O PMUBLIC IMPROVEMENT HEARING
ARCH 20, 1986
The Hearing was called to order by Mayor Nawrocki at 7:30 P.M..
1. Roll Call
Petl~off, Carlson, Peterson, Nawrocki - present Paulson - absent
Councilmember Paulson was attending a meeting of the Cable Communications Commission.
2. Purpose of the Hearing
To conduct a hearing regarding special assessments projects dealing with reconstruction
of 42nd Avenue and miscellaneous surface repairs for various concrete alleys including
the removal and replacement of damaged, deteriorated, settled and/or undermined
concrete panels. The Mayor advised those in attendance that the cost figures being
presented at this hearing were estimates. He stated that the bids will be let soon
and the if the lowest bid exceeds the estimate by 10% there will be another public
hearing on these projects. Mayor Nawrocki reviewed the manner of payment of assess-
ments, when penalities will be included and the anticipated rate of interest.
3. Presentation of Information by Staff
a. Project #8210, P.I.R. #808; Residential Street Reconstruction of 42nd Avenue from
Central Avenue to Reservoir Boulevard
This project was considered last year but did not receive the four-fifths vote needed
to approve it. The vote was 3 to 2. The City Manager advised that the work of this
project would include the removal of old bituminous pavement, curb and gutter, place-
ment of new bituminous surface along with new concrete curb and gutter, sidewalk re-
placement, extension of catch basin leads with new catch basins, replacement of one
water service, construction of a concrete retaining wall, and mi. scellaneous associ-
ated construction items.
Discussion between residents, Council and staff continued regarding specifics of
the project in particular grading of the street, width, engineering costs, and time-
frames of the project if approved. One resident had concern with who pays the cost of
the retaining wall on Central and 42nd. This cost would be spread across the entire
project as it benefits the street by stabilizing it. Councilmember Peterson requested
that alternatives for this retaining wall be explored. It was noted that the sidewalk
adjacent to LaBelle will be paid by the City and that there will be no sidewalks
installed where there presently are none.
Councilmember Paulson arrived at the Hearing at 8:10 P.M..
Mayor Nawrocki stated that the City Council has had an on-going concern with the engi-
neering and administrative costs of assessed projects and will making a close review
of these costs. Councilmember Carlson had previously suggested that some of the City's
assessable projects be paid for out of the General Fund or some other fund. He is
still pursuing this matter. Traffic control and drainage improvement were also dis-
cussed. Mayor Nawrocki requested that those residents interested in the installation
of a stop sign on 42nd Avenue be informed when the Traffic Commission meets next so
their request can be on the agenda.
Mayor Nawrocki polled those residents in attendance regarding their opinion on pro-
ceeding with this project. The majority supported the project being approved.
Motion by Petkoff, second by Paulson to authorize Project #8210 as presented with a
relook at engineering and administrative costs and that alternative designs for the
retaining wall be investigated. Roll call: All ayes

b. Project #8405, P.I.R. #811; Miscellaneous Surface Repairs for Concrete Alleys
The list of alleys being considered totals fifteen. The alley north of 46th Avenue,
Parkview Lane to Parkview Lane had been removed from the original list prior to
the hearing. Work would include the removal and replacement of damaged, deteriorated,
settled and/or undermined concrete panels, mudjacking where necessary, the cleaning
and filling of joints and cracks with bituminous sealant, and miscellaneous associated
construction items.
Each alley was discussed where there were residents in attendance who would be assessed
for the project.
The discussion on individual alley projects involved the following alleys:
Van Buren, Central to 44th to 45th: Two residents objected to the project as one
did not use the alley and the other felt the administrative costs should not be
assessed. Councilmember Peterson noted that if the deterioration is not stopped
that the project will be more costly in the future.
Motion by Carlson to deny the project. Failed for lack of a second.
Mayor Nawrocki observed that when there is no public interest it is difficult to
approve a project.
Motion by Peterson, second by Petkoff to authorize the project as presented. Roll
call: Paulson, Petkoff, Peterson aye Carlson, Nawrocki - nay. Project authoriza~
tion fails as a four-fifths vote is required for approval.
Fifth Street to Sixth Street, 42nd to 43rd Avenues: There was a lengthy discussion
~regarding the condition of the alley. One resident felt there was good run-off and
that there was no possibility of damage to the alley because of water. The engineering
staff indicated they had observed water not running off and felt there was water
settling underneath the concrete which could lead to the break up of the concrete.
Motion by Carlson to deny the project. Failed for lack of a second.
Councilmember Peterson stated confusion with what determines why a project should be
authorized and placed his confidence in the engineering department staff's judge-
ment. Councilmember Petkoff feels the concrete alleys in the City need maintenance
but was willing to move for a denial of this project based on what the residents had
stated. She noted that she probably will be hearing the arguments for denying the
maintenance and the justification in the future.
Motion by Petkoff, second by Paulson to deny the project. Roll call: Ail ayes
Washington to Jefferson Streets, 42nd to 43rd Avenue: The Mayor noted that this
alley has a considerable number of cracks and is in poor condition.
Motion by Paulson, second by Petkoff to approve the project. Roll call: All ayes
Jefferson to Madison, 40th to 41st Avenues: One resident in attendance favored this
project but stated an alley access problem with the location of an utility pole at
the entrance to the alley. The City Engineer said he will contact the utility company
regarding the relocation of the pole.
Motion by Petkoff, second by Paulson to approve the project. Roll call: All ayes
Seventh to Washington Streets, 40th to 41st Avenues: The residents in attendance
supported the improvement but suggested that work on the north end of the alley is
the most needed.

Fifth to Sixth Street, 40th to 41st Avenue: Residents in the area of this alley
feel that there are only two badly deteriorated spots in the alley, one located
at the southend of the alley and the other at the northend. It was their contention
that the majority of the damage has been done by large trucks which drive through
after making deliveries to a nearby restaurant. The City Manager suggested that a
load limit sign for trucks be posted in the alley which would stop these delivery
trucks from using the alley. Councilmember Carlson felt this might create problems
for garbage trucks. Mayor Nawrocki requested that residents get license plate numbers
of these trucks and make a report to the Police Department. A meeting was scheduled
for residents to walk the alley with Engineering Department staff and Councilmembers
to review what work needs to be done on this project.
Motion by Paulson, second by Peterson to continue consideration of this project until
the public hearing on March 25th. Roll call: All ayes
Central Avenue to Reservoir Boulevard, Reservoir Boulevard to 39th Avenue: One
tong-time resident of the area stated that the damage to the alley was caused by
a private watermain break many years ago. This water came from an underground
water heater used to warm a parking lot so snow would not collect on the lot and
need shovelling. This resident felt since the owner was solely responsible for the
water he should be responsible for the repair costs. The City Engineer stated that
the City's records contained little information regarding this water heater. The
Mayor requested that the City Attorney pursue the possiblity of establishing res-
ponsibility to this property owner and recovering some of the costs of the repair.
Motion by Paulson, second by Peterson to approve the project. Roll call: All ayes
Fairway Drive to Highland Place, West Upland Crest to East Upland Crest: Two
residents in this area were opposed to this project. It was noted that residents
are experiencing an access problem with the location of a utility pole on the east
end of the alley.
Motion by Petoff, second by Paulson to approve the project. Roll call: Petkoff,
Paulson - aye Carlson, Peterson, Nawrocki - nay Motion fails.
The Hearing was briefly interrupted to hear a presentation by a party wishing to
sponsor a fundraiser for the Blind Lions' Club to be held at a dinner club located
in Hilltop. He had been advised this matter must be brought before the Columbia
Heights City Council. It was determined that the Columbia Heights City Council has
no jurisdiction over this matter and it was referred to the cities' respective
city attorneys.

Paulson to approve the project. Roll call: Ail ayes
Fourth to Fifth Streets, 42nd to 43rd Avenues: Councilmember Carlson had concerns
with the engineering costs on this project. Mayor Nawrocki requested that this
alley be reviewed from an engineering standpoint regarding concrete replacement.
Motion by Paulson, second by Petkoff to approve the project and that the City
Engineer will review it with the purpose of reducing costs. Roll call: Paulson,

Upland Crest to Stinson Boulevard, North of Ivanhoe Place: Mayor Nawrocki inquired
if the City of Minneapolis has received a hearing notice. He was advised the City had
not received a notice as they had previously indicated they would not participate.
The Mayor was of the opinion that the City of Minneapolis should receive formal
notice of the hearing.
Motion by Peterson, second by Petkoff to continue the hearing on this alley project
until the hearing scheduled for March 25th. Roll call: All ayes
4. Consideration of Resolutions Authorizing Projects
a. Resolution No. 86-20; Being a Resolution Ordering Improvements for Project #8210,
P.I.R. #808 - Residential Street Reconstruction of 42nd Avenue from Central Avenue
to Reservoir Boulevard
Motion by Carlson, second by Peterson to waive the reading of the resolution there
being ample copies available to the public. Roll call: All ayes
RESOLUTION NO. 86-20
BEING A RESOLUTION ORDERING IMPROVEMENTS
BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights,
WHEREAS, the City Council of the City of Columbia Heights by motion on the 27th day
of January, 1986, ordered notice of a hearing to be given to property owners, and
WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council
Meeting on the 20th day of March, 1986, and
WHEREAS, the Council determines to proceed with this local improvement, a portion
of the cost being defrayed by special assessments under Charter provisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is as follows:
Residential street construction of 42nd Avenoe N.E. from Central Avenue N.E.
to Reservoir Boulevard N.E.
Work would include the removal of old bituminous pavement and curb and gutter,
placement of new bituminous surface along with new concrete curb and gutter,
sidewalk replacement, extension of catch basin leads with new catch basins,
replacement of one water service, construction of a concrete retaining wall,
and miscellaneous associated construction items.
Water service replacements are proposed to be assessed on a per parcel basis
if replacement is necessary.

That the materials to be used are as follows:
Aggregate base, bituminous surfacing, concrete curb and gutter, concrete
sidewalk and driveway aprons, sod, 1" copper water sewer pipe, structural
concrete retaining wall, reinforced concrete storm sewer pipe, concrete
manholes and catch basins and various appurtenances.
That a careful estimate of the cost of the improvements has been made by the
City Manager and the several lots and parcels of land fronting upon and
adjacent to such proposed improvements, which be deemed benefited thereby,
were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of the several
parcels so improved as nearly as can be ascertained.
5. That the City Manager shall proceed with taking of bids for the improvements,
or portions of the improvements, as stated herein.
6. These improvements shall also be known as Project No. 808.
