The City Council of the City of Columbia Heights does ordain as follows: Section 1. No person shall hereafter plant any tree within the limits of any parkway or street of the City of Col~ubia tieights without first having a permit from the Tree Warden, Section B. Anyone wishing to plant such tree or trees shall apply to the Tree Warden for a permit, stating the ~ariety and precise location proposed for each tree. After th~ receipt of such application the tree Warden shall grant a permit only if, in his judgment, the location is such as to permit the normal growth and ~evelopment of each tree. The permit shall specify the loca- tion, variety and grade of each tree and method of planting, and including among other things, the supplying of suitable soil~ The permit .shall be good only for.the season stated on same in the year issued, and no charge shall be made for the,same. No trees shall be planted except in accordance with ~2s terms. The specifications of 'the permit shall be such as will secure suitable location, planting and growth of each tree. Section 3. The following brees can be used for street planting; White Elm(ulumus americana) and sugar or hard maple (acer sacchar~m) the latter only at the dis- cretion of the Tree Warden. Section 4. Obnoxious trees for street planting will be classed as the cottonwood (pop~lus deltoides) poplar(populus norwaia) Carolina poplar(populus caroliniana) Lombardy poplar(populus fastigiata) Bolleana poplar(populus bolleana). When caus-ing the heaving of sidewalk or breaking of curbing, if planted before this ordinance was passed, it will be compulsory to have the offending tree removed within ten days from the date of~not~e. Failure to remove the offending tree it shall bec~ue the duty of the Tree W~rden to have it removed and cost asses against the property for such removal. Section $. No peri. it for planting such tree shall be given where the clear space between the curb and sidewalk is less then three ~ ft. 'Neither shall a permit be given ~gaere the soil is too poor to insure the growth of the trees unless the applicant or the owner agrees to excavate a suitable hole of not less than ~ cubic feet and to replace the material removed with a suitable soil. Eection 6. No such tree shall be planted measuring less than two (2) inches in diameter of trunk nne foot above the ground li'ne, unless otherwise specified' by the Tre~ Warden. The trunk of-. each tree shall be withou~t bDanches eight feet from the, ground and the lowest branch shall not be over nine and one-half f~tt. specifically permitted by the Tree Warden in his permit. Section 7. No person ~&ne~her licensed or otherwise, shall move any b~[lding along any street in such as way as to interfere with or injure any of th~ trees or shrub in any street or public ground, inclu~ug pa~ks and parkways, in the City of Columbia Heights, without a special permit obtained from the Tree Warden The ~-pplication shall specify the building and the proposed route. Section 8. All moving of tr~es and shrubs made necessary for the moving of such building or any' other purpose shall be done by the Tree. Warden, or under his ~ supervision, at the expense of the applicant, ~houl~. such noving or replace- lng cause the death of such trees or shrubs the applicant shall ~eplace same his expense. Before such ~rmit is granted the applicant shall ~eposit at least $10.00 per tree and as much more as th~eTree Warden may deem necessary to cover the actual expense of removing and replanting~ if necessary; to be retained until said tree or its successor is permanently established. Section ~0 No person Shall remove, destroy, cut, deface, trim, or in any way inure or interfere with any tree or shrub on any of the ~venues, streets or pub- lic grounds, including parks and parkways of the City of Columbia Heights, with- out a permit from ~the tree warden. ~o any tree or st~rub on any avenue, street or public grounds, inolu,ding parks and parkways,~ of the City of 0olumbia Heights, nor shall any person~ suffer or permit any horse or animal to stand or be near enough to such tree or shrub, to bite or rub against, or in any manner injure or deface the same,. 3eetion 12. Any person who shall violate any section of this ordinance shall on conviction thereof, in the ~unicipal Co~urt of the gity of ~olumbia Heights, be punished by confinement in the city worlduouse for a period not to exceed ninety (90) d:.a. ys, or by a fine of not less than t'~o $2.00) nor more than one hundred I$~00.00) and in default of the payment of such fine, shall be c~onfined in the city workhouse until such fine is paid, not exceed.- inE in all nine~t~. (90) days. Section 13. It shall be the duty of the Tree warden to see that the pro- visions of the ordinance are obeyed. Section 14. The ~ree Warden shall have the power 'to de.stroy, 'b.eesr in streets and parkways if infected by disease or infested by injurious insects when such destruction is necessary to the protection of other trees. Section 1,5. The Tree Warden shall have the power to remove any wire conduit or other things that bur~, cut or chafes any part of any tree, whether trunk root or branch, in any street or parkway, in case the owner of the wire shall fait after three days written notice to take adequate steps to preve~t furhte injury, Section 15~ No paving of any description shall be laid or maintained by any one between the sidewalk and curb which will cut off the air and water from any tree,. A space not less than fifty square feet must be left open for each tree, which space may be covered with a suitable iron grate upon a permit o~ the Tr. ee ~arden, to ~hom the plan of such grate must be first submitted. Section 15. This ordinance shall 'bake effect and be in force thirty days after its passage and publication.
