Roll Call Petkoff, Carlson, Peterson, Nawrocki - present Hovland - absent Councilmember Hovland joined the meeting at 7:45 P.M.. 2. Purpose of Meeting To consider request of Dave's Bar and Dick's Bar to allow sale of beer at the September 14th Downtown Celebration and to take action on Itinerant Food License. The City Mana- ger corrected the annotated agenda to read Lion's Club rather than Dick's Bar. John Zaccardi, owner of Dave's Bar, is requesting permission to sell beer at the Cele- bration on September 14, 1985. He had made application for a license for this purpose and made other arrangements for insurance and equipment for the two booths he planned on having at the Celebration. Recently, he was advised he would not qualify for the license for which he had applied. At a previous Council meeting this matter had been discussed and alternatives were suggested for obtaining this permission. A motion incorporating one of the alternatives was made at the Council meeting o% August 26th. The Council Secretary read the motion which is as follows' "Motion by Petkoff, second by Peterson to extend the license of Dave's Bar to the Col- umbia Heights Celebration location subject to John Zaccardi's having the proper license, the HRA selecting an appropriate location for his booths, and his acquiring the required urance." This matter was tabled until this special meeting. Nawrocki had contacted the party handling the reservation of booths for the Cele- bration and viewed the application. The Booth Chairman was unaware that beer was to be sold from the booths. John Zaccardi reviewed the expenses of this venture that would not be recovered if he were not permitted to participate in the Celebration. His loss on advertising, banners and deposits would amount to approximately $300. It was noted his license application fees would be returned to him by the City. Councilmember Petkoff inquired of Dick Bierch what the position of the Lion's Club is on this matter. He stated the organization is opposed to another booth selling beer at the Celebration. He noted that the Lion's Club had been asked to sell beer in a beer garden by the Celebration Organization. lie personally felt there was no need for two beer establishments at a five hour activity and doubted that proper control could be maintained by Dave's Bar for selling beer. The Mayor stated it is the responsibility of the Council to grant licenses. John Zaccardi stated he would be willing to give the beer away as he feels it is an integral part of his business and would not participate if he could not serve beer. Mayor Nawrocki felt this situation was unfortunate and suggested that Dave's Bar could distribute coupons for beer from the booth instead of serving/selling beer. The Mayor also stated a concern with setting a precedent for other 3.2 beer license holders in the City. Since the passage of Ordinance No. 1103 for single event beer licenses the Mayor noted there have been many questions regarding liability and that insurance rates have been rising. He regretted that the Permits Department had not been better informed regarding this ordinance. e Council Secretary re-read the motion. Roll call: Petkoff - aye Hovland, Carlson, ~erson, Nawrocki - nay Motion fails. ~n Zaccardi withdrew his application for an Itinerant Food license. Motion by Petkoff, second by Peterson to refund the license application fees of John Zaccardi for the special beer license and the itinerant food license for the September 14th Celebration. Roll call: All ayes S~ecial'Council Meeting Auaust 28, 1985 page 2 Nawrocki advised John Zaccardi that the certificate of insurance is being held in the Permits Department and his premium would be refunded if the certificate is returned as soon as possible. Zaccardi inquired of the City Attorney if it would be permissable for the Jaycees to operate his, booth at the Celebration and to serve beer under their license with all of the proceeds going to the Jaycees. The City Attorney replied that it would have to be a Jaycee booth and if they applied for the booth and the license there could be problems with advertising Dave's Bar. A letter was received from Dick Bierch, on behalf of the Columbia Heights Lion's Club requesting permission to dispense beer at the September 14th Celebration. Motion by Petkoff, second by Carlson to grant the single event club beer license to the Columbia Heights Lion's Club for the Downtown Celebration to be held on September 14th, 1985 and that the application, license and clean up fees be waived on the basis of the Lion's Club being a civic organization.
