Minutes of the last regular and two. special mee.tings were read and approved f_th the .exception of the following statements which the Mayor asked to have inserted in the present minutes~ which should have been included in the minutes of the last regular meeting: The. Mayor asked the Council to recind it~ action in. authorizing payment of bills to the Chet Herringer Contract~._~g Co. totalling. S4,595.65, pending an investigation on the validity of the payments. The Council took no action. T~e Mayor also requested t~e Council to table the sale of land to John. Cederberg and Chet. Herringer, pending an investigation to deSermine the order of precedent in matters of this kind~ and that the City Assessor testLfied that a verbal agree- ment had been given before October 5th. The Council took no action. Motion by Deeble seconded by Spekulant, that the bid of the RoCket Oil Co. for #2 Fue~ Oil at 12.9 delivered be accepted. Roll Call -Al!Ayes. ~ Motio~ by Spekulaut seconded by Deebte, to accept tb~e Assessment Roll on the Water and Sewer on 4Oth Avenue in the amount of $2,175 for water and $3,575 for Sewer. Resolution offered by Lange seconded byDeeble, A R~solution adopting assessment rolls for the following local improvements ~ud determin~ing that said improvements be made and ratifying and confirming all other proceedings heretofore had: Local Improvement #230 Sewer and Water 40th Avenue - East &West of Hayes " " 233 Water Main repair~ Lot 5(Ex. N28(Bloc~(~e~,rg~ WHERE~S,. the City Council of Columbia Heights, Min~esota, met on the 13th ~ ~£~ ....... November, 1951, at the City Office in said City, being the time and place set when and ~ere all persons interested could appear and be heard by the Council with respect to benefits, and to the proportion of the cost of making the local improvements above described, a notice of such hearing having been heretofore duly published as required bylaws; and WHEREAS~ this Council has heretofore estimated and fixed the cost of such local improve- ments and has prepared an assessment roll therefore. THE CITY COUNCIL OF COL~IAHEIGHTS P~REBY P~SOLVED: Sectionl. That this Council does hereby adopt the aforesaid assessment rolls known and described as "Assessment~Ro!ls for Local Zmprovem~nts No.230 and 233. Section II. That this Council hereby finds and determines that each of the lots and parcels of land enumerated in said assessment rolls was and is especialtybenefitted by such improvement in an amount not less tha~ the ~nount set opposite the description of each such lot or parcel of land respectively in said asses~nent rolls in the column headed "Amount of Proposed Assessment." And this CoUncil further finds and determines that the proper proportion of the cost of such improvement to be especially assessed against such lot or parcel of land is the amount set opposite the description of each such lot or parcel of~land respectively in sa~d assessment rolls in said column headed "Amount of Proposed Assessmmnt." Section III. That said assessment rolls be and the same are hereby adopted as the assessment rolls the following local improvements hereinafter described, and that s~id ~s~ssm~nt rolls shall be hereafter known and designated as "Assessment Rolls for Local Improvements No.230 and 233. Section IV. That said assessments shall be payable in annual installments for a period of one to eight years on or before the 1st day of June in each of the years from 1952 to 1959, with interest and penalties as provided by law. Section V. That this Council does hereby determine and re-determine to proceed with said improvements, does ratify and confirm, all other proceedings heretofore had in that regard, and said improvement shall hereafter be known and numbered as "Local Improvements No.230 and 233. Section VI. This resolution shall ~'ake effect immediately upon its passage. Roll Call - Ail Ayes. Second reading of Ordinance No.289, Being an Ordinance vacating 38½ Avenue N.E. from the ..~est line of Jefferson Street N.E. to a point 405.5 feet east of the east line of 5th Street N.W~. Ordinance No.289 offered by Spekulant seconded by Lange. Roll Call - Ail Ayes. Second reading of Ordinance No.288, An Ordinance amending an Ordinance ooranting to Minneapolis Gas Light Company, its successors and assigns,-the right to manufacture, import, transport, sell and distribute Gas f~r Heating, illuminating and other purposes in the City of Columbia Heights, and to use the Streets, Avenues and Alleys thereof for that purpose. Ordinance No.288-offered by Lange seconded by Spekulant. Roll Call~- All Ayes. Second readi~ of Ordinance No.290, Being an Ordinance amending Ordinance No.171, being an Ordinance for the purpose of promoting health, safety, order, convenience and general welfare, by regulating the use of land, the location and the use of Buildings and the arrangement of building lots, an~d the density of population in the Cit~ of Columbia Heights. Ordinance No. 290 offered by Holm seconded by Lange. Roll Call - Ail Ayes. First reading o~ Ordinance No.291, An Ordinance authorizing the sale b~ the City of Columbia Heights of certain Real Estate known as Ail of Block 2, except lots 1,2 & 3, Lots 3 to 14 inclusive. Block 3, all of Outlot "B". All in 2nd sub- division of Block "F" Columbia Heights Annex, Anoka CountS Minnesota. First reading of Ordinance No.292, An Ordinance providing for Civil Defense and for protection and promotion of Public Safety, Health, and Welfare in the City of Columbia Heights during Civil Defense Emergencies. A letter was received from the~Ladies Au~iary of Post 230 Veteran's of Foreign Wars, requesting a permit to play Bingo on December 1st, at a Bazar and Dinner they are having at the Field House. Motion by Lange seconded by Spekulant that this permit be granted. Roll Call - All Ayes. A letter was received from the City Clerk of Robbin~dale dated November 7th, asking the City officials to attend a meeting they are having November 28th regarding the Dog problem. A report was received from the Department of Health regarding our water supply. Notion by Lauge seconded by Holm, that this letter dated November 6th be turned over to the City Manager for action. Roll Call - All Ayes. The City Attorney informed the Council that there are no State Laws prohibiting Liquor establishments from being less than 300 feet from school property. Resolution offered by Lange seconded by Holm, ¥~EEAS, an assessment for sew2r has previously been levied on Lot four (4) Block Thirteen (13) ~alton's Second Subdivision of P~servoir Hills (Spec.Assess.~164); and, ¥~EEAS~ assessments were levied against the above described, property as part of Local Improvement No.200; NOW THEBEFORE, BE iT HEEEBY RESOLVED by the City Counci~ of the City of Columbia Heights' that the Comity Auditor be and he is hereby authorized to strike from the assessment rolls the assessments on Local Improvement No.200 against the above described propert~r~ sabsequent to the 1950 le~- a total of $117.24. The ~Hayor brought up the matter of t~he Mayor' s Contingent Fund and he was told by the ~City Attorney, that if the City Council wants to know ~he~e the money is going they~are entitled to that information.
