All membems ware present and answered ro~l call except Co%mcilman George ~Eayor. Foster instructed the secretar~ at the opening of the mestin$.::~ka~:· ~e wished to be lzste~ as "not rating" on all ,motions and re~lutions, e:.cep~ in the event of a tie vote The recitation of P. F. ~Yo~lsh as secretary to the council was r~e~ and upon motion of Karrow, seconded by Dahl, and carried by s rate of.all ayes, was accepted. Kay. This petition was accepted'and referred to the city mana- ger for the regular course of action upon motion by Dahl, seconded by Gilette and~carried by a vote of all ayes. L. J. Clu!ka presented a petition bearing 143 names and signa~u tures of free holders requesting that the ci~y cotu~cil call an ~ election for the purpose of voting upon the question of annexation to ~..~i~neapo!is. Dahl moved that this petition be accepted and his motion was seconded, by t~arrow and carried by a vote of ~l! ayes. A corm~.unication was read from City Attorney Peterson relative his Fees in condemnation proceedings. A 'cormutw~ication from C..M. JevlS. e requesting the council to take action granting the payment of premiums on beneFit~ insurance for Fire department members was read and after hearing represents-., tives o~ the department a motion was made by Gillette and seconded'~ by Dahl that the request be granted.. This was carried by all ayes. A petition was presented by Stanley Ka~cielniak s~d signed by Four property ov~.~ers requesting the gr&~ding Of Jackson street twee~ 4!st and 42nd avenues and for the installation of water~ mains. It was moved by' Gillette and' seconded by Dahi that the petition be accepted, refCrr~ed to the city~ ma~..ager for checking, and that~ regular proceedu~e be Followed. ,~ Carried unanimously. The' city manager pres.ent.ed the ~natter of the widening, or thee anticipating of ~the widening of ~th~ street driveway' before workl was commenced on ~the installation of ~the~ sto:m~ sewer therein. The~ city engineer suggested tha.t this'step be ts[ken in~ order that the future demands for a good thorofar'e be met With. 1Tarrow made ~ motion that. the engineer be instructed to order the storm sewer i~n- stalled 'on the' basis of a 40-foot r'oa~dway from 40t'h' avenue to Sum~ mit a~..d From Summit on a 36-foo. t b, asis. This was seconded by Dahl .and carried ~unanimously. A petition requesting tbs installation of a water main on 39th avev~ue From Buchanan to Johnson street and carrying the signe~tures of five property ovn~ers was presented. It w~s moved by Dahl seconded by Gilette that this petition be accepted and the regular routine followed. Carried by a vote 'of all ayes. A petition signed by property ovn.~ers on Tyler street betwe~n~ 37th and 39th avenues and asking that sidewalk, curb and gutt~em ~e insts~lled on that street, and which was in the hands of the cit~i man.ager, w~s read and the information given t.bat there were not yet the required number of signs~tures, it was. returned to 'the property o~ers with the understanding that action would be .taken~ when sufficient signatures had been obtained. ~rs. gudd appeared and entered a complaint against the ~an4er in'which the sewer contractor was leaving the sewer ditches unfilled and stated that the.re was eminent ~anger of serious accidents if the situation were not remedied. She was 'informed that the city manager had been instructed to check up on .the situation and it was Further mentioned, ths~t in the future the 'estimates of the co. retractor would be held up ~ntil ditche$ on various sections of the work Were properly' taken care of. A co~rdUnimCation was read from the '~pls. General Electric Co., in wBi~h this 'corporation requested the permission to install three I:igb. t ~oles on ~9th Avenue, N. E,, in the vicinity of Hayes and ~o~;~o~ ~treets. Engineer Carroll suggested that in g:ra~nting these ~er~ii~ts the council should demand thzt the company ass~e the res- ~e~S~bility and the' cost of resetting these poles in the event o~ stre~et grading or other improvement, t~rrow moved that the request be granted, This was seconded by Gillette and c~rried unanimously. ~m, Sinnott presented an appeal for action on the part of the couu,ci;1 i~ getting the work of the improvement of $Ynd avenue under way as soon ,as possible. He was informed that the delay had been una,voidable but that immediate action would be taken. -'Fhe ~roperty owners who had ~resented a petition asking for .the i~t~'lla,tion of a sidewalk on Central a~enue between $2nd and ~?~ avenues with. the understanding that the grade established was to 'be lower than the highway grade were infor~aed that this was not ~-~a~tical, that it woul'd establish ~ precedent which would 'eV,~'t'ual, ly spell dis,aster for all concerned and that no action w,eu~d~ 'be taken, at least not s,t present.
