HomeMy WebLinkAboutJun 14, 1982 (2)OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS CITY COUNCIL SPECIAL ASSESSMENT HEARING JUNE 14, 1982 The hearing was called to order by Mayor Nawrocki at 7:30 pm. 1. Roll Call Hovland, Petkoff, Hentges, Nawrocki--present Norberg--absent 2. Purpose of Meeting Consideration of special assessment for local improvements made to qlst Avenue. 3. Presentation of Information Various documents were presented by staff illustrating the assessment proposed for the reconstruction and re)ocation of hist Avenue. Elements of the project include sanitary sewer, watermains, storm sewer, street construction, right turn lane for Central Avenue, park improvementsi and street lighting. Of the total project, the Housing and Redevelopment Authority is paying for all utility costs, sanitary, storm sewer, and watermain. The costs for the rest of the project is being paid by P.J. Gaughan and Columbia Heights Mall, as per development contract. The total cost for the project is $358,788.59. Some residents of the LaBelle Condominiums had concern with regard to the assessment. They had an agreement with the developer that thls assessment would be paid by him. Members of the Council could not address who would pay the assessment since this agreement did not involve the City. Roger Jensen, Director of the HRA, told the Council that Terry Evenson, the developer of the Columbia Heights Mall, anticipated a ten year payback period and hoped this would be the period of time adopted by the Council for the payback. Mayor Nawrocki had concern with the rate of interest being established at 8~ and wondered if this percent would be the same for borrowing money later on. The City Manager felt the law would allow an increase in the rate of interest charged although he had not en- countered a higher interest rate at this time. ~. Adoption of Resolution 82-28 'Motion by Hentges, second by Petkoff to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes Resolution No.82-28 Adopting assessment roll according to the City Charter for the following local im- provement and determining that said improvement has been made and ratifying and con- firming all other proceedings, heretofore had: Special Assessment numbered 767. WHEREAS, the City Council of the City of Columbia Heights, Minnesota, met at 7:30 o'clock p.m. on the 14th of June, 1982, in the City Council Chambers, 590 4Oth Avenue N.E., Columbia Heights, Minnesota, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to benefits, and to the proportion of the cost of making the local improvement above described, a notice of such hearing having been heretofore duly published as requir- ed by law, and a notice mailed to each property owner of record, stating the pro- posed amount of the assessment; and, WHEREAS, this Council has heretofore estimated and fixed the cost of such local improvement and has prepared an assessment roll therefore, THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVES: Section 1. That this Council does hereby adopt the aforesaid assessment roll known and described as "Assessment Roll for Local Improvement" numbered, 767. Section 2. That this Council hereby finds and determines that each of the lots and -Special Assessment Hearing June 14, 1982 page 2 and parcels of land enumerated in said assessment roll was and is especially benefitted by such improvement in an amount not less than the amount set op- posite in the column headed "Total Assessment". And this Council further finds and determines that the proper proportion of the cost of such improvement~ to be especially assessed against such lot or parcel of land is the amount Set opposite the description of each such lot or parcel of land respectively in said assessment ro11. Section 3. That said assessment may be paid in part or in full without interest on or before July 14, 1982, or in annual instal, lm~nt~ for a period of ten years as designated on the assessment roll, payable on or before the 15th day of September, annually, with 8% interest added thereon. Failure to pay the annual installment renders the same delinquent and thereafter a IO% penalty is added and the said delinquent special assessment is certified to the County for collection with.She real estate tax. Section 4. That this Council did hereby determine and redetermine to proceed with said improvement, does ratify and confirm all other proceedings heretofore had in regard to this improvment, and said improvement shall hereafter be known and numbered as Local Improvement numbered 767. Section 5. This resolution shall take effect Immediately upon its passage. Passed this 14th day of June, 1982.
