Columbia Heights City Council
March 16, 1981
The public hearing was called to order by Mayor Nawrocki at 7:35 pm.
1. Roll Call

2. ~.urpose of the Hearing
Special assessments regarding several projects dealing with storm drainage, curb
and gutter, and alley and roadway improvements
3. Presentation of Assessment Projects
a. Seal Coating
The City Manager explained, with the use of maps and graphs, the boundaries of this
seal coat project. Those boundaries are; 45th Avenue on the north; University Avenue
and California Street on the west; 37th Avenue on the south and Central Avenue on
the east. Also included in this project is Monroe Street from 45th Avenue to 46th
Avenue, Monroe Street from 46½ Avenue to 49th Avenue and 45th Avenue from Monroe
Street to Central Avenue.
A film dealing with seal coat procedures was shown.
The City Manager gave a complete breakdown of the costs that are involved with this
project. The City Assessor gave an explanation of the procedures used to compute
individual assessments.
The hearing was opened for questions and answers from the audience. The City Manager
said that the basic idea is to seal coat the streets in the City every six years.
Peter Pawluk, 4039 Main Street, questioned what was to be done on 41st Avenue, which
is only a block long. He was told it was scheduled for seal coating as it has not
been done for a number of years. Peter Kotzer, 4201 2nd Street, was concerned with
a water problem in front of his house and wanted this corrected before any seal
coating was done on 2nd Street. He was advised by the City Attorney this drainage
problem was one of long standing and since it is presently in litigation it would be
ill-advised to continue discussing it.
Motion by Hentges, second by Heintz to authorize the City Manager to proceed with
the seal coat project on the streets as indicated in the presentation.
Motion to amend by Hentges, second by Norberg to delete from the project 38th Avenue
from 5th Street to Madison Place (two blocks).
Roll call on motion to delete: Logacz, Heintz, Norberg, Nawrocki--nay Hentges--aye
Motion fails.
Councilman Hentges asked if 5th Street from 40th Avenue to 42nd Avenue was included
in the seal coating project and was told it was scheduled for this year. The City
Manager referred to a polling of residents in this area pertaining to their opinions
on the project. At this time only 8% had responded. The City Manager advised the
Council that if enough residents request a public hearing it will be scheduled.
The City Manager passed out copies of a letter received from Joseph Matlon, 4016
Washington Street, regarding a problem he was experiencing when driving his car
from his property onto the street.
b. Storm Drainage Improvements of Reservoir Boulevard
The installation and improvement of a storm drainage system to handle the storm
water runoff from the following drainage area: All or part of Blocks 2,3,4,8,9,
lO,11,12,13,14,15,21,and 22 of Auditors Subdivision of Waltons 2nd Subdivision,

or that area bounded by Reservoir Boulevard, 43 Avenue N.E., Polk Street N.E.,
41st Avenue N.E. and all or part of those parcels lying east of Reservoir Bou-
levard and designated by the following addresses: 4455,4449,4441,4433,4423,4419,
4401,4331,4321,4311,4303,4065,4055,4029,4015,4009,4OO7,4005 Reservoir Boulevard;
1801,1819,1827, 44th Avenue; 1508 and 1600 41st Avenue.
The City Manager explained these improvements and gave cost breakdown and assess-
ments. This project and its costs has been presented to the Minneapolis City Council
in that it is felt the City of Minneapolis is a contributor to the drainage prob-
lem. At this point in time Minneapolis chose not to be included in the assessment,
which by statute they can do. The City Manager advised that this matter shall again
be presented to the Minneapolis City Council in that he felt the first presentation
could have been improved upon.
Many residents who would be assessed for this project came to the hearing to give
their views. Some of the residents recalled experiences they had with water coming
into their basements and with ponding on their property. A few felt this project
would benefit them, but most did not. There were many people who thought that other
residents should have been included in this assessment as they contribute some of
the water that could cause problems. Although many of the residents present had
experienced considerable flooding in their basements in the heavy rains of 1978,
and a few have had some wet basements since, opinions were expressed that these
experiences were not sufficient to support this project. The Mayor recalled the
numerous phone calls he had received from people in this area in 1978 and years
previous regarding water in their basements. He knew, even though the last two years
have been relatively dry, problems of ponding still continue after a rain and the
opportunity for basement flooding will still remain i( something isn't done.
Motion by Logacz to proceed with the project on basis of need and to increase the
City's portion of the costs to 50% (the recommendation of the City Manager was for
40%}. Motion dies for lack of a second.
Motion by Hentges to proceed with this project on basis of need and that the City's
share be 40%. He also suggested that other contributing properties and the area on
the west side of Reservoir Boulevard be considered for assessments. Motion dies for
lack of a second. Councilman Heintz questioned the need for this project and was
concerned with the precedent being set in that the City's share is much higher than
on previous assessments.
Motion by Norberg, second by Hentges to deny this project at this time and to call
another hearing at a time suggested by the City Manager and to assemble another
project with the Assessor and Engineering department taking into consideration what
has been said at this hearing.

The Mayor felt this project should proceed as it appears to be needed, it won't
get any less expensive, and without it nothing will be done to solve the problems.
Motion by Heintz, second by Logacz to proceed with the project with a minimum assess-
ment of 5¢ a square foot and that credit be given for projects in this area prev-
iously assessed and to be funded from the General Unallocated Fund, also with the
decreased costs benefitting only the taxpaying properties.

BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights.
WHEREAS, the City Council of the City of Columbia Heights by motion on
the 8th day of December, 1980 ordered notice of hearing to be given to
property owners, and

WHEREAS, pursuant to a notice of hearing certain residents appeared at
a Counci.1 meeting on the 16th day of March, 1981, and
WHEREAS, the Council determines to proceed with this local Improvement,
a portion of the cost being defrayed by speclal assessments under Charter
provisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is as follows:

parcels lying east of Reservoir Boulevard and designated by
the following addresses: 4455, 4449, 4441, 4433, 4423, 4419,
4401, 4331, 4321, 4311, 4303, 4065, 4055, 4029, 4015, 4009, 4007,
4005 Reservoir Boulevard; 1801, 1819, 1827 44th Avenue N.E.;
1508 and 1600 41st Avenue N.E.
2. That the materials to be used are as follows:
Reinforced concrete pipe
P.V.C. storm pipe including appurtences
Asphaltlc material for repair of streets
Concrete curb & gutter or driveway replacement
Sod
3. That a careful estimate of the cost of the improvements has been made
by the City Manager and the several lots and parcels of land fronting
upon and adjacent to such proposed improvements, which be deemed bene-
fited thereby, were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of the
several parcels so improved as nearly as can be ascertained.
5. These improvements shall also be known as project No. 764.
6. Project be completed in 1981.

Motion by Norberg to deny this project. Motion dies for lack of a second.
Councilman Hentges feels strongly that the City should not pay 80% of this project.
Councilman Norberg still wondered if this project is really needed based on what
has been said by residents at this hearing.

Motion by Hentges to call a five minute recess. Motion dies for lack of a second.
Motion by Heintz, second by Logacz to proceed with this project with a maximum
assessment of 5¢ per square foot with credit being given for assessments previous-
ly paid and to apply only to taxpaying properties.
Councilman Norberg left the hearing at this time.

c. Alley off of 41st Avenue between Circle Terrace and Reservoir Boulevard
This project involves paving and drainage of the public alley lying westerly of
Reservoir Boulevard and easterly of Circle Terrace between 40th Avenue and 41st
Avenue.
The Mayor was given a petition signed by property owners assessed for this pro-
ject stating their opposition to it.
The City Manager, with the use of maps and graphs, explained the specifics of the
project and detailed which property owners were being assessed for this project.
Considerable discussion followed concerning the need for this project and whether
it would provide a lasting solution to the problems that presently exist with
soil erosion and water. Most of the residents in attendance felt this alley
project would be of no direct benefit to them.
Motion by Heintz, second by Hentges to deny this project. Roll call: All ayes
d. Traffic Channelization
Traffic channelization, including structures and signing to control one-way traf-
fic, north bound on a proposed service road located adjacent to and east of the
east right-of-way line of Central Avenue and extending from 50th Avenue north
approximately 200 feet. Only one resident affected by this project attended this
hearing, that person being the lessee of the Dunkin' Donuts property. An alternative
proposal was given by the City Manager and it was agreed the first proposal was
preferred. Bob Moore, from Dunkin' Donuts, felt this service road was not needed
in that there is virtually no traffic in this area at the present time. The Mayor
explained that this project has been planned for when future development took
place in this area.
4. Consideration of Resolutions Authorizing Projects
Motion by Hentges, second by Heintz to waive the reading of the resolutions there
being ample copies available to the public. Roll call: All ayes

bounded by 45th Avenue on the north; University
Avenue N.E. and California Street on the west;
37th Avenue N.E. on the south; and Central Avenue
N.E. on the east. Also, Monroe Street N.E. from
hSth Avenue N.E. to 46th Avenue N.E., Monroe Street
N.E. fr~m 46½ Avenue N.E. to hgth Avenue N.E. and
~th Avenue N.E. from Monroe Street N.E. to
Central Avenue N.E.
That the materials to be used are as follow:
Seal coat oil, asphalt, aggregate and posslbly
concrete for curb repair.
That a careful estimate of the cost of the improvements
has been made by the City Manager and the several lots
and parcels of land fronting upon and adjacent to such
proposed improvements, which be deemed benefited thereby,
were properly notified of said hearings, and
That the City Manager shall also list the names and owners
of the several parcels so improved as nearly as can be
ascertained.

WHEREAS, the Council determines to proceed with this local Improvement,
a portion of the cost being defrayed by special assessments under Charter
provisions.

5. A work session was scheduled for Tuesday, March 24th at 7:30 pm to discuss
the community center project.
6. State League of Municipalities Building
The Mayor informed the Council members that the City's assessment for the State
League of Minicipalities Building Project was based upon a projection of the
costs. He also advised them that the project has not as yet been let out for bids.
