SPECIAL ASSESSMENT HEARING
COLUMBIA HEIGHTS CITY COUNCIL
FEBRUARY 21, 1984
The Special Assessment Hearing was called to order by Council President Petkoff at
7:30 P.M.
Roll Call
Hovland, Petkoff, Carlson, Peterson - present Nawrocki - absent
It was noted that Mayor Nawrocki was attending another official function and would be
arriving at the hearing later.
Purpose of the Hearing
Council President Petkoff stated that the purpose of the hearing was to establish
special assessments for various public improvements and to consider adoption of a
resolution levying special assessments for three projects.
Presentation of Information and Adoption of Resolution
The City Manager reviewed the three public improvements that have been completed and
are considered ready for assessments. Using maps and graphs the City Manager gave the
history of the projects and the estimated costs as well as the actual costs. The
projects are as follows:
Project #781, Asphalt Surfacing
Asphalt surfacing for the alley between 5th Street and Madison Place from 37th Avenue to
38th Avenue. Said alley runs south of 37th Avenue across Lot 42, Block 89, Columbia
Heights Annex. The recommendation is for this assessment period to be for a two year
period at a rate of I1% interest.
Project #791 Storm Drainage, Asphalt Surfacing and Curb and Gutter
Storm drainage, asphalt surfacing, curb and gutter for Arthur Place from 44th Avenue
north to Minneapolis reservoir property. The recommendation is for this assessment
period to be for a five year period at a rate of 1)% interest.
A letter from a property owner who is affected by the assessment of Project #791 was
received and distributed to the Council. In the letter the resident requested that the
Council consider a ten year period for the assessment at a 9½% rate of interest. Two
other residents of Arthur Place in attendance at the hearing stated their preference
for a ten year period as well. The City Assessor advised the Council of the annual
payments for a five year period and for a ten year period figured on a fifty foot lot.
It was noted that the payment figures quoted were for the principal amount only. The
City Manager recommended a seven year payback period at 11%.
Project #792 Water Main with Services, Storm Drainage, Asphalt Surfacing, Grading
for Parking Facilities, and Curb and Gutter
Improvements constructed on Reservoir Boulevard from 44th Avenue to 46th Avenue, 46th
Avenue from Reservoir Boulevard to Fillmore Street, Fillmore Street from 46th Avenue to
47th Avenue, and Fillmore Street north of 47th Avenue a distance of 100 feet. The rec-
ommendation is for this assessment period to be fifteen years at a rate of ll~ Interest.
A portion of this assessment will be paid by state aid funds and the amount assessed
for parking facilities is being paid by the City of Columbia Heights. The remaining por-
tion of the assessment will be borne by Crestview Lutheran Home. A request has been
received from Crest View to divide the assessment between the Boulevard Project and
the remaining Crest View parcel. This request is based on a requirement of the Minnesota
Housing and Finance Association who is involved in the financing of the Boulevard Pro-
ject and wishes the assessment to be divided evenly between the two parcels. A rep-
resentative of Crest View Lutheran Home stated that the assessment for the Boulevard
Project, approximately $45,000 wi11 be paid in total immediately. Former Councilman
Hentges inquired how the remaining portion was to be paid and if there is a request for
a lower rate of interest. He was advised that there was no such request and that the

remaining portion of the assessment will be paid in the manner prescribed by the
;ouncil. The recommendation for this project was fifteen years at 11~ interest.
Motion by Hovland, second by Petkoff to amend the recommended assessment period on
Project # 791 from five years to ten years and the interest rate be 1l~. Roll call:

Motion by Carlson, second by Peterson to amend the recommended assessment period on
Project # 791 from five years to ten years and the interest rate be 9½~. Roll call:

Motion by Peterson, second by Petkoff to divide the assessment on Project # 792
equally between the Boulevard Project property and the residual property owned
by Crest View Lutheran Home. Roll call: All ayes
Adoption of the Resolution
Motion by Hovland, second by Petkoff to waive the reading of the resolution there being
ample copies available to the public. Roll call: All ayes
RESOLUTION 84-09
Adopting assessment rolls according to the City Charter for the following local impro-
vements and determining that said improvements have been made and ratifying and con-
firming all other proceedings, heretofore had: Special Assessments numbered 781, 791
and 7~2.
WHEREAS, the City Council of the City of Columbia Heights, Minnesota met at 7:30 o'clock
p.m. on the 21st day of February, 1984, in the City Council Chambers, 590 4Oth Avenue
N.E., Columbia Heights, Hinnesota, being the time and place set when and where all
persons interested could appear and be heard by the Council with respect to benefits,
and to the proportion of the cost of making the local improvements above described,
a notice of such hearing having been heretofore duly published as required by law,
and a notice mailed to each property owner of record, stating the proposed amount of
the assessment; and,
WHEREAS, this Council has heretofore estimated and fixed the cost of such local
improvements and has prepared an assessment roll therefore,
THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVED:
Section 1: That this Council does hereby adopt the aforesaid assessment rolls known
and described as "Assessment Roll for Local Improvements" numbered 781,
791 and 792.
Section 2: That this Council hereby finds and determines that each of the lots and
parcels of land enumerated in said assessment rolls was and is especially
benefitted by such improvement in an amount not less than the amount set
opposite in the column headed "Total Assessment". And this Council further
finds and determines that the proper proportion of the cost of such impro-
vements to be especially assessed against such lot or parcel of land is

the amount set opposite the description of each such lot or parcel of
land respectively in said assessment rolls.
;ection 3: That said assessments may be paid in part or in full without interest on
or before March 22, 1984, or in annual installments for a period of from
one to fifteen years as designated on each assessment ro11, payable on or
before the 15th day of September, annually, with 11~ interest thereon.
Failure to pay the annual installment renders the same dellnquent and there-
after a 10% penalty is added and the same dellnquent special assessment
is certified to the County for collection with the real estate tax.
Section 4: That this Council did hereby determine and redetermine to proceed with
said improvements, does ratify and confirm ail other proceedings hereto-
fore had in regard to these improvements, and said improvements shall
hereafter be known and numbered as Local Improvements numbered 781, 791
and 792.
Section 5: This resolution, shall take effect inamediately upon its passage.
