TY COUNCIL SPECIAL MEETING AUGUST 16, 1982 Mayor Nawrocki called the special meeting of the COlumbia Heights City Council to order at 9:30 pm. Roll Call: Hovland, Petkoff, Norberg, Hentges, Nawrocki--present Purpose of the Special Meeting: There were three items of business for this meeting: 1. City of Hilltop Participation in Repair Costs for Sanitary Sewer in Quincy Street Between 43rd and 44th Avenues 2. Establish Date for Public Hearing Regarding Application for ~tortgage Revenue Bond 3. Authorization for City to be Represented at the Annual Meeting of the American Public Works Association in Houston, Texas Mayor Nawrocki gave the background on the sanitary sewer replacement in Quincy Street, between 43rd and 44th Avenues. This sanitary sewer serves both the City of Hilltop and the City of Columbia Heights. The City of Columbia Heights has been receiving funds from the Metropolitan Waste Control Commission for maintenance of this sewer. When a need for replacement of this sewer pipe was established there was some question as to who was responsible for the costs of that replacement. The Hilltop City Attorney was of the opinion that the responsibility was that of the Metropolitan Waste Control Commission. Members of the City Council of Columbia Heights and staff felt some of the financial responsibility was that of the City of Hilltop. The contract between the City of Columbia Heights and the MWCC expires at the end of 1982. Mayor Nawrocki has met with many members of the MWCC and attended some of the Hilltop City Council meet- ings in an effort to get this problem resolved. It was noted that the City of Hilltop is in an unique situation in that it is the only community that does not have an inter- ceptor on its borders. Results from the I & I Study showed that 62% of the sewage flow in this particular pipe is from Hilltop. The Mayor felt the costs for Hilltop residents should be handled in the same manner as costs are handled for residents of Columbia Heights. Councilman Norberg noted that no place in the agreement presently in force does it mention that Hilltop does not pay any of the costs. The Hilltop City Attorney again stated that he feels this replacement is in reality part of the pipe's mainten- ance and that the City of Hilltop is not responsible for any of the costs. The Council took the position that they will not renew the contract with the Metro- politan Waste Control Commission for the year 1983 for this portion of its sanitary sewer system if some action is not taken for cost-sharing. The Council reviewed for the City Attorney from Hilltop the options open for the Hilltop Council for refuse removal. The Columbia Heights City Attorney had been requested to draft a resolution that would address the Columbia Heights City Council's intention to terminate service for 1983 when the application is received from the Metropolitan Waste Control Commission. A copy of this resolution will be sent to the Hilltop City Council when it is approved so there will be ample time to .make arrangements to supply removal of refuse service. The draft resolution, as prepared by the Columbia Heights City Attorney,was reviewed by the Council. Much discussion followed and some minor changes were made to the draft. Motion by Hentges to read the resolution. Motion dies fgr lack of a second. Motion by Norberg, second by Petkoff to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes Special Council Meeting August 16, 1982 page 2 RESOLUTION NO. 82-46 WHEREAS, the City of Columbia Heights, Minnesota is the owner of sanitary sewer interceptors running from the connection with City of Hilltop, Minnesota sanitary sewer pipes at (1) 45th Avenue Northeast at Jackson Street Northeast and (2) at Quincy Street Northeast to intersection with Fridley, Minnesota Interceptor No. 4-FR-440 at 2nd Street and 45th Avenue Northeast; and, WHEREAS, the City of Columbia Heights, Minnesota is the owner of sanitary sewer interceptors running from the connections with City of Hilltop, Minnesota sani- tary sewer pipes at (1) 49th Avenue Northeast and Jackson, (2} 47th Avenue North- east and Monroe Street, {3} 48th Avenue Northeast and Monroe Street and (4} at 49th Avenue Northeast east of Monroe westerly to intersection with Columbia Heights Interceptor No. l-C0-443 at 2½ Street and 45th Avenue Northeast; and, WHEREAS, a substantial portion of the interceptor running along Quincy Street North- east in Columbia Heights had deteriorated and required replacement; and, WHEREAS, the proper officials of the City of Columbia Heights requested the proper officials of the City of Hilltop to contribute to the cost of such replacement in proportion to the amount of sewage contributed by Hilltop to the said interceptor at the point of replacement; and, WHEREAS, the City of Hilltop refused and continues to refuse to pay its equitable share of the cost of such replacement; and, WHEREAS, on occasion in the past the above mentioned interceptors have accepted sewage and surface water run off in excess of their capacity, thereby causing sewage to back up or become discharged into the basement of houses of Columbia Heights, Minnesota residents; and, WHEREAS, the City Council of the City of Columbia Heights, Minnesota deems it to be in the interest in the health, safety and welfare of the citizens of the City of Columbia Heights, Minnesota to terminate the use by the City of Hilltop of the said interceptors located in the City of Columbia Heights, Minnesota thereby lessening the amount of sewage and surface water runoff the said inter- ceptors are required to carry. NOW, THEREFORE, Be it resolved: The City Manager is directed to notify the City of Hilltop and the Metro- politan Waste Control Commission of the intention of the City of Columbia Heights not to renew its Joint Use Rental Agreement, Contract No. 145, with the Metropolitan Waste Control Commisslon for the rental by the Commission of sanitary sewer interceptors in the City of Columbia Heights during the year of 1983. Motion to amend by Nawrocki, second by Hentges to delete from the draft resolution the second sentence of the second BE IT RESOLVED. Nawrocki, Mayor Motion by Norberg, second by Nawrocki that the City Manager be directed to report on this item under Old Business at Council meetings until told to do otherwise or until such time as this matter is resolved. The City Manager gave information regarding establishing a date for a public hearing for the application for mortgage revenue bond. Motion by Hentges, second by Hovland to establish August 31, 1982 at 7:30 pm as the date for a public hearing regarding the application for mortgage revenue bond. Roll call: Hovland, Petkoff, Hentges, Nawrockl-aye Norberg--nay Mitch DeMars, Street Superintendent, received recognition from the Public Works As- sociation for lenthy service as a public servant. This award will be given in Sept- ember in Houston, Texas. Mitch was recommended for this award by someone in the As- sociation. It was noted that only eighteen people in the country receive this award annually. Motion by Nawrocki, second by Petkoff to authorize the attendance of Mitch DeMars to the Annual Meeting of the American Public Works Association in Houston, Texas and that expenses be paid. Some discussion followed regarding any incentives that may be received from an airline. Motion by Norberg to require that any or all of the incentives that result from booking passage on a certain airline become property of the City. Motion dies for lack of a second.
