Roll Call Hovland, Petkoff, Norberg, Hentges, Nawrocki--present 2. Invocation The Invocation was offered by Pastor Douglas Henderson of the Peoples Church. 3' Minutes of Previo~..s Meetings Motion by Hentges, second by Petkoff to approve the minutes of the City Council Meeting of April llth; and the Fire Department Relief Association-Volunteer Division, Board of Trustees Meeting of April llth as presented in writing, and that the reading be dis- pensed with. Roll call: All ayes 4. Oral Petitions A former member of the Fire Department's Volunteer Division made a request of the Council regarding a hearing scheduled for April 26th of the Volunteer Division Executive Board. 5. Ordinances and Resolutions a. Reconsideration of Ordinance No. 1035 Ordinance No. 1035 is an ordinance amending Ordinance No. 853, City Code of 1977, pertain- ing to limited intoxicating liquor licenses. Reconsideration of this ordinance had been moved at the last regular Council meeting and the options open for this reconsideration of the ordinance were discussed. Motion by Norberg to rescind the action taken on Ordinance No. 1035. Motion dies for lack of a second. No further action was taken on Ordinance No. IO35 so the original action taken on the second reading of Ordinance No. 1035 at the March 14th, 1983 regular Council meet- ing stands. b. Second Reading of Ordinance No. 1037 Conveyance of Property Ordinance No. 1037 amends Ordinance No. 853, City Code of 1977, and conveys part of Lot 6, Block 62, Columbia Heights Annex to Minneapolis to the HRA in conjunction with the proposed development of the Dragon House Restaurant. The ordinance has also been amended to reflect the correct legal description of the area involved. The City Attorney advised that this amendment would not require another First Reading. Motion by Norberg, second by Hovland to waive the reading of the ordinance there being ample copies available to the public. Roll call: All ayes ORDINANCE NO. 1037 BEING A~; ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, CONVEYING PART OF LOT 6, BLOCK 62, COLUMBIA HEIGHTS ANNEX TO MINNEAPOLIS The City Council of the City of Columbia Heights does ordain: Section 1: The City of Columbia Heights shall quit claim and convey to the Housing and Redevelopment Authority of Columbia Heights, Minnesota, the following described property: The north 21 feet of Lot 6, Block 62, Columbia Heights Annex to Minneapolis, Anoka County, Minnesota, including that part of the vacated alleyway lying east of the Northerly extension of the west line of Lot 6 and south of the westerly extension Regular Council Meeting April 25, 1983 page 2 of the north line of said Lot 6, Block 62, Anoka County, Minnesota, excluding that part of the alley in said Block 62, lying north of the north line of Lot 6 and its westerly extension, said Block 62, reserving to Grantor an easement for walkway, utility and right o~ way purposes over, under and across the following described property: BEGINNING at a point located at the intersection of the northerly extension of the West line of Lot 6 and the westerly extension of the North line of Lot 6, thence south along said northerly exten- sion of the west line of Lot 6, a distance of eight feet (81), thence northeasterly to a point of the westerly extension of the north line of Lot 6 eight feet (8') east of the point of beginning, thence west eight feet (8') along the said westerly extension of the north line of Lot 6 to the point of beginning, all in Block 62, Columbia Heights Annex to Minneapolis, and BEGINNING at the northeast corner of Lot 6, thence south along the easterly line of said Lot 6, a distance of eight feet (8'), then northwest to a point on the north line of Lot 6 eight feet (8') west to the point of beginning, thence eight feet (8') east along the north line of said Lot 6 to the point of beginning, all in Block 62, Columbia Heights Annex to Minneapolis. Section 2: The Mayor and City Manager are herewith authorized to execute a Quit Claim Deed to effect the conveyance of the City's interest in said property. Section 3: This ordinance shall be in full force a~d effect from and after thirty (30) days after its passage. Nawrocki, Mayor Jo-Anne Student, Council Secretary C. First Reading of Ordinance No. 1039 Street Excavations The City Manager spoke to the amendments being recommended with Ordinance No. 1039. Most of the amendments dealt with changes in the dollar limits required for liability insur- ance and bonds. These language changes in the ordinance are being proposed so that it will be consistent with practice. Concern was expressed with costs of bonds that may be passed on to a resident. After considerable discussion there were still many unanswered questions regarding costs. Motion by Norberg, second by Hentges to table the reading of Ordinance No. 1039. Roll call: Hovland, Petkoff, Norberg, Hentges--aye Nawrocki--nay It was requested that the First Reading of Ordinance No. i039 be scheduled for the next regular Council meeting. Human Services Commission The Human Services Commission requested that the City Council authorize a recording secretary for the Commission meetings. Motion by Norberg, second by Petkoff to take the request of the Human Services Com- mission for a recording secretary under advisement. Roll call: All ayes b. Action Alert--League of Minnesota Cities The Council received an Action Alert from the League of Minnesota Cities regarding House File #748 which is an amendment to Public Employment Labor Relations Act. This item was for informational purposes only and no formal Council action was taken. It was noted that Mayor Nawrocki had written and spoken to Representative Simoneau and Senator Frank regarding this matter. c. United States Senate Bill #66 Regarding Cable Communications Mayor Nawrocki gave information being received from across the country to both the National League of Cities "compromise" and the Senate Bill #66. The Mayor has advised, in writing, Columbia Heights' opposition to both the NL8 ~:comDromise'' and Senate 3111 ~ to our congressional delegation as well as to the National League of Cities. 7. Old and New Business a. Old Business 1. Establishing Hourly Rate for Cable Commission Clerk-Typist The City Manager advised the Council that the clerk-typist position for the Cable Commis- sion would be on a contract-for-service basis and not a permanent clerical position with the City. The Mayor noted that even though the salary for this person would be coming from the franchise fees realized from cable television, other commissions would be making similar requests and there are no funds for this type of employee. Motion by Norberg, second by Petkoff that the City Manager be authorized to contract for secretarial services on a temporary basis for the minor support of the Cable Communications Commission, that is this person would only take minutes of the Commission meetings and prepare these minutes, in an amount not to exceed $5.52 an hour; costs to come out of franchise funds, not from General Fund. There continued to be concern expressed by the Council as where these secretarial services could be solicited and what hourly rate would be expected. Motion by Norberg, second by Hentges to table this matter until the next regular Council meeting. Roll call: All ayes 2. Expected Completion Date of the 1982 Audit Mayor Nawrocki requested the anticipated completion date of the 1982 City Audit. Bill Elrite, the Finance Director, advised the Council that this date should be available by the next regular Council meeting. 3. Problems Being Experienced with Cable Television Installations and Equipment Mayor Nawrocki had requested information regarding noisy transformers and an installation done in a non-owner occupied residence. The City Manager gave the Council all of the cur- rent information on the status of these complaints and was requested to put all of this information in written form. Presently the cable company is working with the manufacturer of the equipment to decrease the noise by using insulation and rerouting of some of the lines. ~'Regular Council Meeting April 25, 1983 page 4 4. Suburban Rate Authority Councilman Norberg is the City's representative to the Suburban Rate Authority. He gave the details of the last meeting of the Authority and how its decisions have favorably impacted on the member cities. b. New Business 1. Permission to Consume Non-Intoxicating Malt Liquor at Huset Park Motion by Hentges, second by Petkoff to grant permission to Honeywell, Inc. to possess and consume non-intoxicating malt liquor in conjunction with an employee picnic to be held June 7th (weather permitting) or June 8th from 3:00 pm to 8:00 pm. Roll call: A11 ayes 2. Attendance at International Institute of Municipal Clerks Motion by Petkoff, second by Hovland to authorize the attendance of Jo-Anne Student, Deputy Clerk, at the International Institute of Municipal Clerks to be held in Min- neapolis on May 22-26, 1983; and furthermore to reimburse expenses for registration, meals and mileage. Additional information on specific and applicable items of interest to the City will be forthcoming for discussion with the Mayor and Council. Roll call: All ayes 3. Establish Date for Work Session Monday, May 2nd was chosen as a date for a Council work session. The work session will commence at 7:30 pm with interviews of three applicants for the Science, Technology and Energy Commission. 4. Proposal to Purchase City-Owned Parcel at 1237 42½ Avenue N.E. Two proposals for purchase of this parcel have been received. The City Manager expressed concern with stub outs for this parcel in that they face Pierce Street. It was noted by the City Attorney that the property would have to be sold by ordinance but that the methods employed for selling have no legal requirements and any method deemed appropriate by the Council would be acceptable. Motion by Petkoff, second by Norberg to table this matter until the next regular Council meeting. Roll call: All ayes 5. Offer to Purchase Used Buses A letter has been received from the Fridley Bus Company expressing an interest in purchas- ing three buses presently owned by the City. Another bus company has also verbally ex- pressed an interest in the buses but is unable to look at them until later in the week. Discussion continued regarding an alternative use the City may have for one of these buses. Motion by Norberg, second by Hentges to acknowledge the bid of $100 received from the Fridley Bus Company for the purchase of three buses. Roll call: All ayes 7. Computers & You Conference, University of Wisconsin, Madison Councilman Norberg had received information regarding a comprehensive course being of- fered to interested parties on June 1st and 2nd at the University of Wisconsin, Madison. He was familiar with the material being offered in this course and the high level of instruction that has been presented in the past. Councilman Hentges suggested that mem- bers of the staff should be authorized to attend since they will ultimately be working with the computers. Councilman Norberg felt members of the Council should attend since they will be making the decisions regarding choices of computer equipment and programs. Regular Council Meeting April 25, 1983 page 6 Motion by Norberg, second by Hentges to authorize members of the City Council to attend the Computers & You Conference at the University of Wisconsin, Madison on June 1st and 2nd. Roll call: All ayes Registrations for the Conference will be coordinated through the Council Secretary. 8. Authorization to Purchase Traffic Counters Motion by Petkoff, second by Hovland to authorize the purchase of three traffic counters, Model RCT (Electronic Timer) units from the Minnesota Department of Transportation at the price of $250 each. Roll call: All ayes 8. Reports a. Report of the City Manager This report was presented in written form and most of the items were discussed. The item dealing with the semaphor to be placed at 52nd and Central Avenues was discussed in detail. When this installation was originally proposed it was with the understanding that the City would be responsible for its maintenance and operation. The City Engineer inquired if off-systems state aid funds would be available for the costs resulting from the operation and maintenance. Recently he received a memo from the Department of Transportation advising him that funding would have to come from the City. Mayor Nawrocki requested the City Engineer to advise MN/DOT that since the City's state aid funding is being cut back there are no funds with which to do the maintenance and operation work. b. Report of the City Attorney The City Attorney had nothing to report at this time. 9. Licenses Motion by Norberg, second by Hentges to grant the licenses as listed upon payment of proper fees.
