On roll call, Dahl yes, Gsnnon yes, Stineon yes, Karrow not voting, Foster not voting. ~r. Buck then state d that the proceedings at the previous meeting Sept. 24th, authorizing $5000. emergency certificates was invalid and read an ordinanae that fulfilled the requirements. The ordinance was offered by Karrow and seconded by Stinson. On roll call, all ayes Communications- A conmatnlcation was then read from Mr. Frank Ittner as follows: "In order to comply with the state law it is necessary to prohibit smoking in our school buildings. The school board has gone on record to enforce this and failure to comply will make it necessary to refuse rental of the building. Hoping that your honorable body will co- operate with us in this matter, we are Yours very truly, Ind. School Dist. #65. A communication was also read from the Village of Wayzata in regard to a demonstration of the foamite fo~tEenerator to be held Oct. 9, at 4 O0 Pm. The Council members and Y Firemen' : were invited to attend this demonstration. 374 I~otion by Dahl, seconded by Gannon that these communications be acknowledged and placed on file. The following petition was then taken up: "To the Honorable City Council of the City of Colmnbia ~eights- Gentlemen: We, the undersigned residents and taxpayers of the City of Co1tLmbia Heights, do hereby respectfully protest against the issu- ance by said City, of certificates of indebtedness in any form whatsoever, for the payment of the contract price for the opening grading and surfacing of Forty-fourth avenue N. E. ~etween Central Avenue and Reservoir Blvd., on the following grounds to wit: A. The contract for grading and surfacing said street was ratified by a three-fifths vote of all of the members of the City Council, where~as the charter requires such contracts to be ratified by a four-fiftF~ vote of such men~er~. B. The total assessable cost of the improvement provided for under the terms of the contract, together with the total unpaid assessments for previous improvements on the p~operty to be assessed exceeds fifty per cent of the total true and full value of all the land to be assessed therefor, exclusive of structures, and improve- ments thereon. Respectfully submitted. There followed the names of 74 signers. ~otion by Stinson, seconded by Gammon that the petition be accepted and placed on file. All ayes. Resolution offered by Gannon, seconded by Stinson- "Be it re~olved by the City Council of the City of Columbia Height~ that the following pieces of property have paid the full assess- ment for the improvements noted: In Columbia Heights Annex: Block 64- Lots 18,31,19,20,21, 22,23,~4,25 for Sewer. Block65- South 9.8 feet of Lot 9 and Lot i for sewer. Block 58- Lots 8 and 9, grading surfacing curb and gutter. Block 59- Lots 29,30,31,32,33, grading surfacing, curb and gutter. Block 59- Lots I and 34, grading and surfacing. Block 59- Lots 1,2,3,4,5,6,V,8, for water main. Block 90- Lots V,8,9,10,11,12,13,14,15, for water main. American Brake Shoe, described in Book 61 of Deeds, page 539, part of block 90 and part of block "G" and also tract described in book": 67 of Deeds, page 139 and 13V of Block 90, for sewer. " Ex South 80 feet 2e-Arrangement of Block "E that of Lot Four (4), . for sewer. Resolved further that the County Auditor be notified to strike the above from the assessF".nt roll certified to him. ~ On roll call, Dahl, n~, Gannon. yes, Stinson yes, Karrow, no, Foster yes. Carried. passed Oct. 8, 1929. Resolution off,red by Stinson seconded by Gannon to ~ransfer iil200, from public utility fund to permanent improvement fund. Roll Call - Dahl no, Gannon yes, Stinson yes, Karrow no, Foster not voting. an ordinance prohibiting the use of sidewalks for bicycles, roller coasters, etc., passed its first reading. ~otion by Dahl, seconded by Gannon that City ~anager be authorized to spend not more than ~40.00 for a re-built typewriter to be used by the Secretary. Carried by unanimous roll call vote. Resolution by Gannon, seconded by Stinson that City ~anager be authorized to advertise for bids for a tractor and grade to be purchased on a rental basis, such bids to be received on Oct. 18th at 8:00 PM at the High School Building. ~otion to adjourn by Dahl, seconded by Gannon.
