HomeMy WebLinkAboutMar 3, 1986OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS CITY COUNCIL PUBLIC IMPROVEMENT HEARING MARCH 3, 1986 The Public Improvement Hearing was convened at 7:30 by Mayor Nawrocki. 1. Roll Call Paulson, Petkoff, Carlson, Peterson, Nawrocki - present 2. Purpose of Hearing To conduct a Public Improvement Hearing regarding special assessment projects dealing with construction of certain alleys and reconstruction of certain alleys. 3. Presentation of Information by Staff a. Project #8102, P.I.R. #776, Reconstruction of alley between Polk Street and Buchanan Street from 37th to 39th Avenues. Work would include new bituminous surfacing, storm sewer improvements, a retaining wall and construction of a turn-around at the deadend, the replacement of old galvanized and lead water services within the alley right-of-way from the water service shutoff to the City main, and miscellaneous associated construction items. Much discussion followed regarding the need for the retaining wall, steps and sod at the deadend of the alley. Many of the residents opposed these items. Mayor Nawrocki suggested that the paving and drainage work be done and the remainder of the project be deleted. The Mayor again stated his concern with the engineering and administrative costs on this project as well as the others being considered at this hearing and felt these charges needed to be reviewed. Councilmember Carlson shared the Mayor's concern and took the position that this type of assessment should be paid out of the General Fund rather than be assessed to benefiting property owners. Mayor Nawrocki advised those in attendance that these projects, if approved at this hearing, would go out for bid shortly and the work would be done this summer. If the bids came in over or under the estimates by 10% another hearing would be held. The assessment hearing for these projects will be held in the fail. The Mayor explained the assessment payment procedure. The City Manager recommends assessment over a fifteen year period at 11% for Project #8102. Motion by Petkoff, second by Peterson that Project #8102 be authorized, that the turn around, retaining wall and steps be removed from the project, and that the engineering and administrative costs be reviewed. Roll call: Paulson, Petkoff, Peterson, Nawrocki - aye Carlson - nay b. Project #8301, P.I.R. #793 Reconstruction of the alley between Tyler Street and Polk Street from 37th to 39th Avenues. Work would include the placement of new bituminous surfacing and miscellaneous associated construction items. The City Manager noted that the administrative costs for this project had decreased since the last time it was considered. Discussion followed regarding the history of water problems in this alley. Some of the residents felt that the major problem in the alley was in the middle of it and the areas at either end would not need much repair. Councilmember Peterson suggested that an alternate be considered for this project for repairing the center section of the alley only. The City Manager recommends assessment over a five year period at eleven percent. Motion by Petkoff, second by Paulson to authorize Project #8301, that the engineering and administratvie costs be reviewed, and that the feasibility of of patching the center section of the alley only be explored. Project #8~11, P.I.R. # 795 Construction of the alley between University Avenue and Fourth Street from 44th to 45th Avenues Work would include the placement of a new bituminous surface, the replacement of one oalvanized water service within the alley right-of-way from the water service shutoff to the City main, and miscellaneous construction items. The specifics of the project were discussed with the residents from the area in attendance. The City Manager made some minor corrections on the cost estimates. He recommends assessment over a five year period at eleven percent. Motion by Peterson, second by Petkoff to authorize Project #8411 and that the engineering and administrative costs be reviewed. Roll call: All ayes d. Project #8511, P.I.R. # 809 Reconstruction of the alley between Polk Steeet and Taylor Street from 46th to 47th Avenues Work would include replacement of a new bituminous alley surface, a retaining wall and the miscellaneous construction items. The City Engineer advised the Council that the retaining wall is constructed on the alley right-of~way. The history of this retaining wall was discussed. The City Manager recommends assessment over an eight year period at eleven percent. Motion by Petkoff, second by Peterson to proceed with Project #8511 and to look at the retaining wall and determined if it can be salvaged at the new level; if it can't be salvaged, it will be rebuilt with the rebuilding costs coming from the General Fund. Roll call: Paulson, Petkoff, Peterson, Nawrocki - aye Carlson - nay e. Project #8512, P.I.R. # 810 Construction of the alley west of Reservoir Boulevard from Peters Place to Gould Avenue Work would include the placement of a new bituminous alley surface and miscellaneous construction items. This alley has no permanent base at this time. The property owner of 3936 and 3942 Reservoir Boulevard gave the Council a letter from three property owners in the project area stating their opposition to the project. He noted that these three owners own more than half of the assessed area. The Mayor stated there have been complaints received regarding this alley. The resident advised the Council that three of the persons who have complained about the alley have moved. He felt there was only one trouble spot in the alley and when it was bladed and filled with rock last summer it has improved to the point where it was acceptable. Councilmember Paulson felt it was a dangerous alley and needed improvement. Motion by Carlson, second by Petkoff to deny Project #8512. Roll call: Petkoff, Carlson, Peterson, Nawrocki - aye Paulson - nay Project denied. 4. Consideration of Resolution Authorizing Projects a. Resolution No. 86-15; Being a Resolution Ordering Improvements for Project #8102, P.I.R. #776; Reconstruction of the Alley Between Polk Street and Buchanan Street from 37th Avenue to 39th Avenue. Motion by Petkoff, second by Peterson to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes RESOLUTION NO. 86-15 BEING A RESOLUTION ORDERING IMPROVEMENTS Public Improvement Hearing March 3, 1986 page 3 BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, WHEREAS, the City Council of the City of Columbia Heights by motion on the 27th day of January, 1986 ordered notice of a hearing to be given to property owners, and, WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council Meeting on the 3rd day of March, 1986, and, WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions, NOW, THEREFORE, IT IS HEREBY RESOLVED: 1. That the location and extent of such improvements is as follows: Reconstruction of the alley between Polk Street N.E. and Buchanan Street N.E. from 37th Avenue N.E. to 39th Avenue N.E.. Said alley runs south from Buchanan Street N.E. and 39th Avenue N.E. and then dead ends short of 37th Avenue N.E. Work would include new bituminous surfacing, storm sewer improvements, the replacement of old galvanized and lead water services within the alley right-of-way from the water service shutoff to the City main, and miscellaneous associated construction items. Water service replace- ments are proposed to be assessed on a per parcel basis if replacement is necessary. 2. That the materials to be used are as follows: o Aggregate base, concrete surfacing, bituminous surfacing, sod, l" copper water service pipe, P.V.C. storm sewer pipe, reinforced concrete stOrm sewer pipe, concrete manholes and catch basins and various appurtenances. That a careful estimate of the cost of the improvements has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvements, which be deemed benefited thereby, were properly notified of said hearings. 4. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. o That the City Manager shall proceed with taking of bids for the improvements or portions of the improvements, as stated herein. 6. Roll call: All ayes RESOLUTION NO. 86-18 BEING A RESOLUTION ORDERING IMPROVEMENTS BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights WHEREAS, the City Council of the City of Columbia Heights by motion on the 27th day of January, 1986 ordered notice of a hearing to be given to property owners, and, WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on the 3rd day of March, 1986, and, WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessment under Charter provisions. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. That the City Manager shall proceed with taking of bids for the improvements or portions of the improvements, as stated herein. 6. These improvements shall also be known as Project No. 809. Nawrocki It was noted that the retaining wall referred to in Ordinance No. 86-18 ~,ill be further reviewed by the Engineering Department to determine how much of it may need to be replaced or if all of it will need to be replaced. Assessment Costs for Engineering and Administrative Charges The Council had approved the projects with the understanding that the City staff will review all of the engineering and administrative costs with a follow-up discussion with the Council. Councilmember Peterson wanted staff to pursue deducts for those property owners who paid their assessments in full before the full assessment period had passed. There was further discussion between the Council and the staff regarding an alley located on Parkview Lane which is experiencing watermain breaks and whose surface is breaking up. It was also noted that the agreement for work on Upland Crest has not been taken by the Assessing Department staff to the County at this point in time.
