REGULAR COUNCIL MEETING
SEPTEMBER 8, 1986
The meeting was called to order by Mayor Nawrocki at 7:30 p.m..
1. Roll Call

There was no invocator available to offer an invocation.
3. Minutes of Previous Meetings
Motion by Paulson, second by Petkoff to approve the minutes of the Regular Council
Meeting of August 25th, the Board of Trustees - Fire Relief Association of August
26th, and the Special Council Meeting of August 27th, as presented in writing and
that the reading be dispensed with. There were no corrections. Roll call: All ayes
4. Oral Petitions
The owner of property at 4027 Central Avenue requested that she receive a re-evaluation
for the parking assessment on this parcel. She noted that a portion of the building,
which is divided for more than one business, has been vacant for some time. The Mayor
inquired if this request, if it were to be grantedjwould require a public hearing and
other activity. The City Attorney advised that if this had been a normal assessment
situation a public hearing would be necessary but in this assessment project the City
Council had previously decided that each issue would received singular consideration
subject to the increase/decrease of activity. The Mayor requested ~hat this matter
be reviewed and a written response be made by the City Manager to the property owner
and to the City Counci. l by the next regular Council meeting.
5. Ordinances and Resolutions
a. Second Reading of Ordinance No. 1132; Ordinance Vacating that Part of the West
Alley Located on Property Owned by First Lutheran Church
Motion by Petkoff, second by Paulson to waive the reading of the ordinance there being

ORDINANCE NO. 1132
BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, VACATING A CERTAIN
ALLEY
The City of Columbia Heights does ordain:
Section l:
The City of Columbia Heights herewith vacates the public alley over
the following described property:
That part of the east-west alley in Block 58, Columbia Heights Annex
to Minneapolis, Anoka County, Minnesota, lying east of the southerly
extension of the west lot line of Lot 23 and west of the northerly
extension of the west lot line of Lot 17
Section 2:
This ordinance shall be in full force and effect from and after thirty
(30) days after its passage.

Communications
a. Planning and Zoning Commission
1. Donald Logelin/Galaxy Auto, 5101 University Avenue, Conditional Use Permit
Mr. Logelin is requesting a conditional use permit for the operation of an auto
service shop and office at 5101 University Avenue as an extension to the present
Galaxy Auto location at 5229 University Avenue. Discussion was had regarding the
type of auto repairs which would be done at this location. Mayor Nawrocki requested
that maintenance be included in this permit since it is located near a residential
area.
Motion by Petkoff, second by Paulson that a conditional use permit for minor auto
repair be granted to Galaxy Auto with the following conditions:
1. That no major auto repair be conducted at the Site
2. That the following nine items be completed prior to occupancy of the building:
a. The screening fence be repaired.
b. The canopy be repaired.
c. The dumpster be enclosed and located by the northeast corner of the building.
d. The westerly driveway on 51st Avenue be closed.
e. The southerly driveway on University Avenue be closed and replaced with
full height, City-specified curbing.
f. The remaining two driveways be reduced to the City maximum size of 22' in
width.
g. The curbing be installed around the green areas (grass).
h. The parking lot be repaired and parking spaces striped.
i. Install required green areas abutting all public right of ways.
3. That items listed for completion be maintained in a condition of good and
proper repair throughtout the life of the conditional use permit.

2. Gregory Bickford, 3957 Polk Street, Conditional Use Permit (Home Occupation)
This permit is being requested to allow a home occupation of catalog sales for motor-
cycle parts by mail and telephone based at 3957 Polk Street. A lengthy discussion
was held regarding the method for delivery of the business owner's inventory and what
vehicular traffic could be anticipated with the deliveries. Mayor Nawrocki stated his
concern with any additional traffic which may be generated in this residential neigh-
borhood by the business. He felt better control could be had if a Home Occupation
permit were issued rather than a conditional use permit. Inclusion of delivery restri-
ctions in the conditional use permit was considered.

tipulations that there be no pick up of parts at the site by customers, temporary
storage of parts, and a maximum of two deliveries of parts to the site per week. Roll

3. John Farrell, 3736 Second Street, Variance
Motion by Petkoff, second by Paulson to approve a 12' rear yard setback variance
to allow the construction of a 23' x 23' detached garage due to the hardship of
the topography of the lot as recommended by the Planning and Zoning Commission.
Roll call: All ayes
4. E.D. Gilderhus, 4212/4216 Washington Street, Variance
Motion by Petkoff, second by Paulson to grant a 7' rear yard setback variance for
the construction of one garage and the relocation of another due to the hardship
of the location of the existing structure at 4212 Washington Street and the hard-
ship of the existing trees located at 4216 Washington Street. Roll call: All ayes
New Business
1. Request for Temporary Signage
White Castle Systems, Inc. is requesting authorization to use temporary portable
signage at their business in the City while the building is being remodeled. Pre-
sently there are no exterior lights and this has mistakenly given the impression
that the business is no longer open. Mayor Nawrocki noted that the City's Sign
Code specifically prohibits portable signage.
Motion by Peterson, second by Paulson to approve the request for temporary signage
as requested by White Castle Systems, Inc. and that the portable signage remain no
longer than October 31, 1986. Roll call: Paulson, Petkoff, Carlson, Peterson - aye

2. 5100 Central Avenue - Veterinary Animal Hospital
This animal hospital, formerly owned by Dr. Johnson, has been recently sold to Dr.
Mary Beth Egger. The animal hospital as operated by Dr. Johnson was a non-conforming
use in the Retail Business District. Staff noted that the hospital had not been used
since October of 1985. Legal counsel for the new owner stated that the hospital had
been used in the latter part of April, 1986o Discussion continued regarding the use
of the hospital since October 1985. Mayor Nawrocki viewed the process as a method
for circumventing the intent of the ordinance regarding continued use in a non-
conforming fashion. Members of the Council felt the hospital would be a benefit
to the community. Dr. Eggers is also requesting an ordinance amendment to allow
the boarding of healthy animals. It was noted that this practice had been discontinued
by Dr. Johnson in 1982. The City Attorney had prepared an ordinance to address this
request.
Motion by Peterson, second by Carlson that the City Council accept the condition that
the use of the facility at 51OO Central Avenue as a veterinary animal hospital has

A lengthy discussion continued regarding the distinction between a kennel and a
veterinary hospital. The Building Inspector stated he felt the business could only
be used as a pet hospital and not for the boarding of healthy animals as the non-
conforming kennel operation had ceased in 1982 as stated by the records in the
License Department.
Motion by Petkoff, second by Peterson to waive the reading of the ordinance there

BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO
VETERINARY HOSPITALS

Section l:
Section 9.114(1)(jj) of Ordinance No. 853, City Code of 1977, passed
June 21, 1977, which currently reads as follows, to-wit:
(jj) Veterinary animal hospital.
Shall hereafter be amended to read as follows, to-wit:
(j j)
Veterinary animal hospital including indoor boarding facilities
within the building if the subject veterinary animal hospital
is the sole occupant of the building in which the boarding
facilities are located.
Section 2:
This ordinance shall be in full force and effect from and after thirty
(30) days after its passage.

BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO
SANITARY SEWER EASEMENT
The City of Columbia Beights does ordain:
Section l: The easement for installation, maintenance, repair and upkeep of
trunk sanitary sewer through the east one-half of Lot eight (8),
Block four (4), Rearrangement of Block "A'l, Columbia Heights Annex
to Minneapolis is hereby vacated except that the City of Columbia
Heights reserves and does not vacate that portion of the aforedes-
cribed easement described as follows, to-wit:

c. First Reading of Ordinance No. 1135, Pertaining to Hours and Days of Sale of
Alcoholic Beverages
Motion by Petkoff, second by Peterson to waive the reading of the ordinance there
being ample copies available to the public. Roll call: All ayes
The basic change this ordinance would make to present practices is to allow sales
on election day. The City Manager was requested to poll surrounding communities
including the City of Minneapolis regarding the allowable practices for both on-
sale and off-sale.
ORDINANCE NO. 1135
BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO
HOURS AND DAYS OF SALE OF ALCOHOLIC BEVERAGES
The City of Columbia Heights does ordain:
Section 1:
Section 4.401(4) of Ordinance No. 853, City Code of 1977, passed June
21, 1977, which currently reads as follows, to-wit:
4.401(4)
The Manager shall designate the days and hours of operation for liquor
stores, subject to the following restrictions:
No "Off-sales" of intoxicating liquor shall be made on New Year's
Day, Independence Day, Thanksgiving Day, Christmas Day, Sunday,
before 8:00 p.m. on the day of any statewide election, or before
8:00 a.m. and after 10.OO p.m. on any other day.
(b)
No 'IOn-sale" of intoxicating liquor shall be made after l:OO a.m.
on Sunday or between the hours of l:O0 a.m. and 8:00 p.m. on the
day of a statewide election.
No "On-sale" of intoxicating liquor shall be made between the hours
of l:OO a.m. and 8:00 a.m. on any other day.
Shall hereafter read as follows, to-wit:

1:00 a.m. and 8:00 a.m. on any weekday, Monday through Saturday,
nor between the hours of 1:00 a.m. and 12:00 noon on Sunday.
No licensee or his agent or any other person shall consume or
allow to be consumed on the licensed premises any beer between
the hours of 1:30 a.m. and 8:00 a.m..
Section 3: Section 5.502(8)(a) of Ordinance No. 853, City Code of 1977, passed June
21, 1977, which currently reads as follows, to-wit:
(a)
No sales of any intoxicating malt liquor or intoxicating liquor
may be made after 1:00 a.m. on Sunday, before lO:O0 a.m. on
Monday, between the hours of 1:00 a.m. and lO:O0 a.m. on any
weekday, or between the hours of 1:00 a.m. and 8:00 p.m. on any
day of a statewide election.
Shall hereafter read as follows, to-wit:
(a)
No sales of intoxicating or non-intoxicating malt liquor or intoxi-
cating liquor may be made (1) between 1:00 a.m. and 8:00 a.m.
on the days of Tuesday through Saturday; (2) between 12:00 mid-
night and 8:00 a.m. on Mondays; (3) after 1:00 a.m. on Sundays;
or, (4) between 8:00 p.m. on December 24 and 8:00 a.m. on December
25.
Section 4: Section 5.503(12) of Ordinance No. 853, City Code of 1977, passed June
21, 1977, which currently reads as follows, to-wit:
5.503(12) No sale of intoxicating liquor shall be made after one a.m. on Sunday,
nor until eight a.m. on Monday, nor between the hours of one a.m. and
eight p.m. on the day of any statewide election. No sale shall be made
between the hours of one a.m. and eight a.m. on any weekday.
Shall hereafter read as follows, to-wit:
5.503(12) No sale of intoxicating liquor for consumption on a licensed premises
may be made (1) between 1:00 a.m. and 8:00 a.m. on the days of Tuesday
through Saturday; (2) between 12:00 midnight and 8:00 am.. on Mondays;
(3) after l:O0 a.m. on Sundays; or (4) between 8:00 p.m. on December
24 and 8:00 a.m. on December 25.

No sale of intoxicating liquor shall be made on premises licensed under
this section after 11:OO p.m. on any day, nor before 8:00 a.m. on any
day, nor on any Sunday, nor before 8:00 p.m. on the day of any state-
wide election.
Shall hereafter read as follows, to-wit:
5.505(3)
No sale of intoxicating liquor for consumption on the premises licensed
under this section may be made (I) before 8:00 a.m. on any day; (2) after
11:OO p.m. on any day; (3) on Sundays, or (4) between 8:00 p.m. on Decem
ber 24 and 8:00 a.m. on December 25.
Section 7: Section 5.509(7)(a) of Ordinance No. 853, City Code of 1977, passed June
21, 1977, which currently reads as follows, to-wit:
(a)
No licensee or his agent may sell or permit the sale of beer

1:OO a.m. and 8:00 a.m. on any weekday, Monday through Saturday,

inclusive; nor on Sunday between the hours of 1 a.m. and 12 noon, nor
between the hours of 1 a.m. and 8 p.m. on the day of any statewide
election; nor permit the consumption of beer on the premises by any
person, including the licensee or his employees between the hours of
1:30 a.m. and 8:00 a.m.
10.302(4)
No person who manages or operates a club for which an on-sale intoxi-
cating liquor license has been issued shall permit or allow the sale
or consumption of any beer or intoxicating liquor on the licensed
premises between the hours of l:OO a.m. to 4:00 p.m., Monday through
Friday, or the hours of 1:00 a.m. to 1:00 p.m. on Saturday, or after
1:00 a.m. on Sunday, or until 8:00 p.m. on any day of a statewide
election.
Shall hers~fter read as follows, to-wit:
10.302(3)
No person, licensee or his agent, or manager of a club or his agent
shall permit the sale or comsumption of intoxicatinq liquor or beer
other than during the hours specifically authorized in Section Five
(5) of this City Code.

b. 1986 Anoka County C.D.B.G. Restoration of Deferred Funds
This matter had been discussed at a previous Council meeting and action had been
deferred until the expenditures of Public Service Projects had been researched.
An HRA staff member had advised the City Manager that no money had been expended
on the approved projects and that the Human Services Commission will be meeting
to discuss this item. No Council action was taken and this will be an agenda item
at the next regular Council meeting.

c. Other Communications
Mayor Nawrocki advised the Council of a letter he received from a resident on 38th
Avenue regarding the condition of that street. He noted he had responded to this
resident by advising that a petition be circulated to the residents on the street
and that this matter be brought to the Council. He also had a phone conversation
with the resident regarding this. A second letter was received from the resident
stating it was her opinion that it was the responsibility of the City to initiate
this street repair. Receipt of the two letters was acknowledged.
7. Old and New Business
a. Old Business
1. Joint Powers Agreement to Form a Coalition of Metropolitan Communities to be
Known as the Northern Mayors' Association
Motion by Peterson, second by Carlson to authorize the Mayor and City Manager to
execute a Joint Powers Agreement to form a coalition of metropolitan communities
to be known as the Northern Mayors' Association. Roll call: All ayes
2. Advertising Campaign for Top Valu Liquor
Motion by Peterson, second by Carlson to authorize the City Manager to expend up to
$3,006 for an eight-week advertising campaign regarding promotion of the City's
liquor stores to be published in the Twin Cities' Reader. Roll call: All ayes
3. Columbia Heights Lions Club - Liquor/Beer License
The City Attorney advised the Council that the Lions Club will be pursuing a "Club"
liquor license. This was an informational item and no Council action was taken.
b. New Business
1. Establish Date for a Special Assessment Hearing
Motion by Peterson, second by Carlson to establish Tuesday, November 25, 1986
at 7:30 p.m. as the date for the Special Assessment Hearing. Roll call: All
ayes
The Council discussed with staff the projects presently being done and some others
that may be considered.
Motion by Petkoff, second by Peterson to continue with the original projects as
presented at the public hearing. Roll call: Ail ayes
2. Request to Seek Bids on Garbage and Refuse Service
Motion by Petkoff, second by Peterson to authorize the City Manager to seek bids
for garbage and refuse service. Roll call: All ayes
It was noted by staff that references to metal garbage containers and to the
"Spring Clean-up" had been deleted from the garbage service contract. The present
garbage hauler starts pick up at 6:00 a.m.. Mayor Nawrocki feels this is too early
and prefers 7:00 a.m.
3. Request to Seek Bids for the Purchase of a Street Sweeper
Motion by Peter~on, second by Paulson to authorize the City Manager to seek bids
for one small street sweeper unit for alleys and parking lots. Roll call: All ayes
4. Authorization to Seek Bids for Fuel Burner Repairs
Motion by Peterson, second by Carlson to authorize the City Manager to seek bids for
fuel burner repairs at the Columbia Heights City Hall. The Building Inspector esti-
mates this repair will cost between $7.500 and $8,000. Roll call: Alt ayes

Request to Establish Wage Rate for Senior Citizen Coordinator Candidate
In recognition of her experience the City Manager is requesting the Council to com-
pensate the candidate at a higher than entry rate.
Motion by Petkoff, second by Nawrocki to authorize the City Manager to compensate
Ms. Karen Moeller at $1,498 per month, the six month rate for the Senior Citizens
Coordinator position, effective September ll, 1986. Roll call: All ayes
6. Authorization to Seek Architectural Services for Preparation of Roof Repair
Roofs at the City Hall, Service Center and Liquor Store #3 are in need of repair.
Councilmember Petkoff suggested that the staff contact other municipalities re-
garding their experiences with roofing companies. Councilmember Peterson recommended
contacting qualified roofers for gathering specifications for this matter rather
than contacting an architect. The discussion continued regarding the work being com-
pleted before the weather is cold or left for next year. No Council action was taken.
7. Award of Bid for Painting of Water Tower
The Public Works Director distributed the bids received and noted some "irreqularities"
in the bid. He also distributed material gathered from references who had been contacted
for each of the bidders.
The Councilmembers were in agreement to have the name of the City painted on the water
tower.
Motion by Paulson, second by Peterson to award the bid to Odlund Protective Coatings
of Blaine, Minnesota based on the base bid of $15,900 plus Option B in the amount of
$2,000 and that the findings that Valley Contracting, Inc. is an irresponsible bidder
to bid project options A and B and on their failure to finish work on time as stated
the Public Works Director and as stated in their reference check, and, that the
Mayor and City Manager be authorized to enter into same. Roll call: All ayes
8. Authorization to Purchase Security Services for Murzyn Hall
Motion by Carlson, second by Peterson to authorize the Mayor and City Manager to
execute a contract with Burns International Security Services for security service
at Murzyn Hall at the rate of $7.00 per hour based upon low, formal quotation. Roll

9. Purchase Request for Furniture for Murzyn Hall
Motion by Petkoff, second by Paulson to authorize the purchase of two end tables,

a. Report of the City Manager
The City Manager, s report was submitted in written form and the following items
were discussed:
1. Erosion Problem at 1345 Circle Terrace: The resident at this address experienced
erosion of her back yard embankment as a result of storm sewer runoff from Circle
Terrace. The City Manager recommended that City forces restore the property.
2. Appointment of Early Childhood Family Education Coordinator: The City Manager

appointed Carol Vick to the position of Early Childhood Family Education
Coordinator effective September 2, 1986 at the entry rate of $1,840 per
month.
3. Murzyn Hall Problems with Gas Stove and Air Conditioner: It was discovered
that the gas stove had been installed improperly but that the Building
Inspector has had the problem corrected. Complaints from neighbors in
the area have been received about the noise of the air conditioner. Staff
have been pursuing methods for baffling the noise and the Police Depart-
ment has been doing noise level tests. The Public Works Director advised
the Council that the door handles installed in Murzyn Hall do not meet
the requirements for use by handicapped people. The City Attorney will
review the contractor's contract for these items.
4. Locks at John Murzyn Hall: The Public Works Director advised the Council
that problems are being experienced with the locks at Murzyn Hall. He
will pursue this matter.
Budget of the Rice Creek Watershed District
Mayor Nawrocki inquired about the proposed budget for the Rice Creek Watershed
District and its impact on the City's mill rate. The City Manager will check this
matter and report to the City Council.

The City Attorney had nothing to report at this time.
9. Licenses
Motion by Carlson, second by Peterson to approve the licenses as listed upon payment
of proper fees and that the single event beer license for the Columbia Heights Lions
