the for~ of notice of bond sale hereinafter set forth, and to take such further action in respect to the bonds therein described as shall then be found desirable or expedient. 2. The City ~anager is hereby authorized and directed to give notice of the time, place and purpose of said meeting by causing notice thereof to be published in or~e issue of the Columbia Heights Record and in one issue of Co,mercia! West, a financial periodical published at Minneapolis, ~innesota, each of such publications to be at least ten days prior to the date of said meeting, and ~hich notice shall be substantially as follows: ~ NOTICE OF SALE OF $200,000. ~NT T~ROVEMENT REVOLVING FUND BONDS CITY OF COLUMBIA HEIGHTS~ MINNESOTA NOTICE IS PEREBY GIVE~ that the City Council of the City of Columbia Heights, Ninnesota, will meet at the City office, at 550 Northeast Mill Street, in said City, on Thursday, the '~27th of August, 1953 at 8:00 o'clock P.M., to receive, open, and consider bids for the purchase of $200,000 general obligation Permanent Improvement Revolving Fund Bonds of the City to be issued to provide funds for improvements of a lasting character, including installation of pavement, curbs, gutters, storm sewers, and water line and sewer line extensions. The bonds will be dated as of August l, 1953, and in denomination of $1000 each, and will bear interest at a rate or rates specified by the successful bidder, payable February l, 1954, and semiannually thereafter on each February 1 and August 1. Principal and interest will be made payable at any suitable ba~king institution in the United States designated by the successful bidder, the City~ agreeing to pay the reason- able and customary charges of such institution f~r the receipt and disbursement of the principal and interest moneys. Said bonds will be numbered serially from i to 200 inclusive,and will mature serially, in the amount of $20,000 on August I in each of the years 1955 through 1964, all without option of prior payment. The city' will furnish, without cost to the purchaser, the printed and executed bonds and the unqualified approving legal opinion of Dorsey, Colman, Barker, Scott & Barber, Minneapolis, Minnesota, together with the customary no-litigation certificate, and delivery thereof will be made within forty days after acceptance of bid. Such delivery will be made in Minneapolis or St.Paul, Minnesota, or Chicago, Illinois, without cost to the pur- chaser; delivery elsewhere to be at the purchaser's expense. ~ Sealed bids marked "Bid for Permanent Improvement ReVOlving Fund Bonds" may be mailed or otherwise delivered to the undersigned prior to the time of said meeting. Each bid must be unconditional except as to the bonds being, issued and delivered with~ said opinion and certificate in conformity ~h this notice, and each bid must be accompanied by a certified check or cashier's check payable to the~ order of "The City Treasurer of Columbia Heights, Minnesota", drawn on a responsible bank, in the amount of at least $4000, to be forfeited as liquidated damages in case the bid is accepted and the bidder shall fail to comply therewith. Bidders must specify the desired interest rate, or not to exceed three rates, each in an integral multiple of 1/4 or 1/10 of one per cent per annum, the rate to be un~form for all bonds of a~ c~mnon maturity. The bid offer~m~the lowest net interest cost (total interest to maturity, less any premium offered) will be deemed ~h~ most favorable~ No oral bids or any bid of less than par and accrued inter&st from August l, 1953,~ to the date of delivery will be considered. The right to reject any and all bids and to waive informalities is reserved. 3. Each and all of the terms and provisions of the foregoing form of notice are hereby adopted as the terms and provisions for said bonds and for the sale thereof. 4. This resolution shall be published in the official newspaper v&thin fifteen days after its passage, and shall take effect thirty days after its passage, unless suspended by a referendum petition, and upon so taking effect ~ shall operate to ratify, confirm and validate any and all actions of the City Officers theretofore t~ken ~hich are herein authorized or directed to be done. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Holm, and on vote being taken thereon the following voted Yea: Holm, Hosch, Deeble, Knutson and Stopka ~hereupon said resolution was declared duly passed.
