Roll Call Hovland, Petkoff, Carlson, Peterson, Na~rocki - present 2. Purpose of Meeting_ - - A Public Improvement Hearing regarding special assessment projects dealing with seal coating of bituminous alleys and bituminous residential streets. 3. Presentation of Assessment Project.s. by City Mana~e.r Using maps and graphs the City Manager reviewed all aspects of the proposed projects. The projects are as follows: sealing coating of bituminous alleys in the City; also included are the following bituminous residential streets; Polk Street N.E. from 37th Avenue N.E. to 39th Avenue N.E.; and Leander Lane N.E. from Royce Street N.E. to 44th Avenue N.E.. Work would include the miscellaneous repair of concrete curb and gutter on the streets as well as bituminous surface patching of the alleys and streets prior to seal coating. Staff emphasized that th,:- costs stated in the projects proposed were estimated, not actual. The Mayor stated that he felt the engineering cost estimated for the ~lley portion of the ~rojects was outlandish. The City Engineer explained that the casts ~or alleys would probably be double what the costs for streets would be and that these would I~a ,,ainly in labor charges. He stated that more care ~s needed to avoid :)ver- spraying, a smaller aggregai.~ sprayer would be used, and that the clean up would need a smaller sweeper,all of wh;ch would result in the need for more man hours. The Hearing was opened up for questions and comments. The resident of 433i; ~eander Lane had concern with the manhole in front of his house. He noted that previously this manhole had been covered after a project had been com- pleted and proper drainage could nc.t take place. He was advised that manholes are to be covered during the spraying and that drainage on Leander Lane would be considered. The City E,~gineer also ~tated that this street real'ly does not have good drainage any- how and th s project would not significantly increase that drainage. The resident at 4326 Lean~E Lane felt this project would not be a meaningful improvement and was a waste cf m,~oey. He thinks the entire street should be bulldozed and levelled ouz and curbs a,~d ~.':~tters put in. The Mayor noted that this had been a consideration in the past and r...:~i;~,~:~ts of the area were against it. Councilman Hovland inquired how long the City ~:,;~inee:' Felt Leander Lane would hold up with a sealcoating. The City Eng- ineer stat~".d he thought it would start to break up within two year, and that the street sho~ld be re,~onstructed. The reside~,t at 3928 Johnson Street requested reconsideration on his alley assessment. He stated ~hat this is a deadend alley and there is a portion which he cannot use. This alley was ~'eviewed with the Assessor and maps that showed the alley and the 303 feet that is b~ing assessed to this resident. 'The resident at 3803 Polk Street inquired who was being assessed to sealcoat her alley. ~,~ was :~dvised that the alley is not being improved but that Polk Street is. The pro...~rty owner of two double bungalows at 4507-09 and 4513-15 Taylor Street stated ~.hat he felt the alley~assessment on his properties should not be made as he felt his property does not benefit from it. He stated that the alley is not accessible because of an incline in the rear of the properties. All access to his properties is from the front on Taylor Street. The refuse pick up is also from the front. The records showed that the assessment for alley improvements in 1962 had been paid previously. Public Hearing March 19, 1984 page 2 The property owner at 961 37th Avenue felt the costs for the project affecting her were too high. The Assistant City Engineer stated that it is hoped that the actual costs will be less than estimated. She also expressed a concern with a water meter installed by the Metropolitan Waste Con(rol Commission which rendered a portion of her yard unusable. The resident at 3805 Reservoir B~u]evard noted that there was an huge hole that was not properly filled when his alley was improved the last time. This hole washes out each spring and needs patching each spring. He requested that this hole be properly prepared before the alley is improved again. It was noted by staff that much of the surface repair will be done by City crews. The actual assessments will be considered at the Assessment Hearing next fall. It is the policy of the Council that if costs come higher than !0% of the estimated costs that the Hearing will be re-opened. Special mention was made by Councilman Peterson that the City Council should be given a report regarding the work to be done on the alley behind 3305 Reservoir Boulevard relative to the stabilization of the ground. Council members Carlson and Petkoff re- quested additional consideration for two proposals in the project. Mayor Nawrocki restated his concern with the costs of the labor being done by City crews and with the administrative cost. He also felt a better method should be em- ployed to advise people what projects are being proposed and which parcels are being considered for assessment. He felt the present method was confusing and residents didn't know if they were being assessed for a street or alley or were being charged a street or avenue charge. Motion by Carlson, second by Petkoff to table further consideration of the Leander Lane project until a special meeting on Monday, April 16, 1984 at 7:00 P.M.. Roll call: All ayes Motion by Petkoff, second by Carlson to table further consideration of the alley im- provement between Taylor and Fillmore, 45th to 46th Avenues until a special meeting on Monday, April 16, 1984 at 7:00 P.M.. Roll call: All ayes It was the decision of the Council that the property owner at 3928 Johnson Street should only be assessed for 116 feet instead of 303 feet as was originally proposed. Motion by Petkoff, second by Hovland to authorize the City Manager to proceed with Project No. 8400 (PIR 794) with the exceptions as previously noted. Roll call: All ayes 4. Consideration of Resolution Authorizing Projects Motion by Petkoff, second by Hovland to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes RESOLUTION 84-18 BEING A RESOLUTION ORDERING IMPROVEMENTS BE IT HEREBY RESOLVED ~y the City Council of the City of Columbia Heights, WHEREAS, the City Council of the City of Columbia Heights by motion on the 13th day of February, 1984 ordered notice of a hearing to be given to property owners, and Public Hearing March 19, 1984 page 3 WHEREAS, pursuant to a notice of a hearing certain residents appeared at a Council Meeting on the 19th day of March, 1984, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS HEREBY RESO~_VED: 1. That the location and extent of such improvements is as follows: Seal coating of bituminous alleys in the City. Also included are the following bituminous residential streets: Polk Street N.E. from 37th Avenue N.E. to 39th Avenue N.E. and Leander Lane N.E. from Royce Street N.E. to 44th Avenue N.E. 2. That the materials to be used are as follows: Miscellaneous concrete curb and gutter repair, bituminous patching, asphalt emulsion and seal coat aggregate. 3. That a careful estimate of the cost of the improvements has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvements, which be deemed benefitted thereby, were properly notified of said hearings, and 4. That the City Manager shall list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. These improvements shall also be known as Project No. 794.
