PUBLIC IMPROVEMENT HEARING
RIL 9, 1986
The Hearing was called to order by Mayor Nawrocki at 7:30 P.M..
1. Roll Call
Paulson, Petkoff, Carlson, Peterson, Nawrocki - present
2. Purpose of Hearing
To continue public improvements hearings regarding special assessment projects
dealing with street reconstruction, storm sewer improvements, replacement and
installation of sanitary sewer and water services, construction of curb and
gutter, and miscellaneous surface repairs for concrete alleys.
3. Presentation of Information
a. Project ~8405, P.I.R. #811; Miscellaneous surface repairs for concrete alleys
Fifth Street to Sixth Street, 40th Avenue to 41st Avenue
The City Manager reviewed the proposed repairs for this alley and advised the
Council that alt residents in the assessment area were advised by letter that
additional work being proposed had affected the estimated costs. The initial
assessment was $9.74 per alley foot and the revised estimate is $11.88 per alley
foot. This alley is about thirty years old.
Motion by Petkoff, second by Paulson to authorize the City Manager to proceed with
his project. Roll call: All ayes
Upland Crest to Stinson Boulevard, north of Ivanhoe Lane
The hearing on this project had been continued to allow for a formal notice of
the hearing to be sent to the City of Minneapolis in that the City of Minneapolis
owns and maintains property at this location and it is the intent of the City of
Columbia Heights to assess the City of Minneapolis.
Motion by Peterson, second by Carlson to authorize the City Manager to proceed with
this project. Roll call: All ayes
b. Project ~8513, P.I.R. ~779; Construction of permanent street for Stinson
Boulevard, from 45th Avenue to Silver Lake Beach area; storm drainage improve-
ments for the general vicinity; and water service and sanitary sewer service
replacement and installation if necessary.
The City Manager briefly reviewed the project. At the previous hearing some of
the affected residents questioned how their property values would be increased
by this project and how they would be benefitted. In response to these residents'
concerns, the City Manager requested an appraiser who is a long-time resident
of the City, to address these concerns. After reviewing the proposed project
and the parcels being affected the appraiser stated in a letter he is of the
opinion that this project will increase the value of the land 6½ cents per square
foot. He felt a good drainage system and a permanent surface on Stinson Boulevard
will benefit the entire area.
Some residents still had questions as to how they would benefit from the storm
sewer portion of the project. Mayor Nawrocki stated that it is a question of re-
ibility. He stated that it has been the policy of the Council to assess those
perties who contribute to the problem, in this case water which runs off of
their land, and the City pays part of the costs through general taxes. It has
also been the policy of the Council in past storm sewer projects to assess a
maximum of five cents per square foot. The Mayor suggested this practice be

oyed for this project. Also, discussed was the matter of water ponding behind
Benjamin and Stinson, south of 45th.
Mayor Nawrocki stated that the City will be paying half of the costs of the street
work in that the City of St. Anthony whose property borders the east side of the
street has displayed an unwillingness to participate.
The City Engineer told those in attendance that this project as proposed has re-
ceived approval from the Rice Creek Watershed District.
Motion by Peterson, second by Petkoff to authorize the City Manager to proceed
with the project and indicate the intention of the City Council is that the storm
sewer costs would not exceed five cents per square foot and that the City will
pay one half of the street assessment based on the unwillingness of the City of
St. Anthony to cooperate in the project. Roll call: Paulson, Petkoff, Peterson,

c. Project #8010, P.I.R. #737; Construction of permanent street, storm sewer,
and curb and gutter for the Hilltop II Addition, including the following streets: 1. West Upland Crest from Fairway Drive to Pennine Pass
2. North Upland Crest from Pennine Pass to Stinson Boulevard
The City Manager reviewed the revised project and the estimated costs. The Mayor
noted that previous hearings on this project residents not living on West Upland
Crest and North Upland Crest who were included in the assessment area had strongly
,pposed the project. The Council decided to reduce the project to include only
~est Upland Crest. Upon receiving numerous phone calls and a petition signed by
residents of North Upland Crest it was decided to amend the project to include North
Upland Crest. The Mayor noted that this project will be paid for by assessments,
some Anoka County funds, and some City funds for that portion of the project which
includes the storm sewer. Part of this assessment project includes an Anoka County
road.
The Council requests that when ar:y street surfacing or sewer projects may be done
on the streets originally included in. this project and petitioned out of the project
that property owners on West 'Upland Crest and North Upland Crest not be included in
the assessments.
The resident at 2120 North Upland Crest advised the Council of an on-going water
problem behind his property. The City Engineer will check this matter out.
A resident on Fairway Drive and West Upland Crest had concern with children's
activities in her alley.
Motion by Peterson, second by Petkoff that the City Manager to authorized to
proceed with the project.as refined. Roll call: All ayes

4. Consideration of Resolutions Authorizing Projects

Motion by Petkoff, second by Peterson to waive the reading of the resolution there

property owners, and
WHEREAS,
pursuant to a notice of hearing certain residents appeared at a Council
meeting on the 20th and 25th day of March and on the 9th day of April,
1986, and
WHEREAS,
the Council determines to proceed with this local improvement, a portion
of the cost being defrayed by special assessments under Charter pro-
visions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and ex.tent of such improvements is as follows:
5th Street N.E. - 6th Street N.E., 40th Avenue N.E. - 41st Avenue N.E.
Work would include the removal and replacement of damaged, deteriorated,
settled and/or undermined concrete panels, mudjacking where necessary
or possible, the cleaning and filling of joints and cracks with bituminous
sealant, and miscellaneous associated construction items.
That the materials to be used are as follows:
Concrete resurfacing, concrete for mudjacking and bituminous crack and
joint sealant.
That a careful estimate of the cost of the improvements has been made by
the City Manager and the several lots and parcels of land fronting upon
and adjacent to such proposed improvements, which be deemed benefitted
thereby, were properly notified of said hearings, and
That the City Manager shall list also the names and owners of the several
parcels so improved as nearly as can be ascertained.

That the City Manager shall proceed with taking of bids for the improvements,
or portions of the improvements, as state herein.
These improvements shall also be known as P.I.R. #811 - Project #8405.

That the location and extent of such improvements is as follows:
Construction of permanent street for Stinson Boulevard N.E. from 45th
Avenue N.E. to the Silver Lake Beach area, and storm drainage improve-
ments for the general vicinity.
Work would include the construction of new bituminous surfacing, curb
and gutter, storm sewer improvements for the street and collection of
storm water for surrounding areas, a cul-de-sac at the Silver Lake Beach
area, replacement of old galvanized and lead water services within the
street right-of-way from the curb stop to the City main, installation
of sewer stubs for unimproved lots along the street, and miscellaneous
associated construction items.
Water service improvements are proposed to be assessed to the affected
parcels on a per parcel basis if replacement is. necessary.
That the materials to be used are as follows:
Aggregate base, bituminous surfacing, concrete curb and gutter, concrete
servicewalk and driveway aprons, sod, 1" copper water service pipe, P.V.C.
storm sewer pipe, reinforced concrete storm sewer pipe, concrete manholes
and catch basins, treated wood baffle wire and various a~urtenance~.
3. That a careful estimate of the cost of the improvements has been made

by the City Manager and the several lots and parcels of land fronting
upon and adjacent to such proposed improvements, which be deemed bene-
fitted thereby, were properly notified of said hearings, and
That the City Manager shall also list the names and owners of the seve-
ral parcels so improved as nearly as can be ascertained.

That the location and extent of such improvements is as follows:
Construction of permanent street and curb and gutter for the following
streets:
West Upland Crest from Fairway Drive to Pennine Pass
North Upland Crest from Pennine Pass to Stinson Boulevard
Work would include the construction of new concrete curb and gutter,
new bituminous surfacing, storm sewer improvements, the replacement of

old galvanized and lead water services within the street right-of-way
from the curb stop to the City main, and miscellaneous associated con-
struction items.
Work to be special assessed with a reduction by Anoka County contribution
for their portion of the work. Water service replacements are proposed
to be assessed on a per parcel basis if replacement is necessary.
That the materials to be used are as follows:

Mayor Nawrocki commented on the assessment procedure used for this project and
that the conventional grid system usually used for an assessment area was not
employed on this project. He noted that the City Council did deviate from its
policy. Although, this Council's position on a given set of circumstances is not
binding on future councils, the Mayor felt it should be mentioned that this Council's
view of this matter is as follows; since properties on East Upland Crest, Highland
Place and Forest Drive that did not abut West Upland Crest or North Upland Crest
were not proposed to be assessed for storm sewer work on West Upland Crest and on
North Upland Crest that in fairness for any future work regarding street surfacing
Ir storm sewer work on these three streets, East Upland Crest, Forest Drive and
.ighland Place, property owners on North Upland Crest and West Upland Crest
should not be assessed as the property owners on the three aforementioned streets
would not be participating in the work being done on this project.
