HomeMy WebLinkAboutNov 20, 1984OFFICIAL PROCEEDINGS SPECIAL ASSESSMENT HEARING NOVEMBER 20, 1984 The hearing was called to order by Mayor Nawrocki at 7:30 P.M.. 1. Roll Call Hovland, Carlson, Peters~n, Nawrocki - present Councilmember Petkoff was attending a Recreation Commission meeting and joined the hearing at 7:!:0 P.14.. 2. Purpose of Meeting The Mayor stated that the purpose of the hearing was to establish special assessments for various public improvements considered complete and to consider a resolution which would officially levy special assessments on two projects; project #775 - alley construction between Polk and Tyler Streets from 39th Avenue to Ostander Park, and, project #794 - seal coat of specific alleys in the City and seal coat of portions of Leander Lane and of Polk Street. 3. Presentation of Information by Staff The City Manager reviewed project #775, alley construction between Polk Street and Tyler Street from 39th Avenue to Ostrander Park. One resident in the area inquired if the assessment was set at the estimated cost of $9.84. He was advised that the actual cost being assessed was $8.90 per assessable foot. For project #794 the estimated cost was $2.22 per foot and the actual cost was $1.25 per foot. Project #794 included seal coat of alleys in the City, seal coat of Lean- der Lane from Royce Street to 44th Avenue and, seal coat of Polk Street from 37th to 39th Avenues. TF, e property owner at 4545 Heights Drive requested that his assessment be reconsidered. He has an alley along two sides of his property and the formula used to determine his assessment was reviewed by the Assessing Department staff and the Council. It was the consensus of the Council that the special assessment on this property should be re- duced to $86.69. The property owner at 4158 Sixth Street stated he has a corner lot and does not use the alley. He felt since he did not use this alley he should not be assessed. The Mayor stated that the alley does serve this property as well as any trucks or vehicles who service this homeowner. An example of this was the garbage collection. It was also noted that past and future owners of the property may have use of the alley. A resident whose home is at 3759 Main Street had questions regarding the administrative charges on this project. He was advised that these charges are paid by those assessed and not from taxes. The Mayor also had concern with the administrative charges. The resident at 4951 Jefferson Street stated he would not pay his assessment until the north end of his alley which abuts 50th Avenue is aligned with the alley. He has considerable difficulty getting out of the alley in the winter and said the storm sewer in that area is the cause of the problem. This alley had been the sub- ject of discussion at previous Council meetings and the Mayor suggested these dis- cussions be reviewed. The Mayor requested members of the staff who receive complaints or concerns regarding certain projects to pass this information on to the Council members so they may look at these areas before the hearing. Mayor Nawrocki .read a letter received from the property owner at 5024 Sixth Street regarding sealcoating of his alley. Two residents of Leander Lane expressed their disappointment with the seal coat on their street. The Mayor reflected'on the project hearing where the majority of the residents who would be assessed for this project had stated their opposition toward paying for the street repair as recommended by the Engineering Department. The City Engineer also stated he had advised the residents in the assessment area that this seal coat would not hold up and that the street should really be reconstructed. ~pecial Assessment Hearing November 20, 1984 page 2 The City Manager reviewed the seal coat of Polk Street from 37th to 39th Avenues. There was no discussion by residents. Amended Assessment Motion by Hovland, second by Peterson to adjust the proposed alley assessment for 4545 Heights Drive from $197.25 to $86.69. Roll call: All ayes 4. Adoption of Resolution Motion by Petkoff, second by Hovland to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes RESOLUTION NO. 84-65 Adopting assessment rolls according to the City Charter for the following local improvements and determining that said improvements have been made and ratifying and confirming all other proceedings, heretofore had: Special Assessments numbered 775 and 794. WHEREAS, the City Council of the City of Columbia Heights, Mingesota, met at 7:30 o'clock p.m. on the 20th day of November, 1984, in the City Council Chambers, 590 40th Avenue N.E., Columbia Heights, Minnesota, being the time and place set when and where all persons interested could appear and be heard by the Council with re- spect to benefits, and to the proportion of the cost of making the local improvements above described, a notice of such hearing having been heretofore duly published as required by law, and a notice mailed to each property owner of record, stating the proposed amount of the assessment; and, WHEREAS, this Council has here(ofore estimated and fixed the cost of such local improvements and has prepared an assessment roll therefore, THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVED: Section 1: That this Council does hereby adopt the aforesaid assessment rolls known and described as "Assessment Roll for Local Improvements numbered 775 and 794. Section 2: That this Council hereby finds and determines that each of the lots and parcels of land enumerated in said assessment rolls was and is especially benefited by such improvement in an amount not less than the amount set opposite in the column headed "Total Assessment". And this Council further finds and determines that the proper pro- portion of the cost of such improvements to be especially assessed against such lot or parcel of land is the amount set opposite the description of each such lot or parcel of land respectively in said assessment rolls. Section 3: That said assessments may be paid in part or in full without interest on or before December 20, 1984, or in annual installments. for a period of from one to fifteen years as designated on each assessment roll, payable on or before the 15th day of September, ~pecial Assessment Hearing November 20, 1984 page 3 annually, with 11% interest thereon. Failure to pay the annual instal- lment renders the same delinquent and thereafter a 10% penalty is added and the said delinquent special assessment is certified to the County for collection with the real estate tax. Section 4: That this Council did hereby determine and redetermine to proceed with said improvements, does ratify and confirm all other proceedings here- tofore had in regard to these improvements, and said improvements shall hereafter be known and numbered as Local Improvements numbered 775 and 794. Section 5: This resolution shall take effect immediately upon its passage. Passed this 2Oth day of November, 1984. Offered by: Petkoff Seconded by: Hovland Roll call: All ayes Bruce G. Naw'rocki, Mayor Jo-Anne Student, Council Secretary Councilman Carlson again stated he feels the administrative charges for this project ~.-e too high and that the 11% interest rate is too high. Mayor Nawrocki felt con- sidering the costs of borrowing that the I1% interest rate is in line. He added that the PIR Fund must be kept solvent. I't was noted that some projects never reach fruition yet there are administrative expenses incurred preparing them.
