Columbia Heights City Council
March 30, 1981
The hearing was called to order by Mayor Nawrocki at 7:33 pm.
1. Roll Call
Logacz, Heintz, Norberg, Hentges, Nawrocki--present
The Mayor spoke to the assassination attempt on this day and requested that everyone
present'at this hearing observe a minute of silent prayer for the recovery and return
to good health for the four men who were shot.
2. Purpose of the Meetin~
Special assessment of repair and seal coating of bituminous street surfacing on
those streets contained in the area bounded by 45th Avenue on the north; Main
Street on the west; 40th Avenue on the south; and University Avenue on the east.
At this hearing residents who will be affected by this project were able to appear
and make any comments or ask questions they may have regarding the seal coating.
A petition signed by residents in this area was presented to the Council stating
their opposition to this project; this opposition specifically spoke to the flo-
oding problem on the northeast side of 42nd Avenue and 2nd Street and the ponding
on 41st Avenue.
Motion by Heintz, second by Norberg that the petition be recorded as being accepted.
Roll call: All ayes
Peter Kotzer, 4201 2nd Street, inquired about the type and quality of aggregate that
will be used. The Public Works Director explained the various types of aggregate
and cited reasons why certain types are used in the areas that they are.
John Moneta questioned if 3rd Street, between 4Oth and 41st Avenue~was going to be
seal coated and was advised it was not. He was also concerned about re~air of a curb
on 3rd Street and 42nd Avenue and was told that this repair is to be undertaken
with other miscellaneous concrete projects.The resident at 4024 2nd Street asked
for some clarification as to what was being planned for 2nd Street from 40th to
45th Avenue. Staff and the Mayor spoke to the specifics for this area.
3. Presentation of Assessment Project
The Mayor noted that the details of the project were presented at the original
hearing on March 16, 1981 and the costs remain the same; $1.14 per front foot,
and $0.38 avenue foot.
4. Consideration of the Resolution 81-1~
Motion by Heintz, second by Norberg to waive the reading of the resolution there
being ample copies available to the public. Roll call: All ayes

BEING A RESOLUTION ORDERING IMPROVEMENTS
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights.
WHEREAS, the City Council of the City of Columbia Heights
by Motion on the 8th day of December, 1980 ordered notice
of a hearing to be given to the property owners, and
WHEREAS, pursuant to a notice of hearing certain residents
appeared at a Council Meeting on the 30th of March, 1981
and
WHEREAS, the Council determines to proceed with this local
improvement, a portion of the cost being defrayed by
special assessment under Charter provisions.

NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is
as follows:
REPAIR AND SEAL COATING of the folIowing streets and
avenues:
The repair and seal coating of bituminous
street surfacing on those streets contained
in the area bounded by 45th Avenue on the north;
Main Street N.E. on the west; 40th Avenue N.E.
on the south; and University Avenue N.E. on the
east.
That the materials to be used are as follow:
Seal coat oil, asphalt, aggregate and possibly
concrete for curb repair.
That a careful estimate of the cost of the improvements
has been made by the City Manager and the several lots
and parcels of land fronting upon and adjacent to such
proposed improvements, which be deemed benefited thereby,
were properly notified of said hearings, and
That the City Manager shall also list the names and owners
of the several parcels so improved as nearly as can be
ascertained.
5. These improvements shall also be known as Project No. 762.
Passes this 30th day of March , 1981.

Motion by Heintz, second by Hentges to adjourn the hearing. Roll call: All ayes
Adjourned at 7:55 pm
The hearing was re-opened at 8:10 pm by the Mayor.
There was a discrepancy in the time that the public hearing was to start and two
residents arrived after it had been adjourned~requesting it be re-opened.
Robert Smieja, 4305 2nd Street~told the Council he has had considerable water problems

on his property. He gave many examples of what damage his property has had and wanted
to know if this project will help alleviate this situation. He feels this seal coating
should not be done until drainage problems in this area are solved. He was advised
by staff and Council these are two situations different in nature and solution. It is
felt by the staff that delaying the seal coating project would not be justified. Mr.
Smieja differed with this opinion and asked the City Attorney what methods could be
employed to halt this project. The Mayor also requested that the City Manager or the
Public Works Director contact Mr. Smieja to review with him the petition process he
could use regarding a public hearing being called for a storm sewer project.

We :...~e home owners oppose the seal coating on 2nd St
from 40th Ave. through 42nd Ave. until proper steps are
taken to correct the large puddle that forms on the west
side of 41st Ave. and the over flowing problem on the North
East side of 42nd & 2nd St. N.E. threating the flooding of
the basement at 4201 2nd St. N.E.
