AN ORDIh~ANCE TO AMEND ORDIMANCE ~14S, BEING AN ORDINANCE LICENSING AND REGULATING THE SALE AT t~TAIL OF NOE~INTOXICATING m~T~T LIQUG~ S AND PROVIDI~TG A PE~TALT¥ FOR'TEE VIOLATION HEREOF. THE CITY OF COLUMBI~ HEIGHTS DOES ORDAIN: Section 1. That that cart of Section 8 of Ordinance ~14~ which .reads as follows: "No license shall be granted for sale on any premises where a licensee has been con- victed of the violation of this ordinance or where any license hereunder has been revoked for cause for at lemat ninety da,vs after the said conviction or revocation" be and the ss~e hereby is repealed. Section 2. That in the place and in the stead of that portion of Section 8 of Ordinance $1~$ repealed by Section i hereof the following provision shall be inserted in said section: No license shall be granted for sale on any Dremises where &~ license, has been convict&d Of the violation of this ordinance or where any license hereunder has been revoked for cause for at least tkirty (SO) days after the said conviction or rsvp cat ion. Section S. That section 7 of Ordinance No. 14S which reads as follows: "Right to Search and Seize. Any oeace officer ~hall have the uncualified right to enter, inspect and search the premises of a licensee hereunder, dmring business hours, without a search and seizure warrant, and seize all intoxicatin~ liquors found on the premises of such licensee, tulless such licensee has an intoxicating liouor license issued under the provisions of Chapter 4~, Extra SeSsion Laws of 19S$- S4 and acts amendatory thereof; provided however, that this section shall not apply to intoxicating liquor fot~ud in possession of patrons of a licensee if said licuor is in the original package or container in which it was purchased and' the revenue meals thereon have not been broken or the said original oackage or container in any way opene~~ Oe and the s~.ne hereby is repealed. SeCtion 4. That in the place and in the stead of SeCtion 7 of Ordinance No.. l~ repealed by Section ~ hereof the following section be inserted in Ordinance No. as section 7. Right to search and seize: Any peace officer shall have the un~l~alified right to enter, inspect and search the premises of a licensee hereunder, during business hours, without a search and seizure warrant, and seize ail intoxicating liquors found on the premises of such licensee, unless ~uch licensee has an intoxicating liouor license issued under the provisions of Chapter 46, Extra Session Laws of 19SS - S4 and acts ~mendatory t~eroof; proVidied however, that this section shall not apply to intoxicating lieuor found in p~eeession of patrons of the license,. Section 8. 'Time of takiK~.g effect. This or~m shall take effect and be inforce from and after thir~J (SO) days after its passage.
