Columbia Heights City Council

The meeting was called to order by Mayor Nawrocki at 8:06 pm.

Motion by Heintz, second by Hentges to appoint Keith Masuda, secretary pro-tem.

2. Invocation
The Invocation was offered by Councilman Norberg.
3. Minutes of Previous ~eetin~s
Motion by Heintz, second by Hentges to approve the minutes of the Regular Council Meeting
of April 13th; the Board of Review Meeting of May 4th; and the Special Council of May
4th; as presented in writing, with corrections, and that the reading be dispensed with.
Roll call: All ayes
The Council Secretary joined the meeting at 8:15 pm.
4. Oral Petitions
There were no oral petitions.
Plaque Presentations
Mayor Nawrocki presented plaques to three retiring firefighters, Robert Jones, a paid
member of the Department, Ralph Volkman and Roy Meinhardt, volunteer firefighters.
All three of these men served twenty years with the Department. The Mayor thanked these
men for their years of dedicated service to the City and feels it is dedicated service
such as theirs that gives the City's Fire Department the superior reputation that it
has.
5. Resolutions and Ordinances
a. Second Reading of Ordinance No. 943~being an ordinance amending Ordinance No.853,
City Code of 1977, pertaining to the authority and duties of the Traffic Commission.
Ordinance No.943 would have established the Traffic Commission as a review board to
hear requests for variances dealing with traffic visibility problems. The members of
the Traffic Commission met with the City Attorney and after lengthy discussion decided
to recommend that the Council not adopt this ordinance. This ordinance had its first
reading on February 9th, but no Council action was taken at this time.
b. Second Reading of Ordinance No.947 being an ordinance amending Ordinance No.853,
City Code of 1977, pertaining to traffic visibility
Motion by Logacz, second by Hentges to amend the ordinance as proposed by the City
Attorney and revise Section 9.104(7) as follows in the body of Ordinance No.947;
first paragraph, first line add the words, "within the required front yard" and in
the second paragraph, second line add the words, "required front, side and rear yard"

Motion by Hentges, second by Heintz to waive the reading of the resolution there being

ORDINANCE NO. 947
BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977,
PERTAINING TO TRAFFIC VISIBILITY
The City Council of the City of Columbia Heights does ordain:
Section 1: Section 9.104(7) of Ordinance No. 853, City Code of 1977, passed
June 21, 1977 which reads as follows, to wit:

"9.104(7) Traffic Visibility
On the corner lots within the required front yard, no planting or construc-
t-ion in excess of 30 inches above the abutting curb line shall be permitted
within a triangular area as defined as follows: beginning at the intersec-
tion of the projected curb line of two intersecting streets, thence 30 feet
along one curb line, thence diagonally to a point 30 feet from the point of
beginning on the curb line thence to point of beginning."
is hereby revised and amended to read as follows, to-wit:
9.104(7) Traffic Visibility - Street Intersections
On the corner lots within the required front yard, no planting or construc-
tion in excess of 30 inches above the abutting curb line shall be permit-
ted within a triangular area as defined as follows: beginning at the inter-
section of the projected curb line of two intersecting streets, thence 30
feet along one curb line, thence diagonally to a point 30 feet from the
point of beginning on the curb line, thence to point of beginning.
Traffic Visibility Street and Alley Intersections
At all entrances from public alleys onto public streets and within the
required front and side dr rear yard, no planting or construction in excess
of 30 inches above the abutting curb line shall be permitted within an
area on either side of the entering alley and defined as follows: beginning
at the point of intersection of the projection of the alley right-of-way
and the back of the street curb; thence along said point on said alley
right-of-way line and 15 feet from said back of curb; thence 15 feet to
point of beginning.
Section 2: This Ordinance shall be full force and effect from and after thirty (30)
days after its passage.

ORDINANCE NO, 949
BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977,
VACATING THE EXISTING 41ST AVENUE NORTHEAST AND CONVEYING A POR-
TION THEREOF TO THE HOUSING AND REDEVELOPMENT AUTHORITY OF COLUMBIA
HEIGKfS, MINNESOTA
The City Council of the City of Columbia Heights does ordain:
Section 1:
That part of 41st Avenue Northeast, lying easterly of the southerly
extension of the west line of the East 11.00 feet of Lot 31, Block4,
Reservoir Hills, Anoka County, Minnesota, and westerly of the south-
erly extension of the west line of Lot 39~ Block 4, Reservoir Hills,
Anoka County, Minnesota, together with those portions of the five
foot (5') strips adjacent to said &lst Avenue, lying between the
above described extensions and acquired by the City of Columbia
Heights for road purposes, all of which is hereby vacated.
Section 2:
The City of Columbia Heights shall convey by Quit Claim Deed to the
Housing and Redevelopment Authority of Columbia Heights, Minnesota, the
following described real property, to-wit:
That part of the North half of the vacated 41st Avenue Northeast as
platted in Reservoir Hills, Anoka County, Minnesota, lying between the
southerly extension of the east line of Lot 36 and the northerly exten-
sion of the east line of the west 170 feet of Lot 10, Block 5, Reservoir
Hills, Anoka County, Minnesota.
Section 3: The Mayor and City Manager are herewith authorized to execute any documents
necessary to carry out the intent of this ordinance.
Section 4: This ordinance shall be in full force and effect from and after thirty
(30) days after its passage.

d. Second Reading of Ordinance No.950 being an ordinance amending Ordinance No.853,
City Code of 1977, selling certain property to the Housing and Redevelopment Auth-
ority of Columbia Heights.
Motion by Heintz, second by Logacz to waive the reading of the ordinance there being
ample copies available to the public. Roll call: All ayes
The property in the ordinance are two parcels,one is located on Fifth Street and thc-
other is on Seventh Street. The HRA intends to place two homes on these parcels th,~t
are being moved from the Downtown Development Area. The proceeds of the sale will go
to pay off the debt on the bonds when the homes are sold. Councilman Norberg felt it

was not advisable for the HRA to hold the mortgage on the properties when they are sold
as the administrative costs would be high and unjustified. He proposed that the financi
be done through a lending agency and the HRA provide a grant to a qualified low-income
buyer.
ORDINANCE NO. 950
BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY
CODE OF 1977, SELLING CERTAIN REAL PROPERTY TO THE
HOUSING AND REDEVELOPMENT AUTHORI~f OF COLUMBIA HEIGHTS,
MINNESOTA
The City Council of the City of Columbia Heights does ordain:
Section 1:
The City of Columbia Heights shall sell and convey to the Housing and
Redevelopment Authority of Columbia Heights, Minnesota, the following
described parcels of land, to-wit:
Lot 23, Block 30, Columbia Heights Annex to Minneapolis,
according to the map or plat thereof on file and of record
in the office of the County Recorder in and for Anoka
County, Minnesota
Lot 6, Block 27, Columbia Heights Annex to MInneapolis,
according to the map or plat thereof on file and of record
in the office of the County Recorder in and for Anoka
County, Minnesota
Section 2:
The Mayor and City Manager are herewith authorized to execute Quit Claim
Deeds to effect the conveyance of the City's interest in the said pro-
perties.
Section 3: The purchase price shall be $23,295
Section 4: This ordinance shall be in full force and effect from and after thirty
(30) days after its passage.

AUTHORITY OF COLUMBIA HEIGHTS, MINNESOTA
The City Council of the City of Columbia Heights does ordain:
Section 1:
The City of Columbia Heights shall sell and convey to the Housing and
Redevelopment Authority of Columbia Heights, Minnesota the following
described real property, to-wit:
The North 135.00 feet of Lot 12, Block 5, "Reservoir
Hills", Columbia Heights, Anoka County, Minnesota
Section 2: The sale price shall be One Dollar ($1.00).
Section 3: The Mayor and City Manager shall be and herein are authorized to execute
and deliver a Quit Claim Deed for said real property'.

6. Communications
a. Planning and Zoning Commission
1. 546 Investments, 556 40th Avenue, Subdivision Approval
Bob Bocwinski, City Manage~ explained the request for the subdivision. This subdivision
will provide for four additional parking spaces. The City Planner, with the use of maps,
reviewed with the Council the specifics of the properties involved. Councilman Hentges
had reservations about the subdivision in two areas; whether there would be enough
parking provided if the staff were increased in the Ashford Clinic, and whether this
subdivision will meet all code requirements. Councilman Norberg observed that two
non-conforming lots would result from this subdivision. The resolution approving the
subdivision was read by the City Manager.

2. Mitch DeMars, 4101 Sixth Street, Six Foot Setback Variance
Motion by Heintz, second by Hentges, on recommendation of the Planning and Zoning
Commission, to grant a six foot variance for a 24' x 24' detached garage to be con-
structed at 4101 Sixth Street. Roll call: All ayes
3. Robert Barnick, 2301 40th Avenue, Conditional Use Permit
This request has been withdrawn.
c. Anoka County Community Action Program, Inc. Senior Outreach Program
Information regarding this organization's fund raising efforts and its audit
were received. This was on the agenda for informational purposes.
d. Columbia Heights' Charter Commission
A letter from the chairman of this Commission was received that indicated that the Com-
mission agrees with the City Council with the rewording of a section of the Charter.
That section deals with Initiative actions and Petitions submitted to the City Council.
This was an informational item.
e. League of Minnesota Cities Conference
The League of Minnesota Cities is having a four day conference, June 9-12, in St. Paul.
Motion by Hentges, second by Logacz to authorize the attendance of the Mayor, Council-
members, Council Secretary and five staff members at the League of Minnesota Cities
Conference. Roll call: All ayes
7. Old and New Business
a. Purchase of Cash Registers
Motion by Logacz, second by Norberg to award the bid for the purchase of three cash
registers with check endorsers to Northwest Cash Register in the amount of $5,685,
based on low, formal bid received; and furthermore, that the Mayor and City Manager
be authorized to execute a contract with said company. Roll call: All ayes

b. New Business
1. Payment to Anoka County for Data Processing System Use and Program Support
Motion by Hentges, second by Heintz to authorize the payment to Anoka County for data
processing system and program support services in the amount Of $656.77. Roll call:
All ayes
2. Award of Bid for Electrical Work on Project #8028 (Sullivan Lake Park Development)
Motion by Heintz, second by Logacz to retain Wolverton Engineering Co. to perform
electrical engineering consulting services with regard to Sullivan Lake Park Project
2028, at a fee not to exceed a maximum of $8,500.
Councilman Hentges felt the Engineering Department should have encouraged the other
company who submitted a bid to include figures with an hourly scale instead of just
a lump sum figure. Roll call: Logacz, Heintz, Nawrocki--aye Hentges--nay
3. Authorization to Purchase Fireworks Display
Motion by Heintz, second by Logacz to authorize the Mayor and City Manager to enter
into a contract with Arrowhead Fireworks Co.,Inc., in the amount of $4,500 for fire-
works for the 1981 Fourth of July Celebration in the City of Columbia Heights.
Councilman Hentges felt in the face of today's economy and with so many needy people
who could benefit from this amount of money it was ill-advised to approve this expense.

4. Schools and Conferences
Motion by Logacz to authorize the attendance of Mildred Carlson, City Assessor, at the
International Conference on Assessment Administration to be held in Louisville, Kentucky
October 18-21,~1981,and furthermore, that travel expenses (estimated $690 ) be re-
imbursed. Motion dies for lack of a second.
Motion by Heintz, second by Hentges to deny the request. Roll call: Logacz, Nawrocki--
nay Heintz, Hentges--aye Motion fails No action was taken on this request.
5. Special Meeting of the City Council on May 8, 1981
This meeting would be called to discuss one item;
A final inducement resolution with regard to industrial development revenue bonds
for the construction~of the Office Building in our Downtown Development area; such
construction to be undertaken by Terry Evenson
The City Manager was requesting that a time be set for this meeting. Much discussion
followed regarding the item for consideration but no action was taken at this time.
8. Reports
a. Report of the City Manager
This report was submitted in written form. The City Manager briefly reviewed some of
the items on the report. He also referred to a memo received from Minneapolis regarding
the contractor for the work to be done on 37th Avenue. This item will be further
discussed at the meeting on May 26th.
b. Report of the City Attorney
The City Attorney advised the Council that the City has received a counter-claim from
Sizzler Steak suing the City for damages. He also informed the Council of the status
of the problem with a hazardous building located on 37th Avenue. This matter is pre-
sently in litigation. The City Building Inspector has been named as a party in this
lawsuit. It was advised that an inspector not connected with the City be engaged for
this matter.
Motion by Heintz, second by Logacz to engage an outside inspector as an expert witness
regarding the hazardous building located at ~ 37th Avenue. Roll call: All ayes I£13
9. Licenses
Motion by Heintz, second by Logacz to grant the licenses, as listed, upon payment of
proper fee and to deny the taxi cab driver's license as recommended by the Police
Department. Roll call: All ayes
10. Payment of Bills
Motion by Heintz, second by Logacz that the bills, as listed, be paid out of the proper
funds. Roll call: All ayes
