HomeMy WebLinkAboutNov 26, 1985 (2)OFFICIAL PROCEEDINGS COLUHBIA HEIGHTS CITY COUNCIL SPECIAL ASSESSHENT HEARING NOVEHBER 26, 1985 The Hearing wa~ called to order at 17:30 P.M.. 1. Roll Call Hovland, Petkoff, Carlson, Peterson, Nawrocki - present 2. Purpose of Hearing To establish special assessments for various public improvements considered complete and ready for assessment and to consider a resolution which would officially levy special assessments for these public improvements. 3. Presentation of Information Regarding Projects The City Manager reviewed proposed assessments for the following projects: 1. Project #802 - hazardous sidewalk repairs throughout the City and Project #805 - hazardous sidewalk repairs on 42nd Avenue from Central Avenue to Fillmore Street and 41st Avenue from Reservoir Boulevard to Stinson Boulevard. A property owner in attendance had concern with the engineering and ad- ministrative charges for these projects. Mayor Nawrocki inquired if any information had been received from his request regarding the use of state funds for sidewalk repair for sidewalks located on state or county aid roads. He was advised there are funds available and can be used for these repair projects. The Mayor polled the Council regarding opinions for using these funds in this fashion and the Council members con- curred with the Mayor that these funds can be so used. The Special Assess- ments Clerk was requested to return payments already received to those resi- dents who had paid for sidewalk repair which would qualify under the state aid funding. A policy change was discussed and the Council determined that when state aid is available for hazardous sidewalk repair for sidewalks located on municipal or county roads these repairs will not be assessed to the property owners. Mayor Nawrocki requested that in the future prior approval for funds should be gotten so construction funds could be used for this type of project. Councilman Carlson inquired if: this type of funding may be available for properties on Central Avenue. The City Engineer advised him there may be funds available from the Municipal State Aid System. 2. Project #813 - miscellaneous delinquent bills - weeds/trees The City Manager requested that the assessment for 4445 Quincy Street be deleted from the list for Project #813 as this item had been handled by the Council on a separate basis. Motion by Carlson, second by Petkoff to delete from Project #802 and #805 those properties with hazardous sidewalk repair which are located on M.S.A.S. and C.S.A.S. based on using funds received from the State or from the County. and to delete from the assessment roll for Project #813 the property located at 4445 Quincy Street. Adoption of Resolution Adoption of Resolution No. 85-69 Being a Resolution Levying Special Assessments for Projects #802, #805, and #813 Motion by Petkoff, second by Carlson to waive the reading of the resolution there being ample copies available to the public. RESOLUTION NO. 85-69 Adopting assessment rolls according to the City Charter for the following local improvements and determining that said improvements have been made and ratifying and confirming all other proceedings, heretofore had: Special Assessments numbered 802, 805 and 813. WHEREAS, the City Council of the City of Columbia Heights, Minnesota, met at 7:30 olclock p.m. on the 26th day of November, 1985, in the City Council Chambers, 590 40th Avenue N.E., Columbia Heights, Minnesota, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to benefits, and to the proportion of the cost of making the local improve- ments above described, a notice of such hearing having been heretofore duly pub- lished as required by law, and a notice mailed to each property owner of record, stating the proposed amount of the assessment; and, WHEREAS, this Counci] has heretofore estimated and fixed the cost of such local improvements and has prepared an assessment roll therefore, THE CITY COUNCIL OF COLUMBIA HEIGHTS HEREBY RESOLVED: Section 1: That this Council does hereby adopt the aforesaid assessment rolls known and described as "Assessment Roll for Local Improvements" numbered 802, 805 and 813. Section 2: That this Council hereby finds and determines that each of the lots and parcels of land enumerated in said assessment rolls was and is especially benefitted by such improvement in an amount not less than the amount set opposite in the column headed "Total Assessment" And this Council further finds and determines that the proper proportion of the cost of such improvements to be especially assessed against such lot or parcel of land is the amount set opposite the description of each such lot or parcel of land respectively in said assessment rolls. Section 3: That said assessments may be paid in part or tn full without interest on or before December 26, 1985, or in annual installments for a period of from one to fifteen years as designated on each assessment roll, payable on or before the 15th day of September, annually, with 11% interest thereon. Failure to pay the annual installment renders the same delinquent and thereafter a 10% penalty is added and the said delinquent special assessment is certified to the County for collection with the real estate tax. Section 4: That this Council did hereby determine and redetermine to proceed with said improvements, does ratify and confirm all other proceedings here- tofore had in regard to these improvements, and said improvements shall hereafter be known and numbered as Local Improvements numbered 802, 805 and 813. Section 5: This resolution shall take effect immediately upon its passage.
