Ro11 Call: Logacz, Heintz, Norberg, Hentges, Nawrocki-present 2. Invocation: The Invocation was offered by Pastor Carl Smith of Oak Hill Baptist Church. 3. Minutes of Previous Meetings Motion by Heintz, second by Hentges to approve the minutes of the December 29th Special Meeting of the City Council; and the December 31st Special Meeting of the City Council, as presented in writing and that the reading be dispensed with. Roll call: All ayes. 4. Oral Petitions There were no oral petitions. 5. Ordinances and Resolutions a. Resolution 81-07 being a resolution of the City Council of the City of Columbia Heigh~ presenting the opinion of the Planning and Zoning Commission on the review of Hennepin County's Comprehensive Plan A revised resolution was given to the Council that was based on their concerns as expres- sed at a previous meeting. Motion by Norberg, second by Heintz the reading of the resolution be dispensed with ther~ being ample copies available to the public. Roli call: All ayes The Mayor restated a concern the Council has had with the effect the Riverside plant of NSP would have on the quality of air in the City of Columbia Heights. Another concern of the Council was the impact the Cargill operation may have on air quality of the City. It was generally felt the resolution should address these concerns more specifically. The City Attorney suggested language changes in the resolutlon that ~ould speak to these concerns. Ultimately, the Council wishes this resolution to draw attention to concerns of the City about this comprehensive plan to the Metropolitan Council, the body which will eventually approve it. RESOLUTION 81-O7 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA PRESENTING THE OPINION OF THE PLANNING AND ZONING COMMISSION ON THE REVIEW OF HENNEPIN COUNTY'S COMPREHENSIVE PLAN WHEREAS, Hennepin County has prepared a draft Solid Waste and Transportation Plan pursuant to the Metropolitan Land Planning Act, and WHEREAS, Hennepin County, pursuant to Minnesota Statutes 473.858, Subdivision 2, has submitted draft copies of their Solid Waste and Transportation Element of their Comprehensive Plan to the City of Columbia Heights for review and comments, and WHEREAS, the Planning and Zoning Commission and City Council have reviewed the draft Solid Waste and Transportation Elements of Hennepin County's Comprehensive Plan in regards to its scope and effect upon the City of Columbia Heights, and WHEREAS, ~he City Council has expressed concerns about possible adverse effects on,he q~ality of life in Columbia Heights because of pollution problems with proposed refuse derived energy and fuel systems within Northeast Minneapolis, and Regular Council Meeting January 26, 1981 page 2 WHEREAS, the Plan has failed to provide for the abatement of certain known existing pollution sources adversely affecting the City of Columbia Heights, NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Columbia Heights expresses and forwards its comments to the Hennepin County Board of Comissioners that it opposes that portion of the Plan advocating a refuse derived fuel system at the NSP Riverside Plant because of a likely adverse effect on the quality df life of the citizens of Columbia Heights because of the probable polluting nature of such a system at that location. The City Council also opposes the Plan's failure to include provision for abating .air and sound pollution eminating from the Cargill Plant at 37th Avenue and 5th Street N.E. and from similar pollution sources in Northeast Minneapolis. Thatno other significant adverse effect of Hennepln County's implementing its Solid Waste and Transportation Plan is currently perceived. Passed this 26 day of January, 1981. Resolution 81-08 being a resolution of the City Council of the City of Columbia Heights authorizing the preparation and submission of an application for Anoka County Community Development Block Grant Fund for those activities as listed herein. Motion by Heintz, second by Hentges to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes The activities included in this application were discussed at a previous meeting. It includes eight activities to be reviewed by a steering committee for consideration for funding from the Anoka County Development Block Grant (CDBG). Councilman Norberg felt the item dealing with improvements to the new municipal parking lot should not be included for consideration. The Mayor suggested inclusion of a community center at one of the schools that will be closing this year may be a consideration for this list. Councilman Hentges also mentioned the construction of a new facility for community activities may be a consideration. Notion to amend by Norberg to strike from the resolution that activity dealing with the municipal parking lot. Motion dies for lack of a second. RESOLUTION 81 - 08 kHEREAS, Anoka County has been designated by the Department of Housing and Urban Development as an Urban County and thereby eligible o£ Urban County Community Development Block Grant funds, end ~.H£REAS, the county has established a program for distribution of these funds to the communities, and I~dEREAS, the distribution ~r~ces.~ tam, ires an application Regular Council Meeting January 26, 1981 page 3 ~EREAS, the City Council, at a public hearing held on December 2~, 1980 and continued on January 12, 1981, directed the NRA staff to prepare and submit a pre-application to involve the following activities: l) Purchase of four (4) non-conforming homes on Central Avenue. 2) Acquisition~Rehabilitation~Resale Program. 3) itandicapped Housing. a) Acquisition/Demolition of deteriorated building in Redevelopment Target Area. S) Rehabilitation of 5th Street. 6) Street-Soaping. 7) Improvements to new municipal parking lot 8) Expansion of Commercial Loan Program. NO~ THEREFORE BE IT RESOLVED, that 1) The City Council of Columbia Heights hereby authorizes the preparation and sub:mission of an application for Anoka County CDBG Funds. 2) That this application be for those activities listed herein. Resolution 81-09 being a resolution directing the Mayor and City Clerk to Proceed with Registration of Title to Certain Properties This resolution deals with registration of title to City-owned, tax forfeit property. Some of these properties were or may be conveyed by the City of Columbia Heights to landowners displaced by the Downtown Development project. Motion by Norberg, second by Heintz to waive the reading of the resolution there being ample copies available to the public. Roll call: AI! ayes Items nine and ten of the data attached to this resolution deal with the same parcel and should correctly be considered as one item. Resolution 80-79 being a resolution adopting changes in non-union salary ranges The Council received material dealing with the resolution that was previously adopted with 7i salary adjustment for supervisory employees and 9% for non-supervisory employ- ees; material with the percentages of 8% salary adjustment for supervisory employees and 9% for non-supervisory employees in the resolution; and thirdly, a resolution which does not reflect percentages in the body of the resolution but has an at- tached schedule of salary adjustments, The City Manager spoke to these three reso- lutions and presented the most recent survey results taken from surrounding com- munities' salary ranges for similar positions. Motion'by Logacz, second by Nawrocki to adopt resolution 80-79, as amended, to include 8% salary adjustment for supervisory employees and 9~ for non-supervisory employees, Substitute resolution offered by Norberg, second by Logacz to adopt that amended resolution that states no percentages for salary adjustments and the attached pay plan schedule may be decided on with another action, Mayor Nawrocki said the resolution speaks specifically to an attached schedule. Councilman Norberg withdrew his motion for a substitute resolution and again stated he feels the inclusion of percentages in the resolution is misleading. Motion by fleintz, second by Hentges to adopt a substitute resolution estab]ishlng salary increases of 7~ for supervisory employees and 9~ for non-supervisory employees. Motion to amend by Hentges to grant the following salary increases as determined by annual income; ll~ for salaries of $15,000 or under, 10,5~ for salaries of $15,001 to $20,000, 8,5~ for salaries of $20,001 to $25,000 and 6,5~ for salaries over $25,001. Motion to amend dies for lack of a second. Motion to amend by Norberg,second by Heintz to stike from the resolution all of the words in paragraph four after "January !, 1981". These words deal with the specific percentages of the Increases which Councilman Norberg chooses not to include in the resolution. His opinion is not to establish a precedent in printing ' Regular Council Meeting January 26, 1981 page 8 ranges in the resolution. Roll call on motion to amend: Logacz, Hentges, Norberg--aye Heintz, Nawrocki--nay Motion to amend passes. Motion to amend by Norberg, second by Nawrocki on the resolution as amended, to substitute the attached schedule pages one through five from Resolution 80-79 (as amended). Resolution 80-79, as amended, had no percentage salary range figures included. Motion by Logacz, second by Hentges to table this motion to amend the resolution. RESOLUTION -81-11 RESOLUTION OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA ADOPTING CHANGES IN NON-UNIOt~ GROUP SALARY RANGES, ESTABLISHING SALARIES FOR NON-UNIONIZED CITY POSITIONS AND CHANGING EMPLOYERtS LIFE KD HEALTH INSUIL~NCE PREMIUM COST ~IEREAS, the City of Columbia Heights has adopted a Wage Compensation Program for non-unionized City employees effective January 1, 1980, and, WHEREAS, the Wage Compensation Program Indicated that on an annual basis changes will be adopted in Group Salary Ranges based upon reliable survey data; and, WHEREAS, the City of Columbia Heights annually reviews the employer's share of life and health Insurance monthly premiums for its non-unionized employees to compare what Is pald for other employee groups In the City, and, NOW, THEREFORE, BE IT RESOLVED, that the City of Columbla Heights establishes salary ranges for groups of non-unionized City posltlons as Indicated on the attached schedule, which is on file in the office of the City Hanager, effective January !, 1981, Increasing salary ranges by 9.0~ to be applled to the market mean for non-supervisory employees and 7.0~ to be applied to the market mean for supervisory employees, and, BE IT FURTHER RESOLVED, that the City of Columbia Heights establishes the salary for each specific non-unionized City employee position to be effective as per the attached schedule upon such affected City employee fulfilling the require- meats specified in the Wage Compensation Program for a salary change, for such employee, and, BE IT FURTHER RESOLVED, that the City of Columbia Heights establishes the employer's share of life and health Insurance premium for 1981 at $95.00 per month. Roll call: All ayes RESOLUTI Otl 81-10 RESOLUTION OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA, GRANTING AUTHORIZATION TO ENTER INTO AN AGREEHENT WITH THE STATE OF MINNESOTA, DEPARTMENT OF TRANSPORTA- TION FOR PARA TRANSIT ASSISTANCE SERVICE FUNDS WHEREAS, the City of Columbia Heights has been operating a para transit program called Shared Ride since December !, 1978, with para transit assistance from the Minnesota Department of Transportation; and, WHEREAS, the Shared Ride program has demonstrated to be serving a growing number of the population in the last year and shows a continuing need for this service; and, NOW, THEREFORE, BE IT RESOLVED, that the City of Columbia Heights enter into an agreement with the State of Minnesota, Department of Transportation, to provide a Para Transit Assistance Service in the City of Columbia Heights and certain points outside of the city limits; and, BE IT FURTHER RESOLVED, that the City of Columbia Heights agrees to provide 33 1/3 percent of the total deficit of the transit project from local funds not to exceed $8,666 from the General Fund; and, BE IT FURTHER RESOLVED, that authorization to execute the aforementioned agreement is hereby given to the Mayor and City Manager; and, BE IT FURTHER RESOLVED, that the City Manager or the Administrative Assistant to the City Manager is hereby authorized to execute requests for reimbursements from the Minnesota Department of Transportation. Report Regarding Rental Units at 511 ~Oth Avenue This item is regarding rental units located behind the barber shop at 511 ~Oth avenue, o~ned by Mary Simonson. Mr. Simonson has been advised these units mus~ be brought up to code to comply with the City's fire and building codes. He attended this meeting to be advised of what was necessary for these units to be in compliance. Staff gave him the specifics as to what is necessary before these units may be occupied. League of Minnesota Cities Applications for subscriptions to the 1981 Local Government Legislative Bulletin and the Directory of Minnesota Municipal Officials were given to the Council. c. Energy Awareness, Science and Technology Commission The members of this Commission made a request, by letter, for a name change of the Commission. Councilman Norberg spoke to this item. He felt the two words, "Energy Awareness" at the beginning of the Commission name detracted from the last part of the name, thereby not being completely accurate. He felt the energy activity of the Commission was overemphasized and the other functions of the Commission, science and technology, were overlooked. Motion by Norberg, second by Heintz to direct the City Attorney to draw up an ordinance Regular Council Meeting January 26, 1981 page 16 amendment so the new name of the Commission will be Science, Technology and Energy Commission. Authorization to Purchase Two Remington Rand Typewriters for the Recreation and Community Services Department Motion by Logacz, second by Norberg to authorize the purchase of two Remington Rand 15½ "dual pitch single element correcting typewriters, in the amount of $820 each, less trade-in, from Office Products of Minnesota,Inc., based on low, informal quotation. Columbia Court-Proposed Design of Traffic Island Motion by Norberg, second by Hentges to approve plans for a traffic island construc- tion at Columbia Court as per drawings submitted by Public Works Director dated 12/26/80, amended 12/19/80; and furthermore that the City Manager be authorized to advertise for a public hearing for road improvements on the other access of Columbia Court and all developments on Central Avenue. Roll call: AI1 ayes 3. Huset Park Tennis Courts-Transfer of Funds This project was initiated in 1978 and completed in late 1979. In that time period there was a change of personnel and some of the outstanding bills from this project did not get processed as expediently as they should have. Also, there were some field changes approved prior to seeking additional funding. Staff was questioned' about who authorized the field changes and was advised that some of them were authorized verbally by the Park Board to the staff. Since these actions resulted in an overrun of the budget for this project it was felt that the Park Board should have been advised of this situation.Also, there was some question if the Park Board has the authority to issue change orders. There was considerable discussion concerning what parts of this project were paid for and from what source, as well as, author- izations. Motion by Hentges to table this matter for further information concerning author- izations and source of funding from the former Park Superintendent. Motion dies for lack of a second. Motion by Heintz, second by Logacz to transfer $1,208.91 to Huset Park Tennis Court Fund (309) from Capital Improvement Fund (308). Councilman Heintz also requested a detailed report from the City Manager regarding the background information on these expenditures to be presented at the next regular Council meeting. AuthOrization to Proceed with Engineering and Design of 41st Avenue As part of an agreement with one of the developers of the Downtown Development project, the City has agreed to relocate and construct qlst avenue with appropriate utilities. The costs of this project will be assessed to the benefitting properties. Councilman Norberg'was of the opinion, since the City has only one of the two developers' signed agreement at this point, the costs for the remaining developer, whoever it may be, has the potential for being absorbed and not paid by that developer. He felt this would be inequitable if it were to happen. Update Information on Stinson Boulevard At the request of Councilman Norberg, the City Hanager gave the current status of v~at has been done by New Brighton in regard to alleviating the problem of speeding and other traffic problems on Stinson Boulevard. Establish Salary for New Hire Motion by Heintz, second by Logacz to establish the salary of Gregory 01son, retail clerk, at the rate of $881 per month, effective danuary 15, 1981. Authorization to Purchase Consulting Services under the Terms of the League of Minnesota Cities Labor Relations Subscriber Service Councilman Hentges said since the City is assessed on its populatlo~the fee for this service should be questioned since the populatlon of Columbia Heights has dropped as indicated in the preliminary census figures. Iqotion by Norberg, second by Heintz to authorize the purchase of consulting services under the terms of the League of Minnesota Cities Labor Relations Subscriber Service. Roll call: All ayes 6. Rettke-Wolff Property Line Problem at 564 38th Avenue The Rettkes sold property at 56q 38th avenue to the Wolffs. The Rettkes had been in- fringing on eight feet of City property and apparently Included this eight feet in the sale to the ~olffs. The City attempted to settle the matter by offering to sell this eight feet to Mr. ~olff. He chose not to discuss the matter. The City Attorney advised the Council, to avoid adverse possession rights from accruing to Mr. ~olff, a fence should be built around the property in question. Some discussion followed as to what type of fencin~ would prove adequate to establish that this is City- o~ned property and to how much this fencing would cost. The City Manager told the Council he would return to the next regular meeting with estimates for costs for fenc- ing. Regular Council Meeting January 26, 1981 page 18 Motion by Norberg, second by Heintz to authorize the City Manager, if necessary, to build a fence on this property to preserve two fifty-foot lots and negotiate a settlement. Councilman kentges felt the motion should include a dollar amount for the maximum that could be authorized for purchase of fencing materials. Roll call: Logacz, Heintz, Norberg, Nawrocki--aye Hentges--nay 8 Reports a. Report of the City Manager The City Manager's report was presented in writing. The City Manager spoke to some of the items in the report. Considerable discussion was generated by one item, that being the information requested from the City Clerk by the Charter Commission. Coun- cilman Hentges, the Council representative on the Charter Commission, and the City Attorney advised the Council of exactly what had been requested of the City Clerk. The Mayor suggested the Council hold a work session to deal with the items the Charter Commission is considering. He also requested that appointments to the Joint Powers Commission for Cable TV be considered as an item of business at the next regular meeting, as well as, a policy statement as to what is expected from this Commission. b. Report of the City Attorney None Licenses Motion by Norberg, second by Heintz that license applications, as listed, be issued upon payment of proper fees. Roll call: All ayes 10. Payment of Bills Motion by Heintz, second by Logacz to pay the bills, as listed, out of proper funds. Motion by Norberg, second by Hentges to extract bill #38691 from the list of bills so informal bids may be gotten or it is determined that there is no better vendor for this service. This item is for annual maintenance of office equipment, specifically, the billing machines in the assessing and accounting departments. The City Clerk gave an explanation as to why this service is gotten only from one firm. Roll call on motion to extract: Logacz, Heintz, Nawrocki--nay Norberg, Hentges--aye Motion fails.
