WiTi~SSETH:
V~EREAS, the Corporation is the owner of reai~ esbete ~$~t~ated ih the City
of Columbia Heights~ County of Anoka and State of Minnesot~a,~kn-'o~n as "Hilltop
Addition", which Addition consists of Hilltop, Hi_~Ll~op S ~ec~. ~& Unit and ~Hilltop
Third Unit; and
%~HEREAS, certain agreements have heretofore been entered into between
the parties hereto ~th respect to the inst ~a~a?i°~' of,,~ater, severs, etc; and
¥~{EREAS, the parties hereto deem it advisable and necessary to construct
streets, roadways, curbs and gutters in the said Hilltop Second Unit, and to surface
the said streets and roadways with v~at is commonly referred to as "Black-top,,.
NOIr.~ THEREFORE, for a valuable consideration, the sufficiency and receipt
of which is hereby acknowledged, IT IS HEREBY MUTUALLY AGREED by and between the parties
hereto as follows:
THE CITY AGREES:
(1) That it will, ~ th dispatch, procure bids for said improvements in
accordance with the plans and specifications which are on file in the office of the
City Manager of the City of Columbia Heights, which plans and specifications are by
reference made a part hereof with the same Torce and effect as i~ attached hereto.
(2) That it will accept the bid of the lowest responsible bidder and will
procure from such bidder a performance bond with the usual conditions.
(3) That it will pay the lowest responsible bidder or contractor in full
for such improvements when the same are completed and that it will furnish an engineer
to inspect the construction of such improvement as the same progresses, and that it will
perform all other work in connection with the inspection of such construction in order
that the cohtractor completes said work in accordance ~ith the plans, specifications
and ~!ustrations hereinbefore referred to, and w~ll accept said streets, curbs and
gutters as so finished and thereafter will be responsible for the maintenance of the
same.
(4) That the cost of s~ch improvements or constructions shall be assessed
against the property benefited thereby.
THE CORPORATION AGR~S to furnish to the City a performance bond with
sureties approved by the City v~th the usual conditions guaranteeing that the street,
curb and gutter assessments covering said lots will be paid without penalty as and
when the installment payments become payable. IT IS NUTU.~T.1'~Y AGREED:
(1) That the Corporation has h~retofore advanced to the City the sum of
$38,776.36, which said sum shall be credited on the books and records of the City
as follows: A sum equal to $85.00 per lot shall be credited to each lot in Hilltop
Second and Third Units and each lot in the West side of Block 7, Hilltop Addition,
except Lots 21 to 30 inclusive, Block Five (5) Hilltop Second Unit, against the
water tower assessment heretofore levied by the City against each of said lots.
It is estimated by the parties hereto that the said credit that the corporation is
entitled to, at the rate of $85.00 per lot, amounts to approximately the sum of
$20,145.00.
(2) That an additional sum of $31.61 per lot shall be credited to each
lot in Hilltop Second Unit and each lot in the west side of Block seven (7), Hilltop
Addition, except Lots 21 to 30 inclusive, Block Five (5) Hilltop Second Unit, and
lots 19,31 and 34, Block Seven (7), Hilltop, against administrative expe~ nse hereto-
fore levied by the City of Columbia Heights: the total sum of such credit that the
corporation is entitled to is $4,614.41. This sum shall be transferred from the
P.I.R. Fund of Columbia Heights to the Administration Fund of Columbia Heights.
(3) That the balance of the credit that the Corporation is entitled
to receive from the said sum of $38,776.36, or approximately $14,016.95, shall be
credited against special assessments heretofore levied by the City on the lots in
Hilltop Second Unit, and each lot in the West side of Block seven (7), Hilltop
Addition, and such credit shall be entered in the books and records of the City
and the County of Anoka, except a credit will not be made against Lots 21 to 30
inclusive, Block Five (5), Hilltop Second Unit, and Lots 19,31 and 34, Block Seven
(7), H top.
(~) That all agreements, whether oral or written, entered into
between the parties, are hereby null and viud and of no further force and effect,
and except as hereinprovided, each of the parties hereto releases the other from
all claims and demands of every kind, nature and description that they have or
claim to have against the other.

Motion by Lange seconded by Spekulant, that the letter from Joseph E. Menger dated
June 24th,L952, be turned over to the Mayor. ~Roll Call - All Ayes.
Motion by SDekulant seconded by Lange, that the letter received from the Activities
Committee dated July 3,1~52, regarding a new Baud Stand, be placed on file and that
Mayor Stop,a, Councilmen Holm and Spekulant meet ~ith this committee. Roll Call -
All Ayes.
A Hearing was held on Black-topping in Hi]ltop~ and no objection was m~de.
A Hearing was held on a Storm Sewer ~n the alley between Jackson and ~uincy Streets
connecting ~to a storm sewer on 39th Avenue and no objection was made.
Motion by Lange seconded by Holm, that we accept the bid of Richard Ferrin Co.
for this St~orm sewer ~nd authorize the City ~a~ager to enter into a contract with
them. Roll Call - All Ayes.
