REGULAR COUNCIL MEETING
SEPTEMBER 22, 1986
The meeting was called to order by Mayor Nawrocki at 7:30 p.m..
1. Roll Call

There was no Invocator available to offer an invocation.
3. Minutes of Previous Meetings
Motion by Paulson, second by Carlson to approve the minutes of the Regular Council
Meeting of September 8th as presented in writing and that the reading be dispensed
with. There were no corrections. Roll call: All ayes
4. Presentations
George Brown, President of the Columbia Heights/Fridley Kiwanis "K" Club presented
a check for $200 to Mayor Nawrocki for use in the Senior Citizen Center in John P.
Murzyn Hall. This money was realized from the Recycling Center which is staffed
by members of the Club. Mayor Nawrocki thanked the organization for the contribu-
tion and for all of their service to the City.
4a. Oral Petitions
Richard Springer of 1060 Polk Place advised the Council of his concern with potential
water problems which he feels will result from the construction of a home in his area.
He noted to date he has experienced no water problems. Mr. Springer gave the Council
pictures he took showing the current condition of the area after recent rains. He
felt these conditions would continue and be increased with this construction. The
Building Inspector noted that the lay of the land had been altered but that the
contractor had appropriately addressed the waterflow from this area with the instal-
lation of a drain field. The contractor was present at this time. He stated that the
drain field was not completely installed as yet but when it was completed that Mr.
Springer would experience less waterflow than in the past. Discussion continued
regarding the construction of a fence and its legality. Mr. Springer suggested that
if there is any water problem on his property he should be protected by the City
and by the contractor. Mayor Nawrocki stated this is a private matter between him
and the contractor. The Engineering Department has reviewed this project and the
Council is to receive a written report.
5. Ordinances and Resolutions
a. Second Reading of Ordinance No. 1133 Being an Ordinance Amending Ordinance No.
853, City Code of 1977, Pertaining to Veterinary Hospitals
The City Manager recommends that the Retail Business District be amended to allow
for what is proposed to be a principal permitted use in a General Business District,
with the definition of a veterinary animal hospital as stated in Ordinance No. 1133.
Mayor Nawrocki felt nothing needed to be changed. Councilmember Paulson felt that
this type of business should be in a Retail Business District and was aware that
other similar businesses could locate in any of the City's Retail Business Districts.
Motion by Peterson, second by Carlson to waive the reading of the ordinance there
being ample copies available. Roll call: All ayes

Veterinary animal hospital including indoor boarding facilities
within the building if the subject veterinary animal hospital
is the sole occupant of the building in which the boarding
facilities are located.

b. Second Reading of Ordinance No. 1135 Being an Ordinance Amending Ordinance No. 853,
City Code of 1977, Pertaining to Hours and Days of Sale of Alcoholic Beverages
Staff had surveyed nearly forty cities regarding their requirements for sale of liquor
on statewide election days. Thirty eight of the cities who responded to the staff's
inquiry advised they allow sale of alcoholic beverages on statewide elections days.
Motion by Peterson, second by Carlson to waive the reading of the ordinance there
being ample copies available to the public. Roll call: All ayes

BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO HOURS
AND DAYS OF SALE OF ALCOHOLIC BEVERAGES
The City of Columbia Heights does ordain:
Section 1:
Section 4.401(4) of Ordinance No. 853, City Code of 1977, passed June
21, 1977, which currently reads as follows, to-wit:

The Manager shall designate the days and hours of operation for liquor
stores, subject to the following restrictions:
No "Off-sales'' of intoxicating liquor shall be made on New Year's
Day, Independence Day, Thanksgiving Day, Christmas Day, Sunday,
before 8:00 p.m. on the day of any statewide election, or before
8:00 a.m. and 10:O0 p.m. on any other day.
(b) No "On sale" of intoxicating liquor shall be made after 1 a.m.

inclusive; nor on Sunday between the hours of 1 a.m. and 12 noon, nor
between the hours of 1 a.m. and 8 p.m. on the day of any statewide
election; nor permit the consumption of beer on the premises by any
person, including the licensee or his employee between the hours
of 1:30 a.m. and 8 a.m..
No person who manages or operates a club for which an on-sale intoxi-
cating liquor license has been issued shall permit or allow the sale
or consumption of any beer or intoxicating liquor on the licensed pre-
mises between the hours of 1:OO a.m. to 4:00 p.m., Monday through
Friday, or the hours of 1:OO a.m. to l:O0 p.m. on Saturday, or after
1:00 a.m. on Sunday, or until 8:00 p.m. on any day of a statewide
election.

c. Resolution No. 85-54; Certification of Delinquent Utility Charges
Motion by Paulson, second by Petkoff to waive the reading of the resolution there
being ample copies available to the public. Roll call: All ayes
RESOLUTION NO. 86-54
CERTIFICATION OF DELINQUENT UTILITY CHARGES
BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, that
WHEREAS:
All delinquent utility users have been sent a delinquent bill, shutoff
notice and a certification letter,
BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that the
County Auditor be, and he is hereby directed, to levy the delinquent
utility charges on the properties in the City of Columbia Heights as
submitted on the attached sheet, totalling $2,789.59 pursuant to Min-
nesota Statute 444.075 Subdivision 3.
BE IT FURTHER RESOLVED that the aforegoing amounts shall be included in the individual
real estate tax statements and identified thereon as "Delinquent Utility
Charges - Fund #990'l.
SAID LEVIES shall be enforced and collected in the manner provided for the enforcement
and collection of state and county taxes under and in accordance with
the provisions of the general laws of the State. All assessments with
penalties and interest, as indicated thereon, paid to the County
Treasurer shall belong to the City of Columbia Heights and shall be
turned over to the City Treasurer in the manner provided by the City
Charter and Ordinances.

d. Resolution No. 86-55; .Establishing 1987 Business License Fees
The City Manager advised the Council that the license fees for our City are in line
with those in other cities according to a staff survey.
Motion by Peterson, second by Carlson to waive the readiog of the ordinance there
being ample copies available to the public. Roll call: All ayes
RESOLUTION NO. 86-55
ESTABLISHING 1987 BUSINESS LICENSE FEES
WHEREAS:
Ordinance No. 853, City Code of 1977, pertaining to commercial licensing
regulations provides for the establishing of annual license fees; and,
WHEREAS:
The City has participated in a survey of metropolitan municipalities
regarding business license fees charged by other communities; and,
WHEREAS:
The City is attempting to maintain business licenses which are
comparable; and,
WHEREAS: The City annually reviews its business fee schedule;
NOW, THEREFORE, BE IT RESOLVED that the attached proposed license fee schedule
be adopted and effective January 1, 1987.

6. Communications
a. Planning and Zoning Commission
Conditional Use Permit - The Nectary, Inc., dba Tony Roma's, 5085 Central Avenue
The owners of this business are requesting approval of a conditional use permit
to allow the operation of a 273 seat Tony Roma's Bar & Restaurant with a 196 square
foot dance floor.
Motion by Petkoff, second by Peterson to approve the conditional use permit as recom-
mended by the Planning and Zoning Commission for Tony Roma's located at 5085
Central Avenue. Roll call: All ayes
The owners of the business had also requested a liquor license for the operation.
The Police Department has completed its investigation of the application and the
the Police Chief recommends that the license be granted.
Motion by Peterson, second by Carlson that the on-sale liquor license be approved
with approval for Sundays as well, that the fee be paid for the license and that
all relevant documents be submitted to the Building Inspections Department. Roll

1. Bike-A-Thon For St. Jude's Children's Research Hospital
Motion by Carlson, second by Peterson to authorize the St. Jude Bike-A-Thon
to utilize the following streets as the Bike-A-Thon route: Mill Street to
the alley south of 4Oth to Jefferson Street, south to 39th Avenue, west on
39th Avenue to Fifth Street, Fifth Street north to Mill Street, Mill Street
east to the alley; during the hours of 12:00 noon to 4:00 p.m. on Saturday,
September 27, 1986 (subject to Park Board approval): and furthermore, that
the applicant coordinate the Bike-A-Thon activities with the Police, Fire

2. Columbia Heights Athletic Boosters - Selling of Pull Tabs & Raffle Tickets
Motion by Peterson, second by Carlson to approve the Columbia Heights Athletic
Boosters sale of pull tabs and raffle tickets in conjunction with their Annual
Fall Dance scheduled for November 28, 1986 , at Murzyn Hall such sales to take
~lace in the LaBelle Lounge. Roll call: All ayes
3. Purchases
a. Acoustical Dividers for Recreation & Community Services Commission
These dividers will be installed in the Recreation Department, the Early Childhood
Program Room and in the Senior Citizen area in Murzyn Hall. These dividers were
in the budgets of ali three of these programs. It was the decision of the Council
that the money budgeted for the dividers in the Senior Citizen Program budget be
used for senior citizen programs and not for the dividers.
Motion by Petkoff, second by Paulson to authorize the purchase of accoustical
dividers from Neal Slate Company of Eden Prairie at a cost not to exceed $4,310
based upon low, informal quotation; and furthermore, that the Mayor and City
Manager be authorized to execute a contract for same. Roll call: All ayes

b. Turnout Gear for Fire Department
Motion by Carlson, second by Peterson to authorize the purchase of turnout gear
from Mid-Central, Inc. of Edina based upon low, formal bid of $2,563.30; and
furthermore, that the Mayor and City Manager be authorized to execute a contract
for same. Roll call: All ayes
4. Ratify Action of City'Manager Regarding the Purchase of Furniture and Fixtures
for Murzyn Hall
a. Purchase of 8' Slate Pool Tables
Motion by Petkoff, second by Peterson to ratify the purchase of pool tables from
Advance Carter, Inc. based upon low, informal quotation of $1,400; and furthermore,
to ratify the action of the Mayor and City Manager in executing a contract for
same. Roll call: All ayes
b. Purchase of Porcelain Marker Boards
Motion by Carlson, second by Petkoff to ratify the purchase of porcelain marker
boards from Neal State Company of Eden Prairie based on low, informal quotation
of $1,000.80; and furthermore, to ratify the action of the Mayor and City Manager
in executing a contract for same. Roll call: All ayes
5. Review of Development Proposals for Sullivan Lake Site
The Director of Community Development has received five proposals for development of
the Sullivan Lake site. He reviewed each one of the proposals some of which had sub-
mitted drawings or renderings. One developer had shown his proposal to the Council
previously. The Council decided to meet with each developer separately to discuss
proposals individually. No Council action was taken.
6. Repair of Backhoe
Motion by Carlson, second by Peterson to authorize the City Manager to expend up
to $5,000 for the repair and/or replacement of the transmission on the 1969 Ford
backhoe; and furthermore, the City Council recognizes this item to be a prop-
rietary item. Roll call: All ayes
7. Retaining Wall 1234 44th Avenue
The Council previously authorized the Mayor and City Manager to execute a contract
for construction of a retaining wall at 1234 44th Avenue with the understanding that
staff would negotiate an alternative means of constructing the wall. The alternative
negotiated was quite costly. Discussion continued regarding the concrete wall p~evi-
ously authorized and the alternatives.
Motion by Petkoff, second by Paulson to proceed with the contract previously autho-
orized for a concrete retaining wall. Mayor Nawrocki felt the Council should consi-
der some other alternatives, especially the one using wood materials. The maker and
the seconder withdrew their motion. Councilmember Paulson felt that when the Council
discusses the cost effectiveness of a certain type of wall the upkeep and maintenance
over a long period of time should be considered.

City Manager distributed material containing all of the bids received for the
retaining wall at 1234 44th Avenue.
Motion by Paulson, second by Peterson that further discussion regarding this retaining
wall be continued until the Special Council Meeting on Thursday, September 25th. Roll
call: All ayes
8. Confirmation of Purchase of Conference Chairs and Two Tables
Motion by Peterson, second by Paulson to confirm the purchase by the City Manager
of ten conference chairs at $129.95 each and two tables at $69.99 each for a total
of $1,437.50 from Dayton's Commercial Interiors for use at John P. Murzyn Hall.
Roll call: All ayes
9. Planting on the Jefferson Divide
Motion by Petkoff, second by Peterson to authorize the purchase of 715 18" Coral-
berry bushes from Midwest Landscaping for a price of $2.50 to be planted in the
Jefferson divide and based on low, informal quotation. Discussion continued as to
what type of bushes the Coralberry bushes were. The motion was withdrawn.
Motion by Carlson, second by Peterson to refer further consideration of this matter
until the Special Council Meeting on Thursday, ~eptember 25th. Roll call: All ayes
10. Resolution Directing the Administrative Staff to Accept Certain Installation
Payments to Assessments
There was a lengthy discussion regarding the present policy on late special assess-
ment payments and the penalty.
Motion by Petkoff, second by Paulson to table this matter until the Special Council
ting on September 25th. Roll call: All ayes
ll. A letter was received from a resident regarding having a light installed at 37th
Avenue and Hayes Street. It was noted this matter had been considered previously and
that it would take the cooperation of the City of Minneapolis. Staff will review the
pedestrian and vehicular studies which were done.
12. LMC Policy Adoption Meeting
The City Manager advised the Council that the League of Minnesota Cities had
scheduled its Policy Adoption Meeting for November 20, 1986. This meeting had
traditionally been held when the Legislative Session convened.
8. Reports
a. Report of the City Manager
The City Manager's report was submitted in written form and the following items
were discussed:
1. Certificate of Need for Anoka Sanitary Landfill Expansion: This item was pre-
sented for informational purposes but Mayor Nawrocki noted that the I'tipping"
charges had been increased by the City's hauler to $2.50 a ton.
2. Inspection of Fire Department Ambulance - 1973 Chevrolet: This ambulance is
scheduled to be sold at the City's upcoming auction. Members of the Council had
previously suggested it be used for transporting seasonal employees rather than
purchasing another vehicle for this purpose. The ambulance was removed from the
list of auction vehicles.
3. Driveway Problem at 4219 Stinson Boulevard: The Mayor inquired if the Code
has been complied with when this driveway was put in. The City Manager advised
that it had but at the present time the grades have changed and that there is

water seepage onto the property to the south. The Building Inspector noted that he
is presently waiting for the elevations being taken by the Engineering Department
to determine how much the grade had been changed. Mayor Nawrocki stated that in order
to comply with the City's ordinance the City Code must be adhered to. It appears that
this matter has not withstood the test of time and he felt it is therefore not in
compliance. Councilmember. Petkoff observed this matter may be an ideal example of
something which could be brought before the newly-formed Mediation Board.
4. Administration Costs for Upcoming Special Assessments: This item will be an item
for the Council Work Session scheduled for Monday, October 6th.
5. Soo Line Crossing From Murzyn Hall Parking Lot: A decision regarding this matter
has not as yet been received from the administrative law judge. The City Attorney
suggested it may be received within the next few days. Alternatives for egress from
this lot were discussed.
6. Air Conditioners at Murzyn Hall: The City Manager noted that presently the air
conditioner at Murzyn Hall does ~t meet code requirements for noise levels. Alter-
natives for correcting this matter are being considered.
7. Cash Registers Electrical Problem: The Finance Director is recommending the
purchase of equipment which will serve to backup the registers if their operation
were interrupted in the future as well as other enhancements to the system. Council-
member Paulson requested that staff contact the vendor of this equipment and inquire
how the registers will be affected operationally with this equipment. He wondered if
the registers would slow down noticeably.
8. Tax Delinquent Properties Owned by Andrew Kohlan: A meeting was held with Mr. Kohlan,
Mayor Nawrocki, the City Manager and members of the City staff to discuss the parcels
owned by Mr. Kohlan in the City which he is considering building on. These parcels are
tax delinquent. Mr. Kohlan has until October 3rd to redeem these properties. The City
Attorney advised the Council Mr. Kohlan~s rights to redeem only those properties which
he is planning on improving.
